Abstract: This collection explores some of the many ways in which constitutional orders engage with, and are shaped by, their exteriors. Constitutional and legal theory often marginalize 'foreign' elements, such as norms originating in other legal systems, the movement of individuals across borders, or the application of domestic law to foreign affairs. In The Double-Facing Constitution, these instances of boundary crossing lie at the heart of an alternative understanding of constitutions as permeable membranes, through which norms can and sometimes must travel. Constitutional orders are facing both inwards and outwards - and the outside world influences their interiors just as much as their internal orders help shape their surroundings. Different essays discuss the theoretical and historical foundations of this view (grounded in Kelsen, Hobbes, Locke, Rousseau and others), and its contemporary relevance for areas as diverse as migration law, the conflict of laws, and foreign relations law.
Note: "Most of the essays in this collection are based on papers presented at a workshop held in June 2017 at the 'Wissenschaftskolleg zu Berlin'."

Abstract: "Why should we care about religious liberty? Leading commentators, United Kingdom courts, and the European Court of Human Rights have de-emphasised the special importance of religious liberty. They frequently contend it falls within a more general concern for personal autonomy. In this liberal egalitarian account, religious liberty claims are often rejected when faced with competing individual interests - the neutral secular state must protect us against the liberty-constraining acts of religions. Joel Harrison challenges this account. He argues that it is rooted in a theologically derived narrative of secularisation: rather than being neutral, it rests on a specific construction of 'secular' and 'religious' spheres. This challenge makes space for an alternative theological, political, and legal vision. Drawing from Christian thought, from St Augustine to John Milbank, Harrison develops a post-liberal focus on association. Religious liberty, he argues, facilitates creating communities seeking solidarity, fraternity, and charity - goals that are central to our common good"--

Abstract: "What is the purpose of comparative constitutional law? Comparing constitutions allows us to consider the similarities and differences in forms of government, and the normative philosophies behind constitutional choices. Constitutional comparisons offer "hermeneutic" help: they enable us to see "our" own constitution with different eyes and to locate its structural and normative choices by references to alternatives evident in other constitutional orders"--

Abstract: "The metaphor of 'dialogue' has been used to describe and evaluate institutional interactions and constitutional arrangements involving many of the most fundamental questions concerning democracy and rights. It has been put to a variety of descriptive and evaluative uses by constitutional and political theorists concerned with understanding interactions between democratic institutions, particularly interactions concerning rights. But it has also featured prominently in the opinions of courts, and even the rhetoric and deliberations of legislators. This volume brings together many of the world's leading constitutional and political theorists -both proponents and critics of dialogue theory. Together, they debate the nature and merits of constitutional dialogues between the judicial, legislative, and executive branches, explore dialogue's democratic and republican significance, examine its relevance to the functioning and design of different constitutional institutions, examine rights dialogues in specific constitutional contexts and cases of dialogue concerning certain rights, and explore constitutional dialogues from an international and transnational perspective".

Abstract: "In this work, Professors Rosenfeld and Mancini have brought together an impressive group of authors to provide a comprehensive analysis on the greater demand for religions exemptions to government mandates. Traditional religious conscientious objection cases, such as refusal to salute the flag or to serve in the military during war, had a diffused effect throughout society. In sharp contrast, these authors argue that today's most notorious objections impinge on the rights of others, targeting practices like abortion, LGTBQ adoption, and same-sex marriage. The dramatic expansion of conscientious objection claims have revolutionized the battle between religious traditionalists and secular civil libertarians, raising novel political, legal, constitutional and philosophical challenges. Highlighting the intersection between conscientious objections, religious liberty, and the equality of women and sexual minorities, this volume showcases this political debate and the principal jurisprudence from different parts of the world and emphasizes the little known international social movements that compete globally to alter the debate's terms"--
Abstract: "Rethinking the Balance between Religion, Identity, and Equality Introduction: The New Generation of Conscience Objections in Legal, Political and Cultural Context Susanna Mancini and Michel Rosenfeld I. The New Conscientious Objection versus the Old The new generation of conscience based objections differs sharply from its predecessors in that it involves claims that are interventionist and intrusive as opposed to claims aimed at withdrawal and absence from discrete areas of mainstream collective undertakings. Typical of the past, are conscientious objectors who sought to be excused from serving in the military or from going to war, or else from pledging allegiance to their country's flag in public gatherings. In contrast, today's most notorious conscientious objectors seek exemption from generally applicable laws requiring employers to provide contraception coverage in the medical insurance benefits they must extend to their women employees; or from providing services offered to the general public, such as cakes or flowers for wedding celebrations or hotel rooms with large beds, to individuals belonging to sexual minorities; or from issuing marriage or civil union licenses in their capacity as state employees to same-sex couples"--

Abstract: "Transitional justice is the dominant lens through which the world grapples with legacies of mass atrocity, and yet it has rarely reflected the diversity of peace and justice traditions around the world. Hewing to a largely Western and legalist script, truth commissions and war crimes tribunals have become the default means of "doing justice." Rethinking Transitional Justice for the Twenty-First Century puts the blind spots and assumptions of transitional justice under the microscope and asks whether the field might be re-imagined to better suit the diversity and realities of the twenty-first century. At the core of this reimagining is an examination of the broader field of post conflict peace building and associated critical theory, from which both caution and inspiration can be drawn. Abstract: This Companion provides a broad, historically informed introduction to the study of the US constitutional system. In place of the usual laundry lists of cases, doctrines, and theories, it presents a picture of the constitutional system in action, with separate sections devoted to constitutional principles, organizational structures, and the various legal and extra-legal 'actions' through which litigators and average citizens have attempted to bring about constitutional change. Finally, the volume covers a number of subjects that are rarely discussed in works aimed at a general audience, but which are critical to ensuring that constitutional rights are honored in the day-to-day lives of citizens. These include standing and causes of action, suits against officeholders, and the inner workings of the Foreign Intelligence Surveillance Court (FISC). This Companion places present-day constitutional controversies in historical context, and offers insights from a range of disciplines, including history, political science, and law.

Abstract: "As religious polarisation in society deepens, political actors and policy-makers have begun to struggle with questions on the role of the dominant religion and how religion influences constitutional commitments and development. By focusing on Indonesia, Malaysia and Sri Lanka, Constitutions, Religion and Politics in Asia demonstrates how constitution-making and the operation of constitutional arrangements involving religion cannot be separated from the broader political dynamics of society. Although constitutions establish legal and political structures of government institutions and provide tools for rights protection, they do not operate in a vacuum divorced from the games of power and the political realities surrounding them. Here, Shah sets out how constitutions operate and evolve and demonstrates how constitutional provisions can produce unintended consequences over time. Abstract: "Recent years have witnessed a multiplication of initiatives promoting constitutionalism and the rule of law. Both are understood, by many if not most, as necessary to create and sustain a just political order. If constitutionalism refers to a range of ideas and patterns of behaviour about how a government should be regulated in its powers in order to effectuate the fundamental principles of a political regime, it is usually a national constitution that shapes constitutionalism in concrete legal terms. A more abstract definition, which applies not only to nation states but also to a post-national order, identifies constitutionalism as 'an overarching legal framework that determines the relationships of the different levels of law and the distribution of powers among their institutions'"--
Abstract: "Rule of law and constitutionalist ideals are understood by many, if not most, as necessary to create a just political order. Defying the traditional division between normative and positive theoretical approaches, this book explores how political reality on the one hand, and constitutional ideals on the other, mutually inform and influence each other. Seventeen chapters from leading international scholars cover a diverse range of topics and case studies to test the hypothesis that the best normative theories, including those regarding the role of constitutions, constitutionalism and the rule of law, conceive of the ideal and the real as mutually regulating"--

Abstract: "European Constitutional Language If the task of constitutional theory is to set out a language in which the discourse of constitutional law may be grounded, a question of the utmost importance is how this terminology is created, defined and interpreted. In this ground-breaking new work, Andras Jakab maps out and analyses the grammar and vocabulary on which the core European traditions of constitutional theory are based. He suggests understanding key constitutional concepts as responses to historical and present day challenges experienced by European societies. Drawing together a great and diverse range of literature, much of which has never before been touched upon by scholarship in the English language, Jakab reconceptualises and argues for a new understanding of European constitutional law discourse. In so doing he shines new light on what constitutes its distinctively European nature. This remarkable book is essential reading for all scholars and students of constitutional theory in Europe and beyond"--

Abstract: From London to Libya, from Istanbul to Iceland, there is great interest among comparative constitutional scholars and practitioners about when a proposed constitution is likely to succeed. But what does it mean for a constitution to succeed? Are there universal criteria of success, which apply across the board? Or is the choice of criteria entirely idiosyncratic? This edited volume takes on the idea of constitutional success and shows the manifold ways in which it can be understood. It collects essays from philosophers, political scientists, political scientists, empiricists, and legal scholars, that approach the definition of constitutional success from many different angles. It also brings together case studies from Africa, Europe, Latin America, the Middle East, and Asia. By exploring a varied array of constitutional histories, this book shows how complex ideas of 'constitutional success' play out differently in different contexts and provides examples of how "success" can be differently defined under different circumstances.

Abstract: Das neue Buch des renommierten Linguisten Guy Deutscher ist eine sagenhafte Tour durch Länder, Zeiten und Sprachen.

Abstract: Reich illustrierte Informationen zu Land und Leuten, Kunst und Geschichte, Sehenswürdigkeiten, Orten und Landschaften. (Thomas Weidner)
Abstract: Eingeführte Reihe (vgl. von K. Ludwig "Das Baltikum", zuletzt BA 10/92, "Estland", BA 2/00 sowie "Lettland", BA 10/00).

Breite Empfehlung neben Reiseführern (vgl. zuletzt E. Engelbrecht: BA 1/96). (1) (Cornelia Pauß)
