    Abstract: Der demographische Wandel und die damit einhergehenden Finanzierungsschwierigkeiten der sozialen Sicherungssysteme haben in den letzten Jahren die Frage nach der Gerechtigkeit zwischen den Generationen in das Zentrum der öffentlichen Diskussion gerückt. Die ausgewogene finanzielle Belastung zwischen jetzt lebenden und künftigen Generationen wie auch die Sorge um die Zukunftschancen unserer Kinder sind dabei die zentralen Grundfragen der Debatte. So sieht sich auch die sozialwissenschaftliche Forschung vor die Herausforderung gestellt, klassische Konzepte intragenerationeller Gerechtigkeit daraufhin zu überprüfen, inwiefern sie Forderungen nach intergenerationeller Gerechtigkeit standhalten. Neben den empirischen und philosophischen Grundfragen analysieren die Beiträger dieses Bandes das Thema Generationengerechtigkeit aus einer ordnungsökonomischen Perspektive. Es geht zum einen um eine Begründung dafür, warum überhaupt heutige Gesellschaftsmitglieder die Interessen zukünftiger Generationen berücksichtigen sollen. Zum anderen werden solche gesellschaftlichen Regeln gesucht, die im besten Falle geeignet sind, die Interessen der kommenden Generationen langfristig zu sichern und dabei zugleich für die heute Lebenden akzeptabel sind. Eine tragfähige ordnungsökonomische Konzeption der Generationengerechtigkeit muss sich dann auch als Leitfaden für einzelne Felder der praktischen Politik bewähren.     Abstract: The introduction of the 'Common Consolidated Corporate Tax Base' as a means for an efficient and equitable taxation of multinational enterprises in Europe represents the most important issue of European business taxation.     Abstract: Tort law interacts strongly with public regulation. Is the breach of a statutory duty in itself a sufficient basis for liability? Does the fact that some acts are allowed by a permit issued by public agencies exempt them from liability altogether? These questions and similar problems on the borderline between tort and regulatory law serve as a basis for in-depth analyses by several scholars specialized in this field. This book thus systematically analyses the interaction of administrative law and tort law. The focus is mainly on safety regulations and provisions aimed at environmental protection. This publication contains reports from 9 countries of the European Union, from Norway, Switzerland and the USA, three special reports from the perspectives of administrative and regulatory law and of the insurance as well as an economic analysis. The results are summarised in a comparative report, followed by conclusions.

    Abstract: The book explores recent developments in the international and national prosecution of persons accused of committing war crimes and crimes against humanity. It considers the relationship between national and international law, science and practice, with emphasis on the emerging principle of universial jurisdiction and the effect of 'the war on terror' on legal norms.
    Abstract: The demand for accountability for human rights violations is heard throughout the world as never before. This volume explores current developments in the prosecution of human rights crimes on the national and international level. Experts from several countries discuss relevant topics from the academic debate, describe the practice in different countries, and analyze problems which have arisen in this new and exciting field of law. They strike a balance after the first years of the International Criminal Court and a growing universal jurisdiction practice and give the reader a present-day overview of attempts to bring to justice major figures like Augusto Pinochet and Donald Rumsfeld as well as lesser known ones. Emphasis is put on the emerging principle of universal jurisdiction and the effect of the `war on terror` on legal norms. While the latter threatens to weaken and, in some respect, destroy long standing principles of international law, the developing practice of universal jurisdiction offers new resources for dealing with international crimes. The book examines the tension between these two phenomena and its meaning for international criminal law and the implementation of human rights. The contributors include Kai Ambos, Jörg Arnold, Christopher Keith Hall, Scott Horton, Florian Jessberger, Lorna McGregor, Michael Ratner, Nigel S. Rodley and Naomi Roht-Arriaza.

    Abstract: An International Expert Workshop on the Right to Social Security was held in April 2005 at the German Institute for Human Rights, whose purpose was to highlight specific issues of the right to social security which should be addressed by the Committee when drafting a General Comment on article 9. The results of this workshop are published in this volume providing an insight into the current challenges on social security as a human right.
    Abstract: Article 9 of the International Covenant on Economic Social and Cultural Rights on the right to social security is the shortest article in the entire Covenant and for that reason alone highly abstract and vague. A comprehensive analysis of the article 9 is still lacking, not least because it is widely regarded as a Pandora's box better not to be opened. Experience has shown that the quality of the state reporting procedure is greatly improved once the Committee on Economic Social and Cultural Rights has adopted a General Comment. Thus, it seems very desirable to close this gap. For the reason, an International Expert Workshop on the Right to Social Security was held in April 2005 at the German Institute for Human Rights, whose purpose was to highlight specific issues of the right to social security which should be addressed by the Committee when drafting a General Comment on article 9. The results of this workshop are published in this volume providing an insight into the current challenges on social security as a human right.

    Abstract: Declining fish stocks and expanding fishing fleets have combined with growing competition from aquaculture to put increased pressure on the fishing sector to adjust the size and nature of its operations in many countries. In some fishing communities, almost sixty percent of jobs are linked to fishing and in many coastal areas there are few alternative employment opportunities for fishers. This conference proceedings analyses the social issues and policy challenges that arise from fisheries adjustment policies, and how OECD member countries are meeting those challenges.

    Abstract: Recent developments in the European integration process have raised, amongst many other things, the issue of linguistic diversity, for some a stumbling block to the creation of a European democratic polity and its legal and social institutions. The solution to the 'question of language', involves an understanding of the role played by natural languages and the consequent design of policies and institutional mechanisms to facilitate inter-linguistic and intercultural communication. This is not an exclusively European problem, and nor is it entirely new, for it is also the problem of linguistic majorities and minorities within unitary nation-states. However, the effects of globalization and the diffusion of multiculturalism within nation-states have given renewed emphasis to the question of language in diverse societies. Facing the question anew involves reconsidering traditional ideas about social communication and the public sphere, about opinion-formation and diffusion, about the protection of cultural and linguistic minorities, and about the role that language plays in the process of formation of political and legal cultures. This volume is intended as a multidisciplinary contribution towards studying and assessing the range of problems that form the 'language question' in Europe and diverse societies

    Abstract: These workshop proceedings assess the third party liability and compensation mechanisms that would be implemented by participating countries in the event of a nuclear accident taking place within or near their borders. To do so, two fictitious accident scenarios were developed: one involving a fire in a nuclear installation located in the Slovak Republic and resulting in the release of significant amounts of radioactive materials off-site, and the other a fire on board a ship transporting enriched uranium hexafluoride along the Danube River. The first scenario was designed to involve the greatest possible number of countries, with the second being restricted to countries with a geographical proximity to the Danube. These proceedings contain the papers presented at the workshop, as well as reports on the discussion sessions held.

    Abstract: Limiting Institutions examines the security threats in Eurasia and the role of institutions in the post-Cold War international environment. It looks at both the crucial aspect of foreign policy as well as a theoretical area of security studies and its impact in the former Soviet States including Russia, Belarus, Armenia, the Ukraine and Moldova. The first section addresses the important and varied range of security threats to this area of the world, and examines the range of responses open to European countries and to the United States. Threats such as ethnic conflict, transnational crime, and environmental and energy security issues are examined in depth. The second section addresses an important theoretical issue, namely the role that international institutions can perhaps play as arbiters of conflict and facilitators of cooperation in a region abutting the European political space. The role of the OSCE, NATO, the European Union, the Commonwealth of Independent States and the Black Sea Economic Cooperation Council are consequently examined closely. The contributors are scholars with solid international reputations, and the book will be of benefit to students of international relations and conflict analysis

    Abstract: "International business transactions are heavily influenced by culture,practice and rule. The pursuit of business relationships within nation-states can be subject to differences in the generation of norms and the processing of disputes, but these conflicts are magnified many times over in cross-border transactions where nation-state control and support is weak or absent. This book seeks different explanations of the ways in which business people and their legal advisers try to minimise the effect of these magnified difficulties. At the outset the editors suggest four sources through which the international business community might be considered to have supplemented nation-state conflict prevention and dispute resolution institutions - an international legal order; the development of a private normative order based on common business practices (denominated the lex mercatoria); through the efforts and work product of internationalised law firms, and by means of extensive, thick personal relationships often referred to by their Chinese term guanxi. Since most explanations are dominated by North American and European legal scholarship and practice, a second concern of this book is to open up the discussion to competing explanatory frameworks. Specifically, it develops the notion that global legal convergence may not be the immediate, inevitable result of increased global economic interaction. Rather, less formal mechanisms for achieving normative understanding and predictability in business dealings may also flourish."--Bloomsbury Publishing
