    Abstract: Seit Beginn der 1990er Jahre wurde bürgerschaftliche Partizipation im Zuge von Community Policing in den USA und von kommunaler Kriminalprävention in Deutschland als wichtige Ressource für urbane Sicherheitspolitiken dargestellt. Die Arbeit beantwortet empirisch die Frage, ob sich im Feld der Sicherheitspolitik partizipative Projektformen dauerhaft etablieren konnten und ob diese einen Effekt auf das öffentliche Leben der Städte nach sich zogen. Dabei wird empirisch die Situation der kriminalpräventiven Gremienarbeit in zwölf bundesdeutschen Großstädten unter die Lupe genommen und anhand zweier Fallstudien zu Berlin und Stuttgart vertieft. Die Situation in den USA wird anhand einer Fallstudie zu Chicago näher analysiert.

    Abstract: When EU leaders signed the Lisbon Treaty in late 2007, it seemed that the constitutional process in Europe was finally close to fruition. For many, the seemingly imminent conclusion of this lengthy process, which had started in 2000 or even earlier and which had absorbed much of the Unions capacity for policy and compromise, came as a great relief. Although the results of the Irish referendum have led to some disillusion, it is evident that whatever the final outcome might be for the time being the Lisbon "constitution" is as good as it gets in an EU of 27 or more states.Against that backdrop, this volume presents several works by renowned EU lawyers discussing the consequences of "Lisbon" in various policy fields (External Relations, Justice and Home Affairs, Economic Policy, etc.) as well as the pros and cons of the Unions "constitution" as it stands with the Lisbon Treaty. Additional food for thought is provided in a foreword written by Giuliano Amato, one of the most important protagonists of EU constitutionalism from its very beginning.

    Abstract: The introduction of the 'Common Consolidated Corporate Tax Base' as a means for an efficient and equitable taxation of multinational enterprises in Europe represents the most important issue of European business taxation. Starting in 2001, the Commission and the Member States have cooperated in order to develop an innovative technique for the measurement and the allocation of business profits within the European Union. This venture is not only the most ambitious political project of the current European Commission, it also challenges traditional legal and economic concepts of business taxation.     Abstract: "The cultivation of genetically modified (GM) crops in the EU may lead to cases, in which traditional agricultural products contain detectable traces of GMOs. On the one hand, such admixture may result from inadequate application of segregation measures by farmers. On the other hand, as agriculture is an open process that does not allow the complete isolation of individual fields, a certain degree of admixture between neighbouring crops is unavoidable in practice. The presence of GMOs in traditional products may lead to their devaluation, which would entail an economic damage to the producer of the traditional products. For instance, due to the presence of the GMO the traditional product may require to be labelled as GM. GMOs and products containing or produced from GMOs have to be labelled according to Community legislation, in particular Directive 2001/18/EC, Regulation (EC) No. 1829/2003, and Regulation (EC) No. 1830/2003. For the case of adventitious or technically unavoidable presence of GMOs in non-GM products, Regulation 1829/2003 provides for a threshold of 0.9% below which such presence in food or feed does not require labelling. For seeds, Directive 2001/18/EC provides for the possibility of adopting thresholds, below which the adventitious or technically unavoidable presence of GM seeds does not require the labelling of conventional seed lots. Such thresholds have not yet been adopted. The presence of GMOs in a product above the labelling threshold also triggers the need for traceability of GM products according to Regulation 1830/2003, which may cause additional costs for the operators concerned. In the EU, crops may only be commercially cultivated after having been authorised for the purpose of cultivation under Community legislation (i.e. Directive 2001/18 or Regulation 1829/2003). The labelling thresholds only apply for the presence of authorised GMOs. Products containing detectable traces of unauthorised events can not be legally marketed in the EU. According to part B of Directive 2001/18, an individual Member State may grant authorisation for a non-commercial release of a GMO, for instance for the purpose of experimental field testing. As a result of such experimental cultivation, GMOs not authorised under part C of Directive 2001/18 or under Regulation 1829/2003 may be present in traditional crops. This presence could cause economic damage as food and feed could not be marketed if it contains detectable traces of such GMOs. The admixture of GMOs may also have specific implications for organic products. Regulation (EEC) No. 2092/91 on organic production of agricultural products specifies that GMOs may not be used in organic production, with the exception of certain veterinary products. Therefore, products that require labelling as GM could not be used in organic farming. This implies that GMO presence in organic input materials (such as seed or feed) could have implications beyond the necessity of labelling alone. Further economic implications may result for farmers producing non-GM crops, if specific requirements concerning GMO presence, which go beyond the provisions in Community legislation, are laid down in contracts with the retailers or other operators further down the food or feed production chain. Such conditions may also apply for products produced under quality schemes. In addition to the economic implications resulting from the actual presence of a GMO in a traditional product, costs may also occur due to sampling and testing of products, either on a basis of routine controls or in cases, where relevant GMO admixture may be suspected. In many cases, the presence of GMOs and their quantity could not be assessed without the use of laboratory analyses, which may cause significant costs. Furthermore, economic implications for traditional producers that may relate to the presence of GM crop production in a region, and which could enlarge the risk of GMO admixture, could not be ruled out. For instance, food or feed producers may preferentially purchase crops from certain regions, where no GM crop production may take place. If the cultivation of GM crops will become more widespread, the issue of liability in relation to GMO admixture could gain further importance in the EU. Compared to other cases of economic damage resulting from neighbouring activity, GMO admixture may pose specific difficulties because the admixture may initially remain undetected and become known at later stages of the food or feed production chain. Furthermore, the causal link between the damage and the operator responsible for it may not always be apparent as there may be different sources of admixture (e.g., seed impurities, outcrossing with neighbouring crops, volunteers from previous GM crop cultivation). Liability in the case of economic damage that may result from the presence of GMOs in other crops is a case of civil law. Generally, civil law is in the responsibility of the Member States. In Recommendation 2003/556/EC on guidelines for the development of national strategies and best practices to ensure the coexistence of genetically modified crops with conventional and organic farming, the Commission states that: ""The type of instruments [to achieve co-existence] adopted may have an impact on the application of national liability rules in the event of economic damage resulting from admixture. Member States are advised to examine their civil liability laws to find out whether the existing national laws offer sufficient and equal possibilities in this regard. Farmers, seed suppliers and other operators should be fully informed about the liability criteria that apply in their country in the case of damage caused by admixture. In this context, Member States may want to explore the feasibility and usefulness of adapting existing insurance schemes, or setting up new schemes."" Member States may develop national or regional approaches to ensure the co-existence of GM crops with conventional or organic agriculture. According to Article 26a of Directive 2001/18: ""Member States may take appropriate measures to avoid the unintended presence of GMOs in other products."" In the context of national or regional co-existence legislation Member States may also adopt specific provisions for liability in cases of GMO admixture, and develop compensation schemes, such as insurance systems or compensation funds. Liability has to be seen in the context of measures to segregate GM crop production from traditional non-GM production in order to achieve co-existence between these different forms of agriculture. The approach taken by the Member States to allocate the responsibility for developing and implementing these segregation measures among the operators concerned has significant implications on liability."

However, while the general principle behind the concept is by and large unproblematic, its practical application underscores its complexity. The aim of this book is to examine three pertinent issues relating to the concept of individual criminal responsibility for core international crimes: (i) The joint criminal enterprise doctrine, (ii) The defining criteria of international criminal courts, for the purposes of an evaluation of the lifting of state official immunity for core international crimes, in the light of the findings of the ICJ in the Arrest Warrant case, and (iii) The imposition of individual criminal responsibility for terrorism as a crime against humanity, both in international law and in relation to the ICC Statute.

Fragmented approaches to the formulation of laws such as ‘comparative law analysis’ and ‘welfare economic analysis of laws’ exist in the existing literature which are affected by laws is necessary in formulating efficient (socially desirable) laws. In this book, an integrated approach that embeds these 2 approaches as well as other considerations of other dimensions of human welfare is developed. This approach can be applied to formulate efficient laws, irrespective of social, political and economic organisations of the country under study, which maximise social welfare of the country.

It answers a key question in Criminology: What have we learned from recent longitudinal studies of crime and delinquency? The volume includes a synthesis of longitudinal studies in criminology over the last 25 years and an appendix.
    Abstract: Criminology is concerned with many questions which are inherently longitudinal. For example, what is the life-course of criminal behavior? Is there one general offending pattern or multiple offending patterns over time? Which early risk factors, if any, are strongly predictive of criminal behavior? Can early intervention prevent the development of a criminal career? Longitudinal research allows examination of within-person relationships over time, and allows the examination of developmental sequences and timing. This volume examines longitudinal research in relation to crime and delinquency. The main body of Longitudinal Studies on Crime and Delinquency is seven reviews, which were commissioned to answer two simultaneous questions: What have we learned from recent longitudinal research on crime and delinquency that (a) we did not know before, and (b) that capitalizes on the longitudinal nature of the data? Topics for review were chosen with an eye to three considerations: (a) a critical mass of studies addresses the question, (b) an emphasis on longitudinal methods, (c) policy relevance of the question. Three additional chapters include an introduction and overview, an essay reflecting on the findings highlighted in the volume from the broad perspective of the evolutionary ecological theory of crime, and a Future Directions chapter. The volume also includes an appendix which relates each of the reviews to the body of longitudinal studies reviewed in the volume. This not only shows which studies have informed which topics, but also highlights analytic opportunities that have not yet been explored and where this information could be applied in future research.

Worldwide concern with the risk posed by this increased frequency has led to the adoption of international technical standards to promote maritime safety and the insertion of special provisions in the carriage contracts. Moreover, growing environmental awareness and concern with the economic cost implications of maritime casualties have given rise to the regulation of liability and compensation.
    Abstract: The carriage of goods by sea mainly focuses on loss of or damage to goods. There are voluminous discussions and texts on this issue. By contrast, the issue of loss or damage from goods has been paid little attention. Ever-increasing numbers of dangerous goods are carried by sea today. This increase draws attention to explosions or fire on ships, spillages, pollution, accidents and potential danger. Worldwide concern with the risk posed by the increased frequency in the carriage of dangerous goods has led to the adoption of international technical standards to promote maritime safety and the insertion of special provisions in the carriage contracts. Moreover, growing environmental awareness and concern with the economic cost implications of maritime casualties have given rise to the regulation of liability and compensation in respect of damage caused by hazardous and noxious substances.

    Abstract: Die Dissertationsschrift stellt die erste systematische Studie des transatlantischen Konflikts über den Internationalen Strafgerichtshof (IStGH) aus politikwissenschaftlicher Perspektive dar. Der Fall des IStGH wird häufig als ein Beleg für transatlantische Spannungen im Hinblick auf das Völkerrecht und die Arbeit internationaler Organisationen zitiert bzw. als ein Indikator für eine zunehmend unilaterale Außenpolitik der USA aufgefasst. Obwohl der IStGH somit einen prominenten Platz auf der Agenda der transatlantischen Beziehungen einnimmt, wurden die Umstände, die zu dem Konflikt über seine Errichtung zwischen Europa und den USA führten bis dato noch nicht eingehend wissenschaftlich untersucht. In dieser Hinsicht betritt die eingereichte Dissertation Neuland. Sie geht über die vage Klassifikation von US-amerikanischem Unilateralismus versus europäischem Multilateralismus hinaus, indem sie sich systematisch den folgenden Fragen zuwendet: Was sind die Gründe für die unnachgiebige Opposition der USA gegen den IStGH? Warum gaben sowohl Großbritannien als auch Frankreich ihre Allianz mit den USA hinsichtlich des Gerichtshofs auf und unterstützten schließlich einen unabhängigen IStGH? Die Hypothese der Dissertation lautet, dass die wesentlichen Ursachen für den transatlantischen Konflikt über den IStGH in unterschiedlichen Auffassungen von Kernnormen der internationalen Beziehungen liegen, insbesondere in voneinander abweichenden Interpretationen des Prinzips der Souveränität und des Konzepts der Menschenrechte.
    Abstract: The dissertation provides the first systematic study of the transatlantic conflict about the International Criminal Court (ICC) from an international studies point of view. Although the case of the ICC has often been quoted as an example of increasing US unilateralism or as an indicator for a growing divergence in US-American and European approaches to international law and international organisations, it has been rarely analysed on its own. The book therefore makes a contribution on a pertinent and timely topic in the field of transatlantic relations. It aims to go beyond the rather sketchy classifications of US unilateralism versus European multilateralism by systematically addressing the following questions: What accounts for the US’ unrelenting opposition to the ICC? Why did both France and the United Kingdom abandon the alliance with the US with respect to the ICC and eventually opted for a strong and independent Court, thereby aligning themselves with the other EU member states? The hypothesis of the book is that the main reason for the transatlantic differences in the positions towards the court lies in divergent understandings of core norms of international relations, most importantly sovereignty and human rights.

    Abstract: Hans Kelsen's »Pure Theory of Law«, which was published in 1934, is one of the key works on legal theory in the 20th century. In it, Kelsen presents a theory in which he separates the law from morality on the one hand and on the other hand from proven fact, a theory which was also critical of ideologies. Anyone wanting to think about the structure and the validity of the law and the characteristics of jurisprudence, in short, anyone wanting to think about the normativity of the law, will inevitably have to deal with the »Pure Theory of Law.« The first edition of this work, which has been translated into approximately a dozen languages, was reprinted several times in German, but is currently out of print. It is now available as a student edition, which is intended to encourage those interested in the law to read through it and to give it their careful and critical consideration.

    Abstract: Can early criminal defense helping to avoid or shorten detention? When early criminal defense means to avoid unnecessary detention which burdens both the involved parties, the enforcement and detention and in terms of costs, the state in unnecessary ways? These questions are discussed in the present investigation. It represents the concept and the results of the accompanying scientific research from a 1998 pilot project carried out in the JVA Hannover. It relies on the analysis of over 1,300 criminal acts and the Federal Central Register's (Bundeszentralregister) statements, the evaluation of the detention list of the local court of Hanover and on extensive interviews with people involved in the project (defence lawyers, prosecutors, judges, court clerks and remand prisoners). The empirical findings of the accompanying be embedded in a legal framework and criminological conclusions are presented

    Abstract: Die Untersuchung befasst sich mit dem Unfallfluchtparagraph § 142 StGB. Untersucht werden die Fragen nach dem "Ob" und dem "Wie" einer Reform, also der praktischen Ausgestaltung im Einzelnen. Dazu gehört der geltende Unfallfluchtparagraph im Grundsätzlichen auf den Prüfstand gestellt. Im Sinne einer Grundlegung sind die historischen Wurzeln der Verkehrsunfallflucht aufzuarbeiten. Sodann bedarf es einer Auseinandersetzung mit dem Schutzzweck des Tatbestandes, um schließlich die Frage nach der Verfassungsmäßigkeit der Vorschrift im Hinblick auf das Prinzip des "nemo tenetur se ipsum accusare" zu klären, wobei an dieser Stelle eine Einordnung der in § 142 StGB normierten Pflichten vorzunehmen ist. Von besonderem Interesse ist darüber hinaus die vorzunehmende Darstellung der seit Jahren kontrovers diskutierten Reformvorschläge, der kriminologischen Aspekte und ein rechtsvergleichender Blick ins europäische Ausland. Vor diesem Hintergrund gilt es die vom Gesetzgeber mit dem 6. Strafrechtsreformgesetz in Abs. 4 des § 142 StGB eingefügte "Tätige Reue" hinsichtlich der zu erfüllenden Anwendungsvoraussetzungen und Rechtsfolge näher zu betrachten, um sodann die Praktibilität und Effizienz der "Tätigen Reue" im Wege einer eigenen Studie und Auswertung zu prüfen. Sämtliche Aspekte führen dann zu eigenen Vorschlägen hinsichtlich Rahmenbedingungen und Möglichkeiten einer Reform der Vorschrift des § 142 StGB.

    Abstract: Governments intervene in the agricultural sector through policies that both support and shape agricultural production. This leads to two important outcomes. First, agriculture specific programmes intended to increase the welfare of farmers can become capitalised into asset values. Second, many policies, in particular regulatory ones, reduce asset mobility, resulting in reduced economic efficiency due a sub-optimal allocation of resources. This study focuses on the capitalisation of government support into land rents and prices. It assesses the consequences of inflated asset values, and suggests lessons for future policy making.

    Abstract: The increased detection of doping in professional sports has led to a strengthening of the discussion on the legal aspects of doping. So far criminal and/ or verbandsrechtliche questions were the focus. For example the question of whether and how sponsorship contracts may be terminated in cases of misconduct of the sponsored. First, it examines how appropriate cancellation clauses could be like. Second, consider the conditions under which, even without explicit rules for doping a termination in accordance with general principles of contract law is concerned. It also discusses the legal consequences of termination, and in particular its relationship to other contractual consequences of doping, such as claims for damages or penalties

    Abstract: Die Untersuchung setzt bei dem Problem der Folgenbewältigung justizieller Überlastung im deutschen Strafverfahren an. Als Ausweg aus der bestehenden Arbeitsüberlastung der Gerichte und Staatsanwaltschaften durch die steigende Zahl aburteilungsfähiger Strafverfahren bietet sich an, Kompetenzen der Staatsanwaltschaft im Kleinkriminalitätsbereich auf die Polizei zu übertragen. Dadurch könnten für die Staatsanwaltschaften mehr Arbeitskapazitäten im Bereich schwerer Kriminalität entstehen. So befasst sich die Arbeit mit dem Zusammenspiel zwischen Staatsanwaltschaft und Polizei im Bereich der Straftatenermittlung wie auch der verfahrensbeendenden Entscheidungen im deutschen und niederländischen Strafverfahren. Sie mündet in einen am niederländischen Strafverfahren orientierten Gesetzesvorschlag, der es im Bereich von Bagatellkriminalität erlaubt, der Polizei die Befugnis zur Verfahrensbeendigung mit einer Geldauflage zu übertragen. Die Autorin ist wiss. Mitarbeiterin am Institut für Kriminalwissenschaften - Abteilung für Kriminologie, Jugendstrafrecht und Strafvollzug - der Georg-August-Universität Göttingen.

Der Prozess der Harmonisierung des Flüchtlingsrechts auf europäischer Ebene und vor allem die Richtlinie 2004/83/EG des Rates vom 29.04.2004 (Qualifikationsrichtlinie) als eines der zentralen Elemente dieser Asylrechtsharmonisierung verlangen der deutschen Asylrechtsprechung eine grundlegende Revision und Neuorientierung ab. Vor diesem Hintergrund geht die Autorin, selbst Richterin am Verwaltungsgericht, am Beispiel des Widerrufs von Flüchtlingsanerkennungen im Einzelnen der Frage der Völkerrechts- und Europarechtskonformität der deutschen Rechtsprechung nach. Annegret Titze legt dabei besonderes Gewicht auf die dogmatische Entfaltung der für alle Auslegungsfragen im materiellen Asylrecht nunmehr maßgeblichen methodischen Grundlagen, die bei der Auslegung von Völkervertragsrecht einerseits und der Auslegung von EG-Recht andererseits sowie bei der Verzahnung beider Rechtskreise im Bereich der Qualifikationsrichtlinie zu beachten sind.     Abstract: Is it time to take a break from feminism? In this pathbreaking book, Janet Halley reassesses the place of feminism in the law and politics of sexuality. She argues that sexuality involves deeply contested and clashing realities and interests, and that feminism helps us understand only some of them. To see crucial dimensions of sexuality that feminism does not reveal--the interests of gays and lesbians to be sure, but also those of men, and of constituencies and values beyond the realm of sex and gender--we might need to take a break from feminism. Halley also invites feminism to abandon its uncritical relationship to its own power. Feminists are, in many areas of social and political life, partners in governance. To govern responsibly, even on behalf of women, Halley urges, feminists should try taking a break from their own presuppositions. Halley offers a genealogy of various feminisms and of gay, queer, and trans theories as they split from each other in the United States during the 1980s and 1990s. All these incommensurate theories, she argues, enrich thinking on the left not despite their break from each other but because of it. She concludes by examining legal cases to show how taking a break from feminism can change your very perceptions of what's at stake in a decision and liberate you to decide it anew.

    Abstract: Are postcolonies haunted more by criminal violence than other nation-states? The usual answer is yes. In Law and Disorder in the Postcolony, Jean and John Comaroff and a group of respected theorists show that the question is misplaced: that the predicament of postcolonies arises from their place in a world order dominated by new modes of governance, new sorts of empires, new species of wealth-an order that criminalizes poverty and race, entraps the "south" in relations of corruption, and displaces politics into the realms of the market, criminal economies, and the courts.  As these essays make plain, however, there is another side to postcoloniality: while postcolonies live in states of endemic disorder, many of them fetishize the law, its ways and itsmeans. How is the coincidence of disorder with a fixation on legalities to be explained? Law and Disorder in the Postcolony addresses this question, entering into critical dialogue with such theorists as Benjamin, Agamben, and Bayart. In the process, it also demonstrates how postcolonies have become crucial sites for the production of contemporary theory, not least because they are harbingers of a global future under construction.
