    Abstract: THE studies here presented are the outgrowth of a paper read before the Government Club of Harvard University in February, 1911. Some of them have within recent months appeared, in substantially their present form, in certain of the academic and legal journals. In the preparation of the statistical material the author has made no use of the current digests of deci­ sions, annotations to the Constitution, nor of the indices to the Supreme Court Reports, except by way of com­ parison of results. He has gone directly to the body of the Reports and given each case a personal examination. Much repetition will be found throughout the work. This may detract from its logical unity, but it is hoped that it may serve some purpose. The true nature of the Fourteenth Amendment to the Constitution of the United States is little known. The processes of its operation are intricate and complex. This reiteration, therefore, of certain salient features may not be amiss in serving to render more familiar a subject that, al­ though not new historically, has been scantily discussed.     Abstract: As the world's population increases, where will it live? Surely many will end up in cities for a recent United Nations' report anticipates that the globe's urban people will increase from 1. 33 billion in 1970 to 3. 09 billion in the year 2000. In the same period, however, the expectation is that rural population will increase from 2. 25 billion to 3. 02 billion. Of course the latter will be unevenly distributed; 91 per cent are likely to be in the less developed regions of the world while the rural folks of the more developed areas are expected to decline from 335 million to 255 million by 2000 A. D. No matter where, the major part of the increasing rural population probably will go to areas already thinly to densely settled. But not all. Even in parts of the more developed nations and for sure in many of the less developed countries one may expect significant numbers of people to move to what is now uninhabited land. Why? Because this is the nature of people and of nations. Research on the subject discloses that new rural settling is not a limited action that is restricted are ally or in time. Rather it is a natural and continuing process that evidences variety in a nation's desires; these may be expressed directly or indirectly by national governments through sponsored action or simply by permissiveness.

    Abstract: INTERNATIONAL STATUS Albania is a member of the United Nations (December 14, 1955). It is a member of other international organizations. It was a member of the League of Nations. Albania became independent on November 28, 1912, after centuries of Ottoman domination. Its existence was recognized internationally after the First Balkan War on July 28, 1913, and an international control commission drew up a constitution in 1914, providing for a monarchy with a National Assembly most of whose members were elected by the people. 4 Albania Although a neutral state, Albania became involved in the First World War, after which, in January 1920, the Albanian chiefs drew up a new constitution providing for a monarchy. In 1925, Albania was proclaimed a republic and a new constitution, based on the United States constitution, was promulgated. In 1928, the President became King and a new consti­ tution followed. On April 7, 1939, Italy occupied Albania and imposed a constitution providing that Albania was a monarchy under the House of Savoy. On April6, 1941, martial law was proclaimed throughout the country. After the Italian capitulation in 1943, Albania was occupied by Germany. The Albanian Communist Party was founded in November 1941, and the bases of the communist regime were laid at the second national confer­ ence in July 1943 of the Movement for National Liberation, created by the Party to unite and control all the forces opposing foreign occupation.     Abstract: The Treaty of Rome makes no mention of the Mediterranean basin as such, inc1udes not a single provision for the defining of specific relations with that region as a whole. There are only, as a hang-over from the French and Italian colonialist past, certain Dec1arations, in the Appendices, regard­ ing a possible association of Tunis, Morocco, Libya with the new under­ taking. And, of course, there is Artic1e 113 prescribing, at the end of the Community's transition period, the common trade policy - plus the Artic1e (238) giving blanket authorisation for association agreements. These legal prescriptions were duly implemented in the Association Agreements with Greece (1961) and Turkey (1963) and have supplied the basis for bilateral instruments in respect of other Mediterranean lands - ad hoc, pragmatic ar­ rangements. In the circumstances the Community could scarcely have proceeded otherwise. Yet the outlines of a European economic policy with regard to the countries of the Mediterranean basin were there from the beginning -limited, however, over the years by the internal development of the Community itself. One is reminded in this connection of sundry invoca­ tions by European and Mediterranean personalities and members of the European Commission - and, specifically, of a Memorandum presented by Italy to the Council of Ministers in 1964.

    Abstract: As an emerging Continent, with a rich past, dynamic present and promising future, Africa has an important role to play in the develop­ ment of international organization. Well before Africa Year, 1960, when several African States attained their independence and their rightful place in the community of nations, the various movements for unity and co-operation strove towards the creation of regional international organization. Now more than ever before, nearly two scores of African States, members of the United Nations, the Organization of African Unity and several other sub-regional organizations and arrangements, look upon international organization as an important means for safeguard­ ing their independence, enhancing African identity, forging collabor­ ative bonds amongst themselves and with the outside world, and rais­ ing the standard of living for their populations. It should also be noted that the age of science and technology which is, and should be, based on international co-operation, stimulates fur­ ther Africa's desire to strengthen and work through international inter­ governmental organizations.     Abstract: In October I873, as every Conference Report recalls, the Associ­ ation for the Reform and Codification of the Law of Nations was founded in Brussels (Belgium). At the Brussels Conference of I895 the Association's name was changed and ever since it has been "The International Law Association". On August 30 and 3I and September I, I973, a Centenary Cele­ bration will be held in the Association's place of birth. In the course of preparations made for this triduum, plans were also laid by the Executive Council for a Centenary Volume to mark the event. The formula adopted for the book was mostly based on contributions by Chairmen and/or Rapporteurs of International Committees of the Association who were asked to shed light on "the present state" of their subject. Hence the title of the Volume. For good measure, vari­ ous other topics not coming under the terms of reference of Inter­ national Committees were added. Almost all of the authors invited responded favourably, and their studies are to be found in Part II, arranged in sections which have no other justification than the Editor's whim. It should be pointed out that Chairmen and/or Rapporteurs of International Committees wrote their articles a titre personnel and, therefore, cannot be deemed to express opinions held by their Com­ mittees as such. Part I contains the "other essays", dealing with the Association itself rather than with the present state of international law.

    Abstract: XIV Seen as a whole, however, I regard the work before us to be especially noteworthy precisely because of its illumination of both the social contexts surrounding the law and the ideas which underlie the efforts towards criminal law reform. An analysis of this kind has not appeared until now, to my knowledge, even in the German literature on the subject, so that this book is of great value to ·the German reader as well as the American. B. Particulars In Chapter IV: A the authors give a general introduction into the development of the German criminal law reform. In that connection they recognize the special role of the Christian Democratic (CDU), Socialist (SPD) coalition in the political situation [leading to passage of the reform law]. The authors emphasize the importance of the introduction of a uniform prison sentence [that is to say ·the termination of the distinction between kinds of prison sentences] and the elimination of short term prison sentences, as the main points of the reform in the "general part" of the code. They remark (pages 170; 192) that a uniform concept of the goal of punishment is still lacking, although, when all is said, there is a general agreement on the principle of resocialization.

    Abstract: The European Communities are only two decades old. The most important of the three Communities, the European Economic Community (EEC), is even younger, having come into existence in 1958. 1 Two decades have been hardly enough time to have more than reached, much less settled, the impor­ tant questions of the relationship between Community law and institutions and those of the Member States. Among the most challenging of the questions is the extent to which the courts of the Member States will fulfill the obligation of safeguarding the rights created by the Treaty of Rome in favor of private persons, both indivi­ dual and corporate, an obligation which the Court of Justice of the European Communities has said rests upon the national courts. This obligation flows naturally, though not necessarily, from the commitment of the Court of Justice to an effective Community. However, the result depends on that commitment, and there is a natural concern that the national courts may not share the commitment to an effective Community to a degree necessary to fulfill their obligations under Community law as those obligations have been defined by the Court of Justice. In order to fu1fi11 their obligations to Community law the courts of the Member States will have to solve some serious problems, and do it with comparatively little help from the Court of Justice.

    Abstract: The recent series of diplomatic kidnappings has produced some serious thinking not only in Washington but in most of the foreign offices and embassies throughout the diplomatic world. The kidnappings-and how to deal with them-have been the subject of Congressional committee hearings, State Department deliberations, and international debate and action by the Organization of American States. It is the purpose of this study to analyze them within the context of urban guerilla terrorism, international legal norms, and world diplomatic practice. Selected examples of diplomatic kidnappings, particularly those in Latin America and Canada, strikingly illustrate the new revolutionary strategy of utilizing terrorism as a political tactic to achieve long-range political· goals. As with its kindred phenomenon-the airplane hijack­ ings-the kidnappings of foreign diplomats seize upon and exploit innocent victims as hostage pawns; a bargaining situation is thus created in which the revolutionary minority can achieve a diplomatic leverage which is far greater than in proportion to its numbers, military strength, or popular appeal. Through terrorism the urban guerillas hope to achieve tactical advances within the general strategy of political revolu­ tion; even temporary governmental repression if it occurs in reprisal becomes part of that strategy. Chapter I in particular and the entire manuscript in general examine the kidnappings within the parameters of revolutionary terrorism. The kidnappings have also had serious legal and political ramifications in the realm of world diplomacy.

    Abstract: by D.H.N. Johnson* Over the last decade few matters having some connexion with international law have aroused public interest to the same extent as "hijacking", "aerial piracy", "unlawful seizure of aircraft", "unlawful interference with aircraft"--call it what you will. Unfortunately, few matters have also contributed to the same extent to create in the public mind a sense of disillusion with international law arising from its apparent inability to suppress an unprecedented menace to freedom of communication. In 1944 the governments that concluded the Chicago Convention on International Civil Aviation referred in their preamble of that instrument to their "having agreed on certain principles and arrangements in order that international civil aviation may be developed in a safe and orderly manner". What is now at issue is the extent to which this important obligation has been carried out. Few people are more qualified to examine this question than the author of this work. A lecturer in international law at the University of Baghdad, with a background of postgraduate studies in London and in Cambridge, also having some experience as an international civil servant, Dr. Sami Shubber is well aware of the political, practical and legal obstacles that have prevented the international community from living up to the pledges given in 1944. Even the plethora of terms, cited above, used to describe the menace is itself an indication of the strength of these obstacles.

    Abstract: The system of the pacific settlement of disputes contained in the United Nations Charter - confirmed in 1970 in the Declaration on Principles of International Law concerning Friendly Relations and Co-operation among States - is based on agreement between the parties on both the method to be applied and the acceptance of its results. From the juridical point of view states are free in this system to establish in advance their choice of the appli­ cation of one or more methods to a dispute and their willingness to accept the result in respect of all or certain groups of disputes or only to determine their choice when a dispute arises. The functioning of the International Court must be regarded in this light. The practice of pacific settlement shows that there is not too great a distance between the standpoints of the Soviet countries, who emphasise direct negotiation as the starting point in settling disputes, and that of the Western countries, who lay particular stress on judicial settlement as such, because the Western countries usually make the application of arbitration and judicial settlement to a specific dispute dependent on the cooperation of all parties, in obtaining which negotiations are essential.

The present bibliography is based on notes gathered by the compiler over a period of years from material available at the University of Michigan Law Library. It is therefore, inevitably, incom­ plete and occasionally inaccurate and must be considered as a tentative list, subject to implementation and correction at other legal centers. It was felt, however, that its publication might be of some use, since not enough bibliographical information about this important and steadily growing type of legal literature exists

    Abstract: In 1967 S. Dedijer and L. Svennigson published their famous bibliography Brain Drain and Brain Gain, (Lund, 1968, index of authors, countries and regions). It contained 415 items from 40 countries and appeared at a time when the debate about the ad­ vantages and disadvantages of the brain drain was at its most intense. But the brain drain is still not a thing of the past - certain­ ly not for Europe. The European countries and those of the rest of the world are in different stages of transition. Industrialization has generally been associated, on the one hand with ever more rapid forms of trans­ portation and other forms of communication, a long-range rise in the per capita income, the exodus from the countryside to the cities and an enormous urbanization process, and the demand for improved social and economic security, on the other. But these characteristics tend to be more relative than absolute. It is not possible to make a distinct division between developed nations, and countries in various stages of development. All countries are constantly undergoing change and are in transition with respect to development. The constant migration of skilled workers and es­ pecially the search for better training and working conditions on the part of academically trained people is inseparable from this process of transition - i. e. from the phenomenon of long-range. permanent change. Fortunately this is not as deplorable as some observers would make it appear to be.

    Abstract: This monograph is primarily addressed to the problem of avoidance, noncompliance or defiance of obligations related to international organiza­ tions by members and nonmembers. Structurally, it is a survey of the practices of uncooperative members and nonmembers set against a general statement of the norms of international organizations. Minor disruptions in international affairs evoke conflicts of inter­ national obligations and state interests. Today, when the problems are grave and the prospects for peace are gloomy, there is an urgent need for scholars and practitioners of international relations to study and reflect upon the implications of prolonged disregard of international obligations during a time in which international organizations are increas­ ing in numbers and in functions. To provide a systematic framework for this effort is a main purpose of this work. Although the whole range of international organizations provide illus­ trations of these conflicts, practices within the United Nations system have been the focus of the study. There is no pretense of having made a comprehensive study of every international organization nor is there any claim that the coverage of cases having pertinence to the subject matter goes beyond the minimum required to illustrate these problems. From the many cases available, only those which promised to have most relevance or to provide the best understanding of the conflicts of inter­ national obligations and state interests were included.

    Abstract: prospects of the High Commissioner proposal with careful scholarship and shrewd judgment. Mr. Clark wrote the first draft of this book under my supervision for the degree of Doctor of the Science of Law at Columbia Law School before returning to take up his career as a law teacher in his native New Zealand. I am delighted that his work, in this improved and updated version, is now being published. It fills a real need, since it is the first book on this important subject. On this occasion it might be appropriate to add a few comments on the history of the High Commissioner proposal. As Mr. Clark indicates, I had something to do with its "revival" in the United States Government during the closing months of the Kennedy Administration. A few details as to how this "revival" took place may perhaps be useful to students of international relations and international organization.

    Abstract: This Volume contains the Report of the European Commission of Human Rights on the "Greek Case" (Applications No. 3321/67, Den­ mark v. Greece; No. 3322/67, Norway v. Greece; No. 3323/67, Sweden v. Greece; No. 3344/67, Netherlands v. Greece) and the Resolution DH (70) 1 adopted by the Committee of Ministers of the Council of Europe on 15 April 1970 relating to this case. These four applications, which were filed with the Commission of Human Rights in September 1967, alleged that the Greek Government which had come into power in April of that year had violated its obliga­ tions under the European Convention on Human Rights. They referred to the suspension of certain articles of the Greek Constitution and other legislative measures and administrative practices; they alleged that, re­ gardless of any individual or specific injury, these acts affected the cor­ responding Articles of the Convention on Human Rights. The Applicant Governments also submitted that the derogation made by the Greek Government under Article 15 of the Convention (which permits a government to take measures derogating from its obligations under the Convention in time of war or public emergency) was not justified. The Commission on 2 October 1967, decided to give priority to these cases and, after hearing the submissions of the parties on 23 and 24 January 1968, it declared the applications admissible on 24 January 1968. The decision on admissibility was published in this Yearbook Vol. 11, pages 690 to 728.

    Abstract: The present generation lives in a time of transition. The isolated national legal order, the supreme idea of 19th Century legal science, begins to be superseded by the evolution of a wider international and transnational net­ work of legal rules and conceptions. With the recognition of a fundamental guarantee of human rights as a binding ingredient of the framework of inter­ national law, the strict separation of the internal system of the states from the international community is transcended. To this extent, the rules of international law now exercise a direct influence upon the national legal order. In some conventional arrangements safeguarding human rights, the individual is given direct access to international protection against his own state. The piercing of national borders by transnational norms finds its strongest expression in the formation of regional communities of states which seek to develop a common fund of legal rules, concepts and principles among their members. The leading role in this direction lies with European organizations. In the Community formed by the signatories of the European Convention on Human Rights, the members accept for themselves a stan­ dard of legal guarantees for fundamental rights of the individual laid down in the Convention. The organs of the Convention, including the Court and foremost the Commission, fulfill their tasks by measuring the national laws of the member states against the basic requirements embodied in the Euro­ pean Convention.

    Abstract: In the year 1867 the United States purchased Alaska from Russia for the sum of 7,200,000 dollars. At the time the Americans did not under­ stand why money was being spent on buying a desert. A hundred years later one of the largest oilfields in the world was discovered there at Prudhoe Bay. There seems little doubt that large mineral resources will be found and exploited in the Canadian Arctic. In Greenland min­ ing is now being planned on a large scale, under conditions comparable to those of the Antarctic. No economically exploitable deposits of minerals have been found in Antarctica, but there is no doubt that large deposits exist. Whether the progress of technology will enable such deposits to be located and economically mined is not clear. Experts confidently state that at present this is not feasible. Forty years ago an expert asserted that during our geological period there would be no transit of the Northwest Passage by ship. The voyage was accomplished in 1969 by a large commercial tanker. Economic resources, and nothing else should be the reason for New Zealand activities in the Ross Dependency. Other reasons have been advanced. One is scientific research. Yet this could be done far more cheaply by supplying funds to existing research projects in New Antarctic budget is spent on logistics and Zealand for much of our support rather than research itself. Just keeping alive in Antarctica is an expensive business.

    Abstract: Volume I3 of the Yearbook of the European Convention on Human Rights relates to the year I970 and reflects a return to the usual pattern of activity under the Convention during that year, after the exceptional situation produced in I969 by the "Greek Case". This volume is published somewhat later than usual, because an extra volume in this series has been published between volumes I2 and I3 containing the Report of the European Com­ mission of Human Rights and the Resolution of the Committee of Ministers of the Council of Europe relating to the "Greek Case". Part I of this Volume contains, as usual, the basic texts, chief among which are the amendments now made to the Convention following the entry into force on 2I September I970 of the Third Protocol, which relates to the procedure of the Commission. On the same date, the Second Protocol also entered into force, conferring on the Court of Human Rights competence to give advisory opinions. The text of this Protocol is to be found in Volume 6 at pages 3ff. The amendments and additions to the Rules of Court consequent upon the entry into force of the Second Protocol are set out in Part I of this Volume.

    Abstract: Since World War I scholars and practitioners alike have addressed themselves to defining and assessing the "new diplomacy," which the British diplomatist Harold Nicolson has branded the "American method." He distinguishes contemporary practice from earlier forms of diplomacy which, in The Evolution of Diplomatic Method (1954), on the basis of historical orientation, he designates the Greek, Roman, Italian, and French "systems" of diplo­ macy, in this order. Intensified multilaterial, as differentiated from bilateral, diplomacy - or what Lord Maurice Hankey treats as Diplomacy by Con­ ference (1946) - has become one of the principal qualities characterizing twentieth century diplomatic usage. "Conference diplomacy," in turn, consists of both ad hoc and regularized components. The latter, sometimes designated "parliamentary diplomacy," is essentially a form of institutionalized conferencing permeating the func­ tioning of permanent mechanisms called international organizations. Within them member states pursue national and collective interests and espouse national policies, confer and negotiate respecting mutual problems, engage in forensic and often public exposition, and reduce decision making, but usually only ostensibly, to a formalized voting process.

    Abstract: THE INTERNATIONAL PATENT-LEGISLATION AND DEVELOPING COUNTRIES A major concern today in many fields of international cooperation is the development of the nonindustrialized part of the world. This was not always so. Until fairly recently contacts among States were basi­ cally limited to diplomatic intercourse. The concept of State sovereign­ ty naturally led to the application of the principle of legal reciprocity between States. In the few areas outside diplomatic relations where international cooperation developed during the last century the same principle of legal reciprocity was applied. The cooperation that did take place was mostly among a limited number of Western States. In case countries outside this group wished to participate they were free to do so on accepting the traditional standards for such cooperation. Though a few countries, which today would have been or are known as develop­ ing countries, did join in various schemes of international cooperation, the majority of them remained outside. Moreover, a large number of States, which today are known as developing, did not exist as sovereign States at the time. One of the areas in which a system of international cooperation was set up in the latter part of the nineteenth century was that of patent protection.

    Abstract: When the United Nations' Charter was signed in San Francisco in 1945, the number of African member states of the Organisation was only 4. By the end of 1960 it had risen to 22. Today it is 41. How has this come about? The answer is given in this valuable book by Dr. Yassin EI-Ayouty. The handful of Asian and African countries who had the privilege of foundation membership made it their business to see to it that their brethren who were still under the colonial yoke attained their freedom and independence as soon as possible and, in the meanwhile, that they were treated with decency and fairness by their colonial masters. It was a tough assignment. The struggle was long, requiring a great deal of patience and endurance. It was at times fierce, requiring much dogged resolution. It also called for the deployment of intellectual agility ofthe highest order. Fortunately all these qualities were available in the rep­ resentatives of Asia and Africa who led the great struggle. These dis­ tinguished delegates also demonstrated a wonderful degree of solidarity which has, happily, become an Afro-Asian tradition at the United Nations. The battle began even before the Organisation had itself become a fact. It would have been a more difficult struggle, had there been no provision in the Charter at all in respect of colonies, by whatever name called.

    Abstract: to Seeking the answer to the three basic questions of contempo­ rary private international law, I also deemed it essential to out­ line to the reader the historical development of the different concepts of this particular branch of law, for without the know­ ledge of this history it is impossible to understand the contempo­ rary problems. The fact that private international law oscillates between public international law and substantive municipal law as it is applied in individual countries creates considerable problems in both theory and practice. I have tried to deal with these problems in the third part of my study, concerning "universa­ lism" and "nationalism" in the doctrine of private international law, as well as in its fourth part, which is devoted to the object and nature of this law and its place in the overall system of law. The character of private international law, ensuing from the plurality of municipal laws - which also characterize the origin and existence of comparative jurisprudence - in­ spired me to produce the fifth part of this study, which prima­ rily tries to expJain the theoretical problems of comparative jurisprudence but does so - defining its objectives and possibili­ ties - in order to underline at the same time its role in private international law and in the law of international trade.

    Abstract: Dr. Csabafi in his clearly and concisely written book sets out to confront the most pressing jurisdictional problems arising from the exploration and use of outer space, problems which the authors of the Outer Space Treaty of 27th January, 1967, have not attempted to solve. He has recognized that in view of the lack of sufficient knowledge of tech­ nological capabilities present and anticipated of the utilization of outer space and its political, economic and social implications, the time is not yet ripe for the elaboration of specific rules to govern most of the highly com­ plex issues in this context. Apart from the lack of sufficient knowledge and experience, the achieve­ ment of a consensus on rules regarding jurisdiction in outer space is further hampered by the strongly divergent interpretations of the fundamental prin­ ciples of the Outer Space Treaty namely the principle of freedom of outer space for exploration and use and the principle of non-appropriation of outer space. In various parts of his study Dr. Csabafi has, on the basis of a thorough study of the preparatory work of the Outer Space Treaty, ex­ pressed his views on the meaning of these principles.

    Abstract: This study is based on original Russian sources, due atten­ tion being paid to some authoritative views advanced by foreign lawyers. Leaving aside the essentials of the work in the hope that they will speak for themselves; I should like to make some prelim­ inary remarks regarding the linguistic and other formal aspects. First of all it should be noted that many of the Soviet laws have already been translated into English either in the USSR itself or in Western countries. This fact is fully reflected in the bibliographical survey at the end of this study. Some laws have been translated both in the Soviet Union and abroad, as for instance the Fundamentals of Soviet Civil Legislation. In such a case I have used the translation made in the USSR even though linguistically it may be inferior to the translation made in the West. The author has translated only those legal provi­ sions of which no English translation was available. For transliteration, I have used the system of the Library of Congress of the USA without its diacritical marks. Further, a word should be said about the references in the notes. They are very brief and consist of the surnames of the authors concerned and if necessary an additional element, e. g.

    Abstract: General While there is an abundance of literature dealing with the American antitrust laws, one can also observe that the application of this area of the law to foreign commerce is still in an evolutionary stage of development. To some extent this can be quantiflably explained by pointing out that the rapid rise of the interests of the American business community in foreign commerce is only a fairly recent 1 phenomenon. This participatory interest reveals a wide spectrum of commercial activities. While the traditional concept of foreign commerce was often limited to thinking in terms of exports and imports, present commercial activities include also such marketing methods as the establishment of foreign branches or subsidiaries, or 2 the location of manufacturing, processing, or assembly plants abroad. To this array of arrangements, most of which contemplate a widening of the market potential, we may add the current merger movement, the conglomerate charac­ ter of which has been termed its 'most unique characteristic,. 3 Little wonder that at least one author refers to the application of the 311titrust laws to foreign commerce as being still somewhat of a 'frontier area of the law'. 4 Because of the rapidly expanding participation of the American business community in interna­ tional commerce a gradual evolution of the international dimensions of the American antitrust laws seems therefore within the realm of justifIed expecta­ tions.

    Abstract: The classical concept ofInternationalLa w, as developed by Gentilis, Gro­ tius and their successors, accepted as its starting point the sovereignty of states, from which it followed that (r) the rules of International Law were based upon the general consent of those states; and (2) that, since state sovereignty was not capable of limitation, otherwise than by the consent of the state itself, in the last resort, International Law must accept the fact of war. Two world wars within the space of thirty years, and the development of nuclear weapons of unlimited potential, have compelled statesmen and lawyers to take a fresh look at the foundations of international relations. The First World War was followed by the creation of the League of Nations, and by the establish­ ment of the Permanent Court of International Justice. The failure of both, insofar as the preservation of peace was concerned, was apparent in the continuance of international insecurity, culminating in World War II. This again was followed by the establishment of a new inter­ national organisation, the United Nations, with its auxiliary, the International Court of Justice. Nevertheless, international security seems further away than ever, and it may be suggested that it is the devastating potential of nuclear weapons, rather than the strength of international machinery, which has so far prevented a third general conflict far more disastrous than either of the two World Wars which have already taken place.

    Abstract: Eighteen years after the United States presented its plan for the international control of atomic energy to the United Nations, the first major arms control agreement was signed between the United States and the Soviet Union. Including Great Britain, the three major nuclear powers pledged to refrain from nuclear tests in the atmosphere, outer space, and underwater in a treaty negotiated in Moscow within two weeks during the summer of 1963. It was hoped that the treaty would at least discourage those phases of the arms race which required large-yield nuclear explosions in the atmosphere or outer space as well as eliminate further radioactive pollution of the atmos­ phere. In addition, the test ban would discourage, though not eliminate, the development of nuclear weapons by other treaty adherents because the un­ derground testing allowed under the terms of the document would escalate already heavy costs for countries intending to conduct their first nuclear tests. The Kennedy administration expected other agreements to follow the test ban treaty, particularly an agreement to keep outer space free from 1 nuclear warheads and to outlaw underground tests in the near future. But one of the most important anticipated benefits of the treaty was the expected improvement of relations between the United States and the Soviet Union. The treaty was important not only because it was a tangible breakthrough in East-West arms-control negotiations but also because of its implications for domestic and international politics.
