    Abstract: The digitalization of work processes and the generalization of IT are creating unprecedented opportunities. An increasing part of the workforce is experimenting with new forms of work, as freelancers, self-employed or highly skilled employees with greater autonomy. International in scope, this book comprehensively explores these new models of work, mobility and life trajectories, and the increasing role of non-metropolitan coworking spaces. This interdisciplinary book investigates new trends in relationships between work, life plans, work-life balance, and mobility in the context of ongoing societal digitalization. An expert group of contributors adopts a comparative approach in assessing the coworking phenomenon. They examine the social embeddedness of collaborative workspaces and consider topics such as social exchange, cooperation and collaboration, critically assessing the question of individual and collective mobilities, and exploring the historical roots of coworking and its developing meanings and uses in practice.     Abstract: This proceedings volume combines chapters derived from papers presented at the 4th and 5th Annual Conferences on the Future of the Commercial Contract in Scholarship and Law Reform. This ongoing research project brings together scholars from all over the world at an annual international conference in London. The book focusses on technology in commercial contract law as well as on sustainability in commercial contracts. The latter theme was inspired by the United Nations' climate conference that was to take place in Glasgow in the United Kingdom that same year. The book combines topical current issues in commercial contract law and practice organized in three parts. The first part contains contributions to the area of law and technology. The second part of the book expands on aspects of sustainability understood as environmental reasonableness in the context of commercial contracts. The third part includes several chapters on the topics of supervening events and contractual ethics. This book is therefore part of a coherent line of contributions to the furthering of modern contract theory. The choice of topics is closely following current issues of legal policy and contract practice.

    Abstract: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’. Monica den Boer is Professor of Military Policing Operations at the Netherlands Defence Academy. Her primary research focus is on the evolution of military policing, as well as border policing, international policing, urban policing and the policing of organised crime and terrorism. She served as member of the Dutch national parliament from 2017 to 2020. Prior to this she worked in several academic and professional environments, including the Police Academy of the Netherlands and the VU University Amsterdam. Eric Bervoets is a police scientist and criminologist. He has been active as a researcher since 1997. After a master's degree in public administration at Rotterdam Erasmus University, the Netherlands, Bervoets obtained his PhD in 2006 with a dissertation on policing troubled neighbourhoods. In 2020, he was appointed Research Fellow at the Netherlands Defence Academy. Linda Hak obtained her BSc in Criminology at Erasmus University and a master’s degree in Legal Psychology at Maastricht University, the Netherlands. She served as a research intern at Bureau Bervoets and is employed as a detective assistant for the National Police of the Netherlands.

    Abstract: The unmatched technological achievements in artificial intelligence (AI), robotics, computer science, and related fields over the last few decades can be considered a success story. The technological sophistication has been so groundbreaking in various types of applications that many experts believe that we will see, at some point or another, the emergence of general AI (AGI) and, eventually, superintelligence. This book examines the impact of AI on human rights by focusing on potential risks and human rights legislation and proposes creating a Universal Convention for the Rights of AI Systems (AI Convention). John-Stewart Gordon, PhD in Philosophy, serves as an adjunct full professor at LSMU and has held various academic roles. He's an associate editor at AI & Society, serves on multiple editorial boards, and is the general editor of Brill's Philosophy and Human Rights series. With over 90 publications, John is a prolific contributor to practical philosophy.

    Abstract: This brief maps the available data augmented by expert interviews on the impact of the Covid-19 measures on DV in eight European Member States during the first lock-down. The volume addresses an on-going situation, additionally complicated by renewed lockdown restrictions during autumn and early winter 2020. It assesses the assumptions of an imminent wave of domestic violence against reliable data from crime statistics, surveys, and various institutions responding to domestic violence. Collecting partner country reports from Austria, Finland, France, Germany, Hungary, Portugal, Scotland and Slovenia, it demonstrates the effects that lockdown measures starting March 2020 had on reported DV incidents. It considers the differences between each country with respect to policing, legal systems, social and cultural factors and highlights best practices to prevent conditions resulting from Covid-19 lockdown undermining victims’ security and frontline responders’ capacities to provide services and prevent domestic violence.

    Abstract: This book offers a comprehensive analysis of the legal questions that arise for the legislative branch when implementing the crime of aggression into domestic law. Despite being the “supreme international crime” that gave birth to international criminal law in Nuremberg, its ICC Statute definition has been incorporated into domestic law by fewer than 20 States. The crime of aggression was also omitted in the rich debate held among German scholars in the early 2000s regarding the legislative implementation of other ICC Statute crimes. The current inability of the International Criminal Court to respond to the Russian aggression towards Ukraine invites the continuation of these academic debates without neglecting the particularities of the crime of aggression. The fundamental issues discussed in this volume include the obligation to criminalize aggression, the core wrong of the crime, the normative gaps under domestic law and the jurisdictional gaps under the ICC Statute. To facilitate the operationalization of domestic implementation, the book explores the technical options for incorporating the definition into domestic law, the geographical ambit of domestic jurisdiction—most notably universal jurisdiction—as well as legal challenges such as immunities. The book is aimed primarily at researchers and States with an interest in the domestic implementation of international criminal law but those already working in the field should also find much of interest contained within it. Dr. Annegret Hartig is Program Director of the Global Institute for the Prevention of Aggression and worked as a researcher at the University of Hamburg where she obtained her doctoral degree in international criminal law.

    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment.     Abstract: This book explores the impact of 'Fintech' on the information asymmetry between the financial regulator and the markets.     Abstract: This book considers the intellectual property protection of clinical test data that has been submitted to governments, in particular through test data exclusivity rights. It focuses on how these intellectual property rights first emerged in the early 1980s, how they have globalised over the past four decades, and what impact they have had upon access to medicine. This book makes a number of significant and original contributions to the literature around the protection of submitted test data. First, the book draws upon the theory of regulatory globalisation to provide an explanation of how intellectual property rights in submitted pharmaceutical test data have become nearly ubiquitous in the legal systems of most major economies. Second, through a comprehensive analysis and synthesis of provisions on the protection of submitted test data in free trade agreements, as well as a comparison of a range of national approaches to the protection of submitted test data, it reveals the broader global regulatory pattern that has given rise to these intellectual property rights. Third, by analysing data on drug approvals in the US, it provides an empirical insight into the impact of test data exclusivity in national pharmaceutical markets. Fourth, the book covers a number of developments regarding test data exclusivity that have occurred as a result of responses to the COVID-19 pandemic, both at the national level as well as at the World Trade Organisation (WTO). This book will appeal to academics researching the intersection of intellectual property and the life sciences, civil society activists working to promote access to medicines, and students (particularly those at the post-graduate level) studying the relationship between intellectual property and medicine.

    Abstract: This book explores the issue of leadership criminality from a new angle by comparing two highly relevant modes of responsibility. By contrasting individual criminal responsibility for ordering international crimes with indirect perpetration through an organisation, it shows the doctrinal weaknesses of the latter and outlines the much-overlooked advantages of the former. The volume analyses the development of both forms of responsibility, looking at their origins, and their reception in academia and practical use in jurisprudence. The history of indirect perpetration through an organisation (Organisationsherrschaft) is portrayed from its German academic origin, through German jurisprudence to the reception of the doctrine at the International Criminal Court. By comparing the doctrine’s stages of evolution, the book sheds light on the different aspects of the various models of indirect perpetration through an organisation and carves out general and fundamental criticism of it. The characteristics of ordering liability are explored in depth through an analysis of jurisprudence of the Nuremberg subsequent trials, the ad hoc tribunals and the International Criminal Court. This historic and doctrinal comparison reveals a well-defined and to-date much neglected mode of responsibility with enormous potential for the adjudication of leadership figures in the ambit of international criminal law and only one conclusion can follow from this analysis: it calls for practitioners and academics to leave the well-trodden paths of national criminal law doctrine and embrace truly international modes of liability such as the ordering of a crime. This volume in the ICJ series provides practitioners, researchers and students with a detailed account of forms of leadership liability and an innovative approach to the topic’s most discussed issue. Dr. Johannes Block is a criminal lawyer specializing in international criminal law, responsibility of leadership figures, questions of perpetration and participation in crime as well as the national-socialists’ crimes. He studied in Münster, Germany and Bogotá, Colombia and obtained his Dr. iur. from the University of Cologne, where he also worked and taught as a research assistant for several years. His legal clerkship led him to organized crime investigations, criminal defence, the European Commission and the German Federal Ministry of Justice.

    Abstract: The first full-length study of cycling activism through the lens of social movement theory, this book demonstrates that, despite tremendous differences, bike activism can be understood as a continuous and connected activity spanning a century and a half and across continents. With examples from street protest to institutional lobbying, it emphasises cycling's current central importance to zero carbon transport futures, while showing that cycling activism is also not always about the bike or the cyclist, as successive generations of activists have used cycling to articulate different visions of freedom and autonomy. Moving from a consideration of social movement theory as a means to understand cycling activism, the author presents a series of case studies of collective action, organisations, networks and campaigns in order to illustrate and elaborate a theoretical model through which diverse campaigns and approaches to change can be understood.     Abstract: After West African migrants arrived in France in the 1960s, the authorities opened residences for them known as "foyers." Initially intended to contain the West African population, these hostels for single men fostered the emergence of Black communities in the heart of Paris and other cities. More recently, however, a nationwide renovation program sought to replace the collective living arrangements of foyers with more individualized spaces by constructing new buildings or drastically reshaping existing ones-and casting the West African presence as a threat to French identity.Aïssatou Mbodj-Pouye examines the changing roles that foyers have played in the lives of generations of West African migrants, weaving together rich ethnographic description with a critical historical account. She shows how migrants settled in foyers through kinship ties, making these buildings key parts of diasporic networks. Migrants also forged a sense of place in foyers, in an intricate relationship with bureaucratic requirements such as having an address. Mbodj-Pouye scrutinizes the physical and social evolution of foyers and the administrative dynamics that governed them. She argues that even though these buildings originated in state attempts to manage migrants along racial lines, the shared way of life that they encouraged helped spark a sense of political agency and belonging whose significance extends far beyond their walls.Combining close attention to the social and cultural meanings of the foyers and keenly observed portraits of Black experiences in France across decades, An Address in Paris offers a new lens on the global African diaspora.

Allerdings fehlen subnationale Informationen darüber, wo und wie die Gelder verteilt werden, welche Faktoren die Finanzierung beeinflussen und wie sie mit der Dynamik der Wälder und geschützten Gebiete korrelieren. Diese Thesis beabsichtigt, diese Fragen zu beantworten, indem sie sich mit drei Jahrzehnten internationaler Naturschutzfinanzierung in den Hauptabholzungsgebieten Südamerikas auseinandersetzt. Mithilfe gemischter Methoden habe ich die Interessen der Geldgeber thematisch und geografisch kartiert, räumliche Determinanten der Mittelvergabe identifiziert und Schwankungen der Finanzierung über Standorte und Zeit hinweg mit der Dynamik der Waldbedeckung und geschützten Gebiete verknüpft. Die Ergebnisse zeigten, dass die internationale Naturschutzfinanzierung eine Mischung aus global relevanten Interessen und bilateralen Interessen darstellt, ermöglicht durch sozioökonomische und biophysikalische Verbindungen zwischen den spendenden und empfangenden Regionen. Trockenwaldökosysteme mit hoher Abholzungsrate waren besonders unterfinanziert und gefährdeten die Ökosysteme, Arten und die lokale Bevölkerung. Die Verknüpfung von Schutzgebieten und Finanzierung mit dem Konzept der Landnutzungsdynamik enthüllte weitere Nuancen und half, kontextspezifische Empfehlungen zu identifizieren. Diese Studie präsentierte die erste subnationale Analyse der internationalen Naturschutzfinanzierung auf kontinentaler Ebene, zeigte Übereinstimmungen und Diskrepanzen zwischen den zugeteilten Ressourcen und den Naturschutzbedürfnissen und beleuchtete die komplexe und dynamische Landschaft der Finanzierungsmöglichkeiten, mit der andere Akteure umgehen müssen.
    Abstract: International donors have increased funding for tropical forest conservation to address the global challenge of climate, biodiversity, and sustainability. However, subnational information on where and how funds are allocated, factors influencing funding, and its correlation with forest dynamics and protected areas is lacking. This thesis aims to answer these questions by delving into three decades of international conservation funding in South America’s major deforestation areas. Using mixed methods, I mapped donor interests thematically and geographically, identify spatial determinants of funding allocation, and link funding variations across locations and time with forest cover and protected areas dynamics. Results found that international conservation funding carried a mix of globally relevant interests and bilateral interests enabled by socio-economic and biophysical connections between the donating and receiving regions. Dry forest ecoregions with high deforestation rates have been particularly underfunded, threatening the ecosystems, species, and local people depending on them. Dedicated global biodiversity fund, raising attention to drier ecosystems, targeting highly threatened areas, and making funding more accessible to local actors for local conservation needs, may help address the gap. This study presented the first subnational level analysis of international conservation funding at the continental scale, revealed the matches and mismatches between the allocated resources and the conservation needs, and shed light on the complex and dynamic landscape of funding opportunities that other actors need to navigate in.

    Abstract: Der erste Teil dieser Arbeit konzentriert sich auf die systematische Synthese von Informationen über Anpassung, Anpassungsstrategien, Einschränkungen und Grenzen auf globaler Ebene durch die Aufarbeitung der wissenschaftlichen Literatur und mit Hilfe von Techniken des maschinellen Lernens. In einem zweiten Schritt werden mittels einer Online-Umfrage und halbstrukturierter Interviews die Wahrnehmungen von Einschränkungen der Anpassungsmöglichkeiten in den kleinen Inselstaaten der Karibik bewertet, wobei der Schwerpunkt auf den Wechselwirkungen zwischen verschiedenen Arten von Einschränkungen und dem erheblichen Einfluss der fehlenden Anpassungsfinanzierung liegt. Schließlich wird ein zukunftsorientierter Ansatz verfolgt, bei dem Bottom-up- und Top-down-Daten kombiniert werden, um zu veranschaulichen, wie sich sozioökonomische Dimensionen im Zusammenhang mit Einschränkungen bis zum Jahr 2100 unter verschiedenen Szenarien der künftigen sozialen und wirtschaftlichen Entwicklungen entfalten könnten. Die Ergebnisse zeigen, dass die Anpassung derzeit schrittweise und weitgehend fragmentiert erfolgt. Die Erkenntnisse über die Anpassungspolitik nehmen rasch zu, aber es bestehen weiterhin geografische Ungleichheiten. Finanzen und Regierungsführung sind weltweit die größten Einschränkungen, wobei die kleinen Inselstaaten sowie Mittel- und Südamerika die meisten Einschränkungen und Grenzen melden. Die Wechselwirkungen zwischen den Einschränkungen können zu Grenzen und zusätzlichen Verlusten und Schäden führen. Dies unterstreicht die Notwendigkeit, die Einschränkungen parallel anzugehen und eine nachhaltige und gezielte Anpassungsfinanzierung zu gewährleisten. Mögliche Szenarien für die künftige Entwicklung zeigen, dass selbst in den optimistischsten Szenarien sozioökonomische Schlüsseldimensionen wie schwache Regierungsführung die Anpassung bis weit in die zweite Hälfte des 21. Jahrhunderts hinein erschweren werden.
    Abstract: The first part of this thesis focuses on systematically synthesising information on adaptation, adaptation policies, constraints and limits on the global level by reviewing scientific literature and with the support of machine learning techniques. Secondly, through an online-survey and semi-structured interviews, perceptions of constraints in Caribbean Small Island Developing States are assessed, by focusing on the interactions between different types of constraints and the significant influence of the lack of adaptation finance. Finally, a forward-looking approach combining bottom-up and top-down data is taken to illustrate how socio-economic dimensions related to constraints could evolve by 2100, under various scenarios of future development. The results show that adaptation is currently incremental and largely fragmented. Evidence on adaptation policy is rapidly growing but geographic inequalities persist. There is negligible data on adaptation reducing climate change risks. Finance and governance are found to be the most prominent constraints globally, with Small Island Developing States and Central and South America reporting most constraints and limits. Indeed, Caribbean Small Island Developing States face large financial constraints which in turn closely interact with governance, human capacity and information constraints and result in vicious circles. Interactions between constraints can lead to limits and additional losses and damages. This highlights the need to address constraints in parallel and for sustained and dedicated adaptation finance. Potential scenarios of future development show that, even under the most optimistic scenarios, key socio-economic dimensions such as weak governance will challenge adaptation well into the second half of the 21st century. The persistence of constraints, in particular in the most vulnerable regions, calls for stringent mitigation, improved adaptation and increased efforts to address losses and damages.

    Abstract: The study provides an extensive legal, geopolitical and historical analysis of all controversial issues making up the Greek-Turkish maritime dispute: the delimitation of territorial waters, the national airspace, the delineation of exclusive economic zones and continental shelf as well as the issue of military presence on the Eastern Aegean islands and its relation to the Greek sovereignty over them. By immersing thoroughly into international jurisprudence, international treaties and historical facts, the book offers a detailed survey of legal precedents and legal regimes over similar issues worldwide. In this way, the reader has the opportunity to ascertain where every single legal and historical argument has been drawn from and its relevance in the international jurisprudence. Consequently, it follows the evolution of the dispute together with all its twists from 1973 to 2022 that saw a new low in the historically tense Greek-Turkish relationship. The book finally re-examines the dispute in the light of the new green energy geopolitics and the ongoing climate crisis and comes up with some suggestions for an alternative paradigm of co-existence in the Aegean Sea which in the author’s view is urgent and inevitable. .

    Abstract: This book considers contested responsibilities between the public and private sectors over the use of online data, detailing exactly how digital human rights evolved in specific European states and gradually became a part of the European Union framework of legal protections. The author uniquely examines why and how European lawmakers linked digital data protection to fundamental human rights, something heretofore not explained in other works on general data governance and data privacy. In particular, this work examines the utilization of national and European Union institutional arrangements as a location for activism by legal and academic consultants and by first-mover states who legislated digital human rights beginning in the 1970s. By tracing the way that EU Member States and non-state actors utilized the structure of EU bodies to create the new norm of digital human rights, readers will learn about the process of expanding the scope of human rights protections within multiple dimensions of European political space. The project will be informative to scholar, student, and layperson, as it examines a new and evolving area of technology governance – the human rights of digital data use by the public and private sectors. Rebekah Dowd is an Assistant Professor of Political Science at Midwestern University in Texas. Rebekah’s research focuses on human rights within data policy, the online behavior of individuals and states, and policy decision-making by European politicians. Dr. Dowd teaches courses in global studies, international relations, comparative and foundational politics, European politics, and international political economy.

    Abstract: This book provides the first book-lengthy study focusing on Artificial Intelligence (AI) with Chinese characteristics, in line with China’s open ambition of becoming an AI superpower by 2030.     Abstract: This volume presents the findings of an interdisciplinary project aimed at safeguarding the future of this unique resource. Cultural heritage in the Negev desert region of Israel is potentially under threat from a number of social, political and economic activities such as militarization, settlement and tourism, resulting in significant environmental change. The cultural heritage and archaeology extend back at least a quarter of a million years but also include a unique engraved rock art assemblage that dates to at least 3000 BCE. These engravings form a clear association with other relic monuments including prehistoric and protohistoric settlements, agricultural and irrigation regimes, and the remnants of a nomadic way of life
