    Abstract: "Racism and racial discrimination emerged as themes in public international law at the end of the First World War. This was a consequence of the participation of countries from the Global South who had hitherto been excluded from international law making. A Japanese proposal to recognise racial equality in the Covenant of the League of Nations was vetoed by President Wilson. The battle against racial discrimination at the international level really began with the United Nations, in 1946. The Global South pushed for action to deal with racism in South Africa, for example, among several other initiatives directed at racial discrimination. In the first decades of the United Nations, campaigns against racial discrimination were the beating heart of the human rights activities of the organisation. Major landmarks include the adoption of the 1965 Convention on the Elimination of Racial Discrimination and the 1973 Convention Against Apartheid. Important mechanisms in human rights were often instigated in measures directed at racial discrimination. These were invariable pushed by States of the Global South and obstructed by governments of Europe and North America. When the apartheid regime finally fell, in 1990, international activities were recalibrated with a focus on xenophobia. But the issue of racism and racial discrimination, directed principally at people of colour, returned with the 2001 Durban Conference. Tensions have continued about a range of issues, including reparations for slavery and the slave trade. In 2020, the murder of George Floyd prompted renewed activity. This book narrates the history of racism and racial discrimination in international law, challenging the narrative that human rights are a creation of the Global North while demonstrating the decisive contribution of the Global South"--

    Abstract: "Since the 1980s the study of genocide has exploded, both historically and geographically, to encompass earlier epochs, other continents, and new cases. The concept of genocide has proved its worth, but that expansion has also compounded the tensions between a rigid legal concept and the manifold realities researchers have discovered. The legal and political benefits that accompany genocide status have also reduced complex discussions of historical events to a simplistic binary--is it genocide or not--a situation often influenced by powerful political pressures.     Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people

    Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

    Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Abstract: Women's Legal Landmarks commemorates the centenary of women's admission in 1919 to the legal profession in the UK and Ireland by identifying key legal landmarks in women's legal history.     Abstract: Since the turn of the century, South American governments and regional organisations have adopted the world's most open discourse on migration and citizenship. At a time when restrictive choices were becoming increasingly predominant around the world, South American policymakers presented their discourse as being both an innovative and exceptional 'new paradigm' and part of a morally superior, avant-garde path in policymaking. This book provides a critical examination of the South American legal framework through a historical and comparative analysis. We are so accustomed to living in a forest of monuments, to having the past represented to us through museums, historic sites, and public sculpture, that we easily lose sight of the recent origins and diverse meanings of these uniquely modern phenomena.     Abstract: "Since 1970 the Law in Context series has been at the forefront of the movement to broaden the study of law. It has been a vehicle for the publication of innovative scholarly books that treat law and legal phenomena critically in their social, political and economic contexts from a variety of perspectives. The series particularly aims to publish scholarly legal writing that brings fresh perspectives to bear on new and existing areas of law taught in universities. A contextual approach involves treating legal subjects broadly, using materials from other social sciences, and from any other discipline that helps to explain the operation in practice of the subject under discussion.     Abstract: The Oxford Handbook of the Ends of Empire offers the most comprehensive treatment of the causes, course, and consequences of the ends of empire in the twentieth century. The volume's contributors convey the global reach of decolonization, with chapters analysing the empires of Western Europe, Eastern Europe, China and Japan. The Handbook combines broad, regional treatments of decolonization with chapter contributions constructed around particular themes or social issues. It considers how the history of decolonization is being rethought as a result of the rise of the 'new' imperial history, and its emphasis on race, gender, and culture, as well as the more recent growth of interest in histories of globalization, transnational history, and histories of migration and diaspora, humanitarianism and development,0and human rights. The Handbook, in other words, seeks to identify the processes and commonalities of experience that make decolonization a unique historical phenomenon with a lasting resonance. In light of decades of historical and social scientific scholarship on modernization, dependency, neo-colonialism, 'failed state' architectures and post-colonial conflict, the obvious question that begs itself is 'when did empires actually end?' Live-in servants were a distinctive element of early modern society. They were typically young adults aged between 16 and 24 who lived and worked in other people's households before marriage. Servants tended to be employed for long periods, several months to years at a time, and were paid with food and lodging as well as cash wages. Both women and men worked as servants in large numbers. Unlike domestic servants in towns and wealthy households, rural servants typically worked on farms and were an important element of the agricultural workforce. Historians have viewed service as a distinct life-cycle stage between childhood and marriage. It brought both freedom and servility for young people. It allowed them to leave home and earn a living before marriage, whilst learning a range of agricultural and craft skills which reduced their dependence on their parents and increased their choice in marriage partners. Still, servants had limited rights: they were under the authority of their employer, with a similar legal status to children. In many countries the employment of servants was tightly controlled by law. Servants could demand their wages, and leave when the contract ended, but had to work long hours and had little say in their work tasks during employment. While some servants effectively became family members, trusted and cared for, others were abused physically and sexually by their employers."--Back cover

    Abstract: In this innovative legal history of economic life in the Western Indian Ocean, Bishara examines the transformations of Islamic law and Islamicate commercial practices during the emergence of modern capitalism in the region. In this time of expanding commercial activity, a mélange of Arab, Indian, Swahili and Baloch merchants, planters, jurists, judges, soldiers and seamen forged the frontiers of a shared world. The interlinked worlds of trade and politics that these actors created, the shared commercial grammars and institutions that they developed and the spatial and socio-economic mobilities they engaged in endured until at least the middle of the twentieth century. This study examines the Indian Ocean from Oman to India and East Africa over an extended period of time, drawing together the histories of commerce, law and empire in a sophisticated, original and richly textured history of capitalism in the Islamic world

    Abstract: Taxing the Rich draws on unparalleled evidence from twenty countries over the last two centuries to provide the broadest and most in-depth history of progressive taxation available. Scheve and Stasavage explore the intellectual and political debates surrounding the taxation of the wealthy while also providing the most detailed examination to date of when taxes have been levied against the rich and when they haven't. Fairness in debates about taxing the rich has depended on different views of what it means to treat people as equals and whether taxing the rich advances or undermines this norm. Scheve and Stasavage argue that governments don't tax the rich just because inequality is high or rising--they do it when people believe that such taxes compensate for the state unfairly privileging the wealthy. Progressive taxation saw its heyday in the twentieth century, when compensatory arguments for taxing the rich focused on unequal sacrifice in mass warfare. Today, as technology gives rise to wars of more limited mobilization, such arguments are no longer persuasive. Taxing the Rich shows how the future of tax reform will depend on whether political and economic conditions allow for new compensatory arguments to be made. (Publisher's Web site)

    Abstract: This book aims to deconstruct ethnography to alert systems designers, and other stakeholders, to the issues presented by new approaches that move beyond the studies of ‘work’ and ‘work practice’ within the social sciences (in particular anthropology and sociology). The theoretical and methodological apparatus of the social sciences distort the social and cultural world as lived in and understood by ordinary members, whose common-sense understandings shape the actual milieu into which systems are placed and used.  In Deconstructing Ethnography the authors show how ‘new’ calls are returning systems design to ‘old’ and problematic ways of understanding the social. They argue that systems design can be appropriately grounded in the social through the ordinary methods that members use to order their actions and interactions.  This work is written for post-graduate students and researchers alike, as well as design practitioners who have an interest in bringing the social to bear on design in a systematic rather than a piecemeal way. This is not a ‘how to’ book, but instead elaborates the foundations upon which the social can be systematically built into the design of ubiquitous and interactive systems

The last three chapters of the book offer an overview of the history of Roman law from the early Middle Ages to modern times and illustrate the way in which Roman law furnished the basis of contemporary civil law systems. In this part, special attention is given to the factors that warranted the revival and subsequent reception of Roman law as the ‘common law’ of Continental Europe. Combining the perspectives of legal history with those of social and political history, the book can be profitably read by students and scholars, as well as by general readers with an interest in ancient and early European legal history. The civil law tradition is the oldest legal tradition in the world today, embracing many legal systems currently in force in Continental Europe, Latin America and other parts of the world. Despite the considerable differences in the substantive laws of civil law countries, a fundamental unity exists between them. The most obvious element of unity is the fact that the civil law systems are all derived from the same sources and their legal institutions are classified in accordance with a commonly accepted scheme existing prior to their own development, which they adopted and adapted at some stage in their history.     Abstract: By using various data inputs, ubiquitous computing systems detect their current usage context, automatically adapt their services to the user’s situational needs and interact with other services or resources in their environment on an ad-hoc basis. Designing such self-adaptive, context-aware knowledge processing systems is, in itself, a formidable challenge. This book presents core findings from the VENUS project at the Interdisciplinary Research Center for Information System Design (ITeG) at Kassel University, where researchers from different fields, such as computer science, information systems, human-computer interaction and law, together seek to find general principles and guidelines for the design of socially aware ubiquitous computing systems. To this end, system usability, user trust in the technology and adherence to privacy laws and regulations were treated as particularly important criteria in the context of socio-technical system design. During the project, a comprehensive blueprint for systematic, interdisciplinary software development was developed, covering the particular functional and non-functional design aspects of ubiquitous computing at the interface between technology and human beings. The organization of the book reflects the structure of the VENUS work program. After an introductory part I, part II provides the groundwork for VENUS by presenting foundational results from all four disciplines involved. Subsequently, part III focuses on methodological research funneling the development activities into a common framework. Part IV then covers the design of the demonstrators that were built in order to develop and evaluate the VENUS method. Finally, part V is dedicated to the evaluation phase to assess the user acceptance of the new approach and applications. The presented findings are especially important for researchers in computer science, information systems, and human-computer interaction, but also for everyone working on the acceptance of new technologies in society in general

    Abstract: Hacking Europetraces the user practices of chopping games in Warsaw, hacking software in Athens, creating chaos in Hamburg, producing demos in Turku, and partying with computing in Zagreb and Amsterdam. Focusing on several European countries at the end of the Cold War, the book shows the digital development was not an exclusively American affair. Local hacker communities appropriated the computer and forged new cultures around it like the hackers in Yugoslavia, Poland and Finland, who showed off their tricks and creating distinct 'demoscenes.' Together the essays reflect a diverse palette of cultural practices by which European users domesticated computer technologies.     Abstract: This book presents an analysis of global legal history in Modern times, questioning the effect of political revolutions since the 17th century on the legal field. Readers will discover a non-linear approach to legal history as this work investigates the ways in which law is created. These chapters look at factors in legal revolution such as the role of agents, the policy of applying and publicising legal norms, codification and the orientations of legal writing, and there is a focus on the publicization of law. The author uses Herbert Hart’s schemes to conceive law as a human artefact or convention, being the union between primary rules of obligations and secondary rules conferring powers. Here we learn about those secondary rules and the legal construction of the Modern state, and we question the extent to which codification and law reporting were likely to revolutionize the legal field. These chapters examine the hypothesis of a legal revolution that could have concerned many countries in modern times. To begin with, the book considers the legal aspect of the construction of Modern States in the 17th and 18th centuries. It goes on to examine the consequences of the codification movement as a legal revolution before looking at the so-called “constitutional” revolution, linked with the extension of judicial review in many countries after World War II. Finally, the book enquires into the construction of an EU legal order and international law. In each of these chapters, the author measures the scope of the change, how the secondary rules are concerned, the role of the professional lawyers and what are the characters of the new configuration of the legal field.     Abstract: This book presents the latest research on the challenges and solutions affecting the equilibrium between freedom of speech, freedom of information, information security, and the right to informational privacy. Given the complexity of the topics addressed, the book shows how old legal and ethical frameworks may need to be not only updated, but also supplemented and complemented by new conceptual solutions. Neither a conservative attitude (“more of the same”) nor a revolutionary zeal (“never seen before”) is likely to lead to satisfactory solutions. Instead, more reflection and better conceptual design are needed, not least to harmonise different perspectives and legal frameworks internationally. The focus of the book is on how we may reconcile high levels of information security with robust degrees of informational privacy, also in connection with recent challenges presented by phenomena such as “big data” and security scandals, as well as new legislation initiatives, such as those concerning “the right to be forgotten” and the use of personal data in biomedical research. The book seeks to offer analyses and solutions of the new tensions, in order to build a fair, shareable, and sustainable balance in this vital area of human interactions

    Abstract: Research in Natural Language Processing (NLP) has rapidly advanced in recent years, resulting in exciting algorithms for sophisticated processing of text and speech in various languages. Much of this work focuses on English; in this book we address another group of interesting and challenging languages for NLP research: the Semitic languages. The Semitic group of languages includes Arabic (206 million native speakers), Amharic (27 million), Hebrew (7 million), Tigrinya (6.7 million), Syriac (1 million) and Maltese (419 thousand). Semitic languages exhibit unique morphological processes, challenging syntactic constructions, and various other phenomena that are less prevalent in other natural languages. These challenges call for unique solutions, many of which are described in this book. The 13 chapters presented in this book bring together leading scientists from several universities and research institutes worldwide. While this book devotes some attention to cutting-edge algorithms and techniques, its primary purpose is a thorough explication of best practices in the field. Furthermore, every chapter describes how the techniques discussed apply to Semitic languages. The book covers both statistical approaches to NLP, which are dominant across various applications nowadays, and the more traditional, rule-based approaches, that were proven useful for several other application domains. We hope that this book will provide a "one-stop-shop'' for all the requisite background and practical advice when building NLP applications for Semitic languages

    Abstract: The 20th century saw an unprecedented number of major wars, conflicts, and massive human rights violations. From each emerged the desire to make sense of the recent past (and present) by imagining new ways of dealing with such events. In order to prevent new forms of violence, or to punish the persons responsible of past horrors, various solutions have been imagined, deployed, implemented, and discussed, at different levels. This book is a reflection on the social and historical construction, appropriation, and circulation of categories, norms, and savoir-faire related to the ways social groups and institutions-state, judiciary, professional organizations-confront traumatic events. Even if there is a robust literature on purges and other mechanisms intended to deal with an authoritarian or violent past, written by authors belonging to numerous disciplines and exploring different periods and topics with a variety of theoretical and methodological backgrounds, our goal was to propose a more sociologically oriented model of analysis. Far from being only an intellectual frenzy, this orientation appears to be less normative than most “post-transitional” approaches and potentially more general than strictly monographic approaches. In doing so, our objective is not only to provide a critical approach, but also to sustain a more realistic view of this highly political and moral domain

    Abstract: On 25 January 2012, the European Commission presented its long awaited new Data protection package. With this proposal for a drastic revision of the data protection framework in Europe, it is fair to say that we are witnessing a rebirth of European data protection, and perhaps, its passage from an impulsive youth to a more mature state. Technology advances rapidly and mobile devices are significantly changing the landscape. Increasingly, we carry powerful, connected, devices, whose location and activities can be monitored by various stakeholders. Very powerful social network sites emerged in the first half of last decade, processing personal data of many millions of users. Updating the regulatory framework was imminent and the presentation of the new package will initiate a period of intense debate in which the proposals will be thoroughly commented upon and criticized, and numerous amendments will undoubtedly be proposed. This volume brings together some 19 chapters offering conceptual analyses, highlighting issues, proposing solutions, and discussing practices regarding privacy and data protection. In the first part of the book, conceptual analyses of concepts such as privacy and anonymity are provided. The second section focuses on the contrasted positions of digital natives and ageing users in the information society. The third section provides four chapters on privacy by design, including discussions on roadmapping and concrete techniques. The fourth section is devoted to surveillance and profiling, with illustrations from the domain of smart metering, self-surveillance and the benefits and risks of profiling. The book concludes with case studies pertaining to communicating privacy in organisations, the fate of a data protection supervisor in one of the EU member states and data protection in social network sites and online media

    Abstract: More and more transactions, whether in business or related to leisure activities, are mediated automatically by computers and computer networks, and this trend is having a significant impact on the conception and design of new computer applications. The next generation of these applications will be based on software agents to which increasingly complex tasks can be delegated, and which interact with each other in sophisticated ways so as to forge agreements in the interest of their human users. The wide variety of technologies supporting this vision is the subject of this volume. It summarises the European Cooperation in Science and Technology (COST) Action project on Agreement Technologies (AT), during which approximately 200 researchers from 25 European countries, along with eight institutions from non-COST countries, cooperated as part of a number of working groups. The book is the first to provide a comprehensive overview of the emerging field of Agreement Technologies, written and coordinated by the leading researchers in the field. The results set out here are due for wide dissemination beyond the computing sector, involving law and social science as well.
