    Abstract: Terrorismus ist noch immer eines der bedrohlichsten Phänomene der heutigen Zeit. In diesem Buch werden mithilfe von Gerichtsakten vom Generalbundesanwalt beim Bundesgerichtshof in Karlsruhe die Radikalisierungsprozesse von 58 deutschen Jihadisten analysiert. Durch das umfassende Datenmaterial ist es möglich, die Wege dieser Personen von der Radikalisierung bis zum Anschluss an eine terroristische Organisation im Ausland (u.a. Islamischer Staat) sowie ausgeübte strafrechtlich relevante Handlungen zu rekonstruieren. Mithilfe einer Netzwerkanalyse wird das radikale Netzwerk untersucht, das aus Deutschland mit Jihadkämpfern im In- und Ausland verbunden gewesen ist. Dabei wird ein Augenmerk auf den Aufbau, die Funktionsweise und die Schlüsselpersonen des Netzwerks gelegt. Auch werden die unterschiedlichen Rollen und Unterstützungshandlungen der Netzwerkmitglieder in den Fokus genommen. Zusätzlich werden strafrechtlich relevante Radikalisierungs- und Mobilisierungsstrategien salafistisch-jihadistischer Prediger entschlüsselt, die weitaus tiefere Verbindungen zu terroristischen Organisationen im Ausland haben als bisher angenommen. Die Autorin Kristin Weber ist Kriminologin, Soziologin und wissenschaftliche Mitarbeiterin im Bereich der Radikalisierungs-, Terrorismus- und Extremismusforschung. An der Deutschen Hochschule der Polizei in Münster-Hiltrup hat sie ihre Dissertation im Rahmen des Projektes X-Sonar "Analyse extremistischer Bestrebungen in sozialen Netzwerken", welches vom Bundesministerium für Bildung und Forschung gefördert wurde, geschrieben.

    Abstract: Poverty and inequality have pervaded British society to this day, but this has not always been self-evident to contemporaries - popular understandings have depended on existing knowledge. Inequality Knowledge provides the first detailed history of the numbers about the gap between rich and poor. It shows how they were produced, used, and suppressed at times, and how activists, scientists, and journalists eventually wrestled control over the figures from the state. The book traces the making and the politics of statistical knowledge about economic inequality in the United Kingdom from the post-war era to the 1990s. What kind of knowledge was available to contemporaries about socio-economic disparities in Britain and how they evolved over time? How was this knowledge produced and by whom? What did policy makers and civil servants know about the extent of poverty and inequality in British society and to what extent did they take the distributional impact of their social and fiscal policies into account? Far from just a technical matter, inequality knowledge had far-reaching implications for key debates and the wider political culture in contemporary Britain. Historicizing inequality knowledge speaks to a long tradition of historical research about social class divisions and cultural representations of economic disparities in twentieth-century Britain.

Was bedeuten diese Spannungen heute? Maria Anna Willer untersucht Strukturen und Prozesse der Ausgrenzung in der Face-to-Face-Gesellschaft eines Dorfes am bayrischen Alpenrand zur Zeit der NS-Herrschaft und beleuchtet dessen Erinnerungskultur. In Anlehnung an Foucault beschreibt sie im Modell eines »Dispositivs der NS-Verfolgung« die engmaschigen Strukturen der Kontrolle und Überwachung sowie Widerstand und Hilfeleistungen als Kategorien der NS-Diktatur auf dem Dorf. Es zeigt sich: Nach 1945 ist eine Kontinuität der Ausgrenzung erkennbar, wenn die Erinnerung an Opfer der NS-Verfolgung verdrängt wird.

    Abstract: Obdachlose gehören zum städtischen Alltag. Sie sind sichtbar und werden zugleich kaum wahrgenommen. Nadine Recktenwald blickt in die historischen Räume der Obdachlosen wie Asyle, Notunterkünfte und selbstangeeignete Orte. Sie untersucht deren Erfahrungen mit urbanen Strukturen, sozialstaatlichen Maßnahmen und gesellschaftlicher In- und Exklusion. In der Weimarer Republik profitierten Obdachlose erstmals von kommunaler Sozialfürsorge. Zugleich blieb Obdachlosigkeit bis 1974 ein Straftatbestand. Diese Ambivalenz zwischen Fürsorge und Strafe ermöglichte Handlungsspielräume für die Betroffenen ebenso wie für die staatlichen Akteure. Insbesondere aber nicht nur im Nationalsozialismus wurden Obdachlose verdrängt und verfolgt. Mit einem raumanalytischen Ansatz, umfangreichen Quellen und Einzelbiografien erforscht die Autorin, wie Obdachlose spezifische soziale Praktiken ausbildeten, um ihre gesellschaftliche Position zu beeinflussen. Eindrucksvoll zeigt sie die Interaktionen der Betroffenen untereinander ebenso wie mit Ämtern, der Justiz und den städtischen Öffentlichkeiten. Eine aufschlussreiche Sozial- und Stadtgeschichte der Obdachlosen in der Weimarer Republik, im Nationalsozialismus und in der Bundesrepublik.

Es wird herausgearbeitet, wie sich diese Interessenkonflikte auf die Praxis der betrieblichen und behördlichen Datenschutzbeauftragten auswirken und welche Unterschiede sich bei einer internen oder externen Benennung des Datenschutzbeauftragten ergeben. Art. 38 Abs. 6 S. 1 DSGVO sieht ein Verbot der Zuweisung konfligierender Aufgaben vor – die Möglichkeiten eines Interessenkonflikts des Datenschutzbeauftragten gehen jedoch weit über diese normierte Konfliktmöglichkeit hinaus. Konkret werden in der Arbeit Interessenkonflikte in Bezug auf die unabhängige Stellung, die Aufgaben, die Pflichten und die Rechtsbeziehungen des Datenschutzbeauftragten betrachtet. Bei der Analyse der Interessenkonflikte wird berücksichtigt, dass der Datenschutzbeauftragte zugleich dem Verantwortlichen, den Betroffenen, den Aufsichtsbehörden und dem Datenschutz als abstraktes Schutzgut verpflichtet ist. Schließlich wird in der Arbeit aufgezeigt, welchen Verbundenheiten sich der Datenschutzbeauftragte ausgesetzt sieht und welche Antworten des Rechts den Interessenkonflikten gegenüberstehen.

Um diese Hintergrundermittlungen nicht vorzeitig aufzudecken, wird die sog. ›Legendierte Kontrolle‹ eingesetzt, bei der die Ermittlungsbehörden eine Durchsuchung als allgemeine Verkehrskontrolle tarnen. Die Arbeit ordnet das Instrument in das bestehende System verdeckter und täuschender Ermittlungsmaßnahmen ein. Sie analysiert die verfassungs- und strafverfahrensrechtliche Zulässigkeit des staatlichen Vorgehens, das sich im Grenzbereich zwischen Gefahrenabwehr und Strafverfolgung bewegt. Ein besonderer Schwerpunkt liegt auf der Frage, ob entgegen dem Grundsatz der Aktenwahrheit eine legendierte, also unzutreffende oder unvollständige Aktenführung erlaubt sein kann.     Abstract: "Thousands of intact ceramic bowls and plates as well as fragments made in the medieval Byzantine empire survive to this day. Decorated with figural and non-figural imagery applied in a variety of techniques and adorned with colourful paints and glazes, the vessels can tell us much about those who owned them and those who looked at them. In addition to innumerable ceramic vessels, a handful of precious metal bowls and plates survive from the period. Together, these objects make up the art of dining in medieval Byzantium. This art of dining was effervescent, at turns irreverent and deadly serious, visually stunning and fun. It is suggestive of ways in which those viewing the objects used a quotidian and biologically necessary (f)act - that of eating - to reflect on their lives and deaths, their aspirations and their realities.     Abstract: This volume brings together a series of discussions by scholars from a range of disciplinary, (trans)regional and epistemic perspectives that came out of the Berlin-based "co2libri" networking initiative, with longstanding collaborative partners based in the global South. "Co2libri" stands for "conceptual collaboration: living borderless research interaction". As an interdisciplinary and transregional oriented initiative, co2libri envisages a multicentric perspective that integrates neglected positions of Southern theory and praxis into the heart of academic conversations. Co2libri’s collaborative endeavor builds on long-standing active connections with partners in Africa, South and Southeast Asia, and the Middle East. Instead of setting an agenda from the North, it proposes to figure out ways forward through collaborative engagement, building on relationships of mutual trust. Using formats that facilitate substantial and open-ended discussion, we are re-thinking theory and method, academic practices, and research ethics, while keeping material inequalities in view.

    Abstract: Anyone who visits Berlin’s Olympic Park will inevitably stumble across the continued effects of the site's Nazi monumentality—and also its largely unbroken tradition of ethnic and anti-Semitic monumentality. The criticism of this is diverse, but so far rather loosely interwoven: Where does the debate stand—or, indeed, where do the debates stand? What views are there from the perspectives of history, museums, art, politics, sport or monument protection? Where can bridges of criticism be built, where are the different perspectives contradictory, and where is fundamental reorientation or readjustment of the debate(s) required? This anthology attempts to address these questions, not only to outline or initiate paths of debate but also to identify fundamental problems.

    Abstract: Archival research into policing and surveillance of migrant women illuminates pressing contemporary issues. Examining little-known policing archives in France, Senegal, and Cambodia, Jennifer Anne Boittin unearths the stories of hundreds of women labelled 'undesirable' by the French colonial police and society in the early 20th century. These 'undesirables' were often women travelling alone, women who were poor or ill, women of colour, or women whose intimate lives were deemed unruly. In considering how ordinary women pursued autonomy, security, companionship, or simply a better existence in the face of surveillance and control, 'Undesirable' illuminates pressing contemporary issues of migration and violence.

    Abstract: This book focuses on the development of bilateral Jewish-Muslim relations in London and Amsterdam since the late-1980s. It offers a comparative analysis that considers both similarities and differences, drawing on historical, social scientific, and religious studies perspectives. The authors address how Jewish-Muslim relations are related to the historical and contemporary context in which they are embedded, the social identity strategies Jews and Muslims and their institutions employ, and their perceived mutual positions in terms of identity and power. The first section reflects on the history and current profile of Jewish and Muslim communities in London and Amsterdam and the development of relations between Jews andMuslims in both cities. The second section engages with sources of conflict and cooperation. Four specific areas that cause tension are explored: the Israeli-Palestinian conflict; antisemitism and Islamophobia; attacks by extremists; and the commemoration of wars and genocides. In addition to ‘trigger events’, what stands out is the influence of historical factors, public opinion, the ‘mainstream’ Christian churches and the media, along with the role of government.     Abstract: Black communities have been making major contributions to Europe's social and cultural life and landscapes for centuries. However, their achievements largely remain unrecognized by the dominant societies, as their perspectives are excluded from traditional modes of marking public memory. For the first time in European history, leading Black scholars and activists examine this issue – with first-hand knowledge of the eight European capitals in which they live. Highlighting existing monuments, memorials, and urban markers they discuss collective narratives, outline community action, and introduce people and places relevant to Black European history, which continues to be obscured today.

    Abstract: Being a historian of Germany and of the German-Jews in modern times, the author has written numerous essays on the history and historiography of Antisemitism in this country. Some of them are rather well-known, such as the essay on "Antisemitism as a Cultural Code", and others were printed in peripheral journals and Festschrifts or were never published in English. Since the phenomenon of Jew-hating is now once again an issue discussed by scholars and non-scholars alike, both in Europe and in the United States, and especially since it now arouses particular interest in the context of the Palestinian fight against Israel, it seems timely to re-publish these essays in a slightly revised form, and attach to them an extended introduction as well as a follow-up essay at the end, updating old notions, reformulating some and adding commentary on controversies that are being conducted today regarding the term Antisemitism, its various contexts and the phenomenon it signifies. Freshly looking at Antisemitism in Germany before, during and after National-Socialism seems to be needed at this point in time

    Abstract: In the era of bourgeois modernity (1750-1900), the family is as valued as it is vulnerable. It constitutes a community of care, conflict, and emotion. Time and again, it is evoked as a bond of love as well as a moral institution. Yet both love and morality are fragile. A more detailed exploration reveals that domestic life during this period was much more colorful, open, and dynamic - and also more prone to crisis - than one might expect given the vaunted view of the family that characterized the heyday of the bourgeoisie. This book rewrites the history of the modern family. Self-narratives - primarily diaries - written by members of eight families from Germany, Switzerland, and Austria serve as sources for this research. The focus extends far beyond the bourgeoisie. With a micro-historical eye, the author reconstructs family histories from the peasant milieu to the patrician elite, from the parsonage to the educated bourgeoisie; he considers the domestic life of a journeyman craftsman, a couple's descent from the ranks of the petite bourgeoisie, the effects of an itinerant childhood among the proletariat, and the strain of being caught between a bourgeois family and artistic individuality. Many of these aspects point beyond bourgeois modernity to the family in our time

    Abstract: In 'The Subversive Seventies', Michael Hardt sets out to show that popular understandings of the political movements of the seventies - often seen as fractious, violent, and largely unsuccessful - are not just inaccurate, but foreclose valuable lessons for the political struggles of today. Looking at a wide range of movements around the globe during the 1970s, from the United States, to Guinea Bissau, South Korea, Chile, Turkey, and Italy, Hardt argues that the movements of the 1970s identified and attempted to resolve the political problems that still face contemporary radical political thought and action.

    Abstract: Die Abschaffung der Verfallsperre im Zuge der Reform des Rechts der Vermögensabschöpfung zum 1. Juli 2017 hat die Anwendbarkeit der Einziehungsvorschriften für das Steuerstrafrecht zur Folge. Mehrere Nachjustierungen des Gesetzgebers lassen vermuten, dass die Eigenheiten des Steuerstrafrechts bei der Reform nur unzureichend berücksichtigt worden sind. Die dadurch entstandene Schnittmenge zwischen neuem Einziehungsrecht und Steuerstrafrecht ist Gegenstand dieser Arbeit, da neben die klassische Steuereintreibung durch die Finanzämter nun auch Einziehungsentscheidungen durch Strafgerichte treten können. Die Autorin Julia Brunner ist in der bayerischen Finanzverwaltung tätig.

    Abstract: Die Regulierung des Internets, häufig auch als Internet Governance bezeichnet, erfolgt gegenwärtig durch eine Vielzahl sowohl privater als auch staatlicher Akteure. Zugleich ist es eine der drängendsten Herausforderungen mit Blick auf die Zukunft des Internets, den ständigen Prozess des Wandels und der Fortentwicklung dieses Mediums regulatorisch zu begleiten und einzuhegen. Dies wirft die Frage auf, welchen Regelungen und Vorschriften Regulierungsmaßnahmen unterliegen, die auf das Internet abzielen. Da aufgrund der entgrenzten Natur des Internets einer Regulierungsmaßnahme praktisch stets eine grenzüberschreitende und damit internationale Dimension zukommt, lässt sich dies jedoch nicht allein anhand nationaler Rechtsvorschriften beantworten. Stattdessen ist hierfür ein Rückgriff auf das Völkerrecht angezeigt. Der Band soll einen Beitrag dazu leisten, die Bedeutung des Völkerrechts für die globale Internet Governance zu ermitteln. Der Autor David Hamburger war von 2017 bis 2021 wissenschaftlicher Mitarbeiter und Doktorand am Lehrstuhl für Staats- und Verwaltungsrecht, Völkerrecht, Europäisches und Internationales Wirtschaftsrecht an der Universität Passau.     Abstract: Gegenstand dieses Buches ist die Zurechnung des Wissens der Aufsichtsratsmitglieder einer deutschen AG.     Abstract: Dieses Buch beschäftigt sich mit hochaktuellen und grundlegenden rechtlichen und rechtsethischen Fragen der Regulierung der modernen Biotechnologie, insbesondere von genetisch veränderten Organismen. Zentraler Gegenstand der Arbeit ist die Rechtssache Confédération Paysanne des EuGH, in der die Anwendung des Vorsorgeprinzips im europäischen Gentechnikrecht gestärkt wurde. Dies wurde von naturwissenschaftlicher Seite als gegenwärtig nicht angemessen und veraltet kritisiert. Das Vorsorgeprinzip, verankert im europäischen Umweltrecht und in verschiedenen Verträgen des internationalen Rechts, ist vor allem bei der Regulierung von Biotechnologie umstritten. Es geht daher in diesem Buch um Fragen der angemessenen und ethisch fundierten Regulierung von Teilbereichen der Biotechnologie als einer Zukunftstechnologie. Dies geschieht vor der anhaltenden Debatte um eine mögliche Neuausrichtung des europäischen Biotechnologierechts. Die theoretischen und dogmatischen Grundlagen für die gegenwärtige und zukünftige Normierung werden dargelegt.     Abstract: This book offers a comprehensive analysis of the legal questions that arise for the legislative branch when implementing the crime of aggression into domestic law. Despite being the “supreme international crime” that gave birth to international criminal law in Nuremberg, its ICC Statute definition has been incorporated into domestic law by fewer than 20 States. The crime of aggression was also omitted in the rich debate held among German scholars in the early 2000s regarding the legislative implementation of other ICC Statute crimes. The current inability of the International Criminal Court to respond to the Russian aggression towards Ukraine invites the continuation of these academic debates without neglecting the particularities of the crime of aggression. The fundamental issues discussed in this volume include the obligation to criminalize aggression, the core wrong of the crime, the normative gaps under domestic law and the jurisdictional gaps under the ICC Statute. To facilitate the operationalization of domestic implementation, the book explores the technical options for incorporating the definition into domestic law, the geographical ambit of domestic jurisdiction—most notably universal jurisdiction—as well as legal challenges such as immunities. The book is aimed primarily at researchers and States with an interest in the domestic implementation of international criminal law but those already working in the field should also find much of interest contained within it. Dr. Annegret Hartig is Program Director of the Global Institute for the Prevention of Aggression and worked as a researcher at the University of Hamburg where she obtained her doctoral degree in international criminal law.

    Abstract: This book explores the issue of leadership criminality from a new angle by comparing two highly relevant modes of responsibility. By contrasting individual criminal responsibility for ordering international crimes with indirect perpetration through an organisation, it shows the doctrinal weaknesses of the latter and outlines the much-overlooked advantages of the former. The volume analyses the development of both forms of responsibility, looking at their origins, and their reception in academia and practical use in jurisprudence. The history of indirect perpetration through an organisation (Organisationsherrschaft) is portrayed from its German academic origin, through German jurisprudence to the reception of the doctrine at the International Criminal Court. By comparing the doctrine’s stages of evolution, the book sheds light on the different aspects of the various models of indirect perpetration through an organisation and carves out general and fundamental criticism of it. The characteristics of ordering liability are explored in depth through an analysis of jurisprudence of the Nuremberg subsequent trials, the ad hoc tribunals and the International Criminal Court. This historic and doctrinal comparison reveals a well-defined and to-date much neglected mode of responsibility with enormous potential for the adjudication of leadership figures in the ambit of international criminal law and only one conclusion can follow from this analysis: it calls for practitioners and academics to leave the well-trodden paths of national criminal law doctrine and embrace truly international modes of liability such as the ordering of a crime. He studied in Münster, Germany and Bogotá, Colombia and obtained his Dr. iur. from the University of Cologne, where he also worked and taught as a research assistant for several years. His legal clerkship led him to organized crime investigations, criminal defence, the European Commission and the German Federal Ministry of Justice.

    Abstract: This book examines prisons and imprisonment. Historically, prisons and prisoners have been a source of interest to the general public. To ask this differently, why do agents still create or resort to informal institutions despite the presence of formal institutional rules and regulations? How do informal institutions matter? What roles do they play in sociopolitical life? How can we classify informal institutions? What novel types of informal institutions can we identify and explain? How do informal institutions interact with formal institutions? How do they shape formal institutional rules, mechanisms, and outcomes? Finally, how do existing informal institutions change? What factors might trigger informal institutional change? In order to answer these questions, Sarigil examines several empirical cases of informal institution as derived from various issue areas in the Turkish sociopolitical context (i.e., civil law, conflict resolution, minority rights, and local governance) and from multiple levels (i.e., national and local).

    Abstract: Kolonialismus ist Teil vieler europäischer Familiengeschichten: Bis heute bewahren Familien Tagebücher, Militaria oder Beutestücke auf, die VorfahrInnen als koloniale AkteurInnen nach Hause gebracht haben. Sie bezeugen nicht nur familiäre Verstrickungen, sondern haben obendrein über Jahrzehnte hinweg kollektive Vorstellungen über die koloniale Vergangenheit geprägt. Fotografien waren daran - als vermeintlich authentische Zeugnisse - ganz wesentlich beteiligt. Über den Tod der »Erlebnisgenerationen« hinaus vermittelten sie koloniale »Erfolgsgeschichten«, wodurch Familien zu einem Hort kolonialer Geschichtsmythen, etwa der »anständigen« KolonialherrInnen, wurden. Dieses Buch nimmt die kolonialen Bildbestände von Familien in der italienischen Provinz Bozen / Bolzano in den Blick, deren (Groß-)Vätergeneration am faschistischen Kolonialkrieg gegen das Kaiserreich Abessinien (1935-1941) teilgenommen hatte. Markus Wurzer untersucht die »sozialen Leben« kolonialer Bilder, also wie und wozu diese durch Soldaten und ihre Familien (re-)produziert, gebraucht und über Generationen hinweg weitergegeben wurden.

    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.
