Abstract: This book is open access, which means that you have free and unlimited access. The increasing capacity of digital networks and computing power, together with the resulting connectivity and availability of “big data”, are impacting financial systems worldwide with rapidly advancing deep-learning algorithms and distributed ledger technologies. They transform the structure and performance of financial markets, the service proposition of financial products, the organization of payment systems, the business models of banks, insurance companies and other financial service providers, as well as the design of money supply regimes and central banking. This book, The Future of Financial Systems in the Digital Age: Perspectives from Europe and Japan, brings together leading scholars, policymakers, and regulators from Japan and Europe, all with a profound and long professional background in the field of finance, to analyze the digital transformation of the financial system. The authors analyze the impact of digitalization on the financial system from different perspectives such as transaction costs and with regard to specific topics like the potential of digital and blockchain-based currency systems, the role of algorithmic trading, obstacles in the use of cashless payments, the challenges of regulatory oversight, and the transformation of banking business models. The collection of chapters offers insights from Japanese and European discourses, approaches, and experiences on a topic otherwise dominated by studies about developments in the USA and China.

Abstract: This book looks at a substantively new model of educational philosophy and its application within the field of tertiary education, in relation to socio-economic development in Southeast Asian members of the Organization of Islamic Conferences (OIC). Focusing on and drawing from the cross-regional South East Asian Cooperation (SEACO), a network promoting regional economic cooperation, the author presents a thoughtful evocation of a new orientation to educational philosophy and policy within the development context in the time of, and relating to, COVID-19. The generalized worldview of Islamic educational and socio-economic development model is laid down in relation to the philosophy of education and an ethical-scientific structure of development in terms of the theory of knowledge (epistemology, episteme). The foundation of scientific thought and a comparative Islamic worldview in understanding the unified reality of ‘everything’ is presented. The objectivity of socio-scientific learning at all levels of educational development is further explained within the context of SEACO and its think tank vis-à-vis a reconstructive perspective in which the Islamic episteme of the unity of knowledge and its substantive methodology is addressed and unpacked. The book is relevant to policymakers and scholarly researchers in Islamic philosophy and development and higher education in Southeast Asia and in the Muslim world and more broadly for the world of learning. .

The Future Solution to Hardship: A Relational and Good Faith Approach.
Abstract: This book provides fair and acceptable solutions to hardship issues in long-term relational supply contracts. This book uses an approach to strike a balance between the traditional approach underlying classical contract law which emphasises the almost absolute prevalence of the principle of pacta sunt servanda and a flexible approach that is based on the principle of clausula rebus sic stantibus. This book argues for an emerging principle of pacta sunt servanda bona fide on the basis of the relational contract theory. Additionally, this book demonstrates how good faith can serve as a foundation for imposing a duty to renegotiate on the parties. The aim of this book is rather to propose how relational contract theory can be applied to the analysis of specific legal rules in general. Lastly, this boos highlights how the duty to renegotiate and the power to adapt a contract can be further developed upon the occurrence of hardship, based on good faith and the relational nature and characteristics of a long-term relational supply contract. This book explores and enriches the existing research on relational contract theory concentrates primarily on its application in domestic contract laws, particularly in the regulation of long-term contracts in American contract law. As an outcome this book provides a more feasible and satisfactory approach for courts or arbitral tribunals to undertake when facing hardship issues in international contract disputes. Overall, hardship themes, long-term relational supply contracts and good faith are examined extensively. .

Abstract: This book focuses on the PRC’s cross-border data transfer legislation in recent years, as well as the implications for international trade law. The book addresses the convergence of industries and technologies notably caused by digitization; the issue of conflicts between goods and services; and the General Agreement on Tariffs and Trade (GATT) and General Agreement on Trade in Services (GATS) as well as the difficulty of classifying service sectors under WTO members’ commitments. The book also examines the FTAs that entered into force after 2012 that regulate digital trade beyond the venue of the WTO and analyzes their rules of relevance for cross-border data flows and international trade. It asks whether and how these FTAs have deliberately reacted to the increasing importance of data flows as well as to the trouble of governing them in the context of global governance.

Abstract: This open access book analyzes the dualism and inequality insofar as how it is manifested in interregional disparity and small enterprises. Using the case of Indonesia, the author considers how the general direction of policy should be to mitigate the effects of agglomeration forces leading towards concentration, and exploit the same forces by encouraging small businesses to operate in a cluster for collective action. The book addresses these issues by focusing on the role of interactions between policies and institutions, of which social capital is an important part. “Iwan Azis’ new book has all the elegance of his deep understanding of institutions and policies……(it) has widespread interest for those working on problems of the populous countries of the Third World.” —Yoginder. Since 2009, a group of researchers at the CASS Institute of Law has worked to assess the Chinese government’s transparency. In this context, they designed an index system to truthfully record and reflect the reality and development of openness in the Chinese government for eight consecutive years. This book compiles their reports on each year’s development, systematically combining quantitative analysis and the status quo for each year. Thanks to these reports, readers will be able to clearly understand the evolution of the Chinese government’s openness during these eight years. They highlight what the government has done to improve transparency, what has been achieved, and the goals for the future. These reports have not only been acclaimed in academic circles, but have also greatly influenced government policies and procedures. For example, the assessment was expanded to the judicial system including the Supreme People’s Court, maritime court, and local provincial courts in 2011, and ever since the national judicial system’s openness has been considerably improved, in response to recommendations based on the assessment. .

Abstract: This book focuses on how to improve the quality management of official statistics in China. Official statistics help to build an overview of China’s social and economic development and play an important role in policymaking for government as well as in decision-making for enterprises. Because of the great value in reference, the quality of official statistics also constitutes the concern from the public. This book summarizes three levels for understanding the concept of the quality of official statistics and analyzes possible affections from social and economic environment, political and management perspectives. Government statistical data is an important information reflecting China’s economic and social development, an important tool for Party committees at all levels, governments, enterprises and the public to understand and grasp China’s economic operation and social development, an important basis for Party committees and governments at all levels to conduct economic and social management and decision-making and an important reference for enterprises and the public to make decisions on production, operation, investment and consumption. Therefore, the government, enterprises and the public at all levels are demanding more and more government statistics. Accordingly, the quality of government statistical data is becoming more and more important, because it concerns the objectivity and accuracy of government statistical data, the scientificity of economic and social management, the decision-making of Party committees, the correctness of production, operation, investment and consumption decisions of enterprises and the public. Therefore, the quality of government statistical data is extremely important, which is not only the focus of social concern, but also the core issue of government statistics.

Abstract: This book provides an overall understanding of Chinese labour law and covers many important issues related to the application of Chinese labour law. Particularly, the book explains the difficult points in Chinese labour law from the perspective of juridical practice. Many typical cases are selected to illustrate the important issues in Chinese labour law. These cases are from the courts in the developed areas in China, where foreign-funded enterprises gather. Also, the book addresses the implications of the Civil Code on the labour law. The latest developments are reflected in the book, which include guidelines related to labour dispute case hearing formulated by the Higher Courts in many provinces, and the guiding cases released by the Supreme Court. Such developments are the reflections of fragmented judicial application of Chinese labour law.

Abstract: This edited volume starts from the perspectives of Beijing in how it sees that religion should serve the interests of the state. From China’s viewpoint, religion should act as a stabilizing force of society, or else the Christian Churches will lose their reason for existence. This might be incomprehensible to Western Christians, who believe in the freedom of religion and their right to embrace their faith. This collection of articles represents the concerted efforts of Chinese, Italians, and an American—who live in China, Europe, and the United States and belong to different disciplines, such as History, Religious Studies, and Language Studies—to promote a better understanding of the Catholic Church in the world and in China.

Abstract: After reviewing related theories on stigmatisation of people living with HIV/AIDS (PLWHA), this book applies social exclusion theory, actor theory and stigma theory to the study of social mechanisms of stigmatisation of PLWHA in China to show the influence and mechanism of stigmatisation on them, and tries to construct the policy framework to tackle stigmatisation from the perspective of welfare pluralism. Qualitative analysis was used and data was obtained during the field interview. Thirty PLWHA and seventeen healthy people (non-infected people and staff of ASO Service Organizations) were selected by using random sampling and snowball sampling for semi-structured depth interviews. The research examines the treatments and living conditions of those PLWHA, aiming to explore the influence of HIV on them in education, employment, medical care, economy, welfare and social relations. The book is intended for graduate students, researchers interested in this field and relevant policymakers.

Abstract: This book acquaints the reader with the critical changes in India’s economy and society amidst the unprecedented pandemic outbreak of COVID-19, which has been devastating by breaking all prior records of illness and fatality. The present crisis is shown to be more than an acute health hazard as it carries with it other threats associated with the economy, society, culture, psychology, and politics. The dynamic driving forces that have a significant bearing on life, space, and time are explored, providing a basis on which social scientists can understand the prevailing equations and project the unforeseen future to contribute to a policymaking mechanism. The Indian scenario presented here takes into account how the COVID-19-induced lockdown of transport services, closing of factories, and restrictions on mobilization have caused the economy to face a recession, affecting mostly the unorganized sector. Travel restrictions and quarantines affecting hundreds of millions of people have left Indian factories short of labour, causing havoc in the production system. Semi-skilled jobholders have lost their employment, and the country has witnessed the plight of large pools of migrant labourers returning on foot to their homelands hundreds of miles away with their families and belongings. Contributors to this volume are drawn from diverse disciplines, displaying the solidarity of academic knowledge in a physically divided world. This common platform is provided to the practitioners of relevant academic disciplines under the umbrella of regional sciences – a forum for the exchange of ideas that may be effective in the sustainable management of the crisis and a way forward after it is mitigated. Thought-provoking discussions regarding different facets of the crisis are relevant not only to the current times but also to being prepared for the unforeseen post-COVID economic and societal order.

Abstract: The Macroeconomy: Foreign Trade, Structural Transition and the Environment -- Health and Standard of Living -- Education, Human Capital and Evolution of the Employment Quality in India -- Banking and Credit: Access, Efficiency and Stability.
Abstract: This book covers a wide range of the issues in development studies. Recognizing the existence of manifold challenges in achieving and sustaining economic development, it is divided into four sections—(i) The Macroeconomy: Foreign Trade, Structural Transition and the Environment, (ii) Health and Standard of Living, (iii) Education, Human Capital and Evolution of the Employment Quality in India, and (iv) Banking and Credit: Access, Efficiency and Stability. The book brings together a right mix of senior and young economists who use cutting edge econometric techniques and/ or revisit a perennial question with much sharper focus and tools to unravel insights that are important and will inform tomorrow’s theorisation and policy making. The volume looks at important questions like spatial concentration of low infant and child health outcomes, trade liberalisation and export quality, intergenerational occupational mobility, multidimensional poverty incidence in rural India, robustness of the banking sector, to name a few. To do so, the contributions use novel and esoteric methods like machine learning, spatial econometrics, system GMM, quintile regression and counterfactual decomposition (QRCD), and so on. The rich collection holds importance for researchers and policy makers alike, and also for practitioners working in different developmental sectors.

Abstract: A unique study of public service evolution in the 15 post-soviet countries from independence to date. It reveals the diversity in their transformation shaped by historical and cultural traditions and the soviet legacy they inherited, as well as by the impact of the political will of ruling elites, all of which influenced the socio-economic and governance models these countries adapted. Its value lays with the fact that it is a collaborative outcome of prominent practitioners, who actively participated in the transformation process, and leading scholars representing all 15 post-soviet countries. It is valuable addition to the body of knowledge of public administration, allowing for improved understanding of the complexity and depth of change that has taken place over the past 30 years. It provides an in-depth analysis of the public service reform process; a subject relevant to the countries of the Region and beyond. Abstract: This is the first book published that focuses on competition law and policy in the Japanese pharmaceutical sector. It consists of chapters written and edited by academics who research the industry from various perspectives, including economics, competition law, pharmaceutical regulations, and intellectual property law. Competition policies involving pharmaceutical products attract attention from academics and policymakers worldwide. The pharmaceutical industry is regulated by drug laws that vary from country to country and are affected by differing practices and industrial structures. The book begins by examining drug regulations and trade practices in the industry that are peculiar to Japan and its healthcare system. It then presents the Japanese Antimonopoly Act and cases involving it, and discussions of current competition law issues in the Japanese pharmaceutical industry. The book also discusses innovation and intellectual property and economic analyses of pharmaceutical regulations and drug discovery. The chapters include comparative studies on Japanese regulations vs. those in the European Union and the United States. Japan is one of the biggest pharmaceutical markets in the world. With this in mind, the book provides “one-stop shopping” for anyone interested in pharmaceutical regulations in the country. Covering the basics but extending to in-depth explorations of complex problems, this book appeals not only to students and academics, pharmaceutical companies and regulators, but also to those dealing with real-world policy issues that encompass competition policy, intellectual property, and pharmaceutical regulation. Abstract: This book reconstructs the philosophical issues informing the debate between the makers of modern India: Ambedkar and Gandhi. At one level, this debate was about a set of different but interconnected issues: caste and social hierarchies, untouchability, Hinduism, conversion, temple entry, and political separatism. The introduction to this book provides a brief overview of the engagements and conflicts in Gandhi and Ambedkar's central arguments. However, at another level, this book argues that the debate can be philosophically re-interpreted as raising their differences on the following issues: The nature of the self, The relationship between the individual self and the community, The appropriate relationship between the constitutive encumbrances of the self and a conception of justice, The relationship between memory, tradition, and self-identity. Ambedkar and Gandhi’s contrary conceptions of the self, history, itihaas, community and justice unpack incommensurable world views. These can be properly articulated only as very different answers to questions about the relationship between the present and the past. This book raises these questions and also establishes the link between the Ambedkar--Gandhi debate in the early 20th century and its re-interpretation as it resonates in the imagination and writing of marginalized social groups in the present times.

Abstract: This book examines interactions and discusses intersectionality between public international law and private international law. With contributions from scholars from USA, Canada, Australia, India and EU, this book brings out truly international perspectives on the topic. The contributions are arranged in four themes—Public international law and private international law: historical and theoretical considerations of the boundary; Harmonisation of private international law by public international law instruments: evaluation of process, problems, and effectiveness; Case studies of intersectionality between public international law and private international law; Future trends in the relationship between public international law and private international law. The ultimate aim of this book is to analyse whether these two legal disciplines become convergent or they are still divergent as usual. With wide coverage spanning across these four themes, the book has takeaways for a wide readership. For scholars and researchers in the fields of public international law and private international law, this book sparks further thoughts and debates in both disciplines and highlight areas for continuing research. For practitioners, this book offers fresh insights and perspectives on contemporaneous issues of significance. This book is also be a great resource for students at both undergraduate and postgraduate levels taking subjects such as public international law or private international law or some related disciplines such as international sale of goods, international trade law or international investment law to advance their knowledge and understanding of the disciplines.

Abstract: This book shows how telecom, broadcast, and Internet researchers as well as experts from Japan's leading mobile operators interpret, analyze, and evaluate the emerging phenomenon of the Japanese broadband ecosystem. The broadband ecosystem, as it rapidly changes against the backdrop of swift technological progress, is forcing major changes in the existing socioeconomic framework and generating many policy issues that require discussion. The book aims to provide a theoretical and practical framework for policymakers to address these issues from a broader perspective than has been available in the past. The topics addressed in this book cover sharing of 5G infrastructure, online platform regulation, diffusion of autonomous driving, content industry, trends and use cases of 5G, capacity development for AI, ride-hailing service, smartphone games, the right to be forgotten, and the economic value of personal information. Although this book cannot provide definitive answers to all these recently emerging and rapidly changing issues, it does provide important guidance for evidence-based discussion involving policymakers and researchers working on these issues. It is also recommended for graduate students who want to enter this challenging field of policy discussion.

Abstract: This book brings together an impressive group of scholars to critically engage with a wide-ranging and broad perspective on the historical and contemporary phenomenon of Zen. The structure of the work is organized to reflect the root and branches of Zen, with the root referring to important episodes in Chan/Zen history within the Asian context, and the branches referring to more recent development in the West. In collating what has transpired in the last several decades of Chan/Zen scholarship, the collection recognizes and honors the scholarly accomplishments and influences of Steven Heine, arguably the most important Zen scholar in the past three decades. As it looks back at the intellectual horizons that this towering figure in Zen/Chan studies has pioneered and developed, it seeks to build on the grounds that were broken and subsequently established by Heine, thereby engendering new works within this enormously important religio-cultural scholarly tradition. This curated Festschrift is a tribute, both retrospective and prospective, acknowledging the foundational work that Heine has forged, and generates research that is both complementary and highly original. This academic ritual of assembling a liber amicorum is based on the presumption that sterling scholarship should be honored by conscientious scholarship. In the festive spirit of a Festschrift, this anthology consists of the resounding voices of Heine and his colleagues. It is an indispensable collection for students and scholars interested in Japanese religion and Chinese culture, and for those researching Zen Buddhist history and philosophy. .

Abstract: This book brings together state-of-the-art advances in intelligent data analytics as driver of the future evolution of PaE systems. In the modern power and energy (PaE) domain, the increasing penetration of renewable energy sources (RES) and the consequent empowerment of consumers as a central and active solution to deal with the generation and development variability are driving the PaE system towards a historic paradigm shift. The small-scale, diversity, and especially the number of new players involved in the PaE system potentiate a significant growth of generated data. Moreover, advances in communication (between IoT devices and M2M: machine to machine, man to machine, etc.) and digitalization hugely increased the volume of data that results from PaE components, installations, and systems operation. This data is becoming more and more important for PaE systems operation, maintenance, planning, and scheduling with relevant impact on all involved entities, from producers, consumer,s and aggregators to market and system operators. However, although the PaE community is fully aware of the intrinsic value of those data, the methods to deal with it still necessitate substantial enhancements, development and research. Intelligent data analytics is thereby playing a fundamental role in this domain, by enabling stakeholders to expand their decision-making method and achieve the awareness on the PaE environment. The editors also included demonstrated codes for presented problems for better understanding for beginners.

Abstract: This book offers an interdisciplinary and dynamic account of the politicization of urban planning in Mumbai, India. It presents a unique perspective on the tensions and conflicts pervading the development and regulation of contemporary cities in the wider context of global urbanization, and broadens readers’ understanding of urban planning, chiefly focusing on the interplay between grassroots movements, experts’ involvement, and sociotechnical questions. As the respective chapters of the book show, the various controversies surrounding the Mumbai Development Plan (MDP) have called into question the social and political effects of reshaping the city, the exclusion, and inequalities it has produced, but also the role it confers on the state and the market, and its impacts on the environment. After carefully describing these controversies, the book tackles the fundamental democratic question of who gets to define the future of a city. Given its scope, the book is of interest to researchers, students, and teachers of city planning, urban development, and urban studies, as well as policymakers.

Abstract: This is the first book that analyzes public–private partnership (PPP) infrastructure development in developing countries by focusing on recent developments in the Philippines. Infrastructure is extremely important for economic development and poverty reduction. However, given the infrastructure gap and pressures on public expenditure, there is a growing expectation that PPP will fill this gap globally. Over the years, PPP as a mechanism for financing and procuring infrastructure has been the basis of an active and provocative debate in the Philippines, which is known to have inadequate infrastructure—twice in the 2010s, when a significant policy shift on the financing source of public infrastructure was announced by the Philippine government. Drastic policy changes concerning the roles of public finance and PPP in infrastructure development within this decade are not seen in other developing countries. There is no precedent for substantial study on the changes of infrastructure governance in the Philippines, but this book assesses policy changes in infrastructure development in the country and, as academic contributions, identifies several factors behind the changes related to infrastructure governance there, especially the drastic shifts during the Aquino III and Duterte administrations. Furthermore, the findings presented in the book, including the desirable role of public finance and PPP in developing infrastructure in developing countries, could improve infrastructure governance, such as choice of the financing mode, design, and implementation of the PPP project, in other developing countries as an operable contribution to policymakers of government and to industry and management practitioners.

Abstract: This book is divided into two parts. One is the state of trade in East Asia before and after the collapse of the tributary system to the Ming Dynasty, and the other is the war of aggression in which Toyotomi Hideyoshi of Japan sent a large number of troops to the Korean Peninsula with a view of conquering China at the end of the sixteenth century. With regard to East Asia in the sixteenth and seventeenth centuries, the contributors in this book share a problem awareness in terms of using trade and war as subjects to clarify multi-ethnic, borderless, and multi-layered situations. Although there are many chapters related to Japan, this book tries to grasp the interaction between Japan as a region of East Asia and neighboring countries from a global perspective, not the one singular national history. Abstract: This book presents the welfare regime of societies of Chinese heritage as a liminal space where religious and state authorities compete with each other for legitimacy. It offers a path-breaking perspective on relations between religion and state in East Asia, presenting how the governments of industrial societies try to harness the human resources of religious associations to assist in the delivery of social services. The book provides background to the intermingling of Buddhism and the state prior to 1949; and the continuation of that intertwinement in Taiwan and in other societies where live many people of Chinese heritage since then. The main contribution of this work is its detailed account of Buddhist philanthropy as viewed from the perspectives of the state, civil society, and Buddhists. This book will appeal to academics in social sciences and humanities and broader audiences interested by the social role of religions, charity, and NGOs, in social policy implementation. It explores why governments turn to Buddhist followers and their leaders and presents a detailed view of Buddhist philanthropy. This book contributes to our understanding of secularity in non-Western societies, as influenced by religions other than Christianity. Abstract: This book develops a discursive ‘equalitarian’ theoretical framework for studying African mining ecosystem issues and policy interventions. The theory of ‘equalitarianism’ is developed as an alternative to the reductionist approach that has dominated post-colonial debates about the classical jus ad bellum requirements to empower women in development spaces. However, the classical approach narrows the debate down to “women issues,” rather than the ‘whole-of-society.’ As a consequence of this reductionism, women continue to be devalued in the mining sector, characterized by poverty traps, power struggles, and a lack of capacity to engage in large-scale mining (LSM) activities. This book advances principles for a holistic approach, and spells out the implications for women across the mining value chain. Drawing on moral scholarship, the book poses that for women to gain access to strategic spaces in the mining sector, the drive for empowerment must be embedded within ‘whole-of-society’ principles. This book is of interest to scholars researching gender policy, public policy, political philosophy, conflictology, and human geography. It also offers practitioners a guide for evaluating their policy work on mainstreaming gender in the mining sector, presenting options for financing, forging partnership and planning for an inclusive economic development in Africa, and beyond. .

Abstract: This Key Code and Handbook examines the corporate governance and accountability of Major Banks, their directors and executives which were the central focus of bank, Supervisor, Regulator and governmental activity and public scrutiny in 2018 and 2019. This book explores this responsibility focus by providing evidence from the Global Financial Crisis and beyond with both APRA and ASIC investigating illegal conduct, misconduct and conduct which was below the level of community expectations. This book discusses how the Royal Commission into misconduct in the banking and financial services industry has already given rise to a detailed Final Report whose recommendations are still being put into effect. Further, this book uses evidence provided by the large number of Prudential Standards issued by APRA and investigations into the conduct of Major Banks by Regulators. This book explores governance variables – over 1,700 in number and grouped into 159 ‘key groupings’ or separate categories – which are all indexed to 28 governmental, regulatory and supervisory reports and documents to create a governance code and commentary specifically tailored to Australian banks. Each governance variable is modelled on the Stage 1 Relational Approach contained in Enhancing Firm Sustainability Through Governance. Given the huge interest in the governance of banks, Parts 1 and 2 – explaining the Relational Approach - of Stage 1 were recently published in November 2018 and June 2019 in the Australian Journal of Corporate Law. This book is the largest reference book and handbook in publication worldwide containing the structures, mechanisms, processes and protocols – the checks and balances we call ‘governance variables’ – that deeply addresses and explains banking accountability and regulation in Australia. .
