    Abstract: Nur etwa ein Prozent der Flüchtlinge sind tatsächlich politisch Verfolgte und werden als asylberechtigt anerkannt, zwei Drittel der Asylbewerber sind Muslime und vier Fünftel alleinstehende junge Männer, die im Regelfall ihre gesamten Familien nachholen werden, sobald sie im Inland ein Bleiberecht erlangt haben. Im Jahr 2015 wurden 441.899 Erstanträge vom Bundesamt für Migration und Flüchtlinge entgegengenommen. Im Monat November 2015 beantragten 55.950 Personen Asyl in der Bundesrepublik Deutschland. Unbekannt ist nach wie vor die Zahl der illegal Eingereis-ten, die sich nicht registrieren ließen. Über die Anzahl der auf diese Weise ebenso ins Inland gelangten islamistischen Kämpfer kann man nur spekulieren. Die Flüchtlings- und Migrationsbewegung war Thema des 32. Symposiums der Studiengruppe für Politik und Völkerrecht vom 29. bis 30. November 2015 in Berlin. Es fand in Verbindung mit der Kulturstiftung der deutschen Vertriebenen statt. Unter der Überschrift »Migration, Asyl, Flüchtlinge und Fremdenrecht« diskutierten Wissenschaftler die aktuellen politischen und rechtlichen Fragen der bald als Flüchtlingskrise bezeichneten Migrationsbewegung. / »Migration, Asylum, Refugees, and Aliens' Rights« -- Worldwide, 85 million migrants, 13 million refugees and asylum seekers and about 20 million illegal immigrants live outside their home country. Moreover, 30 million people are classified as internally displaced persons according to the UN refugee or-ganisation. Thus, about 150 million people worldwide live as migrants in a state, which is not their original home. Many of the refugees are trying to come to Europe and find a better life, especially in the Federal Republic of Germany. They apply for asylum, which is only available to them in the case of political persecution

    Abstract: This is a detailed study of the extent to which an increased influx of foreign workers is a threat to law and order in the context of the data-generating process of police statistics and the media coverage of "crimes" committed by foreigners. It shows that a general mood in which foreign workers are viewed as potential danger to Japanese society "protects" the criminalization of foreign "illegal" migrant workers. The work begins by tracing the upsurge of "illegal" foreign workers in Japan. It builds a social profile of these "illegals" showing that because of fear of expulsion, lack of knowledge of the law and over-dependence on employer and workplace, their ability to avail themselves off the protection of the law is neglible, and they are always at risk of becoming victims to multiple exploitation.

    Abstract: Are postcolonies haunted more by criminal violence than other nation-states? The usual answer is yes. In Law and Disorder in the Postcolony, Jean and John Comaroff and a group of respected theorists show that the question is misplaced: that the predicament of postcolonies arises from their place in a world order dominated by new modes of governance, new sorts of empires, new species of wealth-an order that criminalizes poverty and race, entraps the "south" in relations of corruption, and displaces politics into the realms of the market, criminal economies, and the courts.  As these essays make plain, however, there is another side to postcoloniality: while postcolonies live in states of endemic disorder, many of them fetishize the law, its ways and itsmeans. How is the coincidence of disorder with a fixation on legalities to be explained? Law and Disorder in the Postcolony addresses this question, entering into critical dialogue with such theorists as Benjamin, Agamben, and Bayart. In the process, it also demonstrates how postcolonies have become crucial sites for the production of contemporary theory, not least because they are harbingers of a global future under construction.

    Abstract: Is it time to take a break from feminism? In this pathbreaking book, Janet Halley reassesses the place of feminism in the law and politics of sexuality. She argues that sexuality involves deeply contested and clashing realities and interests, and that feminism helps us understand only some of them. To see crucial dimensions of sexuality that feminism does not reveal--the interests of gays and lesbians to be sure, but also those of men, and of constituencies and values beyond the realm of sex and gender--we might need to take a break from feminism. Halley also invites feminism to abandon its uncritical relationship to its own power. Feminists are, in many areas of social and political life, partners in governance. To govern responsibly, even on behalf of women, Halley urges, feminists should try taking a break from their own presuppositions. Halley offers a genealogy of various feminisms and of gay, queer, and trans theories as they split from each other in the United States during the 1980s and 1990s. All these incommensurate theories, she argues, enrich thinking on the left not despite their break from each other but because of it. She concludes by examining legal cases to show how taking a break from feminism can change your very perceptions of what's at stake in a decision and liberate you to decide it anew.

Most have been driven from their homes by armed strife, displacing people into settings that fail to meet standards for even basic human dignity. Yet advocacy must go beyond international law to human rights as an ethical standard to prevent displaced people from falling through the cracks of our conflicted world.Refugee Rights: Ethics, Advocacy, and Africa draws upon David Hollenbach, SJ's work as founder and director of the Center for Human Rights and International Justice at Boston College to provide an analytical framework for vigorous advocacy on behalf of refugees and internally displaced people. Representing both religious and secular perspectives, the contributors are scholars, practitioners, and refugee advocatesùall of whom have spent time on the ground in Africa.     Abstract: Illicit Flows and Criminal Things offers a new perspective on illegal transnational linkages, international relations, and the transnational. The contributors argue for a nuanced approach that recognizes the difference between "organized" crime and the thousands of illicit acts that take place across national borders every day. They distinguish between the illegal (prohibited by law) and the illicit (socially perceived as unacceptable), which are historically changeable and contested. Detailed case studies of arms smuggling, illegal transnational migration, the global diamond trade, borderland practices, and the transnational consumption of drugs take us to Asia, Africa, Latin America, Europe, and North America.
