    Abstract: The capacity to abuse, or in general affect the enjoyment of human, labour andenvironmental rights has risen with the increased social and economic powerthat multinational companies wield in the global economy. At the same time,it appears that it is difficult to regulate the activities of multinational companiesin such a way that they conform to international human, labour and environmentalrights standards. This has partially to do with the organization of companiesinto groups of separate legal persons, incorporated in different states, aswell as with the complexity of the corporate supply chain. Absent a businessand human rights treaty, a more coherent legal and policy approach is required.Faced with the challenge of how to effectively access the right to remedy inthe European Union for human rights abuses committed by EU companies innon-EU states, a diverse research consortium of academic and legal institutionswas formed. The consortium, coordinated by the Globernance Institute forDemocratic Governance, became the recipient of a 2013 Civil Justice ActionGrant from the European Commission Directorate General for Justice. A mandatewas thus issued for research, training and dissemination so as to bringvisibility to the challenge posed and moreover, to provide some solutions forthe removal of barriers to judicial and non-judicial remedy for victims of business relatedhuman rights abuses in non-EU states. The project commenced inSeptember 2014 and over the course of two years the consortium conductedresearch along four specific lines in parallel with various training sessions acrossEU Member States.The research conducted focused primarily on judicial remedies, both jurisdictionalbarriers and applicable law barriers; non-judicial remedies, both to company based grievance. The results of this research endeavour make up the content ofthis report whose aim is to provide a scholarly foundation for policy proposalsby identifying specific challenges relevant to access to justice in the EuropeanUnion and to provide recommendations on how to remove legal and practicalbarriers so as to provide access to remedy for victims of business-related humanrights abuses in non-EU states

    Abstract: Critical Race Theory is a familiar and important strand of North American legal scholarship, but it is virtually unknown in Europe. This book aims to bring Critical Race Theory to a European context. Outlining its development in North America, and bringing its insights to bear upon European law and legal scholarship, the book considers Critical Race Theorys relevance in Europe, and particularly in civil law traditions, where the relationship between race and law is often presented as anodyne. Redressing the almost exclusive European focus and reading of anti-racism in terms of anti-Semitism, the conflation of race and racism with issues related to citizenship and religion, and the more general reluctance to speak of race, the book outlines the elements of a European Critical Race Theory. For law, it is demonstrated, is just as deeply involved in constructing, discriminating and subordinating racial minorities in the European context as it is in the American one even if, as this book shows, it does so in different ways
    Abstract: "The CRT approach adopted in this book illustrates the reasons why the relationship between race and law in European civil law jurisdictions is far from anodyne. Law plays a critical role in the construction, subordination and discrimination against racial minorities in Europe, making it comparable, albeit in slightly different ways, to the American experience of racial discrimination. Anti-Semitism, Islamophobia, anti-Roma and anti-Black racism constitute a fundamental factor, often tacitly accepted, in the relationship between law and race in Europe. Consequently, the broadly shared anti-race and anti-racist position is problematic because it acts to the detriment of victims of racism while privileging the White, Christian, male majority

    Abstract: "Hate speech law can be found throughout the world. But it is also the subject of numerous principled arguments, both for and against. These principles invoke a host of morally relevant features (e.g., liberty, health, autonomy, security, non-subordination, the absence of oppression, human dignity, the discovery of truth, the acquisition of knowledge, self-realization, human excellence, civic dignity, cultural diversity and choice, recognition of cultural identity, intercultural dialogue, participation in democratic self-government, being subject only to legitimate rule) and practical considerations (e.g., efficacy, the least restrictive alternative, chilling effects). The book develops and then critically examines these various principled arguments. It also attempts to de-homogenize hate speech law into different clusters of laws/regulations/codes that constrain uses of hate speech, so as to facilitate a more nuanced examination of the principled arguments. Finally, it argues that it is morally fitting for judicial and legislative judgments about the overall warrant of hate speech law to reflect principled compromise. Principled compromise is characterized not merely by compromise over matters of principled concern but also by compromise which is itself governed by ideals of moral duty or civic virtue (e.g., reciprocity, equality, and mutual respect)"--

    Abstract: "In the context of growing global concerns about climate change, this book presents a regional and sub-continental synthesis of pastoralists' responses to past environmental changes and reflects on the lessons for current and future environmental challenges. Drawing from rock art, archaeology, paleoecological data, trade, ancient hydrological technology, vegetation, social memory and historical documentation, this book creates detailed reconstructions of past climate change adaptations across Sahelian Africa. It evaluates the present and future challenges to climate change adaptation in the region in terms of social memory, rainfall variability, environmental change and armed conflicts and examines the ways in which governance and policy drivers may undermine pastoralists' adaptive strategies. The book's scope covers the Red Sea coast, Somaliland, Somalia, the Ogaden region of Ethiopia, and northern Kenya, part of the Ethiopian highlands and Eritrea, areas where past climate change has been extreme and future change makes it vital to understand the dynamics of adaptation.     Abstract: This book explores the contentious topic of how collective and community issues should be protected and enforced in international law. Elena Katselli Proukaki takes a detailed look at the issue of third-State countermeasures, and considers the work the International Law Commission has done in this area. The volume addresses both the theory and practice of third-State countermeasures within international law. Critically reviewing the conclusions of the International Law Commission on the non-existence of a right to third-State countermeasures, it includes consideration of examples of State practice not previously covered in the literature of this topic.
