    Abstract: The digitalization of work processes and the generalization of IT are creating unprecedented opportunities. An increasing part of the workforce is experimenting with new forms of work, as freelancers, self-employed or highly skilled employees with greater autonomy. International in scope, this book comprehensively explores these new models of work, mobility and life trajectories, and the increasing role of non-metropolitan coworking spaces. This interdisciplinary book investigates new trends in relationships between work, life plans, work-life balance, and mobility in the context of ongoing societal digitalization. An expert group of contributors adopts a comparative approach in assessing the coworking phenomenon.     Abstract: Internationale Geldgeber haben die Finanzierung für den Schutz tropischer Wälder erhöht, um der globalen Herausforderung von Klima, Biodiversität und Nachhaltigkeit zu begegnen. Allerdings fehlen subnationale Informationen darüber, wo und wie die Gelder verteilt werden, welche Faktoren die Finanzierung beeinflussen und wie sie mit der Dynamik der Wälder und geschützten Gebiete korrelieren. Diese Thesis beabsichtigt, diese Fragen zu beantworten, indem sie sich mit drei Jahrzehnten internationaler Naturschutzfinanzierung in den Hauptabholzungsgebieten Südamerikas auseinandersetzt. Mithilfe gemischter Methoden habe ich die Interessen der Geldgeber thematisch und geografisch kartiert, räumliche Determinanten der Mittelvergabe identifiziert und Schwankungen der Finanzierung über Standorte und Zeit hinweg mit der Dynamik der Waldbedeckung und geschützten Gebiete verknüpft. Die Ergebnisse zeigten, dass die internationale Naturschutzfinanzierung eine Mischung aus global relevanten Interessen und bilateralen Interessen darstellt, ermöglicht durch sozioökonomische und biophysikalische Verbindungen zwischen den spendenden und empfangenden Regionen. Trockenwaldökosysteme mit hoher Abholzungsrate waren besonders unterfinanziert und gefährdeten die Ökosysteme, Arten und die lokale Bevölkerung. Die Verknüpfung von Schutzgebieten und Finanzierung mit dem Konzept der Landnutzungsdynamik enthüllte weitere Nuancen und half, kontextspezifische Empfehlungen zu identifizieren. Diese Studie präsentierte die erste subnationale Analyse der internationalen Naturschutzfinanzierung auf kontinentaler Ebene, zeigte Übereinstimmungen und Diskrepanzen zwischen den zugeteilten Ressourcen und den Naturschutzbedürfnissen und beleuchtete die komplexe und dynamische Landschaft der Finanzierungsmöglichkeiten, mit der andere Akteure umgehen müssen.
    Abstract: International donors have increased funding for tropical forest conservation to address the global challenge of climate, biodiversity, and sustainability. However, subnational information on where and how funds are allocated, factors influencing funding, and its correlation with forest dynamics and protected areas is lacking. This thesis aims to answer these questions by delving into three decades of international conservation funding in South America’s major deforestation areas. Using mixed methods, I mapped donor interests thematically and geographically, identify spatial determinants of funding allocation, and link funding variations across locations and time with forest cover and protected areas dynamics. Results found that international conservation funding carried a mix of globally relevant interests and bilateral interests enabled by socio-economic and biophysical connections between the donating and receiving regions. Dry forest ecoregions with high deforestation rates have been particularly underfunded, threatening the ecosystems, species, and local people depending on them. Dedicated global biodiversity fund, raising attention to drier ecosystems, targeting highly threatened areas, and making funding more accessible to local actors for local conservation needs, may help address the gap. This study presented the first subnational level analysis of international conservation funding at the continental scale, revealed the matches and mismatches between the allocated resources and the conservation needs, and shed light on the complex and dynamic landscape of funding opportunities that other actors need to navigate in.

    Abstract: Der erste Teil dieser Arbeit konzentriert sich auf die systematische Synthese von Informationen über Anpassung, Anpassungsstrategien, Einschränkungen und Grenzen auf globaler Ebene durch die Aufarbeitung der wissenschaftlichen Literatur und mit Hilfe von Techniken des maschinellen Lernens. In einem zweiten Schritt werden mittels einer Online-Umfrage und halbstrukturierter Interviews die Wahrnehmungen von Einschränkungen der Anpassungsmöglichkeiten in den kleinen Inselstaaten der Karibik bewertet, wobei der Schwerpunkt auf den Wechselwirkungen zwischen verschiedenen Arten von Einschränkungen und dem erheblichen Einfluss der fehlenden Anpassungsfinanzierung liegt. Schließlich wird ein zukunftsorientierter Ansatz verfolgt, bei dem Bottom-up- und Top-down-Daten kombiniert werden, um zu veranschaulichen, wie sich sozioökonomische Dimensionen im Zusammenhang mit Einschränkungen bis zum Jahr 2100 unter verschiedenen Szenarien der künftigen sozialen und wirtschaftlichen Entwicklungen entfalten könnten. Die Ergebnisse zeigen, dass die Anpassung derzeit schrittweise und weitgehend fragmentiert erfolgt. Die Erkenntnisse über die Anpassungspolitik nehmen rasch zu, aber es bestehen weiterhin geografische Ungleichheiten. Finanzen und Regierungsführung sind weltweit die größten Einschränkungen, wobei die kleinen Inselstaaten sowie Mittel- und Südamerika die meisten Einschränkungen und Grenzen melden. Die Wechselwirkungen zwischen den Einschränkungen können zu Grenzen und zusätzlichen Verlusten und Schäden führen. Dies unterstreicht die Notwendigkeit, die Einschränkungen parallel anzugehen und eine nachhaltige und gezielte Anpassungsfinanzierung zu gewährleisten. Mögliche Szenarien für die künftige Entwicklung zeigen, dass selbst in den optimistischsten Szenarien sozioökonomische Schlüsseldimensionen wie schwache Regierungsführung die Anpassung bis weit in die zweite Hälfte des 21. Jahrhunderts hinein erschweren werden.
    Abstract: The first part of this thesis focuses on systematically synthesising information on adaptation, adaptation policies, constraints and limits on the global level by reviewing scientific literature and with the support of machine learning techniques. Secondly, through an online-survey and semi-structured interviews, perceptions of constraints in Caribbean Small Island Developing States are assessed, by focusing on the interactions between different types of constraints and the significant influence of the lack of adaptation finance. Finally, a forward-looking approach combining bottom-up and top-down data is taken to illustrate how socio-economic dimensions related to constraints could evolve by 2100, under various scenarios of future development. The results show that adaptation is currently incremental and largely fragmented. Evidence on adaptation policy is rapidly growing but geographic inequalities persist. There is negligible data on adaptation reducing climate change risks. Finance and governance are found to be the most prominent constraints globally, with Small Island Developing States and Central and South America reporting most constraints and limits. Indeed, Caribbean Small Island Developing States face large financial constraints which in turn closely interact with governance, human capacity and information constraints and result in vicious circles. Interactions between constraints can lead to limits and additional losses and damages. This highlights the need to address constraints in parallel and for sustained and dedicated adaptation finance. Potential scenarios of future development show that, even under the most optimistic scenarios, key socio-economic dimensions such as weak governance will challenge adaptation well into the second half of the 21st century. The persistence of constraints, in particular in the most vulnerable regions, calls for stringent mitigation, improved adaptation and increased efforts to address losses and damages.

    Abstract: This book offers a comprehensive analysis of the legal questions that arise for the legislative branch when implementing the crime of aggression into domestic law. Despite being the “supreme international crime” that gave birth to international criminal law in Nuremberg, its ICC Statute definition has been incorporated into domestic law by fewer than 20 States. The crime of aggression was also omitted in the rich debate held among German scholars in the early 2000s regarding the legislative implementation of other ICC Statute crimes. The current inability of the International Criminal Court to respond to the Russian aggression towards Ukraine invites the continuation of these academic debates without neglecting the particularities of the crime of aggression. The fundamental issues discussed in this volume include the obligation to criminalize aggression, the core wrong of the crime, the normative gaps under domestic law and the jurisdictional gaps under the ICC Statute. To facilitate the operationalization of domestic implementation, the book explores the technical options for incorporating the definition into domestic law, the geographical ambit of domestic jurisdiction—most notably universal jurisdiction—as well as legal challenges such as immunities. The book is aimed primarily at researchers and States with an interest in the domestic implementation of international criminal law but those already working in the field should also find much of interest contained within it. Dr. Annegret Hartig is Program Director of the Global Institute for the Prevention of Aggression and worked as a researcher at the University of Hamburg where she obtained her doctoral degree in international criminal law.

    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.     Abstract: Räume und Städte sind gesellschaftlich produzierte Verhältnisse. Nur wie lassen sich diese Verhältnisse erkennen, verstehen und erklären? Die Einzelbeiträge reflektieren jeweils die Entstehungskontexte, Kernargumentationen, empirischen Verwendungsmöglichkeiten sowie die transformatorische Bedeutung der diskutierten Theorien und Konzepte. Der Band fasst die derzeitige Debatten und die mit ihnen zusammenhängenden Fragestellungen zusammen und stellt Grundthemen und Analysebereiche der Ansätze heraus.     Abstract: The rule of law in cyberspace currently faces serious challenges. From the democratic system to the exercise of fundamental rights, the Internet has raised a host of new issues for classic legal institutions. This book provides a valuable contribution to the fields of international, constitutional and administrative law scholarship as the three interact in cyberspace. The respective chapters cover topics such as the notion of digital states and digital sovereignty, jurisdiction over the Internet, e-government, and artificial intelligence.     Abstract: This book thoroughly discusses the concept of sovereign immunity in international law and how the problems normally associated with the said subject can be resolved in order to promote justice. In part one, the author shows through a careful analysis of the law that restrictive immunity does not have vox populi in developing countries and that it lacks usus. He also argues that forum law, i.e., the lex fori is a creature of sovereignty and between equals before the law, only what is understood and acknowledged as law among states must be applied in as much as the international legal system is horizontal. Furthermore, the state never acts as a juridical or natural person and, therefore, in logical terms, its functions cannot be divided into potere politico and persona civile as a prelude to determine jurisdiction. The said Italian doctrine, therefore, is ex-facie erroneous, and that a simple dichotomy between absolute immunity and restrictive immunity wholly predicated on the nature test alone would not be helpful in promoting justice. Hence the contextual approach, arbitration and comparative dominant theory are suggested as essential tools to supplement the UN Treaty on state immunity when it comes into force because some states are likely to stay out of the said treaty regime. In part two, of the book, the author provides a comprehensive analysis of international criminal justice i.e., the prosecution of heads of state before international tribunals and the means or tools available to defend these leaders. To that end, it is apposite that a distinction between immunity ratione personae and immunity ratione materiae be made clear, whereby emphasis must be placed on their differences and legal consequences in regard to the verticality of international tribunals and foreign criminal jurisdiction of states e.g., the ICC and SCLC. The author further argues forcefully that the law has not changed and that despite the reforming zeal of some important states to change the law, in reality however, the law remains almost intact wholly structured on the presumption of immunity subject to certain limited acknowledged exceptions duly supported by opinio juris, thus eclipsing the suggestion by some scholars, senior courts and international tribunals that the law be instead based on an acknowledged exception to a presumed jurisdiction. This is because international law is a decentralized public order system without a compulsory jurisdiction.

    Abstract: This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses. Jodie Hodgson is a lecturer in Criminology at Manchester Metropolitan University, UK. Jodie has previously worked as a lecturer at Leeds Beckett University and the University of Liverpool. She completed her PhD at Liverpool John Moores University. Her research interests are situated within the areas of youth justice, feminism and critical criminology.

    Abstract: This timely book comprehensively examines whether the worst human rights violations directed specifically at sexual and gender minorities are punishable under international criminal law, as codified in the Rome Statute of the International Criminal Court. Drawing on general rules of interpretation, the development of human rights for sexual and gender minorities, and the social construction of gender, this monograph reveals that the worst crimes committed against persons because of their sexual orientation or gender identity can amount to crimes against humanity, particularly the crime of persecution under Article 7(1)(h). It also shows how legislators can be held individually criminally responsible for passing laws that criminalize consensual same-sex sexuality. The book not only makes a significant and original contribution to the literature but is also highly relevant for international criminal law practitioners, since, so far, no cases regarding this topic exist.     Abstract: “Can I choose to die?” As the number of requests for euthanasia and physician-assisted suicide continues to rise, human rights law faces a new conflict: the right to die vs. the right to life… The right to die or, in other words, ‘the right to choose the time and manner of one’s own death’ is a question of personal autonomy and its limits. This book provides a comprehensive understanding of the right to die and sheds light on its possible future under the European Convention on Human Rights. After setting a clear framework by defining the key terminology, the book takes a two-part approach to achieving its aim. The first part focuses on the right to die in practice by examining selected jurisdictions. Switzerland, which is famous for its assisted suicide organizations, and the Netherlands, which was the first country to legalize euthanasia, are examined in detail. Belgium, Germany, the United Kingdom, and -as an exception to the Convention perspective - Canada are also included. While this examination offers a better understanding of what the right to die looks like in practice, it also provides insights on the slippery slope argument, which serves as a counterweight to personal autonomy, without making a definitive statement on its validity. This part also illustrates the different paths that led or did not lead to the right to die in practice. The second part is an analysis of the European Court of Human Rights case law on the right to die. The Court has made important statements in only very cases, while its caution when approaching such a delicate and controversial topic among its 47 members is understandably emphasized. This analysis of the Court’s approach to the balancing of personal autonomy against other interests allows us to take a look back at the practice in more permissive jurisdictions through the lens of the Convention. Taken together, the book’s two parts provide valuable lessons for countries that decide to practice assisted dying, which are outlined in the conclusion. In addition, given that a purely legal approach can only offer a partial picture, the book argues that an interdisciplinary approach would be much more favorable in terms of providing the necessary basis for the right to die debate.

    Abstract: Autonomes Fahren (AF) wird potenziell die Präferenzen für die im Auto verbrachte Zeit stark beeinflussen und dementsprechend den Wert der Reisezeit, der ein Schlüsselelement von Kosten-Nutzen-Analysen im Verkehr ist. Die Untersuchung dieses Aspekts des AF ist daher entscheidend für die Analyse potenzieller Auswirkungen der Technik auf die zukünftige Verkehrsnachfrage. Trotz der steigenden Anzahl an Studien zu diesem Thema, gibt es noch erhebliche Forschungslücken. Der Fokus der Dissertation ist die potenziellen Änderungen des Reisezeitwerts, die durch das AF entstehen, zu messen sowie ihre Determinanten zu analysieren. Es wurden sowohl qualitative Ansätze als auch quantitative Methoden verwendet. Dabei wurden zwei Konzepte von AF betrachtet: privates und geteiltes autnomes Fahrzeug. Die Ergebnisse der Analysen zeigen einen niedrigeren Wert der Reisezeitersparnis beim AF im Vergleich zum manuellen Fahren, allerdings nur auf Pendelwegen. Das private Fahrzeug wird als eine attraktivere Option als ein geteiltes Fahrzeug wahrgenommen, jedoch unterscheiden sich die Nutzerpräferenzen für geteilte Fahrzeug stark zwischen den durchgeführten Studien. Individuelle Charakteristiken, wie Erfahrung mit Fahrassistenzsystemen, beeinflussen stark die Wahrnehmung der Zeit im AF; andere sozio-demographischen Faktoren, wie Alter und Geschlecht haben vor allem einen indirekten Effekt auf den Reisezeitwert indem sie Einstellungen potenzieller Nutzer beeinflussen. Die Verbesserung des Fahrterlebnisses durch das AF und das Vertrauen in die Technik sind wichtige Determinanten der Reisezeitwahrnehmung. Fahrvergnügen und andere wahrgenommene Vorteile vom manuellen Fahren gleichen in einem gewissen Ausmaß den Nutzen vom AF aus. Es wurden Reisezeitwerte für unterschiedliche potenzielle Nutzersegmente berechnet. Abschließend wurden politische Implikationen, Empfehlungen für die Entwicklung von AF sowie Empfehlungen für künftige Studien und potenziellen Forschungsgebiete abgeleitet.
    Abstract: Autonomous driving will potentially strongly affect preferences for time spent in a vehicle and, consequently, the value of travel time savings (VTTS). As VTTS is a key element of cost-benefit analysis for transport, these interrelations are crucial for analysing the potential impact of the technology on future travel demand. Despite the increasing number of studies dedicated to this topic there are still many unanswered questions. The focus of the thesis is to measure potential changes in the VTTS resulting from the introduction of autonomous driving and analyse their determinants. Qualitative approaches and quantitative methods were used. Two concepts of AVs were considered: a privately-owned AV (PAV) and a shared AV (SAV). The analysis results suggest lower VTTS for autonomous driving compared to manual driving, but only on commuting trips. A PAV is perceived as a more attractive option than an SAV, but user preferences for SAVs vary between the conducted studies. Individual characteristics, such as experience with advanced driver assistance systems, strongly affect the perception of time in an AV; other socio-demographic factors, such as age and gender, affect mode choices and the VTTS mainly indirectly by influencing the attitudes of potential users. The improvement in travel experiences due to autonomous driving and trust in the technology are important determinants of the perception of travel time. Enjoyment of driving and other perceived benefits of manual driving partially counterbalance the utility of riding autonomously. VTTS for different potential user segments were calculated. In conclusion, several policy implications, development recommendations for AVs as well as recommendations for future studies and potential research avenues are derived from the findings.

    Abstract: Hinter Migrationsprozessen wird sehr viel schneller als hinter anderen historischen Vorgängen das Schicksal des Einzelnen greifbar. Anliegen des vorliegenden ersten Bandes wie auch der Schriftenreihe insgesamt ist es deshalb, entsprechende Forschungslücken durch das Beschreiten innovativer, auch Diskussion provozierender Wege zu überwinden. In present and past migration processes the fate of the individual becomes tangible much faster than in many other historical processes. Hence, it is not uncommon that people take sides with the migrant and possibly also of his or her country of origin, even though the academia should refrain from biased judgements. Not least as a result of the "refugee crisis" of 2015, a noticeable need for orientation knowledge based on economics and economic history has developed, which historical migration research has not been able to satisfy so far. The aim of this first volume, as well as of the series as a whole, is therefore to overcome the corresponding gaps in research by taking innovative and provocative paths in order to stimulate discussion.

    Abstract: Freedom of speech is central to the liberal democratic tradition. It touches on every aspect of our social and political system and receives explicit and implicit protection in every modern democratic constitution. It is frequently referred to in public discourse and has inspired a wealth of legal and philosophical literature. The liberty to speak freely is often questioned; what is the relationship between this freedom and other rights and values, how far does this freedom extend, and how is it applied to contemporary challenges? This handbook seeks to answer these and other pressing questions. It provides a critical analysis of the foundations, rationales, and ideas that underpin freedom of speech as a political idea, and as a principle of positive constitutional law.
