Abstract: The general international law regarding foreign merchant ships in internal waters has never been codified. The question of the breadth of the territorial sea was finally solved during the Third United Nations Conference on the Law of the Sea. But conflicts between coastal States and foreign merchant ships in internal waters and the territorial sea may arise. This comprehensive study analyses these issues and strives for reasonable and generally acceptable solutions.
Abstract: The general international law regarding foreign merchant ships in internal waters has never been codified. Despite the codification efforts made by the League of Nations and the Geneva Convention on the Territorial Sea and the Contiguous Zone of 1958, the question of the breadth of the territorial sea was finally solved during the Third United Nations Conference on the Law of the Sea. In addition, the right of innocent passage of foreign ships has been regulated in the 1982 Convention in greater detail than ever before, whilst the new regime on the prevention of marine pollution in the Convention has also considerable impact on this right. In practice, potential conflicts between coastal States and foreign merchant ships in internal waters and the territorial sea may well arise. This comprehensive study analyses these issues and cautiously strives for reasonable and generally acceptable solutions.

Abstract: The legal protection of the underwater cultural heritage is a field in which there is growing international interest. Shipwrecks and other underwater cultural remains in every maritime zone are threatened both by activities 'directed at' them, such as treasure hunting, and by activities 'incidentally affecting' them, such as mineral exploration and exploitation, pipeline and cable-laying, dredging, and fishing. Since the first edition of this collection (published in 1999), the urgent need for an international legal framework to regulate these activities has been formally recognised by the ado
Abstract: Comprises a collection of sixteen national perspectives on law, policy and practice in respect of the underwater cultural heritage, written in light of the UNESCO Convention 2001. This volume features essays which provide an account of the legal position in each jurisdiction, as well as considering the impact that the 2001 Convention is having

Abstract: These workshop proceedings assess the third party liability and compensation mechanisms that would be implemented by participating countries in the event of a nuclear accident taking place within or near their borders. To do so, two fictitious accident scenarios were developed: one involving a fire in a nuclear installation located in the Slovak Republic and resulting in the release of significant amounts of radioactive materials off-site, and the other a fire on board a ship transporting enriched uranium hexafluoride along the Danube River. The first scenario was designed to involve the greatest possible number of countries, with the second being restricted to countries with a geographical proximity to the Danube. These proceedings contain the papers presented at the workshop, as well as reports on the discussion sessions held.

Abstract: "The accession of eight post-communist countries of Central and Eastern Europe (and also of Malta and Cyprus) to the European Union in 2004 has been heralded as perhaps the most important development in the history of European integration so far. While the impact of the enlargement on the constitutional structures and practices of the EU has already generated a rich scholarly literature, the influence of the accession on constitutionalism, democracy, human rights and the rule of law among the new member states has been largely ignored. This book fills this gap, and addresses the question of the consequences of the ""external force"" of European enlargement upon the understanding and practice of democracy and the rule of law and among both the main legal-political actors and the general public in the new member-states. A number of leading legal scholars, sociologists and political scientists, both from Central and Eastern Europe and from outside, address these issues in a systematic and critical way. Abstract: "The Politics of Adoption identifies and analyses the fundamental social and legal functions of adoption. It is a timely publication as across the world adoption law reform is now giving rise to contentious issues. The change process underway in England and Wales offers an opportunity and a perspective to explore areas of commonality and difference in the experience of other nations. It also provides a window through which to examine the presumption that within and between cultures there exists a common understanding of what is meant by adoption. This book offers a comparative analysis of developments in the law, policy and practice of adoption in England and Wales, the US, Australia and Ireland. It explores the global phenomenon of intercountry adoption. The impact of the European Convention and other international legal instruments are assessed and the resulting implications for the future of adoption are considered. It suggests that the more 'open' experience of adoption in indigenous communities such as the Maori of New Zealand, the Aboriginal people of Australia and the Inuit of Canada challenges some of the basic assumptions underpinning adoption law in modern western nations. ""This is an excellent publication for those wanting to get an international perspective on the politics of adoption. It is authoritative and greatly informative."" Professor John Triseliotis ""Kerry O'Halloran's Politics of Adoption provides a comprehensive and thoughtful overview of adoption law, both domestic and international, in the common law world. It is an invaluable resource not only for practitioners and scholars but for anyone interested in acquiring an in depth understanding of adoption in all its forms and complexity."" Abstract: "Liberal theories have long insisted that cultural diversity in democratic societies can be accommodated through classical liberal tools, in particular through individual rights, and they have often rejected the claims of cultural minorities for group rights as illiberal. Group Rights as Human Rights argues that such a rejection is misguided. Based on a thorough analysis of the concept of group rights, it proposes to overcome the dominant dichotomy between ""individual"" human rights and ""collective"" group rights by recognizing that group rights also serve individual interests. It also challenges the claim that group rights, so understood, conflict with the liberal principle of neutrality, on the contrary, these rights help realize the neutrality ideal as they counter cultural biases that exist in Western states. Group rights deserve to be classified as human rights because they respond to fundamental, and morally important, human interests. Reading the theories of Will Kymlicka and Charles Taylor as complementary rather than opposed, Group Rights as Human Rights sees group rights as anchored both in the value of cultural belonging for the development of individual autonomy and in each person's need for a recognition of her identity. This double foundation has important consequences for the scope of group rights: it highlights their potential not only in dealing with national minorities but also with immigrant groups, and it allows to determine how far such rights should also benefit illiberal groups. Participation, not intervention, should here be the guiding principle if group rights are to realize the liberal promise."

Abstract: The book provides a comprehensive analysis of the advisory role of the International Court of Justice in light of its jurisprudence and overall contribution over a period of more than 55 years. The author highlights the `organic connection` between UN organs and the Court and the Courts contribution as one of the UNs principal organs to the Organisation. The basic argument of this study is that the advisory function should be understood as a two-sided process involving the interplay between UN organs and the ICJ. The request for and the giving of an advisory opinion is a collective coordinated process, involving more than one organ or part of the Organisation. The author concludes that the Courts role as a participant in the UNs work is circumscribed by its duty to act judicially. In practice, the Court has succeeded in establishing a balance between its role as a principal organ of the UN and its position as a judicial institution with a duty to administer justice impartially.

Furthermore, the book traces the essential characteristics of the common visa policy - restrictiveness, flexibility and dependency on activity under the intergovernmental Pillars -, relating these to the nature of the EU and considering the working of the EU pillar structure in this context. The working of the pillar structure is also considered in relation to some of the Union's efforts to build an ""area of freedom, security and justice""."

Abstract: Responsibility and Punishment, Third Edition presents a clear-headed defense of retributivism against several long-standing criticisms. In the end, a viable version of retributivism emerges as one which withstands more criticism than competing theories of responsibility and punishment. Extending the problem of wrong doing to collectives and compensation, Corlett explores the matter of reparations for past wrongs in the case of the crimes committed against Native Americans by the United States Government. No other philosophical work on responsibility and punishment exhibits this breadth of scope, as it delves deeply into particular concerns with retributivism, responsibility, and certain areas of compensation. Academicians and professionals in ethics, moral, social, political, and legal philosophy are likely to benefit from this analytical treatment of responsibility and punishment.

Abstract: Based on the expertise of thirty leading experts on confiscation in the EU, this is the first book to analyse the practice of proceeds from crime confiscation in the original fifteen EU Member States. It examines the implementation of confiscation provisions in all three (investigative, judicial and disposal) phases of confiscation proceedings. It quantifies the enforcement of confiscation provisions in the EU, using an innovative and unique methodology and thereby furnishes understanding of obstacles and best practices. The conclusion of the book is that the 'tough on criminal wealth' philosophy is largely alien to the everyday practice of law enforcement agencies. Putting criminals behind bars is still the main aim of the system, and most of the scarce resources available are devoted to achieving this. This title is of interest to academics and students in the fields of criminology, sociology, and law, as well as to law enforcement officers, public prosecutors, and policymakers.

Abstract: Methods of Legal Reasoning describes and criticizes four methods used in legal practice, legal dogmatics and legal theory: logic, analysis, argumentation and hermeneutics. The book takes the unusual approach of discussing in a single study four different, sometimes competing concepts of legal method. Sketched this way, the panorama allows the reader to reflect deeply on questions concerning the methodological conditioning of legal science and the existence of a unique, specific legal method.

Abstract: 60 years after the trials of the main German war criminals, the articles in this book attempt to assess the Nuremberg Trials from a historical and legal point of view, and to illustrate connections, contradictions and consequences. In view of constantly reoccurring reports of mass crimes from all over the world, we have only reached the halfway point in the quest for an effective system of international criminal justice. With the legacy of Nuremberg in mind, this volume is a contribution to the search for answers to questions of how the law can be applied effectively and those committing crimes against humanity be brought to justice for their actions

Abstract: The end of the Cold War brought about new secessionist aspirations and the strengthening and re-awakening of existing or dormant separatist claims everywhere. The creation of a new independent entity through the separation of part of the territory and population of an existing State raises serious difficulties as to the role of international law. This 2006 book offers a comprehensive study of secession from an international law perspective, focusing on practice and applicable rules of international law. It includes theoretical analyses and a scrutiny of practice throughout the world by eighteen distinguished authors from Western and Eastern Europe, North and Sub-Saharan Africa, North and Latin America, and Asia. Core questions are addressed from different perspectives, and in some cases with divergent views. The reader is also exposed to a far-reaching picture of State practice, including some cases which are rarely mentioned and often neglected in scholarly analysis of secession

Abstract: Crime prevention should be rational and should be based on the best possible evidence. Decision-makers should weigh heavily any available evidence on what works best. How can a program that has produced no discernable evidence of effectiveness, as shown through numerous evaluations, be considered for implementation? Unfortunately, this happens all the time. Evidence-based crime prevention attempts to overcome this and other obstacles by ensuring that the best available evidence is considered in any decision to implement a program designed to prevent crime. This book is about evidence-based crime prevention. A project of the Campbell Collaboration Crime and Justice Group, Preventing Crime brings together the leading scientific evidence on what works best for a wide range of interventions organized around four important domains in criminology: at-risk children, offenders, victims, and places. It is the first book to assess the effectiveness of criminological interventions using the most rigorous review methodology of the systematic review. It is an indispensable guide to the leading scientific evidence on what works best to prevent crime.

Abstract: This book analyses the interrelationship of recordkeeping, ethics and law in terms of existing regulatory models and their application to the Internet. It proposes an Internet model based on the notion of a legal and social relationship as a means of identifying the legal and ethical rights and obligations of recordkeeping participants in networked transactions. It also provides a unique approach to property, access, privacy and evidence for online records.
Abstract: Distributed networks such as the Internet have altered the fundamental way a record is created, captured, accessed and managed over time. Law and ethics provide the major sources of regulatory controls over participants in such networks. This book analyses the interrelationship of recordkeeping, ethics and law in terms of existing regulatory models and their application to the Internet environment. It proposes an Internet model based on the notion of a legal and social relationship as a means of identifying the legal and ethical rights and obligations of recordkeeping participants in networked transactions. Medical, business and governmental relationships within communities of common interest based on trust illustrate the practical application of the model. As legal relationships have their basis in the law of obligations found in common and civil law systems, as well as archival science, the model has a broad-based application. The relationship model also provides a unique ethical and legal approach to property, access, privacy and evidence. Most importantly, the book provides an interdisciplinary approach to Internet regulation, which contributes to closer ties between those who research, teach and work in fields of ethics, law and archival science.
Description / Table of Contents: The recordkeeping-ethics-law nexus and recordkeeping regulatory models; Identity, trust, evidence and the recordkeeping nexus; Legal and social relationships and the recordkeeping nexus; Recordkeeping participants: legal and ethical responsibilities; Property, privacy, access and evidence as legal and social relationships; Legal and social relationships as regulatory mechanisms; Recordkeeping regulatory models in the web environment; Legal and social relationships: an alternative Internet regulatory model

Abstract: What does it mean to have a right? Previous answers to this question fall into two groups: interest/benefit theories of rights and choice/will theories. This book proposes an alternative to these traditional views: the justified-constraint theory of rights, which avoids the pitfalls of earlier theories, and solves the puzzle of the relational nature of rights. The analysis shows that this theory applies without modification to past, present and future beings.

Abstract: This book enhances understanding and consensus on why and how we need to work more strategically and coherently on the integration of human rights and development. It reviews the approaches of different donor agencies and their rationales for working on human rights, and identifies the current practice in this field. It illustrates how aid agencies are working on human rights issues at the programming level, and it draws together lessons that form the core of the current evidence around the added value of human rights for development. Lastly, it addresses both new opportunities and conceptual and practical challenges to human rights within the evolving development partnerships between donors and partner countries, as well as in relation to the Paris Declaration on Aid Effectiveness as a new reference point of the international aid system. By giving numerous examples of practical approaches, this publication shows that there are various ways for donor agencies to take human rights more systematically into account – in accordance with their respective mandates, modes of engagement and comparative advantage.

Abstract: Preoccupation over the relationship between human rights and social justice and international trade competitiveness has led to the inclusion of the issue of the rights of workers in the agenda of leading international organizations. International labour issues once seen as a monopoly preoccupation of the ILO (International Labour Organization) have now become important issues in other international organizations, as well as within regional trading blocs. This original study examines the extent to which international labour issues have become issue of concern within the European Union, the ILO

The book's focus on reported case-law offers a new perspective on the Islamisation of Pakistan's legal system in which Islam emerges as more than just a challenge to Western conceptions of human rights. The first part examines the emergence of Islamic arguments in the period up to 1977 when General Zia ul Haq embark

Abstract: Citizenship is frequently invoked both as an instrument and goal of immigrant integration. Yet, in migration contexts, citizenship also marks a distinction between members and outsiders based on their different relations to particular states. A migration perspective highlights the boundaries of citizenship and political control over entry and exit as well as the fact that foreign residents remain in most countries deprived of core rights of political participation. This book summarizes current theories and empirical research on the legal status and political participation of migrants in European democracies

Abstract: Speaking about racism in the western political climate of the first decade of the twenty-first century is more difficult than ever before. There is a feeling in post-colonial and post-immigration societies that the blatant overt racism of the past is no longer as pressing. Admitting racism elicits discomfort because common wisdom tells us that racism opposes everything that we believe in as citizens of democratic, "civilised" modern states. Yet state racism appears to be here to stay and, in

Abstract: This paper analyses institutional reforms and political participation, most notably indirect and direct elections of residential committees (RC), in China's urban neighbourhoods and communities (shequ). It shows that these elections at present are not meaningful to the majority of city dwellers as the RCs have little decision-making power and no revenues generated by a collective economy as in most of China's villages. RCs are primarily important to those weaker strata of society who depend on the state to be provided with social services and financial support - tasks that the RCs are forced to assume on behalf of higher government authorities. Nevertheless, the author finds that as limited the significance of - and knowledge about - RC elections in the daily lives of China's urban dwellers still are, they still have some influence on political awareness and participation. For instance, they make people voice more opinions in their shequ, which may be a good starting point for more direct interference in local political affairs soon to come. The paper emphasizes that RC elections have been introduced in order to enhance regime legitimacy but suggests that they may spur democratization by the rise of accountability as a conditioning factor of this legitimacy and by electoral 'habituation' as a transition to full democratic commitment. Whilst 'security first, participation second' seems to be the order of the day and the 'freedom of politics' is still more important than a concern for RC elections and shequ affairs, it remains to be seen if those elections may not soon trigger off a meaningful drive for political participation in China's cities.
