    Abstract: Dieser Open Access Band bietet sowohl deutsch- als auch italienischsprachige Beiträge zu wesentlichen Bereichen des gewerblichen Rechtsschutzes und des Urheberrechts aus der Sicht des deutschen, italienischen und österreichischen Rechts sowie zum TRIPS-Abkommen samt einem Blick auf das vorläufig in Kraft getretene Handelsabkommen zwischen Kanada und der Europäischen Union (CETA). Ein Schwerpunkt ist Schadenersatzansprüchen aus der Verletzung von Immaterialgüterrechten gewidmet, wobei die bei grenzüberschreitenden Sachverhalten auftretenden Fragen der internationalen Gerichtszuständigkeit und des Kollisionsrechts speziell behandelt werden. Darüber hinaus werden Bezüge zum italienischen Verfassungsrecht sowie zum europäischen Wettbewerbsrecht hergestellt und auch wirtschaftsstrafrechtliche Aspekte angesprochen. Schließlich wird ein Ausblick auf die zukünftige Entwicklung des internationalen Immaterialgüterrechts in der Europäischen Union gegeben. Ausgangspunkt für das Buch bildete der vom Internationalen Forum für Wirtschaftsrecht getragene 1. Bozner Wirtschaftsrechtstag, bei dem besonderes Augenmerk auf die Berührung des deutschsprachigen Rechts- und Wirtschaftsraumes mit dem italienischen gelegt wird.

    Abstract: The volume Contro Bernardino. Processi al maestro Amedeo Landi is the result of the discovery of unpublished documentation on the trials - only partly known - against the abacus master Amedeo Landi, who taught the Milanese merchants at the Broletto. This is an exceptional case not only because only one witness to the activity of the Milanese inquisitorial court in the Middle Ages (whose documentation has been entirely lost) was known until now, but also because of the role of the ecclesiastical court and its officials. The wealth of information and themes has prompted a team effort by the professors of the Department of Historical Studies to clarify the many aspects (political, religious, economic, documentary) of an event that shows the vitality of 15th-century Milan, in which the protagonist, the teacher Amedeo Landi, in an attempt to protect his students, clashes with the most important preacher of his time, Brother Bernardino of Siena, whose canonisation process is temporarily blocked precisely to shed light on the Milanese episode
    Abstract: Il volume Contro Bernardino. Processi al maestro Amedeo Landi nasce dal ritrovamento di documentazione inedita riguardo ai processi – solo in parte noti – contro il maestro d’abaco Amedeo Landi che insegnava ai mercanti milanesi presso il Broletto. Si tratta di un caso eccezionale non solo perché finora si conosceva un solo testimone dell’attività del tribunale inquisitoriale milanese nel medioevo (la cui documentazione è andata interamente perduta), ma anche per il ruolo del tribunale ecclesiastico e dei suoi funzionari. La ricchezza delle informazioni e dei temi ha suggerito un lavoro d’équipe dei docenti del Dipartimento di studi storici per chiarire i molteplici aspetti (politici, religiosi, economici, documentari) di una vicenda che mostra la vitalità della Milano quattrocentesca, in cui il protagonista, il maestro Amedeo Landi, nel tentativo di tutelare i suoi studenti si scontra con il più importante predicatore del suo tempo, frate Bernardino da Siena, il cui processo di canonizzazione viene momentaneamente bloccato proprio per fare luce sull’episodio milanese

    Abstract: Der Band hinterfragt den Nutzen des Begriffs „Orientalismus“ zur Erforschung der vielfältigen deutsch-jüdischen kulturellen Beziehungen im 19. und 20. Jahrhundert. Dabei wird Orientalismus einerseits als postkolonialer Diskurs verstanden, der Identitätskonflikte und Sprachprobleme der jüdischen Diaspora in den Blick nimmt, andererseits als philologische Wissenschaft vom Orient. Die Beiträge behandeln folgende Fragen: In welchem Maße wurden deutsche Juden vom zeitgenössischen wissenschaftlichen Diskurs über den „Orient“ und den „Orientalen“ beeinflusst bzw. gestalteten ihn mit? Wie tief verinnerlichten Juden die stereotypen Bilder ihrer Umgebung und inwiefern konnten die deutsch-jüdischen Orientalisten diese Vorurteile und deren philosophische Legitimierung wissenschaftlich widerlegen? Wie veränderte sich das Bild des Orients, als viele emigrierte deutsche Juden sich in Palästina mit dem „wahren“ Orient konfrontiert sahen?

    Abstract: Die Beiträge des Sammelbandes "Travelling Objects" widmen sich dem Austausch von Kunstwerken zwischen Italien und dem Habsburgerreich während des 17. und 18. Jahrhunderts. Diese Gegenstände vermittelten als Botschafter des Transfers zwischen Nord und Süd und bildeten folglich eine bedeutende materielle Grundlage der kulturellen Beziehungen. Sie dienten als diplomatische Geschenke (Papsthof-Kaiserhof), als Bestechungsmittel (Odescalchi-Kaunitz) oder der symbolischen Kommunikation im Rahmen dynastischer Beziehungen (Mantua-Wien, Florenz-Innsbruck). Als Agenten des Transfers fungierten Händler (etwa im Herzogtum Krain), Adelige (Obizzi, Savoyen) sowie Botschafter und Gesandte (Savelli, Lamberg, Gallas, Albani, Apponyi).

    Abstract: The papers presented in this volume analyse the many ways in which the Vatican, national Churches and individual catholics dealt with the rise of the extreme right in Europe throughout the 1920s, 1930s and early 1940s, from the end of the First World War, arguably one of the main catalysts of European interwar fascism, to the conclusion and immediate aftermath of the Second World War. While a number of papers focus primarily on theoretical, methodological issues pertaining to the book’s general theme, the majority of papers focus on either a country or region where a fascist movement or regime flourished between the wars and during the Second World War, and where there was a significant catholic presence in society. The various chapters cover almost the entire European continent – an endeavour that is unprecedented –, and they explore a wide range of relevant contexts and methodologies, thus further contributing to the general development of an interpretive ‘cluster’ model that incorporates a series of investigative matrixes, and that will hopefully inspire future research.

    Abstract: This book is a collection of articles by Italian and foreign scholars designed to offer an overview of the processes and issues involved in the history of the confraternity movement, as yielded by studies in the historical, social, legal, literary and artistic spheres in the course of the twentieth century. The articles deal with the historical context of western Europe, and more specifically with Italy, in the period comprised between the Middle Ages and the early Modern Age. The collection is divided into four sections: Individuals and groups, which explores the emergence of an interest in confraternity communities in disciplines addressing the history of social groups, of the rural world, of women and of young people. The legal and institutional framework deals with issues of legitimacy and institutional structure. The economics of charity analyses the relations between the confraternities and the hospital structures, the procedures for the administration of the assets, and the strategies of governance underlying the policies of aid of which the confraternities were the principal instrument. Finally, the section Theatrical, musical, artistic and documentary evidence is devoted to the sources that have handed down evidence of the operation of the confraternities
    Abstract: Il volume raccoglie interventi di studiosi italiani e stranieri miranti a offrire una panoramica di percorsi storiografici e di problematiche relativi alla storia del movimento confraternale, così come sono emersi nell'ambito di discipline storiche, sociali, giuridiche, letterarie e artistiche sviluppatesi nel corso del Novecento. I contributi si riferiscono al contesto storico dell'Europa occidentale, con più specifico riguardo per l'Italia, nel periodo compreso fra medioevo e prima età moderna.     Abstract: In April 1479, the communities of the marquisate of Mantua pronounced for the first time a general oath of fealty to Federico Gonzaga, the third marquis, inaugurating a custom that was to be repeated with relative regularity in the following decades every time a Prince died. It was a practice which was fairly new for the Gonzago marquisate, at least in this capillary and general extension to the entire body of the State. The significance of an innovation of this kind deserves attention, as do the genesis and the partial forms that preceded this mature expression.     Abstract: This book is a collection of articles by Italian and foreign scholars designed to offer an overview of the processes and issues involved in the history of the confraternity movement, as yielded by studies in the historical, social, legal, literary and artistic spheres in the course of the twentieth century. The articles deal with the historical context of western Europe, and more specifically with Italy, in the period comprised between the Middle Ages and the early Modern Age. The collection is divided into four sections: Individuals and groups, which explores the emergence of an interest in confraternity communities in disciplines addressing the history of social groups, of the rural world, of women and of young people. The legal and institutional framework deals with issues of legitimacy and institutional structure. The economics of charity analyses the relations between the confraternities and the hospital structures, the procedures for the administration of the assets, and the strategies of governance underlying the policies of aid of which the confraternities were the principal instrument. Finally, the section Theatrical, musical, artistic and documentary evidence is devoted to the sources that have handed down evidence of the operation of the confraternities

    Abstract: In April 1479, the communities of the marquisate of Mantua pronounced for the first time a general oath of fealty to Federico Gonzaga, the third marquis, inaugurating a custom that was to be repeated with relative regularity in the following decades every time a Prince died. It was a practice which was fairly new for the Gonzago marquisate, at least in this capillary and general extension to the entire body of the State. The significance of an innovation of this kind deserves attention, as do the genesis and the partial forms that preceded this mature expression. This book comprises an edition of the entire related documentary corpus, complete with photographic reproductions of the individual documents, and preceded by a substantial introduction in which the event is described, placed in context and interpreted from various points of view
    Abstract: Le comunità del marchesato di Mantova pronunciarono per la prima volta un generale giuramento di fedeltà a Federico Gonzaga terzo marchese nell'aprile 1479, inaugurando un uso che si sarebbe ripetuto con relativa continuità nei decenni successivi ad ogni morte del principe. Si tratta di una pratica relativamente nuova per il marchesato gonzaghesco, almeno in questa capillare e generale estensione all'intero corpo dello stato: il significato di una innovazione di questo genere merita attenzione, come anche la genesi e le forme parziali che hanno preceduto questa forma matura. In questo volume si dà l'edizione dell'intero corpus documentario relativo, integrata dalla riproduzione fotografica dei singoli documenti, e preceduta da una corposa introduzione che punta a inserire il case-study mantovano nel recente, articolato dibattito intorno alla costruzione e alla crescita di linguaggi politici diversificati nel tardo medioevo italiano

Uno dei periodi tra i più rilevanti del passato del nostro paese è qui affrontato da alcuni tra i maggiori specialisti a livello internazionale attraverso la ricostruzione dei percorsi, delle tematiche e dei risultati conseguiti dalle principali storiografie straniere (tedesca, francese, americana, spagnola e inglese). Ne emerge un quadro assai articolato di come l'esperienza della civiltà comunale sia stata trattata e valutata nel tempo fuori dall'Italia. Centrata sull'esperienza di Firenze ma aperta alla comparazione con altre esperienze italiane, l'indagine evidenzia come, nella trasformazione del quadro politico dall'età comunale a quella dello Stato territoriale tra XIII e XV secolo, i rapporti di forza tra i poteri attivi sul territorio trovarono nella giustizia un terreno di confronto, una risorsa per la competizione politica, uno strumento di legittimazione. Tra gli intenti del volume è infatti quello di contribuire al rinnovamento della nozione di giustizia, superandone la visione tradizionale in termini di funzione pubblica e di aspetto della progressiva affermazione dello Stato

I Rossi, la cui eminenza sociale e politica risale all'età comunale, costruirono nel Parmense un dominio di notevoli proporzioni, basato sul possesso territoriale e castrense ma anche su una vasta clientela rurale e urbana: e il potere del casato, benché ridimensionato in seguito alla crisi delle relazioni con gli Sforza nel 1482, trovò gli spazi per ricostituirsi su basi parzialmente diverse durante le guerre d'Italia. The objective of these study days was to address the question of the powers of lordship which were exercised in the countryside of central-northern Italy between the mid fourteenth century and the end of the fifteenth century. The discussions focused on what instruments and what foundations of legitimacy these same powers had and what was their relationship with the authority of the prince and with the ordinary citizen, on the one hand, and with the community and the homines on the other. These and various other issues thrown up by the study of feudal power are the topics which emerge in the various contributions gathered in this volume, devoted principally to the Lombardy of the Visconti and the Sforza, but also to other areas of Italy

    Abstract: This book, generated by the encounter between two schools - the Italian early mediaeval and the Argentine late antique - ranges from Italy to Gaul and the Eastern Mediterranean over a timespan from the third/fourth to the eighth centuries. It introduces a world polarised between an East destined to be divided between Byzantium and Islam, and a West composed of the post-Roman barbarian societies. The East, rooted within the Roman-Hellenistic heritage, represents a source of religious experiences which profoundly influence the West. With reference to Italy, the study focuses on an analysis of the Episcopal network, the emergence of the Benedictine Rule, and the correspondence of Gregory the Great. In the passage from East to West, the 'new' Barbarian societies emerge in the front line, proving that they too were seeking out ancient roots, both in Gaul and in Italy, the latter being partly still linked to Byzantium and partly under the dominion of the Lombards. Finally various crucial aspects of the Lombard kingdom - which proves to be profoundly permeated by the legacy of Rome - are addressed, including royalty, the capitals and the law, through the analysis of both written and archaeological sources

    Abstract: This book is a collection of the proceedings of the study seminar held in Verona on 14 November 2003. This was the occasion for the presentation of the results of archive research performed by young researchers on the Jewish presence in numerous cities and smaller towns of the Venetian hinterland in the fifteenth century (Vicenza, Verona, Treviso, Feltre, and the minor centres of the Polesine and Verona and Vicenza territory). The various themes that are developed though attentive and documented analysis include: the autonomous initiative of the civic communities in the relation with the Jewish moneylenders and the attitude of Venice, divided between protection and the anti-Jewish tensions that were widespread among the lagoon nobility; the encounter and dialectic between the Ashkenazi and Italian components in the communities settled within the cities and hamlets of Veneto; the difference of the social and cultural climate between the first and second half of the fifteenth century, marked by incisive Franciscan preaching and attempts at expulsion from the cities; a look 'from the inside' which opens up the role of women in the economic life of the Jewish communities. Over twenty years after the convention on 'The Jews and Venice' promoted by the Fondazione Cini, these contributions illustrate the revival of study and the ever-present need for comparison and exchange on the issue of the Jewish presence in Italy

These were homines novi who, without resorting to dynastic connections and often rejecting the associative model of the guilds, managed to build fortunes and dignity through trade, enterprise, the exploitation of the land, the solidarity of district and parish and the management of welfare. Emblematic of such careers is the figure of an economic agent originating from the rural district, Donato Ferrario da Pantigliate, who in 1429 founded in Milan a devotional and welfare institute, the Scuola della Divinità. The book reconstructs the social, economic and spiritual conduct of Donato, placing it within the urban context of Milan in the first half of the fifteenth century

    Abstract: City life in the Italy of the communes was a unique experience in the Middle Ages, “another world” from that of the countryside in terms of the customs, beliefs and practices that conditioned the attitudes of a complex society. In order to verify Lopez’ definition of the city as a “frame of mind”, the issues addressed include the perception and memory of time (both real and mythical), the elaboration of models of behaviour (that of chivalry), and the conditioning of the urban ambience through to the creation of an “acoustic landscape” of the city. The significance of what it meant to be a citizen in mediaeval Italy emerges tangibly from the evidence of contemporaries

    Abstract: Il volume, che raccoglie i contributi di ex borsisti italiani dell'ultimo decennio del Deutsches Historisches Institut di Roma, vuole essere un omaggio a uno dei medievisti più noti a livello internazionale e all'attento e sensibile studioso della storia italiana, ma soprattutto un segno di gratitudine di giovani studiosi che con tale borsa hanno potuto consolidare i loro percorsi di ricerca. I 14 contributi che lo compongono non sono quindi accomunati da un comune orientamento formativo di scuola, ma spaziano fra diversi settori di ricerca e differenti ambiti cronologici
