Abstract: This book examines prisons and imprisonment. Historically, prisons and prisoners have been a source of interest to the general public. However, despite near universal acceptance of imprisonment as a feature of society, the reality of prison life, and the effects it has on individuals and communities, remain a mystery to many. Using academic scholarship, empirical research, government papers, policy reports, and accounts from lived experiences of the institution, this book analyses the complexities and contradictions of prison life, the place of the prison in twenty-first century society, and its prospects for the future. It introduces readers to key debates surrounding the use of imprisonment, and encourages readers to interrogate conventional perspectives on an institution that reflects the society in which it is situated. Cormac Behan is Lecturer in Criminology at the Technology University Dublin, Ireland. Abigail Stark is Lecturer in Criminology at the University of Central Lancashire, UK. .

Abstract: Socio-centric societies have vibrant-albeit different-concepts of human flourishing than is typical in the individualistic West. These concepts influence the promotion of human rights, both in domestic contexts with religious minorities and in international contexts where Western ideals may clash with local norms. Human Rights in Thick and Thin Societies uncovers the original intentions of the drafters of the Universal Declaration of Human Rights, finds inspiration from early leaders in the field like Eleanor Roosevelt, and examines the implications of recent advances in cultural psychology for understanding difference. The case studies included illustrate the need to vary the application of human rights in differing cultural environments, and the book suggests a new framework: a flexible universalism that returns to basics-focusing on the great evils of the human condition. This approach will help the human rights movement succeed in a multipolar era.

Abstract: This book provides an account and explanation of a fundamental dilemma facing secular states: the "legitimacy gap" left by the withdrawal of religion as a source of legitimacy. Legitimacy represents a particular problem for the secular state. The "secular" in all its manifestations is very much linked to the historical rise of the modern state. It should not be seen as a category that separates culture and religion from politics, but rather as one that links these different dimensions. In the first part of the book, Depaigne explains how modern constitutional law has moved away from a "substantive" legitimacy, based in particular on natural law, towards a 'procedural' legitimacy based on popular sovereignty and human rights. Depaigne examines three case studies of constitutional responses to legitimacy challenges which articulate the three main sources of "procedural" legitimacy (people, rights, and culture) in different ways: the "neutral model" (constitutions based on the "displacement of culture"); the "multicultural model" (constitutions based on diversity and pluralism); and the "asymmetric model" (constitutions based on tradition). Even if secularization can be considered European in its origin, it is best seen today as a global phenomenon, which needs to be approached by taking into account the particular cultural dimension in which it is rooted. Depaigne's detailed study shows how secularization has moved either towards "nationalization" linked to a particular national identity (as in France and, to some extent, in India)-or towards "de-secularization", whereby secularism is displaced by particular cultural norms, as in Malaysia --Front flap of book

Abstract: How can universal human rights be reconciled with respect for wide cultural differences? This textbook introduces the core issues for students and addresses them through an interdisciplinary analysis of key case studies. Throughout the book, an alternative philosophical framework is offered as a model through which universalism and difference can be reconciled into a single global vision. 〈strong〉Helpful student features include: Core questions: each chapter starts with 10 core questions, which students are invited to answer as they read to put what they learn into practice. Every chapter ends with suggestions for further reading, to help students deepen their study in particular areas. Abstract: "This volume aims to introduce cultural rights and cultural diversity to a non-legal audience as well as to legal and human rights specialists who may not be very familiar with this area of law - which has been termed the Cinderella of the human rights family. Cultural rights and the associated notion of cultural diversity are under-conceptualized from a theoretical viewpoint and poorly understood by governments and rights-holders and thus not implemented as well as they might be. It is therefore necessary to specify clearly the content, and scope of these rights and their relationship to other human rights as well as the various domains in which they are important. Underlying this work is the belief that cultural rights and cultural diversity are increasingly implicated in important areas of policy and legal development and so need to be better understood by governments, governmental authorities, cultural specialists and the rights-holders themselves. Over recent years, the subject of cultural rights has expanded greatly, from that of a national culture available to all citizens to the non-material elements of heritage which, in turn, involves the idea of active public participation in the decision-making process and of citizens being able to contribute actively to their culture. As a result, there is increasing demand for better promotion and protection of cultural rights as an integral part of human rights. The book is divided into two parts. The first section sets out the broader context in which cultural rights and diversity operate, and examines in detail the concept of cultural diversity and its applications, introducing the potential scope for and content of cultural rights and specific challenges they pose to human rights theory. The second section includes in summary form various texts (treaties, other legal instruments and political texts) relevant to cultural rights and cultural diversity. This volume therefore provides the reader with a detailed discussion of cultural rights and diversity combined with the main legal and political primary sources supporting it"--Back cover

Abstract: "A thriving, yet small, liberal component in Israeli society has frequently taken issue with the constraints imposed by religious orthodoxy, largely with limited success. However, as this thoughtful new book by Guy Ben-Porat suggests, in recent years, in part because of demographic changes and in part because of the influence of an increasingly consumer-oriented society, dramatic changes have occurred in secularization of significant parts of public and private lives. Even though these fissures often have more to do with lifestyle choices and economics than with political or religious ideology, the demands and choices of a secular public and a burgeoning religious presence in the government are becoming ever more difficult to reconcile. The evidence, which the author has accrued from numerous interviews and a detailed survey, is nowhere more telling than in areas that demand religious sanction such as marriage, burial, the sale of pork, and the operation of businesses on the Sabbath. This book makes an important and timely contribution to the study of contemporary Israeli society, as new alliances are being forged in the political arena"--

Abstract: "Cultural law is a new and exciting field of study and practice. The core themes of linguistic and other cultural rights, cultural heritage, traditional crafts and knowledge, the performing arts, sports, and religion are of fundamental importance to people around the world, engaging them at the grass roots and often commanding their daily attention. The related legal processes are both significant and complex. This unique collection of materials and commentary on cultural law covers a broad range of themes. Opening chapters explore critical issues involving cultural activities, artifacts, and status as well as the fundamental concepts of culture and law. Subsequent chapters examine the dynamic interplay of law and culture with respect to each of the core themes. The materials demonstrate the reality and efficacy of comparative, international, and indigenous law and legal practices in the dynamic context of culture-related issues. Throughout the book, these issues are presented at multiple levels of legal authority: international, national, and subnational"--Provided by publisher

Abstract: "What is the relationship between hip-hop and African American culture in the post-Civil Rights era? Does hip-hop share a criticism of American culture or stand as an isolated and unique phenomenon? How have African American texts responded to the increasing role intellectual property law plays in regulating images, sounds, words, and logos? Parodies of Ownership examines how contemporary African American writers, artists, and musicians have developed an artistic form that Schur terms "hip-hop aesthetics." This book offers an in-depth examination of a wide range of contemporary African American painters and writers, including Anna Deavere Smith, Toni Morrison, Adrian Piper, Colson Whitehead, Michael Ray Charles, Alice Randall, and Fred Wilson. Their absence from conversations about African American culture has caused a misunderstanding about the nature of contemporary cultural issues and resulted in neglect of their innovative responses to the post-Civil Rights era. By considering their work as a cross-disciplinary and specifically African American cultural movement, Schur shows how a new paradigm for artistic creation has developed."--Publisher's description

Abstract: "The international community created the Special Court for Sierra Leone to prosecute those who bore the greatest responsibility for crimes committed during the country's devastating civil war. Tim Kelsall examines some of the challenges posed by the fact that the Court operated in a largely unfamiliar culture, in which the way local people thought about rights, agency and truth-telling sometimes differed radically from the way international lawyers think about these things. By applying an anthro-political perspective to the trials, he unveils a variety of ethical, epistemological, jurisprudential and procedural problems, arguing that although touted as a promising hybrid, the Court failed in crucial ways to adapt to the local culture concerned. Culture matters, and international justice requires a more dialogical, multicultural approach"--Provided by publisher

Abstract: In a book that confronts our society's obsession with violence, Maria Tatar seeks the meaning behind one of the most disturbing images of twentieth-century Western culture: the violated female corpse. This image is so prevalent in painting, literature, film, and, most recently, in mass media, that we rarely question what is at stake in its representation. Tatar, however, challenges us to consider what is taking place - both artistically and socially - in the construction and circulation of scenes depicting sexual murder. In examining images of sexual murder (Lustmord), she produces a riveting study of how art and murder have intersected in the sexual politics of culture from Weimar Germany to the present.

Abstract: In this book David Miller defends the principle of nationality. He argues that national identities are valid sources of personal identity; that we are justified in recognizing special obligations to our co-nationals; that nations have good grounds for wanting to be politically self-determining; but that recognizing the claims of nationality does not entail suppressing other sources of personal identity, such as ethnicity. Finally, he considers the claim that national identities are dissolving in the late twentieth century

Abstract: This book investigates the ways in which literacy was important in early mediaeval Europe, and examines the context of literacy, its uses, levels, and distribution, in a number of different early mediaeval societies between c. 400 and c. 1000. The studies, by leading scholars in the field, set out to provide the factual basis from which assessments of the significance of literacy in the early mediaeval world can be made, as well as analysing the significance of literacy, its implications, and its consequences for the societies in which we observe it. In all cases, the studies represent recent research and bring evidence such as the recent archaeological discoveries at San Vincenzo al Volturno to the subject. They provide fascinating insight into the attitudes of early mediaeval societies towards the written word and the degree to which these attitudes were formed. This period is shown as fundamental for the subsequent uses of literacy in mediaeval and modern Europe
