    Abstract: The following principles should guide competition authorities when devising remedies in merger cases: i) remedies are to be considered only if a threat to competition has been identified; ii) remedies should be the least restrictive means to effectively eliminate competition concerns; iii) remedies should address only competition concerns, and should not be used for industrial planning or other non-competition purposes; and iv) flexibility and creativity are key in devising remedies. Competition authorities in general strongly prefer structural remedies in the form of divestitures even though they might consider behavioural remedies, alone or in conjunction with divestiture remedies, appropriate in certain cases to address competitive concerns raised by a merger. Where several competition authorities consider remedies in the same transaction, coordination and cooperation among them is important to ensure consistency between remedial solutions. Despite differences in substantive tests and procedures, such cooperation and coordination with respect to remedies has been successful in an increasing number of transnational mergers.     Abstract: This report focuses on one environmental instrument which is part of the UK’s wider programme of policies to deal with its various obligations to control climate change. The instrument is the Climate Change Levy (CCL) which takes the form of a tax on energy. However, the CCL cannot be viewed in isolation – it is part of a fairly elaborate package of measures, and its interaction with the other instruments in that package need to be understood. Accordingly, we first set out a brief history of the UK’s approach to climate change control, and describe the various components of the policy package. A detailed history of the CCL is then provided, and this is followed by an analysis of the features of the CCL, focusing particularly on the political factors that influenced its design, and the various reactions to it. Finally, we look at the likely future of the CCL in light of developments in climate change policy in the wider Europe.

    Abstract: This paper draws on the responses of DAC members to requests for ICT “lessons learned” and “good practice”, which can be found in the OECD document “ICTs for Development: Lessons Learned and Good Practices”. Members agreed that in ICT, as with all development co-operation, success or failure depends more on developmental processes rather than the specifics of the co-operation. Integrating ICTs into development co-operation is not, therefore, a special case, different from all other development interventions. It must follow basic principles of development co-operation good practice.

    Abstract: Extended Producer Responsibility (EPR) is an environmental policy approach under which the responsibility of producers for their products is extended to include the social costs of waste management, including the environmental impact of waste disposal. This paper sets out a framework for assessing the costs and benefits of EPR. As comparedwith “conventional” waste management EPR involves the collection of particular end-of-life products, product categories or waste streams. In some cases these wastes would traditionally be handled appropriately through municipal waste management programs. Packaging would be one example. In other cases they might be handled, or might need to be handled, as special wastes which would be inappropriate for a municipal waste management programme. Solvents, scrap tires, used crankcase oil, lead acid batteries and electronics fit into this category. To evaluate the costs and benefit ratio for EPR programmes, the costs of these features need to be weighed against the benefits in terms of the reduced social costs of waste management, including the various externalities associated with landfilling or incineration and the environmental risks associated with “doing nothing” by maintaining existing practices.

    Abstract: This paper discusses the topic of Universal Access -- specifically Universal Access to telecommunications in rural areas of developing countries -- from the policy perspectives of telecommunication policy reform and of complementary Universal Access public subsidy mechanisms. Starting with broad lessons learned on competition in telecommunications, the report will narrow in onto the specific mechanism of minimum-subsidy auctions for Universal Access to telecommunications. First of all, how does competition in telecommunications affect Universal Access/Service? What roles does competition play on technological innovations such as Internet or mobile? And what regulatory safeguards have been or are necessary to enable competition and to promote Universal Access/Service?We will first analyse the experiences of OECD countries that started reforming their telecommunication markets early on, to gather insight into the process and impact of telecommunication reform. We will also review complementary mechanisms that OECD countries have set up to subsidise Universal Access in the areas unlikely to be covered by market forces alone. We will then review some regulatory measures that can help to provide Universal Access to the rural areas of developing countries without subsidies, and we will discuss some cost-effective ways for developing countries to provide incentives to markets to expand telecommunication infrastructure to poor rural areas, before making use of subsidies...

    Abstract: This paper discusses the manure policy in the Netherlands with emphasis on the N and Paccounting system MINAS. MINAS was introduced by the Netherlands’ government in 1998, to step-wise decrease the N and P surpluses at farm level in 5 to 10 years to environmental acceptable levels (e.g. Henkens and Van Keulen, 2001). Individual farms that exceed certain levy-free surpluses for N and P (expressed in kg per ha per year) are charged with a financial levy, so as to encourage farmers to decrease the N and P surpluses. Whilst the use of nutrient balances in agricultural research has a history of at least one century, using nutrient balances with levies on surpluses as an instrument to ecologically transform agriculture had no precedent.

    Abstract: The fixed nature of pension benefits under corporate defined benefit (DB) pension plans imply that plan sponsors face financial and potentially biometric risks. A large number of OECD countries have such DB pension schemes, whereby employees receive a specific payment upon retirement and for which sponsoring employers are responsible to some extent for meeting any shortfall in pension funding relative to liabilities, although, across countries, these schemes vary in importance. Recent financial market developments, including in particular the post-2000 equity market correction and declining interest rates have illustrated the vulnerability of DB plan sponsor companies to financial risks. While it is difficult to form a judgement about the exact magnitude of the funding gaps that have arisen, estimates of such gaps were considered to be of sufficiently large scale to raise concern amongst policymakers.     Abstract: The Ministry of Ecology and Emergency Situations (MEES) of the Kyrgyz Republic approached the OECD/EAP Task Force Secretariat with the request to assess the national system of environmental compliance assurance in light of good international practice and identify priority actions for its reform. In response to this request, which was also voiced during the 2003 REPIN meeting, the Network members supported the Kyrgyz Republic’s initiative to be the first country to test the Peer Review Scheme. A peer review involves a systematic examination and assessment of the performance of a state by other states, with the ultimate goal of helping the reviewed country adopt best practices and comply with established standards and principles. The peer review mechanism is free of any threat of non-compliance sanctions arising from the findings of the review: its impact relies on the influence and persuasion exercised by “peers” (equal partners in the review process). The review serves the following purposes: • To provide international peer support for institutional reform of enforcement authorities;• To enhance their transparency, accountability, and visibility, at national and international level;• To extend opportunities for inter-government policy dialogue and support capacity building.

    Abstract: This review of regulatory reform in Russia covers the overall economic context for regulatory reform, the government’s capacity to manage regulatory reform, competition policy and enforcement, and market openness. The review also examines specifically the regulatory framework in the electricity and railway sectors. The analysis in this review assesses Russia against a number of OECD instruments. At the same time, the review has been adjusted to take into account the specific regulatory challenges faced by the Russian authorities, as well as administrative re-organisation required. The review contains comprehensive and detailed policy recommendations that will assist the Russian authorities in structuring and implementing regulatory reforms in order to boost economic growth, job creation, innovation and investment. The review will also help the authorities develop a more comprehensive approach in order to produce results more quickly.

    Abstract: Innovation surveys provide a broad measure of the successful commercial introduction of new product and process innovations. The dual purposes of this paper are to establish whether survey-based measures of innovation are related to more widely used intermediate measures, such as R&D and patents, and to identify the principal factors that affect the probability of successful innovation. Cross-country panel data is used from the third European Community Innovation Survey (CIS3), with allowance made for possible differences by firm size and by sector of activity. The survey measures of innovative activity and success are found to be positively correlated with past R&D and patenting, suggesting that factors affecting the development of innovations also affect their subsequent implementation. The availability of qualified personnel and private financing, less rigid product and labour market regulations, greater co-operation in the innovation process and public financial support are all found to be positively associated with the proportion of successful innovators for at least some sectors and firm sizes. Innovation in small firms is found to be more dependent on co-operation and the availability of finance than in larger firms.

    Abstract: Mobilising private investment is recognised as a priority area for development so that poor countries are not left further behind. But reaping the maximum benefits of investment is not automatic. Policies matter too. A key challenge, therefore, is how to frame investment policies in a way that supports and reinforces economic development. In this respect, OECD Investment Committee co-operation activities with non-member economies aim to promote private investment, both foreign and domestic, and to create the policy environments needed to unleash the full benefits from investment, in terms of economic growth, poverty reduction and sustainable development. Investment for Development provides a record of the OECD Investment Committee's co-operation programmes with non-member economies and their results. These extensive co-operation activities are organised around three dimensions: global events, regional initiatives and dialogue with individual countries. This report documents how these initiatives help to strengthen implementation capacities and best practices among non-members, drawing on the broad applicability of the principles and expertise the OECD has developed in the area of international investment, including the positive contribution of responsible international business. Host countries are not alone in advancing this agenda. Home countries have a key role to play too. One example is the role of official development assistance in mobilising private investment. Investment for Development includes a report that identifies policy lessons and the analytical evidence that underpins them.

    Abstract: This study examines the nature and the extent of use of customs fees and charges that affect imports at borders. It is part of a series of studies that analyse various types of non-tariff measures and the objective of this paper is to contribute to discussions in the Negotiating Group on Market Access (NAMA), the Council on Trade in Goods and elsewhere in the trade policy community. The analysis draws on data collected from WTO Trade Policy Reviews, non-tariff barrier notifications to NAMA, and the UNCTAD TRAINS database and country notes. The study reveals that most types of customs fees and charges on imports are applied ad valorem rather than with regard to the underlying costs of the services rendered. The use of customs fees and charges has also evolved over time: the use of both customs surcharges and consular invoice fees has markedly declined over the last two decades while more countries nowadays charge importers fees for the use of various customs-related services.

    Abstract: Following up a 2003 publication by the Trade Committee, this paper examines the treatment of agriculture in regional trading arrangements (RTAs) against the background of treatment under the multilateral trading system (MTS). This paper describes 18 RTAs and its findings may not be generalizeable to the 169 RTAs that have been notified to the WTO. The relationship between the treatment of agriculture in RTAs and that within the MTS is complex. This paper contains illustrates the topography of agricultural treatment within RTAs under four separate headings including: coverage, domestic support, contingency protection and sanitary and phytosanitary regulations. This descriptive analysis is prepared both as a basis for assessing progress on agriculture in RTAs and as frame of reference for considering the treatment of agriculture at the multilateral level.

    Abstract: This paper provides an assessment of the impact of a package of structural reforms in all OECD countries on their long-run trade and output gains. The package includes reforms that reduce competition-restraining regulations, cut tariff barriers and ease restrictions on foreign direct investment to “best practice” levels in the OECD area. The analysis, which is based on earlier OECD studies, indicates that such reforms could lead to gains in GDP per capita in OECD countries of up to 4 to 5 per cent. As the analysis is confined to a relatively narrow set of policies and abstracts from potential dynamic effects from reform-induced increases in innovation, the overall gains from broad reforms could be significantly higher than reported in the paper.

    Abstract: This paper analyses customs automation which is one of the most powerful tools to increase customs efficiency. It focuses in particular on the benefits and implementation costs of automation. It is part of a series of studies that analyse various aspects of trade facilitation and the objective is to contribute to discussions in the WTO Negotiating Group on Trade Facilitation. Based on cost estimations in customsrelated lending projects, the paper finds that the costs for implementing, maintaining and operating automated customs systems are substantial. However, the very great majority of WTO members have already implemented such systems and past experiences show that the financial benefits in many cases have exceeded the costs over time. Among the various lessons learned from successful implementation of automated customs systems, two are particularly worth highlighting. First, automation should not be considered a panacea for trade facilitation; and second, commitment and financial sustainability are prerequisites for successful customs modernisation involving automation.

    Abstract: This Review measures the level and composition of support to Brazilian agriculture, and evaluates the effectiveness of current measures in attaining their objectives. The study finds that Brazil provides much lower support to its agricultural sector than most OECD countries. However, a large and increasing share of that support is provided in the form of credit subsidies; support which could be more productively oriented to areas such as research and extension, training, and the development of rural infrastructure. A greater focus on such long-term investments could help Brazil to address the two major challenges confronting its agricultural sector: the need to sustain improvements in international competitiveness, and at the same time draw poor smallholders into the development process. At the international level, the report finds that, having substantially reformed its own agricultural policies, the main source of future benefits to Brazil will be reforms in other countries, where access to OECD country markets is the most important issue. Yet while trade liberalisation offers important benefits for the majority of households, those gains need to be placed in the context of the broader opportunities and adjustment pressures confronting both commercial farmers and smallholders.

The global market in 2003 was over USD 21 billion compared with USD 32 billion for the recorded music industry. The main segments are off-line consoles and PCs; online and wireless games are still relatively small but there is a general online trend and the industry is increasingly strategic for media, Internet and consumer electronics firms. “Dis-intermediation” is occurring in the value chain as distributor and retail roles are taken by publishers directly or via ISPs and game Web sites. ISPs are also acting as content aggregators and game Web sites and portals as retailers (“re-intermediation”). Development barriers include the availability of network infrastructure, skills and management challenges, financing issues, and the legal and payments infrastructure. The policy framework affecting the industry includes R&D and technology, market and skills development; IPR and piracy issues; online business conditions including broadband quality, micro-payments, standards and taxation issues; and social dimensions including culture, age ratings and content issues, and games applications in education.

    Abstract: These workshop proceedings deal with the local partnership methodology employed in Belgium in order to develop an integrated proposal to the national government to construct and operate a disposal facility for low-level radioactive waste that is adapted to local conditions. The partnerships were formed among representatives of local organisations in affected communities and representatives of the Belgian national radioactive waste management agency. Insights are provided into a unique - and so far very successful - governance approach to dealing with interests, values and knowledge in managing risk.

    Abstract: This DAC Reference Paper outlines key issues faced when designing Environmental Fiscal Reform (EFR). EFR refers to a range of taxation and pricing measures which can raise fiscal revenues while furthering environmental goals. The objective is to provide insights and “good practice” on how development co-operation agencies can help developing countries take advantage of EFR approaches in both their development and poverty reduction strategies. Following a review of the instruments of EFR and related technical issues, Environmental Fiscal Reform for Poverty Reduction focuses on the political economy and governance aspects of EFR. This includes an examination of the precondition for successful design and implementation, the various steps involved through the EFR Policy Cycle, the challenges faced at each stage, and the main stakeholders involved. The role of donors in supporting EFR processes is also outlined. Subsequently, these issues are reviewed in relation to sectors of particular relevance for developing countries: forestry, fisheries, fossil fuel, electricity, drinking water and industrial pollution control.

    Abstract: This paper was prepared by Sigma, upon the request of the Ministry of the Interior of the Czech Republic, to serve as a basic comparative working document for the preparation of a new policy and regulation on conflict of interest in the Czech public sector. Given its generalist orientation, the paper could also be useful for other countries carrying out specific reforms in the area of conflict of interest and general reforms related to anti-corruption policies and instruments. This paper provides descriptive data and an analytical overview of approaches to managing conflicts of interest in the public sector of nine European countries — six “old” EU members (France, Germany, Italy, Portugal, Spain and the United Kingdom) and three “new” EU members (Hungary, Latvia and Poland). The paper also provides some conclusions that are worth taking into account when reforming policies and instruments to improve regulations and practices on conflict of interest.

It also provides insights into some of the factors that are associated with the development of problem-solving skills and into how these factors interact and what the implications are for policy development. Finally, the report sheds light on countries that succeed in achieving high performance levels while at the same time providing an equitable distribution of learning opportunities.

    Abstract: This publication provides policy guidance in an area that has been given little policy priority until recent years. It brings together key lessons from 17 OECD countries, providing evidence on the strategies in place to improve adults’ participation in learning. It addresses potential barriers to learning as well as the policies to remedy them. Among these are policies for increasing and promoting the benefits of adult learning to make them transparent and easily recognised. Other policy levers include economic incentives and co-financing mechanisms that can raise the efficiency of adult learning provision, while delivering quality learning that is adapted to adults’ needs. Finally, policy making can be improved via co-ordination and coherence in a field that is characterised by a wide variety of stakeholders, including ministries of education and ministries of labour.

    Abstract: This paper draws together the key findings from separate detailed analyses of the determinants of R&D, patenting and the commercial introduction of innovations in the business sector in order to identify the policies, institutions and framework factors that provide the most effective means of supporting innovation. The evidence suggests that there is a clear role for framework conditions, framework policies and specific science policies, both independently and in interaction with each other. Policies that raise the absorptive capacity of the economy (the capacity to understand and make use of new knowledge) are likely to have dual benefits, not only helping to stimulate new innovative activities, but also helping to maximise the benefits to be gained from the existing stock of knowledge. Potential policy trade-offs also need to be taken into account. Some policies that offer benefits for current innovation also have costs that could adversely affect future incentives to innovate. Others have trade-offs when considered in combination. Cross-country differences in the level of R&D intensity are shown to be closely correlated with crosscountry differences in science policies and institutions. Framework conditions and policies have an important influence when accounting for cross-country differences in the rate of change of R&D intensities over time.

    Abstract: Government and its agencies have a fundamental lead role to play in providing an environment favourable to business operations and conducive to private investment. This is especially true for small business. In order to flourish and grow they need an environment that facilitates and enables business start-ups, does not hamper them with excessive and costly regulations, and facilitates access to finance and business services. In 2002, the OECD and the European Bank for Reconstruction and Development (EBRD) launched the Enterprise Policy Performance Assessments (EPPAs) in the framework of the Investment Compact for South East Europe (SEE) Programme. The EPPAs consist of a series of reports covering all countries of South East Europe They assess the quality of government policy for the Small and Medium Enterprise sector, and regularly monitor its implementation. The 2004 edition of the EPPAs has been prepared by the OECD and the EBRD in close consultation with the European Commission. Synergies have been created between the EPPA and the European Union Charter for Small Business, covering seven policy dimensions: institutional framework; regulatory environment; tax policy; access to finance; advisory services; business incubators; and, entrepreneurship, vocational training and access to technology. This Enterprise Policy Performance Assessment report is presented as an independent and constructive contribution to the debate on enterprise policy in Romania, bringing forward the views of the small business sector and providing a set of priority actions and policy recommendations to the government and the small business community.

The report concludes with specific recommendations regarding prevention and detection, as well as prosecution and punishment. Key legal provisions to deter, prevent and fight corruption as submitted by Canada to the review process are also included.
