    Abstract: The book considers the changes which national sovereignty has undergone through the supranational European integration. In various contributions by renowned academics and high judges demonstrate the serious impacts of supranationality on the EU member states and even on third countries which are connected with the EU by international treaties. It becomes clear that primacy of EU law, the most significant expression of supra-nationality, collides with national sovereignty as anchored in the national constitutions. The studies clearly show that most member states do not fully deny EU law primacy but are aware of the need to find an adequate balance between the supranational and the national orders. The result from the analyses of the authors from various European countries is that the upcoming constitutional paradigm is “constitutional identity”, a concept established by jurisprudence in Germany, France, Czech Republic (without being named so) and debated also in Poland which, herself, denies supranational impact on the national Constitution entirely. Studies on selected EU member states clarify the specific national approaches towards the limitations of their sovereignty as developed by the constitutional jurisprudence (Poland, Czech Republic, Hungary, Romania, Italy, Germany with comparative references to United Kingdom and France). It is illuminated that traditionally strong sovereignty concepts (UK, France) are considerably relativized and functionally opened towards the integration challenges. Basic issues are furthermore reflected, such as the supranational impact on the State’s power to reform its Constitution, the relation of national and constitutional identity and the national and supranational perspectives of identity. The book also includes Europe beyond the EU by research on the supranational character of association treaties (from a Ukrainian perspective) and on the Europeanization of a third country preparing EU membership (Albania).

    Abstract: This book deals with the theoretical, methodological, and empirical implications of bounded rationality in the operation of institutions. It focuses on decisions made under uncertainty, and presents a reliable strategy of knowledge acquisition for the design and implementation of decision-support systems. Based on the distinction between the inner and outer environment of decisions, the book explores both the cognitive mechanisms at work when actors decide, and the institutional mechanisms existing among and within organizations that make decisions fairly predictable. While a great deal of work has been done on how organizations act as patterns of events for (boundedly) rational decisions, less effort has been devoted to study under which circumstances organizations cease to act as such reliable mechanisms. Through an empirical strategy on open-ended response data from a survey among junior judges, the work pursues two main goals. The first one is to explore the limits of “institutional rationality” of the Spanish lower courts on-call service, an optimal scenario to observe decision-making under uncertainty. The second aim is to achieve a better understanding of the kind of uncertainty under which inexperienced decision-makers work. This entails exploring the demands imposed by problems and the knowledge needed to deal with them, making this book also a study on expertise achievement in institutional environments. This book combines standard multivariate statistical methods with machine learning techniques such as multidimensional scaling and topic models, treating text as data. Doing so, the book contributes to the collaboration between empirical social scientific approaches and the community of scientists that provide the set of tools and methods to make sense of the fastest growing resource of our time: data

    Abstract: This book shows six different realities of same-sex families. They range from full recognition of same-sex marriage to full invisibility of gay and lesbian individuals and their families. The broad spectrum of experiences presented in this book share some commonalities: in all of them legal scholars and civil society are moving legal boundaries or thinking of spaces within rigid legal systems for same-sex families to function. In all of them there have been legal claims to recognize the existence of same-sex families. The difference between them lies in the response of courts. Regardless of the type of legal system, when courts have viewed claims of same-sex couples and their families as problems of individual rights, they have responded with a constitutional narrative protecting same-sex couples and their families. When courts respond to these claims with rigid concepts of what a family is and what marriage is as if legal concepts where unmodifiable, same-sex couples have remained outside the protection of the law. Until forty years ago marriage was the only union considered legitimate to form a family. Today more than 30 countries have granted rights to same sex couples, including several that have opened up marriage to couples of the same sex. Every day there is a new bill being discussed or a new claim being brought to courts seeking formal recognition of same sex couples. Not all countries are open to changing their legal structures to accommodate same-sex couples, but even those with no visible changes are witnessing new voices in their communities challenging the status quo and envisioning more flexible legal systems

    Abstract: This volume provides a comprehensive analysis of why taxpayers behave the way they do. It reveals the motivations for why some taxpayers comply with the law while others choose not to comply. Given the current global financial climate there is a need for governments worldwide to increase their revenue collections via improving taxpayer compliance. Research into what shapes and influences taxpayer behavior is critical in that any marginal improvement in understanding and dealing with this behavior can potentially have a dramatic impact upon government revenue. Based on Australian data derived from the data bases of the Australian Taxation Office as an example, this book presents findings that provide lessons for tax systems around the world. Regardless of the type of tax system in place, taxpayers of all nationalities are concerned about how their tax authorities deal with non-compliance and in particular how the tax authorities go about encouraging compliance and ensuring a fair tax system for all. The book presents empirical evidence concerning taxpayer compliance behavior with particular attention being drawn to the moral values of taxpayers, the perceived fairness of the tax system and the deterrent measures undertaken by revenue authorities which influence that behavior. Other issues examined include the degree to which tax penalties operate as an effective deterrent to curbing behavior and how taxpayers' level of general tax knowledge and awareness also impacts upon their actions

    Abstract: A revised survey of Rembrandt’s complete painted oeuvre. The question of which 17th-century paintings in Rembrandt’s style were actually painted by Rembrandt himself had already become an issue during his lifetime. It is an issue that is still hotly disputed among art historians today. The problem arose because Rembrandt had numerous pupils who learned the art of painting by imitating their master or by assisting him with his work as a portrait painter. He also left pieces unfinished, to be completed by others. The question is how to determine which works were from Rembrandt’s own hand. Can we, for example, define the criteria of quality that would allow us to distinguish the master’s work from that of his followers? Do we yet have methods of investigation that would deliver objective evidence of authenticity? To what extent do research techniques used in the physical sciences help? Or are we, after all, still dependent on the subjective, expert eye of the connoisseur? The book provides answers to these questions. Prof. Ernst van de Wetering, the author of our forthcoming book which deals with these questions, has been closely involved in all aspects of this research since 1968, the year the renowned Rembrandt Research Project (RRP) was founded. In particular, he played an important role in developing new criteria for authentication. Van de Wetering was also witness to the way the often overly zealous tendency to doubt the authenticity of Rembrandt’s paintings got out of hand. In this book he re-attributes to the master a substantial number of unjustly rejected Rembrandts. He also was closely involved in the (re)discovery of a considerable number of lost or completely unknown works by Rembrandt. The verdicts of earlier specialists - including the majority of members of the original RRP (up to 1989) - were based on connoisseurship: the self-confidence in one’s ability to recognise a specific artist’s style and ‘hand’. Over the years, Van de Wetering has carried out seminal research into 17th-century studio practice and ideas about art current in Rembrandt’s time. In this book he demonstrates the fallibility of traditional connoisseurship, especially in the case of Rembrandt, who was par excellence a searching artist.     Abstract: Global Perspectives on Subsidiarity is the first book of its kind exclusively devoted to the principle of subsidiarity. It sheds new light on the principle and explores and develops the many applications of the principle of subsidiarity. The book provides a comprehensive overview of the principle in all its facets, from its philosophical origins in the writings of Aristotle and Aquinas, to its development in Catholic social doctrine, and its emergence as a key principle in European Union Law. This book explores the relationship between subsidiarity and concepts such as sphere sovereignty and social pluralism. It analyses subsidiarity in light of globalisation, federalism, democracy, individual rights and welfare, and discusses subsidiarity and the Australian, Brazilian and German Constitutions.

    Abstract: This volume contributes to the on-going legal discussion on pressing procedural and substantial law issues in the ambit of international human rights and civil liberties. While the 20th century has seen the true awakening of human rights, the 21st century poses new challenges to this ever-unfolding area of law.     Abstract: This book revises the picture of the teacher and educator of princes, Vittorino Rambaldoni da Feltre (c. 1378, Feltre -- 1446, Mantua), taking a completely new approach to show his work and life from the individual perspectives created by his students and contemporaries. From 1423 to 1446, Vittorino da Feltre was in charge of a school in Mantua, where his students included not only the offspring of Italy’s princes, but also the first generation of authors dealing with books in print. Among his students were historians like Bartolomeo Sacchi (named Platina), who wrote an extensive history of the popes, and mathematicians like Jacopo Cassiano (Cremonensis), who translated the work of Archimedes from Greek into Latin. Vittorino is still regarded as the educationalist of Italian Renaissance humanism per sé. This work not only contributes to the study of the history of Italian humanist institutions, it also uses available sources to demonstrate the development of a new attitude to education in Italy

    Abstract: This volume addresses the role of the judge and the parties in civil litigation in mainland China, Hong Kong and various European jurisdictions. It provides an overview and an analysis of how these respective roles have been changed in order to cope with growing caseloads and quality demands. It also shows the different approaches chosen in the jurisdictions covered. Mainland China is introducing far-reaching reforms in its system of civil litigation. From an inquisitorial procedure, in which the parties play a relatively minor role, the country is changing to a more adversarial system with increased powers for the parties. At the same time, case management and the role of the judge as it is understood in mainland China remains different from case management and the role of the judge in Western countries, mainly as regards the limited powers of individual Chinese judges in this respect. Changes in China are justified by the ever-increasing case load of the Chinese courts and the consequent inability to deal with cases in an adequate manner, even though generally speaking Chinese courts still adjudicate civil cases within a relatively short time frame (this may, however, be problematic when viewed from the perspective of the quality of adjudication). Growing caseloads and quality concerns may also be observed in various European states and Hong Kong. In these jurisdictions the civil procedural systems have a relatively adversarial character and it is some of the adversarial features of the existing systems of procedure which are felt to be problematic. Therefore, the lawmakers have opted for increasing the powers of the judge, often making the judge and the parties mutually responsible for the proper conduct of civil cases. Starting from opposite directions, mainland China and the various European states and Hong Kong could meet half way in their reform attempts. This is, however, only possible if a proper understanding is fostered of the developments in these different parts of the World. Even though in both China and Europe the academic community and lawmakers are showing a keen interest in the relevant developments abroad, a study addressing the role of the judge and the parties in civil litigation in both China and Europe is still missing.     Abstract: This book deals with medieval Jewish authors who wrote in Arabic, such as Moses Maimonides, Judah Halevi, and Solomon Ibn Gabirol, as well as the Hebrew translations and commentaries of Judaeo-Arabic philosophy. It brings up to date a part of Moritz Steinschneider’s monumental Die Hebraeischen Übersetzungen des Mittelalters und die Juden als Dolmetscher (The Hebrew Translations of the Middle Ages and the Jews as Interpreters), which was first published in 1893 and remains to this day the authoritative account of the transmission and development of Arabic and Latin, and, by way of those languages, Greek culture to medieval and renaissance Jews. In the work presented here, Steinschneider’s bibliography has been updated, some of his scholarly judgments have been judiciously revised and an exhaustive listing of pertinent Hebrew manuscripts and their whereabouts has been provided.     Abstract: This book discusses all critical privacy and data protection aspects of biometric systems from a legal perspective. It contains a systematic and complete analysis of the many issues raised by these systems based on examples worldwide and provides several recommendations for a transnational regulatory framework. An appropriate legal framework is in most countries not yet in place. Biometric systems use facial images, fingerprints, iris and/or voice in an automated way to identify or to verify (identity) claims of persons. The treatise which has an interdisciplinary approach starts with explaining the functioning of biometric systems in general terms for non-specialists. It continues with a description of the legal nature of biometric data and makes a comparison with DNA and biological material and the regulation thereof. After describing the risks, the work further reviews the opinions of data protection authorities in relation to biometric systems and current and future (EU) law. A detailed legal comparative analysis is made of the situation in Belgium, France and the Netherlands. The author concludes with an evaluation of the proportionality principle and the application of data protection law to biometric data processing operations, mainly in the private sector. Pleading for more safeguards in legislation, the author makes several suggestions for a regulatory framework aiming at reducing the risks of biometric systems. They include limitations to the collection and storage of biometric data as well as technical measures, which could influence the proportionality of the processing. The text is supported by several figures and tables providing a summary of particular points of the discussion. The book also uses the 2012 biometric vocabulary adopted by ISO and contains an extensive bibliography and literature sources

    Abstract: This book is a critical edition of John Bale's The Image of Both Churches (c. 1545). The Introduction provides a thorough overview of this sixteenth century work, explaining its relationship to the apocalyptic tradition and to Bale's important inspirations, from Augustine to Erasmus and Luther. Topics such as Bale's language, the place of the Image in his oeuvre, his use of medieval chronicles, and the influence of his exegesis are also discussed. The Image has often been called Bale's most important work; it articulated and developed the English Protestant view of the Apocalypse, influencing other Reformers both in England and on the continent. This book offers the first critical edition of the Image, including fully modernized spelling and punctuation as well as extensive explanatory notes. The five sixteenth-century printed editions of the Image are collated here, with textual notes that illustrate the relationship between variant readings and provide information on the choices made in this particular edition. This book also reproduces the striking woodcut illustrations from the Image in their original placements; examples from two different woodcut series are offered, as well as an overview of the history and importance of these images in the early printed texts. Five appendices, including a glossary of unfamiliar terms and a chart outlining Bale's periodization of history, also provide a wealth of information that enables readers to understand and use this edition. The largest appendix, on historical names and terminology, gives biographical information for 450 individuals and explains their importance, both to Bale and to the sixteenth-century Reformers in a broader context. This critical edition of the Image offers the most thorough study of the work to date, opening up the opportunity for a deeper understanding of this monumental text and for many further avenues of research

    Abstract: This volume deals with the so-called new Information and Communication Technologies (ICT) and their interrelationship with Muslims and the interpretation of Islam. This volume taps into what has been labelled Media Studies 2.0, which has been characterized by an intensified focus on everyday meanings and ‘lay’ users - in contrast to earlier emphases on experts or self-acclaimed experts. This lay adoption of ICT and the subsequent digital ‘literacy’ is not least noticeable among Muslim communities. According to some global estimates, one in ten internet users is a Muslim. This volume offers an ethnography of ICT in Muslim communities. The contributors to this volume also demonstrate a new kind of moderation with regard to more sweeping and avant-gardistic claims, which have characterized the study of ICT previously. This moderation has been combined with a keen attention to the empirical material but also deliberations on new quantitative and qualitative approaches to ICT, Muslims and Islam, for instance the digital challenges and changes wrought on the Qur’an, Islam’s sacred scripture. As such this volume will also be relevant for people interested in the study of ICT and the blooming field of digital humanities. Scholars of Islam and the Islamic world have always be engaged and entangled in their object of study. The developments within ICT have also affected how scholars take part in and influence public Islamic and academic discussions. This complicated issue provides basis for a number of meta-reflexive studies in this volume.     Abstract: The terrorist attacks occurred in the United States on 11 September 2001 have profoundly altered and reshaped the priorities of criminal justice systems around the world. Atrocities like the 9/11 attacks, the Madrid train bombings of March 2003, and the terrorist act to the United Kingdom of July 2005 threatened the life of democratic nations. The volume explores the response of democratic nation-states to the problems of terrorism and counter-terrorism within the framework of the Rule of Law. One of the primary subjects of study is the ways in which the interests of the state (security from external threats, the maintenance of civil peace, and the promotion of the commonwealth) are balanced or not with the liberty and freedom of the citizens of the state. The distinctive aspect of this focus is that it brings a historical, political, philosophical and comparative approach to the contemporary shape and purposes of the criminal justice systems around the world.

    Abstract: The capability approach of Martha Nussbaum and Amartya Sen places human capabilities at the centre stage of discussions about justice, equality, development and the quality of life. It rejects too much emphasis on mere preference satisfaction or resource provision and highlights the importance of human agency and freedom. This approach has already significantly influenced different fields of application, such as economics and development studies. Only recently have scholars started to explore its relevance for and application to the area of technology and design, which can be crucial factors in the expansion of human capabilities. How does technology influence human capabilities? What difference could a capability approach make to policies and practices of applying ICT in development processes in the South? How can we criticize and improve the design of technology from the perspective of the capability approach? The authors of this volume explore the implications of the capability approach for technology design and together create the first volume on this emerging topic. Ilse Oosterlaken is one of the pioneering authors in the area of the capability approach, technology and design. She is co-founder of a thematic group on this topic within the Human Development Capability Association (HDCA) and organizer of the very successful 2011 HDCA conference, with 'innovation' as its theme. Recently she was co-guest-editor of a special issue of Ethics and Information Technology on the capability approach. Jeroen van den Hoven is scientific director of the 3TU.Centre for Ethics and Technology and full professor in moral philosophy at TU Delft, specializing in the ethics of information technology. He is editor-in-chief of the journal Ethics and Information Technology. He is project leader of an NWO-funded multidisciplinary research project 'Technology for Development - A Capability Approach', in which co-editor Ilse Oosterlaken also works as one of the researchers.

    Abstract: This monograph addresses the legal and policy issues relating to the commercial exploitation of natural resources in outer space. It begins by establishing the economic necessity and technical feasibility of space mining today, an estimate of the financial commitments required, followed by a risk analysis of a commercial mining venture in space, identifying the economic and legal risks. This leads to the recognition that the legal risks must be minimised to enable such projects to be financed. This is followed by a discussion of the principles of international space law, particularly dealing with state responsibility and international liability, as well as some of the issues arising from space mining activities. Much detail is devoted to the analysis of the content of the common heritage of mankind doctrine. The monograph then attempts to balance such interests in creating a legal and policy compromise to create a new regulatory regime.

    Abstract: Community-based enterprises are the result of a process in which the community acts entrepreneurially to create and operate a new enterprise embedded in its existing social structure and network. This book argues that community-based enterprise could represent a strategy for fostering sustainable local development while at the same time maintaining traditional knowledge in ethnomedicine and conserving the local ecosystems. The overall purpose of this monographic study is to investigate a new entrepreneurial approach which offers an alternative to the mainstream one and to analyze its possible contribution at the grassroots level in the herbal sector, a domain where local communities still play to a large extent a marginalised role. This innovative approach is represented by community-based enterprises (CBEs) active in India. The study of indigenous populations and their different forms of entrepreneurships is not simply an exercise in analysing outliers in the global world-system. Rather, it provides a source for the theoretical and empirical analysis of entrepreneurship relevant to the development of generalisable theory applicable in many environments including, but by no means exclusive to, indigenous communities. This volume analyses the very first community-based enterprise active in the herbal sector in India, the GMCL (Gram Mooligai Company Limited). It demonstrates that the GMCL example provides a unique model of how a community-based enterprise could represent an alternative and promising model for development of local communities. It is an unconventional form of entrepreneurship, in that it is based on regarding collective and individual interests as fundamentally complementary, and views communal values and the notion of the common good as essential elements in venture creation

    Abstract: This is the fifth volume of A CORPUS OF REMBRANDT PAINTINGS, which will consist of six volumes in total. The CORPUS is dedicated to the painted works of Rembrandt.     Abstract: Scientia is the term that early modern philosophers applied to a certain kind of demonstrative knowledge, the kind whose starting points were appropriate first principles. In pre-modern philosophy, too, scientia was the name for demonstrative knowledge from first principles. But pre-modern and early modern conceptions differ systematically from one another. This book offers a variety of glimpses of this difference by exploring the works of individual philosophers as well as philosophical movements and groupings of the period. Some of the figures are transitional, falling neatly on neither side of the allegiances usually marked by the scholastic/modern distinction. Among the philosophers whose views on scientia are surveyed are Hobbes, Descartes, Spinoza, Gassendi, Locke, and Jungius. The contributors are among the best-known and most influential historians of early modern philosophy.

The author goes further to suggest that similar systems can be detected across cultures, while each world remains colored by a distinctive soundscape.Mans also looks at the way each cultural soundscape is a symbolic manifestation of a society's collective cognition, sorting musical behavior and sounds into clusters and patterns that fulfill each society's requirements. She probes the fact that in today's globalized and mobile world, as people move from one society to another, cross-cultural acts and hybrids result in a number of new aesthetics.Finally, in addition to three personal narratives by musicians from different continents, the author has invited scholars from diverse specializations and locations to comment on different sections of the book, opening up a critical dialogue with voices from different parts of the globe. The volume also discusses some ""philosophers of law"" who are not philosophers in a broader sense, but who cannot be omitted because certain far greater ""real"" philosophers would then become unintelligible.     Abstract: Phenomenology and existentialism transformed understanding and experience of the Twentieth Century to their core. They had strikingly different inspirations and yet the two waves of thought became merged as both movements flourished. The present collection of research devoted to these movements and their unfolding interaction is now especially revealing. The studies in this first volume to be followed by two succeeding ones, range from the predecessors of existentialism - Kierkegaard/Jean Wahl, Nietzsche, to the work of its adherents - Shestov, Berdyaev, Unamuno, Blondel, Blumenberg, Heidegger and Mamardashvili, Dufrenne and Merleau-Ponty to existentialism's congruence with Christianity or with atheism. Among the leading Husserlian insights are treated essence and experience, the place of questioning, ethics and intentionality, temporality and passivity and the life world. The following book will uncover the perennial concerns guiding the wondrous interplay of these two inspirational sources.

    Abstract: In this book the editors brought together outstanding articles concerning intercultural aesthetics. The concept 'Intercultural aesthetics' creates a home space for an artistic cross-fertilization between cultures, and for heterogeneity, but it is also firmly linked with the intercultural turn within Western and non-Western philosophy. The book is divided into two parts, yet one can sense a clear unity throughout the whole book. This unity is related to the underlying subject that the different authors, each in their own way and from their own background, try to reveal. They use related, and overlapping terms such as 'the suchness of things', 'dancing and shaping lives', 'presenting a meaning beyond words, presenting the unpresentable, experiencing', in order to bring to our awareness the genuine importance of the non-conceptual, next to the conceptual. Several authors moreover take on a reflective, and at times even a self-reflective stance, pointing to the intrinsic relation between cultural aesthetics and ethics, making this book unique in its kind.

The book summarizes Hägerström's main arguments while enabling further critical assessment, and tries to answer such questions as: If norms are neither true nor false, how can they be adequately understood on the basis of Hägerström's theory of knowledge? Did the founder of the Uppsala school uphold emotivism in moral philosophy? What consequences does such a standpoint have in practical philosophy? Is he really the inspiration behind Scandinavian state absolutism?A Real Mind places the complex web of issues addressed by Hägerström within the broader context of 20th century philosophy, stretching from epistemology to ethics. His philosophy of law is examined in the core chapters of the book, with emphasis on the will-theory and the relation between law and power.     Abstract: During the last decades, legal theory has focused almost completely on norms, rules and arguments as the constitutive elements of law. Concepts were mostly neglected. The contributions to this volume try to remedy this neglect by elucidating the role concepts play in law from different perspectives. A main aim of this volume is to initiate a debate about concepts in law. Åke Frändberg gives an overview of the many different uses of concepts in law and shows amongst others that concepts in the law should not be confused with the role of concepts in descriptions of the law. Dietmar von der Pfordten criticizes the restriction to norms as parts of the law in contemporary legal theory by questioning what concepts are and what their function is, both in general and in legal conceptual schemes. Giovanni Sartor assumes the inferential analysis of meaning proposed by Alf Ross in his ground breaking paper Tû-tû and addresses the question how possession of a concept, including the rules defining it, is possible without endorsing these rules. Jaap Hage argues that 1. legal status words such as 'owner' have a meaning because they denote things or relations in institutional reality, 2. the meaning of these words consists in this denotation relation, 3. knowledge of this meaning presupposes knowledge of the rules governing these words. Torben Spaak contributes to this volume with an exemplary analysis of one of the most central concepts of the law, namely that of a legal power. Lorenz Kähler discusses the role of concepts in determining the scope of application of legal rules and raises from this perspective the question to what extent legal concept formation can be arbitrary. Ralf Poscher argues that as soon as a concept is used in stating the law, the precise scope of application of this concept has become a legal matter.

    Abstract: Incidents of bioterrorism and biowarfare are likely to recur, leading to increased public concern and government action. The deficiencies of the Biological and Toxin Weapons Convention (BTWC) are in urgent need of attention: the BTWC is the central international agreement to prevent the proliferation of biological warfare programmes. Uniquely, this book is written by diplomats involved in the decade-long effort (1991-2001) in which State Parties to the BTWC tried to agree a Protocol to the Convention with legally binding measures to strengthen its effectiveness, and academics concerned with the negotiations. Just before negotiations foundered, when the Chairman's proposed text was virtually complete, the problems and proposed solutions were examined thoroughly, leading to this book. The book is wide-ranging in its review of the history of biological warfare, the reasons why the current biological revolution is of such concern, and the main features of the BTWC itself. The core of the book examines the key elements of the proposed protocol - declarations, visits, challenge-type investigations, and enhanced international cooperation - and the implications for government, industry and biodefence, giving us all a better understanding of what still remains to be done to avert a biowarfare catastrophe.

    Abstract: Philosophy of Religion for a New Century represents the work of nineteen scholars presented at a conference in honor of Eugene T. Long at the University of South Carolina, April 5-6, 2002. This volume is a good example of philosophy in dialogue; there is both respect and genuine disagreement. First, an account of our present situation in the Philosophy of Religion is given, leading to a discussion of the very idea of a 'Christian Philosophy' and the coherence of the traditional concept of God. The implications of science and a concern for the environment in our concepts of God are carefully examined. A discussion follows on the possibility of speech about God and silence about God. Since much of modern European philosophy is concerned with the `Death of God' theme, the positions of Nietzsche and some of his twentieth-century interpreters are presented. There are presentations on Feminist Approaches to Philosophy of Religion, and Comparative Religion is examined in relation to cultures and the demands of rationality. The volume concludes with a critical dialogue on the relation of Religious Discourse to the Public Sphere. Developing global awareness has led to significant change in the Philosophy of Religion. One-dimensional approaches have given way to honest dialogue. The traditional boundaries between the secular and the religious have shifted, and new approaches to traditional problems are required. This volume presents examples of these new approaches.

    Abstract: Bioethicists, moral philosophers and social policy analysts have long debated about how we should decide who shall be saved with scarce, lifesaving resources when not all can be saved. It is often claimed that it is fairer to save younger persons and that age is an ethically relevant consideration in such tragic decisions. Medical benefit should be maximized and final selection should aim to minimize the contaminating influence of chance. These claims are challenged by Duff R. Waring in Medical Benefit and the Human Lottery, one of the few books that attempts a sustained defence of random patient selection. This book combines ethics and political philosophy in its novel and strict egalitarian approach to patient selection for transplantable organs. Waring addresses the question of whether we should choose between lives on the basis of fair chances or best outcomes. He argues that final selection criteria should be based on fair chances that equalize opportunity as opposed to best outcomes. His defence of "hardy" egalitarianism aims to show that random selection by lottery can affirm both a common humanity and the equal value of lives. The notion of patient selection by lottery has not fared well in bioethics and has been regarded by some as a moral affront. Waring argues that a human selection lottery may be neither as crude nor as ethically anomalous as some have supposed. Indeed, it can reflect a familiar conception of equality as a political and moral ideal. This conception abstracts from many undeniable differences between patients and claims that scarce resources should be allocated on the principled assumption that each of their lives is equally worth saving. The book is also notable for its critiques of some recent utilitarian notions of medical benefit which can have an age-biased impact on elderly patients. Waring then argues against the leading, contemporary age-based approaches to patient selection. He explores the way random selection by lottery can affirm his egalitarian ethos in cases where eligible transplant candidates have each passed a threshold level of prospective medical benefit that has been set by democratic deliberation. Taming chance with a human lottery is defended as the most lucid means of ensuring equal opportunity. In so doing, Waring argues that we give the principle of equal concern and respect a radical expression: above a noncomparative threshold of medical benefit, each candidate can have an equal claim to life.

    Abstract: Are Western epistemology, metaphysics, methodology and the philosophy of science grounded only in men's distinctive understandings of themselves, others, and nature? Does this less than human understanding distort our models of reason and of scientific inquiry?     Abstract: Research records composed of notes and protocols have long played a role in the efforts to understand the origins of what have come to be seen as the established milestones in the development of modern science. The use of research records to probe the nature of scientific investigation itself however is a recent development in the history of science. With Eduard Dijksterhuis, we could address them as a veritable "epistemologiCal laboratory". The purpose of a workshop entitled "Reworking the Bench: Laboratory Notebooks in the History of Science", held at the Max Planck Institute for the History of Science in Berlin was to bring together historians who have been exploiting such resources, to compare the similarities and differences in the materials they had used and and to measure the potential and scope for future explorations of "science in the making" based on such forms of documentation. The contributions which form this volume are based on papers presented at this workshop or written afterward by participants in the discussions. This is the first book that addresses the issue of research notes for writing history of science in a comprehensive manner. Its case studies range from the early modern period to present and cover a broad range of different disciplines.

The essays address the connections between medicine and culture and relate the medical practices to the cultures which produced them.     Abstract: Toward an Anthropology of Graphing: Semiotic and Activity-Theoretic Perspectives presents the results of several studies involving scientists and technicians. In Part One of the book, "Graphing in Captivity", the author describes and analyses the interpretation scientists volunteered given graphs that had been culled from an introductory course and textbook in ecology. Surprisingly, the scientists were not the experts that the author expected them to be on the basis of the existing expert-novice literature. The section ends with the analysis of graphs that the scientists had culled from their own work. Here, they articulated a tremendous amount of background understanding before talking about the content of their graphs. In Part Two, "Graphing in the Wild", the author reports on graph usage in three different workplaces based on his ethnographic research among scientists and technicians. Based on these data, the author concludes that graphs and graphing are meaningful to the extent that they are deeply embedded in and connected to the familiarity with the workplace

    Abstract: The ability to shape one's own destiny-to make decisions on the basis of one's own ideals and goals-is a uniquely human characteristic. It is shared by the groups that human beings fonn-peoples, nations, and other communities--each bound by a common destiny. The very existence of different individuals and groups that have this characteristic virtually guarantees that there will be conflicts among them. And yet it is also human to want to find common ground with others. When individuals or groups emphasize their differences, the result is conflict; when they find common ground, cooperation becomes possible. However, even when it appears that cooperative efforts have resolved the sources of conflict, not all conflict will disappear. Conflict is a natural part of all human interaction. Both conflict and cooperation exist simultaneously. All social phenomena can ultimately be reduced to the question of how these two human characteristics are reconciled and allowed to coexist on the same plane.

    Abstract: This book is a historical-epistemological study of one the most consequential idea of early modern celestial mechanics: Robert Hooke's proposal to "compoun[d] the celestial motions of the planets of a direct motion by the tangent & an attractive motion towards a central body," a proposal which Isaac Newton adopted and realized in his Principia. Hooke's Programme was revolutionary both cosmologically and mathematically. It presented "the celestial motions," the proverbial symbol of stability and immutability, as a process of continuous change, and prescribed only parameters of rectilinear motions and rectilinear attractions for calculating their closed curved orbits. Yet the traces of Hooke's construction of his Programme for the heavens lead through his investigations in such earthly disciplines as microscopy, practical optics and horology, and the mathematical tools developed by Newton to accomplish it appear no less local and goal-oriented than Hooke's lenses and springs. This transgression of the boundaries between the theoretical, experimental and technological realms is reminiscent of Hooke's own free excursions in and out of the circles occupied by gentlemen-philosophers, university mathematicians, instrument makers, technicians and servants. It presents an opportunity to examine the social and epistemological distinctions, relations and hierarchies between those realms and their inhabitants, and compels a critical assessment of the philosophical categories they embody

    Abstract: The focus of this volume, the Proto-Scientific Revolution, is that distinctive period, essentially High Renaissance in character, which paved the way for the Scientific Revolution of the seventeenth century. A complexity, however, is the fact that this care is divided amongst a range of professions. This book addresses issues of meaning (meaning of care and meaning of life) from all the different professional perspectives involved.
