    Abstract: Das 20. Jahrhundert ist oft als das Jahrhundert der Gewalt bezeichnet worden. Daher mangelt es nicht an Gewaltphänomenen, die es genauer zu untersuchen gilt, als dies bislang geschehen ist. In diesem Band werden deswegen Gewalttaten aus neuen Perspektiven untersucht, neue Interpretationen ihrer Entstehung vorgestellt und neue Herausforderungen der sozialwissenschaftlichen Gewaltforschung debattiert. Folgende Fragen werden unter anderem in diesem gesellschaftspolitisch folgenreichen Buch behandelt: Kann der lange dominierende Begriff der physischen Gewalt überhaupt noch leitend sein, und muß die Gewaltanalyse sich nicht wieder stärker der strukturellen Gewalt zuwenden, da zunehmend eine »Gewalt ohne Gesicht« auftritt? Stecken die Ursachen im Gewalthandeln selbst, so daß Hinweise auf soziale Hintergründe etwa in die Irre führen? Verlieren sozialwissenschaftliche Forschungen aufgrund neuer biologischer Ansätze völlig an Relevanz? Biographische Informationen Wilhelm Heitmeyer, geboren 1945, war von 1996 bis 2013 Direktor des Instituts für interdisziplinäre Konflikt- und Gewaltforschung der Universität Bielefeld und arbeitet dort jetzt als Forschungsprofessor. In der edition suhrkamp gab er u. a. die Reihe Deutsche Zustände heraus.     Abstract: Launch activities performed by private entities deal with a complex legal environment. The Space Treaties provide a general liability framework. Launch participants are subject to regulatory or institutional control, and to domestic liability laws. Specific contractual practice has developed due to insurance limitations, the inter-participants' waivers of liability and claims. This book synthesizes information on the norms of play, to allow the grasp of their relative weight and interactions in the assessment of liability risk for launch activities. It reveals a legal framework presently lacking sufficient predictability for an efficient liability risk management: the waivers of liability suffer weaknesses as do all such clauses, and lack uniformity and reliability; and the Space Treaties contain ambiguous terms preventing predictable determination of the States responsible for authorizing and supervising launch activities and for damage compensation, and do not reflect the liability of launch operators. This book offers suggestions of new approaches for: harmonizing waivers of liability to improve their consistency, validity and flow-down; and improving the Space Treaties for their implementation to non-governmental launch activities. In the launch community, the need for lawmaking is less compelling than in fields such as aviation. Nevertheless, adjustments to the present framework are proposed through model clauses and an international instrument, for further thinking and contribution by those sharing the opinion that creative lawmaking is needed now to prepare for tomorrow's endeavors.

    Abstract: This volume represents the first attempt to systematically compare organised crime concepts, as well as historical and contemporary patterns and control policies in thirteen European countries. These include seven ‘old’ EU Member States (Denmark, France, Germany, Italy, The Netherlands, Spain and the United Kingdom), two ‘new’ members (the Czech Republic and Poland), a candidate country (Turkey), and three non-EU countries (Albania, Russia and Switzerland). Based on a standardised research protocol, thirty-three experts from different legal and social disciplines provide insight through detailed country reports. On this basis, the editors compare organised crime patterns and policies in Europe and assess EU initiatives against organised crime. Special attention is paid to the subjective perceptions and thought patterns of the different players, for the perception that international political players have of the outside world is an important element that is frequently neglected in political and military analyses

    Abstract: Arnd Uhle untersucht das Verhältnis von freiheitlichem Verfassungsstaat und kultureller Identität, das bislang kaum – wenn, dann lediglich partiell – erforscht wurde. Der Autor beleuchtet die Relevanz der kulturellen Identität für Entstehung, Gestalt und Fortbestand des freiheitlichen Verfassungsstaates aus verfassungstheoretischer, aus verfassungsrechtlicher und schließlich aus europarechtlicher Perspektive.Bereits aus verfassungstheoretischer Sicht ergibt sich dabei, daß die kulturelle Identität gleichermaßen Entstehungs- wie auch Geltungsbedingung freiheitlicher Verfassungsstaatlichkeit ist, weil der freiheitliche Staat in vielfältiger Weise an die kulturelle Identität anknüpft. Eine Betrachtung aus verfassungsrechtlicher Perspektive unterstreicht diesen Befund und belegt, daß namentlich das deutsche Grundgesetz in einer prima facie zwar komplex und unüberschaubar erscheinenden, letztlich aber systematisch geordneten und differenzierenden Weise an die kulturelle Identität anknüpft – und diese angesichts ihrer Bedeutung für den dauerhaften Fortbestand des freiheitlichen Verfassungsstaates überdies durch das in der Habilitationsschrift erstmals entfaltete grundgesetzliche Staatsziel der Vitalität und Dauerhaftigkeit der freiheitlichen Verfassungsordnung mit verfassungsrechtlichem Schutz umhegt. In der Konsequenz dieses Staatsziels ist der grundgesetzgebundene Staat zur Pflege und zum Schutz der kulturellen Identität verpflichtet. Eine abschließende europarechtliche Betrachtung verdeutlicht, daß die grundgesetzliche Anknüpfung an die kulturelle Identität wie auch deren verfassungsrechtliche Sicherung den Schutz des Art. 6 Abs.3 EUV genießen, der die Achtung der nationalen Identität anordnet.

    Abstract: Die Arbeit befasst sich mit dem mandatum iuris gentium und der völkerrechtlichen Treuhand. Im ersten historischen Teil werden die rechts- und ideengeschichtlichen Wurzeln beider Institute nachvollzogen. Im zweiten Teil werden problematische Fälle des modernen Völkerrechts dargestellt, in denen das Mandats- bzw. Treuhandrecht in völkerrechtlichen Streitfragen besondere Relevanz hatte und z. T noch hat, z.B. Südwestafrika/Namibia, Israel/Palästina und Nauru. Im dritten und letzten Teil wird die Zukunft der völkerrechtlichen Treuhand untersucht, insbesondere in besonders aktuellen Fällen wie Kosovo, Afghanistan und Ost-Timor, die de facto mit der völkerrechtlichen Treuhand vergleichbar sind. In diesem Teil werden auch Vorschläge zu Wiederbelebung des UN-Treuhandsystems, auch im Umweltvölkerrecht, und ähnliche Vorschläge aus der Völkerrechtslehre diskutiert. Insgesamt wird festgestellt, dass der Treuhandgedanke seit seiner Entstehung im Völkerrecht nicht an Aktualität eingebüßt hat.

    Abstract: Limiting Institutions examines the security threats in Eurasia and the role of institutions in the post-Cold War international environment. It looks at both the crucial aspect of foreign policy as well as a theoretical area of security studies and its impact in the former Soviet States including Russia, Belarus, Armenia, the Ukraine and Moldova. The first section addresses the important and varied range of security threats to this area of the world, and examines the range of responses open to European countries and to the United States. Threats such as ethnic conflict, transnational crime, and environmental and energy security issues are examined in depth. The second section addresses an important theoretical issue, namely the role that international institutions can perhaps play as arbiters of conflict and facilitators of cooperation in a region abutting the European political space. The role of the OSCE, NATO, the European Union, the Commonwealth of Independent States and the Black Sea Economic Cooperation Council are consequently examined closely. The contributors are scholars with solid international reputations, and the book will be of benefit to students of international relations and conflict analysis

Do human rights agendas address the problems many people face, or are they more often the imposition of Western values onto largely non-Western communities? Human Rights in a Global Perspective develops a social critique of rights agendas.     Abstract: In Indonesia, the world's largest Muslim-majority country, Muslims struggle to reconcile radically different sets of social norms and laws, including those derived from Islam, local social norms, and contemporary ideas about gender equality and rule of law. In this 2003 study, John Bowen explores this struggle, through archival and ethnographic research in villages and courtrooms of the Aceh Province, Sumatra, and through interviews with national religious and legal figures. He analyses the social frameworks for disputes about land, inheritance, marriage, divorce, Islamic History and, more broadly, about the relationships between the state and Islam, and between Muslims and non-Muslims. The book speaks to debates carried out in all societies about how people can live together with their deep differences in values and ways of life. It will be welcomed by scholars and students across the social sciences, particularly those interested in anthropology, cultural sociology and political theory.

    Abstract: Sexuality, motherhood and marriage were matters of public policy throughout the nineteenth and early twentieth centuries. They were prominent areas in the regulation of women, but the idea that the law merely reflected what was normal and natural obscured the extent of this regulation. Regulating Womanhood poses historically and culturally specific questions about the mechanisms that have controlled and restricted women. It shows not merely how laws and policies have set boundaries to the lives of women but also how the category of 'woman' has been constructed as a specific object for legal and social policy, and how women came to be seen as needing 'special' regulation. In addition, Regulating Womanhood explores how children and the organisation of reproduction and sexuality operated to normalise and make acceptable the degree of regulation to which women were subjected. Yet this is not a catalogue of the unmitigated subjection of women in history. The contributors focus on women's resistance and activity, and on the shift in modes of regulation, to challenge the idea of an unchanging history of the legal oppression of women

    Note: Die Forschung zur Gewalt in modernen westlichen Gesellschaften hat in den letzten Jahren zugenommen. Die Erklärungen dafür sind zahlreich: tatsächlicher Anstieg bei bestimmten Gewaltvarianten, neue Sensibilitäten, Rückkehr alter Gewaltformen, Verlagerung von Gewalt in andere gesellschaftliche Bereiche etc. Bisher fehlte jedoch ein systematischer Überblick über die tatsächlichen Befunde. Das "Internationale Handbuch der Gewaltforschung" füllt diese Lücke. Es stellt die langfristigen Entwicklungen umfassend dar, berücksichtigt aber auch ganz aktuelle Ereignisse. Insgesamt dominiert dabei der soziologische Schwerpunkt: Gewalt als soziales Phänomen. Entsprechend sind die Artikel gruppiert nach sozialstrukturellen Verhältnissen und Gewalt, Sozialisation und Lernen von Gewalt, Gewalterfahrungen und Gewalttätigkeiten etc. Ge-waltopfer werden ebenso thematisiert wie die Gewalt in gesellschaftlichen Institutionen, im öffentlichen Raum, durch politische Gruppen oder in bezie-hungsweise durch staatliche Institutionen. Thematisiert werden auch die jeweiligen Gewaltdiskurse, Rechtfertigungen und Verarbeitungen, mithin die ganze Prozessdynamik.     Abstract: If globalization is to be a benefit and not a burden to humankind, it must be governed by global institutions that are perceived by all people to be democratic and just. But before we can create such institutions, we must imagine them, and that requires a rethinking and extension of normative political theory. Global Justice and Transnational Politics encourages and advances that work.The book's first part, "Weak Universalism," contains essays by Amartya Sen and Leif Wenar that offer constructive developments of John Rawls's statement of the principles a liberal polity might reasonably propose to govern its relations with other peoples. The second part, "Strong Universalism and Transnational Commitments," contains essays by Jurgen Habermas, David Luban, Martha Nussbaum, and Thomas Pogge examining the normative sources and possible types of cross-border commitments. In the third part, "Transnational Politics and National Identities," Habermas discusses the possibility of a democratic political order developing within the institutional framework of the European Union; Thomas McCarthy draws on Kant to show how cosmopolitanism might be reconciled with the legacy of nationalism; and Craig Calhoun tries to retrieve a positive aspect of the tradition of nationalism, namely that it provides large populations with a powerful way of imagining political community across space and time.

    Abstract: Andreas Wimmer argues that nationalist and ethnic politics have shaped modern societies to a far greater extent than has been acknowledged by social scientists. The modern state governs in the name of a people defined in ethnic and national terms. Democratic participation, equality before the law and protection from arbitrary violence were offered only to the ethnic group in a privileged relationship with the emerging nation-state. Depending on circumstances, the dynamics of exclusion took on different forms. Where nation building was 'successful', immigrants and 'ethnic minorities' are excluded from full participation; they risk being targets of xenophobia and racism. In weaker states, political closure proceeded along ethnic, rather than national lines and leads to corresponding forms of conflict and violence. In chapters on Mexico, Iraq and Switzerland, Wimmer provides extended case studies that support and contextualise this argument.

In this book she gives an overview of the history of legal anthropology and at the same time urges anthropologists, lawyers, and activists to recognize the centrality of law in social change. Nader traces the evolution of the plaintiff's role in the United States in the second half of the twentieth century and argues that the atrophy of the plaintiff's power during this period represents a profound challenge to justice and democracy. Taking into account the vast changes wrought in both anthropology and the law by globalization, Nader speaks to the increasing dominance of large business corporations and the prominence of neoliberal ideology and practice today. In her discussion of these trends, she considers the rise of the alternative dispute resolution movement, which since the 1960s has been part of a major overhaul of the U.S. judicial system. Nader links the increasing popularity of this movement with the erosion of the plaintiff's power and suggests that mediation as an approach to conflict resolution is structured to favor powerful--often corporate --interests

    Abstract: Netwar-like cyberwar-describes a new spectrum of conflict that is emerging in the wake of the information revolution. Netwar includes conflicts waged, on the one hand, by terrorists, criminals, gangs, and ethnic extremists; and by civil-society activists (such as cyber activists or WTO protestors) on the other. What distinguishes netwar is the networked organizational structure of its practitioners-with many groups actually being leaderless-and their quickness in coming together in swarming attacks. To confront this new type of conflict, it is crucial for governments, military, and law enforcement to begin networking themselves.

    Abstract: "International business transactions are heavily influenced by culture,practice and rule. The pursuit of business relationships within nation-states can be subject to differences in the generation of norms and the processing of disputes, but these conflicts are magnified many times over in cross-border transactions where nation-state control and support is weak or absent. This book seeks different explanations of the ways in which business people and their legal advisers try to minimise the effect of these magnified difficulties. At the outset the editors suggest four sources through which the international business community might be considered to have supplemented nation-state conflict prevention and dispute resolution institutions - an international legal order; the development of a private normative order based on common business practices (denominated the lex mercatoria); through the efforts and work product of internationalised law firms, and by means of extensive, thick personal relationships often referred to by their Chinese term guanxi. Since most explanations are dominated by North American and European legal scholarship and practice, a second concern of this book is to open up the discussion to competing explanatory frameworks. Specifically, it develops the notion that global legal convergence may not be the immediate, inevitable result of increased global economic interaction. Rather, less formal mechanisms for achieving normative understanding and predictability in business dealings may also flourish."--Bloomsbury Publishing

    Abstract: Main description: Between 1750 and 1850, the methods and function of imprisonment went through a transformation. Prisons became the centre of public disciplination. Their function was to transform delinquents into useful citizens. But how should the buildings be designed to achieve that aim? Which new technologies could be used? The birth of modern prisons was long-lasting, covering three generations. The author outlines this process and shows parallels to the developments in England and the United States.
    Abstract: Main description: Der fundamentale Transformationsprozess des Strafsystems zwischen 1750 und 1850 machte die Strafanstalt zum Zentrum des staatlichen Strafvollzugs. Mit ihrer Hilfe hofften die Zeitgenossen, den Delinquenten in einen nützlichen Staatsbürger umschaffen zu können. Doch welches Design mußte diese Institution haben? Mit welchen Techniken war die Besserung des Delinquenten zu erreichen? Und wie sollte diese neue Straftechnologie in das bestehende Anstaltssystem implementiert werden? Die Geburt des Gefängnisses war ein langwieriger Erfindungsprozeß, der sich über drei Generationen hinzog. Thomas Nutz zeichnet nach, wie sich im ausgehenden 18. Jahrhundert ein spezifischer Diskurs über die Reform der Haftanstalten formierte und ein internationales Fachwissen herausbildete. Eine Entwicklung, die schließlich Mitte des 19. Jahrhunderts in der Entstehung einer eigenständigen Disziplin der "Gefängniskunde" mündete. Am Beispiel Preußens demonstriert der Autor, wie eng die staatlichen Bürokratien bei der Durchführung der Reformen des Vollzugswesens mit den gefängniskundlichen Experten zusammenarbeiteten.

    Abstract: Privatisierung ist ein Zeichen tiefreichender Wandlungsprozesse im Verhältnis von Staat und Gesellschaft sowie in den Bereichen des öffentlichen und des Privatrechts. Verbreitet ist die Hoffnung, der unter seinen Kompetenz- und Finanzlasten schwerfällig gewordene Staatskoloß könne wieder 'schlank' werden, wenn er sich zugunsten gesellschaftlicher Kräfte aus Tätigkeitsbereichen zurückziehe. Wichtige Privatisierungsimpulse gehen nach wie vor von den Wettbewerbsbestimmungen des Europäischen Gemeinschaftsrechts aus. Auf kommunaler Ebene ist die 'Organisationsprivatisierung' verbreitet. Mit der Novellierung der Kommunalverfassungen versuchen die Landesgesetzgeber, dem Trend zur kommunalen Eigengesellschaft Einhalt zu gebieten, verletzen jedoch mitunter die Vorgaben des Gesellschaftsrechts. Jörn Axel Kämmerer weist nach, daß sich der Staat im Zuge des Privatisierungsprozesses keineswegs ganz zurückzieht. Vielmehr nimmt der Staat seine grundlegenden verfassungsrechtlichen Aufgaben auch in der 'Privatisierungsfolgenphase' weiterhin wahr – wenn auch nicht mehr durch eigene Leistungen, sondern als Garant und Regulator. Dabei wächst der Spielraum für 'private Grundrechtseingriffe', und die Grundrechte selbst wandeln sich zu Schutzpflichten. Zugleich bringt 'Organisationsprivatisierung', die Begründung privatrechtlich organisierter Wirtschaftsunternehmen der öffentlichen Hand ohne öffentlich-rechtliche Befugnisse, die Grenzen zwischen Staat und Gesellschaft zum Verschwimmen. Letztlich hat der Staat eine Gratwanderung vor sich, bei der er weiterhin als ausgleichende Instanz für eine komplexe, zur Selbstregulierung unfähige, aber in den transnationalen Bereich ausgreifende Gesellschaft agieren können muß, ohne in ihr aufzugehen.

    Abstract: There is widespread concern that the growth of the Internet is exacerbating inequalities between the information rich and poor. Digital Divide examines access and use of the Internet in 179 nations world-wide. A global divide is evident between industrialized and developing societies. A social divide is apparent between rich and poor within each nation. Within the online community, evidence for a democratic divide is emerging between those who do and do not use Internet resources to engage and participate in public life. Part I outlines the theoretical debate between cyber-optimists who see the Internet as the great leveler. Part II examines the virtual political system and the way that representative institutions have responded to new opportunities on the Internet. Part III analyzes how the public has responded to these opportunities in Europe and the United States and develops the civic engagement model to explain patterns of participation via the Internet.

    Abstract: Das Konzept einer redistributiven Sozialpolitik scheint schon seit längerem in Deutschland an seine Grenzen gestoßen zu sein: Die durchgehend mit einer erheblichen Umverteilungskomponente versehenen sozialen Sicherungssysteme haben einerseits zu unerträglichen Belastungen insbesondere der laufenden Arbeitseinkommen geführt, ohne jedoch andererseits den Wunsch nach sozialer Gerechtigkeit nachhaltig erfüllen zu können. Ironischerweise scheint es sogar so zu sein, daß die Unzufriedenheit mit dem Sozialstaat aus einer wie auch immer definierten "Gerechtigkeitsperspektive" mit dem Ausmaß der Umverteilung wächst. Dieses ernüchternde Ergebnis hat in der Vergangenheit immer wieder zu wirtschaftswissenschaftlichen und -politischen Diskussionen darüber geführt, ob die traditionelle Umverteilungspolitik mit laufenden Einkommen als Zielgröße und Aktionsparameter redistributiver Maßnahmen nicht schon vom Ansatz her verfehlt ist. --
    Abstract: In diese Diskussion reiht sich die Dissertation von Thomas Wilke ein. Der Autor geht von der in einem theoretischen Teil abgeleiteten Hypothese aus, daß nicht das Arbeitseinkommen als Ergebnis der individuellen Leistungsfähigkeit und Leistungswilligkeit Gegenstand der Umverteilung sein darf, sondern vielmehr die individuellen Einkommenserzielungschancen, die durch das beim einzelnen gebildete Humankapital und gegebenenfalls geerbte oder geschenkte Vermögen maßgeblich beeinflußt werden. Chancengleichheit und nicht Egalität von Arbeitseinkommen ist folglich das durch eine Redistributionspolitik zu verfolgende Ziel. Damit aber rücken intergenerative Transfers und ihre umverteilende Besteuerung als Alternative zur Einkommensumverteilung in den Blickpunkt. --
    Abstract: Thomas Wilke beschäftigt sich intensiv mit einer theoretischen Diskussion unterschiedlicher Motive bezüglich intergenerativer Transfers. Durch eine sich auf Daten des Sozio-ökonomischen Panels und des Europäischen Haushaltspanels stützende empirische Untersuchung wird daran anschließend der Frage nachgegangen, ob und inwieweit man mit einer Erbschaft- und Schenkungsteuer die vom Staat wahrzunehmende Umverteilungsfunktion effizienter und gerechter ausfüllen kann. Der Autor kommt zu dem Ergebnis, daß dies nur dann gelingt, wenn ausschließlich Erbschaften, nicht aber Schenkungen zwischen Generationen besteuert werden

Birgit Eckardt untersucht, ob und unter welchen Bedingungen Fachsprache zur Kommunikationsbarriere zwischen Fachleuten und Laien werden kann. Auf der Grundlage eines vierstufigen Kommunikationsmodells und unter Berücksichtigung von sprach- und rechtswissenschaftlichen sowie psychologischen und soziologischen Aspekten analysiert die Autorin die Fachsprache des Rechts am Beispiel des Ehescheidungsrechts. Die gewonnenen Ergebnisse lassen erkennen, auf welchen Kommunikationsebenen Verständigungsschwierigkeiten auftreten und welche Strategien zu ihrer Vermeidung oder ihrem Abbau geeignet sind

    Abstract: Against the backdrop of South Africa's transition from apartheid, this provocative book explores the role of late twentieth century constitutionalism in facilitating political change. Using South Africa as a case study, Klug's larger project is to investigate why there has been renewed faith in justiciable constitutions and democratic constitutionalism despite the widespread recognition that courts are institutionally weak, lack adequate resources and are largely inaccessible to most citizens. He places this question in a broader context, evaluating the appeal of different constitutional models and illustrating how globalized institutions can be adapted to serve local domestic needs. Incorporating constitutional law, politics and legal history, this examination of South Africa's constitution-making process provides important insights into the role of law in the transition to democracy

    Abstract: Voluntary approaches are schemes whereby firms make commitments to improve their environmental performance.They cover arrangements such as public voluntary programmes, negotiated agreements or unilateral commitments. Until recently, voluntary approaches have not been subject to systematic analysis, inasmuch as, unlike taxes and tradable permits, they have not been prescribed by economic theory. Voluntary approaches were "invented" by those who devise and implement them: policy-makers, business associations, individual firms, non-governmental associations, etc. The use of voluntary approaches in environmental policy (e.g.negotiated agreements between Government and industry) is spreading and attracting growing interest in OECD countries. This book provides a systematic analysis of the different types of voluntary approaches, their economic characteristics, their role and effectiveness.

    Abstract: In this book, Thomas Buoye examines the impact of large-scale economic change on social conflict in eighteenth-century China. He draws upon a large body of actual, documented homicide cases originating in property disputes to recreate the social tensions of rural China during the Qianlong reign (1736–1795). The development of property rights, a process that had begun in the Ming dynasty, was accompanied by other changes that fostered disruption and conflict, including an explosion in the population growth and the increasing strain on land and resources, and increasing commercialization in agriculture. Buoye challenges the 'markets' and 'moral economy' theories of economic behaviour. Applying the theories of Douglass North for the first time to this subject, he uses an institutional framework to explain seemingly irrational economic choices. Buoye examines demographic and technological factors, ideology, and political and economic institutions in rural China to understand the link between economic and social change.

    Abstract: In der andauernden Auseinandersetzung um die Bedingungen des Ausstiegs aus der Nutzung der Kernenergie zur Stromerzeugung sind auch die verfassungsrechtlichen und europarechtlichen Rahmendaten umstritten. Auf Seiten der Kernkraftwerks-Betreiber wird die geplante Stillegung der Anlagen als eine grundsätzlich entschädigungspflichtige Enteignung angesehen. Demgegenüber kommt Erhard Denninger in seiner Studie zu dem Ergebnis, daß ein »Ausstiegsgesetz«, das die gewerbliche Nutzung der Atomenergie für die Zukunft überhaupt untersagt, eine verfassungsrechtlich zulässige Inhalts- und Schrankenbestimmung des Eigentums darstellt. Allerdings muß das schutzwürdige Vertrauen der bisherigen Kraftwerksbetreiber nach dem Grundsatz der Verhältnismäßigkeit berücksichtigt werden. Dies kann durch entsprechende Gestaltung der »Restlaufzeiten« geschehen. Die Arbeit beruht auf einem Rechtsgutachten für das Bundesumweltministerium. Der Verfasser ist mehrfach mit Arbeiten zu Verfassungsrechtsfragen im Technikrecht hervorgetreten
