    Abstract: The private international law of intellectual property is currently much debated both in Europe and abroad. Art. 8 of the Rome II Regulation of 2007, which codifies a territorial approach for the infringement of intellectual property, has provoked an intensive discussion in Europe as to whether the lex loci protection is still appropriate for intellectual property litigation in the age of worldwide networks. A condensed outcome of this debate is summarized in the »Principles for Conflict of Laws in Intellectual Property« (CLIP Principles) drafted by the European Max Planck Group on Conflict of Laws in Intellectual Property (CLIP), published recently in a second preliminary draft. On the international scale, the American Law Institute's »Intellectual Property: Principles Governing Jurisdiction, Choice of Law, and Judgments in Transnational Disputes« of 2007 (ALI Principles) are the focal point of the debate. A Japanese project (»Transparency Proposal«) was finalized in 2009. This volume provides a comparative analysis of the three proposals. It compiles papers presented at an international conference held in Tokyo in May 2009

    Abstract: The Calvin year 2009 began on October 31, 2008 with a conference organized by the Institute for Reformation Research (Apeldoorn) on the topic »Calvin: Saint or Sinner?« A number of scholars dealt with the question of whether and how Calvin brought a renewal to theology, the church and society. This volume contains the papers held at this conference, which demonstrate the detailed and growing research on the reformer of Geneva. Since the contributions reflect the latest research in Calvin studies, the conclusions reached in many of the papers are surprising. Calvin was not a reformer in all respects in the original sense, as some would have wanted him to be.     Abstract: This book is a history of an illusion. It is also a history of the dream that preceded the illusion. The book discusses statistics as the field of tension between the scientific claims of neutrality and universality on the one hand and the political and economic reality of the conflicting interests of nation-states on the other. The various paths of state- and nation-building that European countries traversed in the nineteenth century are recognisable in the objectives of government statistics and are reflected in the topics selected for statistical study and in the categories used in the research. Each congress was clearly dominated by the specific interests of the country in which the statisticians convened. The book shows in each case how the organisation of government statistics and national concerns influenced the international agenda. It describes the perceptions, goals and dilemmas of the protagonists and their contact with each other, and in so doing unravels the complex relationships between science, government and society, wherever possible from their point of view. The genesis of international statistics was inspired by a desire for reform. Belgium's pioneering role in the European statistical movement was informed both by its liberal polity and the special status of statistics within it, and by Adolphe Quetelet's key position as an intellectual. The consolidation of the Grand Duchy of Baden, a new medium-sized state in the Rhine Confederation and later in the German Confederation, offered great opportunities for the development of official statistics

    Abstract: Ancient Rome has always been considered a compendium of City and World. In the Renaissance, an era of epistemic fractures, when the clash between the 'new science' (Copernicus, Galileo, Vesalius, Bacon, etcetera) and the authority of ancient texts produced the very notion of modernity, the extended and expanding geography of ancient Rome becomes, for Shakespeare and the Elizabethans, a privileged arena in which to question the nature of bodies and the place they hold in a changing order of the universe. Drawing on the rich scenario provided by Shakespeare's Rome, and adopting an interdisciplinary perspective, the authors of this volume address the way in which the different bodies of the earthly and heavenly spheres are re-mapped in Shakespeare's time and in early modern European culture. More precisely, they investigate the way bodies are fashioned to suit or deconstruct a culturally articulated system of analogies between earth and heaven, microcosm and macrocosm. As a whole, this collection brings to the fore a wide range of issues connected to the Renaissance re-mapping of the world and the human. It should interest not only Shakespeare scholars but all those working on the interaction between sciences and humanities

Nicht immer beeinflusst die eine Sphäre die andere; Isomorphismus impliziert gemeinsame Entdeckungen, durch die beide Bereichen zur gleichen Zeit neue investigative Modelle und Darstellungssysteme entwickeln. Dialog und gegenseitiges Verständnis zwischen den beiden sogenannten »zwei Kulturen« werden so stimuliert.     Abstract: Leaders around the globe have long turned to the armed forces as a "school for the nation." Debates over who serves continue to arouse passion today because the military's participation policies are seen as shaping politics beyond the military, specifically the politics of identity and citizenship. Yet how and when do these policies transform patterns of citizenship? Military service, Ronald R. Krebs argues, can play a critical role in bolstering minorities' efforts to grasp full and unfettered rights. Minority groups have at times effectively contrasted their people's battlefield sacrifices to the reality of inequity, compelling state leaders to concede to their claims. At the same time, military service can shape when, for what, and how minorities have engaged in political activism in the quest for meaningful citizenship. Employing a range of rich primary materials, Krebs shows how the military's participation policies shaped Arab citizens' struggles for first-class citizenship in Israel from independence to the mid-1980s and African Americans' quest for civil rights, from World War I to the Korean War. Fighting for Rights helps us make sense of contemporary debates over gays in the military and over the virtues and dangers of liberal and communitarian visions for society. It suggests that rhetoric is more than just a weapon of the weak, that it is essential to political exchange, and that politics rests on a dual foundation of rationality and culture

    Abstract: The Egyptian press has a large readership and potential influence on public opinion in Egypt and the Arab world. The Egyptian Press and Coverage of Local and International Events analyzes this understudied area. Written in Egypt, the book is formed of five chapters and analyzes in qualitative and quantitative methods close to 300 newspaper and magazine articles. It studies the Egyptian press and investigates the challenges it faces to be compatible with that in the west, and evaluates the renowned book Four Theories of the press and whether today's Egyptian press can fit in one of those theories. It also looks at the concepts of framing and discourse analysis adopted later. The author examines how the Egyptian press framed the Sudanese refugees' riot in Cairo in December 2005 by the top thirteen Egyptian national, independent, and party newspapers. It found that independent and party newspapers enjoy more freedom than national ones in criticizing government and the way police tackled the protest. However, independent newspapers were more vigorous in their criticism than party ones. The author observes that the weekly magazines tended to frame their coverage in a somewhat anti-government slant, accusing authorities and ferry owners of failure and corruption. Finally, the book compares coverage of the Israeli War in Lebanon in July 2006 by Egypt's giant semi-official daily newspaper Al-Ahram with that by two prominent, non-Egyptian pan-Arab dailies Al-Hayat and Asharq Al-Awsat. He finds that while Al-Hayat and Asharq Al-Awsat, which are owned by Saudi businessmen, portrayed Hizbullah in an unfavorable manner, Al-Ahram was somewhat favorable in its coverage of the Lebanese resistance group

Roundly rejects the idea that reactive, unplanned adaptation will solve our problems; that species will migrate northward as climates warm, and farmers will shift to new crops and more hospitable locations and is highly critical of 'geoengineering' schemes that are designed to cool the planet by such methods as injecting iron into oceans or exploding volcanoes. Insists that smart adaptation will require a series of local and regional projects, many of them in the countries least able to pay for them and least responsible for the problem itself. Ensuring that we address the needs of these countries, while we work globally to reduce emissions over the long term, is our best chance to avert global disaster and to reduce the terrible, unfair burdens that are likely to accompany global warming

    Abstract: In considering the pattern of emigration in the context of migration history, Choquette shows that, in many ways, the movement toward Canada occurred as a by-product of other, perennial movements, such as the rural exodus or interurban labor migrations. Overall, emigrants to Canada belonged to an outwardly turned and mobile sector of French society, and their migration took place during a phase of vigorous Atlantic expansion. They crossed the ocean to establish a subsistence economy and peasant society, traces of which lingered on into the twentieth century

    Abstract: "This book is a study of the evidence for the business of female prostitution in the Roman world during the central part of Rome's history, a period extending from approximately 200 B.C. to A.D. 250. The main focus is on the economics of venal sex, meaning precisely the manner in which it was sold, a subject that extends to the ownership, operation, staffing, and location of brothels, as well as to various aspects of nonbrothel prostitution. Though the state of the evidence discourages any and all attempts at quantification, an attempt is made by the author to recover a sense of the role, the presence, and as much as is possible, the lived experience of prostitution city. Unlike most modern societies, the Roman political and legal authorities allowed the business of venal sex to proceed virtually unregulated, with a degree of tolerance that seems strange to a modern sensibility, but with consequences that emerge as sometimes equally foreign to us."
