Kurzfassung: Chapter 1 The Mosque and the State in Turkey -- Chapter 2 The Kindred Evolution of the Turkish State and Diyanet -- Chapter 3 Redefining Diyanet in the AKP Era -- Chapter 4 Swinging between Turkish Nationalism and Global Pan-Islamism -- Chapter 5 Militarism, Necrophily, Glorification of Martyrdom and Jihadism -- Chapter 6 Securitisation, Demonization and De-humanisation of AKP’s Opponents -- Chapter 7 Conspiracy Theories and Politics of Victimhood -- Chapter 8 Populist Civilizationism, Otherization of Christians, and Antagonism Towards Interfaith Dialogue -- Chapter 9 The Future of the Mosque-State Relations in Turkey.
Kurzfassung: This book explores state–religion relations under a populist authoritarian ruling party in Turkey. In doing so, it investigates how the ruling Justice and Development Party (AKP) instrumentalizes state-controlled religion to further, defend, legitimatize and propagate its authoritarian populist political agenda in a constitutionally secular nation-state. To exemplify this, the authors examine the Friday sermons delivered weekly in every mosque in Turkey by the Turkish State’s Directorate of Religious Affairs (Diyanet). By analyzing all sermons delivered between 2010-2021, the book shows how the Diyanet has enthusiastically adopted AKP’s increasingly Islamist, authoritarian, civilisationist, militarist and pro-violence populism since 2010, and how it has tried to socially engineer beliefs in line with this ideology. Ihsan Yilmaz is the Research Professor and Chair of Islamic Studies and Intercultural Dialogue at the Alfred Deakin Institute for Citizenship and Globalisation, Deakin University, Melbourne, Australia. He has conducted mixed-method research on nation-building, citizenship, Islam–state–law relations in majority and minority contexts (Turkey, Pakistan, Egypt, Indonesia, UK, USA and Australia), authoritarianism, Islamism, populism, transnationalism, ethno-religious and political minorities, securitisation, political participation and intergroup relations. He was Professor of Political Science at Istanbul Fatih University (2008-2016), Lecturer in Law, Social Sciences and Politics at SOAS, University of London (2001-2008), and a fellow at Centre for Islamic Studies, the University of Oxford (1999-2001). Ismail Albayrak is the Professorial Fellow at the Australian Catholic University, Melbourne. He has worked on Islamic studies and specifically on Qur’anic Studies, Classical Exegesis, Contemporary Approaches to the Qur’an and Orientalism. He is also interested in the place of Muslim communities and their activities in globalizing world together with a focus on interfaith dialogue. In line with these areas of interest, he has built a strong teaching and research track record in the study of Islam and complementary understanding of interfaith principles. His recent publications have focused on Islamic studies, Qur’anic studies, Interfaith dialogue, Muslims in modern world, Islamic movements and Islamic mysticism.

Kurzfassung: This book brings together some of the most respected Asian and Australasian experts on medical liability to provide insightful perspectives on civil and criminal law from selected Australasian jurisdictions. It focuses on the idiosyncrasies of the existing law and case law in this part of the world with regard to medical liability, adopting a comparative and critical perspective. The aim is to provide an overview of the basic elements of medical liability in Asian and Australian jurisdictions, as well as the latest developments and general trends in jurisprudence. Given the broad range of jurisdictions covered, the book offers lawmakers, health administrators and practitioners, both in law and medicine, an alternative approach to the delivery of health care. Further, it is essential reading for all those (academics, lawyers, judges, researchers, practicing doctors and those involved in the growing area of legal medicine) working in medical liability, specially in the Australasian context.

Kurzfassung: This book analyses how public toilets were provided by the government and local business in Hong Kong between the 1860s and 1930s through a process that was embedded in class and racial politics. Addressing public toilet provision from a political economy perspective, it focuses on the interplay of the cross-border night soil business between Hong Kong and China’s silk producing area; the silk market between China and Colonial powers; the Hong Kong land market between the colonial government and Chinese business; and how these factors jointly produced a network of toilets in the colony. As the book shows, the commercial viability of toilets created multiple logics and a new moral geography; further, exploring the topic can help us gain a better understanding of how urban governance functioned in colonies and how it intertwined with economic contingencies within a global economic system. The intended readership includes academics and members of the general public with an interest in colonialism, public infrastructures, public health, government–business relations, and urban governance.

Repatriation of Korean Captives from Japan after Toyotomi’s Invasion.
Kurzfassung: This book is divided into two parts. One is the state of trade in East Asia before and after the collapse of the tributary system to the Ming Dynasty, and the other is the war of aggression in which Toyotomi Hideyoshi of Japan sent a large number of troops to the Korean Peninsula with a view of conquering China at the end of the sixteenth century. With regard to East Asia in the sixteenth and seventeenth centuries, the contributors in this book share a problem awareness in terms of using trade and war as subjects to clarify multi-ethnic, borderless, and multi-layered situations. Although there are many chapters related to Japan, this book tries to grasp the interaction between Japan as a region of East Asia and neighboring countries from a global perspective, not the one singular national history. Mihoko Oka is an associate professor at the School of Interdisciplinary Information Studies and Historiographical Institute, University of Tokyo.

Kurzfassung: This book is a study of the change and continuity in paradigms in China studies, both inside and outside of China. In the last few years, the United States and China appeared to be moving in the direction of “de-coupling,” indicating that the engagement policy with China in the last four decade is ending. The “modernization theory” that is the theoretical foundation of the engagement policy has proved to be wrong. This situation calls for a reexamination of the field of China studies. Historically, scholarly paradigms shifts often went hand in hand with drastic social change. As we have entered an era of great uncertainty, it is constructive to reflect on the paradigms in China studies in the past and explore the possibility of new paradigms in the future. How are the shifts of major theories, methods and paradigms in China studies in the west related to social change? How did some of China’s paradigms impact on the country’s social change and developments? This book will appeal to a wide readership, including scholars and graduate students, upper division undergraduate students of China studies, Asian studies. Shiping Hua is Calvin & Helen Lang Distinguished Chair in Asian Studies, Director of Asian Studies Program, Professor of Political Science at The University of Louisville, USA.

It is organized in specific themes in thirteen chapters. It incorporates a wealth of research on India’s strategic significance in the Indian Ocean arena throughout history. It enriches the reader's understanding of the emergence of the Indian Ocean basin as a global arena for cross-cultural networking and nation-building. It discusses issues of trade and commerce, the circulation of ideas, peoples and objects, and social and religious themes, focusing on Hinduism, Buddhism, and Islam. The book provides a refreshingly different survey of India’s connected history in the Indian Ocean region starting from the archaeological record and ending with the coming of empire. The author’s unique experience, combined with an engaging writing style, makes the book highly readable. The book contributes to the field of global history and is of great interest to researchers, policymakers, teachers, and students across the fields of political, cultural, and economic history and strategic studies.

Kurzfassung: This book looks at a substantively new model of educational philosophy and its application within the field of tertiary education, in relation to socio-economic development in Southeast Asian members of the Organization of Islamic Conferences (OIC). Focusing on and drawing from the cross-regional South East Asian Cooperation (SEACO), a network promoting regional economic cooperation, the author presents a thoughtful evocation of a new orientation to educational philosophy and policy within the development context in the time of, and relating to, COVID-19. The generalized worldview of Islamic educational and socio-economic development model is laid down in relation to the philosophy of education and an ethical-scientific structure of development in terms of the theory of knowledge (epistemology, episteme). The foundation of scientific thought and a comparative Islamic worldview in understanding the unified reality of ‘everything’ is presented. The objectivity of socio-scientific learning at all levels of educational development is further explained within the context of SEACO and its think tank vis-à-vis a reconstructive perspective in which the Islamic episteme of the unity of knowledge and its substantive methodology is addressed and unpacked. The book is relevant to policymakers and scholarly researchers in Islamic philosophy and development and higher education in Southeast Asia and in the Muslim world and more broadly for the world of learning. .

Kurzfassung: The problem of enforcing a money judgment exists in every legal system in the world, but the methods and orientation vary significantly. Effective enforcement proceedings are crucial to ensure full access to justice for creditors. Complete and full knowledge of the debtors’ assets is crucial to choose the appropriate enforcement measure. But each legal system must balance the creditors’ rights to an efficient enforcement with the debtors’ rights. The wide differences between enforcement proceedings mirror the way each society tries to find a balance between confronting rights and interests. This book explores and compares how different legal systems approach these issues with a focus on the discovery of debtors’ assets, which is a common problem for enforcement and execution proceedings in almost every jurisdiction. This is the first book to compare enforcement proceedings around the world and presents a variety of information and country reports from leading experts from four continents. It represents the joint work of academic and legal authorities from Germany, Japan, Korea, France, the UK, Switzerland, Austria, Spain, Poland, Russia, Greece, North America, Taiwan, Brazil, Argentina, Chile, and the EU.

Kurzfassung: This book highlights that an independent judiciary is indispensable for the very existence of any society based on democratic values, such as the observance of the rule of law and respect for the human rights of individuals. In order to ensure that the judiciary’s interpretation of the law is not bound by the will of the executive and that it is able to call the executive to account by protecting the life as well as liberty of the governed, it is imperative to guarantee, among other things, a transparent method of appointment and the security of tenure of the judges. Taking into account the importance of an independent judiciary in a democratic society, the framers of the Constitution of Bangladesh, 1972, following in the footsteps of the framers of the Constitutions of India and Pakistan, incorporated in the Constitution the ideal of safeguarding the independence of the judiciary as one of its basic features. This book, however, makes it manifestly evident that the key elements for realising such an ideal have not adequately been guaranteed by the Constitution. Consequently, this book sheds light on how succeeding generations of executives have sought to undermine the independence of the judiciary. Accordingly, this book puts forward recommendations for the insertion of detailed norms in the Constitution of Bangladesh for establishing the best means for excluding patronage appointments to the bench and for guaranteeing the security of tenure of the judges. This book asserts that the incorporation of such norms, safeguards the independence of the superior judiciary to decide cases without fear or favour. This book, therefore, seeks to address the gap that exists between the theory and practice concerning the independence of the judiciary in Bangladesh. Since no book is currently available in the market that critically examines these issues in a systematic and structured manner, this research enhances knowledge by not only identifying the flaws, deficiencies and lacunae of the constitutional provisions concerning the method of appointment of the judges of the Supreme Court of Bangladesh but also the measures undertaken by the current Bangladeshi regime to dispense with the transparent method of removal of the judges involving a body of judicial character.

Kurzfassung: This book provides updated, full-picture analysis of the laws and practices of cross-border debt finance in the PRC. It is featured by the first-handed experiences of the author’s academic research and legal practice in this field over two decades. The author discusses legal and regulatory issues, transaction structures and documentation in relation to two debt finance products: loan and bond, covering the inbound structure (Chinese debtors’ raising funds from the international market) and the outbound structure (Chinese creditors’ supplying funds to the international market). For cross-border loans, this book thoroughly illustrates the foreign debt regulatory regime in the PRC and approaches the lending by Chinese banks to support exports and overseas investments under the “Belt and Road Initiative” (BRI). For cross-border bonds, it discusses how Chinese issuers, by designing various transaction structures, enter into the international bond market, and then researches the “opening-up” of Chinese bond market to both international issuers (for issuing “Panda Bonds”) and investors (for purchasing Chinese bonds). This book is used as an authoritative source for not only students and researchers, but also bankers and legal practitioners, who are interested in the Chinese debt finance market.

Kurzfassung: This book presents the outcomes of a study on indices of rule by law in China conducted by the Chinese Academy of Social Sciences (CASS). Since 2009, a group of researchers at the CASS Institute of Law has worked to assess the Chinese government’s transparency. In this context, they designed an index system to truthfully record and reflect the reality and development of openness in the Chinese government for eight consecutive years. This book compiles their reports on each year’s development, systematically combining quantitative analysis and the status quo for each year. Thanks to these reports, readers will be able to clearly understand the evolution of the Chinese government’s openness during these eight years. They highlight what the government has done to improve transparency, what has been achieved, and the goals for the future. These reports have not only been acclaimed in academic circles, but have also greatly influenced government policies and procedures. For example, the assessment was expanded to the judicial system including the Supreme People’s Court, maritime court, and local provincial courts in 2011, and ever since the national judicial system’s openness has been considerably improved, in response to recommendations based on the assessment. .

Kurzfassung: Introduction -- The form of Data Monopoly -- Defining Relevant Market for Data Monopoly -- Entry Barriers of Data Monopoly -- Abuse of Dominant Position -- The Impact on Consumer Welfare -- Conclusions.
Kurzfassung: This book analyzes the business model of enterprises in the digital economy by taking an economic and comparative perspective. The aim of this book is to conduct an in-depth analysis of the anti-competitive behavior of companies who monopolize data, and put forward the necessity of regulating data monopoly by exploring the causes and characteristics of their anti-competitive behavior. It studies four aspects of the differences between data monopoly and traditional monopolistic behavior, namely defining the relevant market for data monopolies, the entry barrier, the problem of determining the dominant position of data monopoly, and the influence on consumer welfare. It points out the limitations of traditional regulatory tools and discusses how new regulatory methods could be developed within the competition legal framework to restrict data monopolies. It proposes how economic analytical tools used in traditional anti-monopoly law are facing challenges and how competition enforcement agencies could adjust regulatory methods to deal with new anti-competitive behavior by data monopolies.

Kurzfassung: An overview of China’s tax system -- The rule of Law China and its requirements for the tax system -- China’s tax system structure: issues and solutions -- Improving the tax-sharing system -- Local taxes: issues and solutions -- Tax collection and management: issues and solutions.
Kurzfassung: This book discusses China’s tax system, presenting a comprehensive and systematic research based on a multidisciplinary approach involving economics, finance, political science, sociology, law, public administration, history, and econometrics. With China moving toward the rule of law, this book proposes reforms to the tax laws and the stratified governance with a view to achieving tax neutrality, law-based taxation, tax equality and tax burden stability. It focuses on clarifying the implications, extension, nature, and features of a law-based tax system as well as the logical relationships between the optimization of the tax system structure, modern governance, law-based tax administration, as well as the tax-sharing system of tax collection and the rule of tax law. It suggests that optimizing the tax structure, reforming the tax-sharing system, improving local taxes, and restructuring the tax collection and management system will push China's tax system toward sound design and rule of law. This book is intended for scholars specializing in China’s tax system and general readers interested in China’s economy.

Kurzfassung: This book brings together an impressive group of scholars to critically engage with a wide-ranging and broad perspective on the historical and contemporary phenomenon of Zen. The structure of the work is organized to reflect the root and branches of Zen, with the root referring to important episodes in Chan/Zen history within the Asian context, and the branches referring to more recent development in the West. In collating what has transpired in the last several decades of Chan/Zen scholarship, the collection recognizes and honors the scholarly accomplishments and influences of Steven Heine, arguably the most important Zen scholar in the past three decades. As it looks back at the intellectual horizons that this towering figure in Zen/Chan studies has pioneered and developed, it seeks to build on the grounds that were broken and subsequently established by Heine, thereby engendering new works within this enormously important religio-cultural scholarly tradition. This curated Festschrift is a tribute, both retrospective and prospective, acknowledging the foundational work that Heine has forged, and generates research that is both complementary and highly original. This academic ritual of assembling a liber amicorum is based on the presumption that sterling scholarship should be honored by conscientious scholarship. In the festive spirit of a Festschrift, this anthology consists of the resounding voices of Heine and his colleagues. It is an indispensable collection for students and scholars interested in Japanese religion and Chinese culture, and for those researching Zen Buddhist history and philosophy. .

Kurzfassung: This book revisits the discourse theories of Habermas and Foucault in a Chinese context. After arguing that Habermas’s Discourse Theory of Law and Democracy is too normative and idealistic, it presents Foucault’s Discourse Theory of Power Relations to illustrate the tensions between different Western discourse theories. The book then draws on the normative concept of Confucian Rationality from traditional Chinese cultural sources in order to investigate how adaptable these two discourse theories are to the Chinese society, and to balance the tension between them. Presenting these three dimensions of discourse theory, as well as the relations between them, it also uses empirical descriptions of certain facts of political-legal discussion both in traditional China and in the country’s new media age to explain, supplement and question this theoretic framework. The book asserts that, because of the diverse modes of thinking in specific cultures, there might be different normative paradigms of discorse and different political-legal discussion modes across corresponding cultural contexts. Normative discourse theories provide guidance for the practices of deliberative democracy and legal discussions, which can in turn verify, supplement, improve and challenge the normative discourse theories. In addition to demonstrating the multiple dimensions of discourse theories, this research also promotes an approach to the Discourse Theory of Law and Democracy that combines elements of both Chinese and modern society. .

Kurzfassung: Introduction: Observing Law and Order -- Action, Culture and Order -- Law Pluralism, Social Control and Order -- Conclusion: Constructing a Legal Theory Centered on Chinese Issue.
Kurzfassung: This book, based on extensive ethnographic material, analyzes the complex relationships between the law and various social controls, helping to answer the question of how social order is formed. Formal law exists in a web of complex structures and meanings. Accordingly, legal study must take into account multiple types of order, allowing us to understand in depth the strengths and weaknesses, reasonable and absurdity, and successes and failures of the law. In addition, the interactions of numerous actors shape the structure and context of the law. Exploring these aspects—while also highlighting diverse informal/non-state norms that influence day-to-day social practices, and which have never been replaced by modern laws—the book offers an insightful resource for all readers who are interested in the practice of Chinese law or in the connections between culture, society, and the law.

The chapters rely on the cases and changing dynamics of elections and electoral violence in the different Nigerian states. Good Faith in Domestic Laws and International Instruments -- Chapter 5. Manifestations of Good Faith in the Context of Hardship under the UNIDROIT Principles and the Way Forward -- Chapter 6. The Future Solution to Hardship: A Relational and Good Faith Approach.
Kurzfassung: This book provides fair and acceptable solutions to hardship issues in long-term relational supply contracts. This book uses an approach to strike a balance between the traditional approach underlying classical contract law which emphasises the almost absolute prevalence of the principle of pacta sunt servanda and a flexible approach that is based on the principle of clausula rebus sic stantibus. This book argues for an emerging principle of pacta sunt servanda bona fide on the basis of the relational contract theory. Additionally, this book demonstrates how good faith can serve as a foundation for imposing a duty to renegotiate on the parties. The aim of this book is rather to propose how relational contract theory can be applied to the analysis of specific legal rules in general. Lastly, this boos highlights how the duty to renegotiate and the power to adapt a contract can be further developed upon the occurrence of hardship, based on good faith and the relational nature and characteristics of a long-term relational supply contract. This book explores and enriches the existing research on relational contract theory concentrates primarily on its application in domestic contract laws, particularly in the regulation of long-term contracts in American contract law. As an outcome this book provides a more feasible and satisfactory approach for courts or arbitral tribunals to undertake when facing hardship issues in international contract disputes. Overall, hardship themes, long-term relational supply contracts and good faith are examined extensively. .

Kurzfassung: This book provides an overall understanding of Chinese labour law and covers many important issues related to the application of Chinese labour law. Particularly, the book explains the difficult points in Chinese labour law from the perspective of juridical practice. Many typical cases are selected to illustrate the important issues in Chinese labour law. These cases are from the courts in the developed areas in China, where foreign-funded enterprises gather. Also, the book addresses the implications of the Civil Code on the labour law. The latest developments are reflected in the book, which include guidelines related to labour dispute case hearing formulated by the Higher Courts in many provinces, and the guiding cases released by the Supreme Court. Such developments are the reflections of fragmented judicial application of Chinese labour law.

Kurzfassung: This book is the first book to comprehensively and deeply explain and construct the legal system of Chinese art auctions. Based on agency theory in traditional contract law, this book combs the legal relationship between client, auctioneer, and buyer. Aiming at the most difficult problem of art identification, this book shows the obligations that auctioneers must perform and the common methods for auctioneers to avoid these obligations. The purpose of this book is to ease the current situation in which the interests of buyers and auctioneers are too opposed and speed up the legalization process of art auctions through the construction of the legal system of art auctions in China. Additionally, using the method of policy demonstration, this book discusses how public power should intervene in the process of art auctions.

Kurzfassung: This is the first book published that focuses on competition law and policy in the Japanese pharmaceutical sector. It consists of chapters written and edited by academics who research the industry from various perspectives, including economics, competition law, pharmaceutical regulations, and intellectual property law. Competition policies involving pharmaceutical products attract attention from academics and policymakers worldwide. The pharmaceutical industry is regulated by drug laws that vary from country to country and are affected by differing practices and industrial structures. The book begins by examining drug regulations and trade practices in the industry that are peculiar to Japan and its healthcare system. It then presents the Japanese Antimonopoly Act and cases involving it, and discussions of current competition law issues in the Japanese pharmaceutical industry. The book also discusses innovation and intellectual property and economic analyses of pharmaceutical regulations and drug discovery. The chapters include comparative studies on Japanese regulations vs. those in the European Union and the United States. Japan is one of the biggest pharmaceutical markets in the world. With this in mind, the book provides “one-stop shopping” for anyone interested in pharmaceutical regulations in the country. Covering the basics but extending to in-depth explorations of complex problems, this book appeals not only to students and academics, pharmaceutical companies and regulators, but also to those dealing with real-world policy issues that encompass competition policy, intellectual property, and pharmaceutical regulation. Kurzfassung: This book examines the structures and processes of political decision-making and governance in Nigeria. Since Nigeria returned to elected government in 1999, it has been observed that several factors account for the differences between the design of statutory structures and processes of political decision-making and how they operate in reality. In other words, there are wide gaps between statutes and practice of political decision-making. However, the nexus between the two remains largely understudied by political scientists. Instinctively, political scientists assume that informal influences in political decision-making are aberrations, episodic or temporary. This book is designed to interrogate the nexus between the formal and non-formal dimensions of the dynamics of political decision making in Nigeria and also provide evidence about the actual functioning of governmental structures in Nigeria. The thesis of the book is that the non-formal dimension of political decision making as evidenced in rising ethno-political patronages, religious sentiments, clientelism and factionalism, are interacting with formal decision-making structures in ways that largely undermine the latter and, by extension, the democratic system. The book pursues this thesis by examining the roles of actors and institutions including, electoral choices made by voters, legislations, which perhaps is the most fundamental form of political decision-making, policies made by the executive and administration, as well as decision making within political parties, since parties are sites for articulating and aggregating issues on which decisions are to be made. Kurzfassung: Risk Management in Outer Space Activities assesses selected risks associated with space activities, from an Australian and New Zealand perspective. The book explores the rise of commercial space activities and considers the development of Australia and New Zealand’s regulatory frameworks, and how they are equipped to address new and emerging risks in the space sector. The book examines the juxtaposition of international space law against the domestic legal regimes of Australia and New Zealand, and how these regulatory frameworks are designed to create governance mechanisms to control space risk. Both national jurisdictions approach space risk from the perspective of liability and international legal obligations, but as a result of their different historical space trajectories, their risk approaches differ. This is illustrated by research that suggests that from an Australian point of view, much of its space industry development has been influenced by Cold War era military and national security concerns. On the other hand, the New Zealand perspective is grounded on the rapid market-led commercial development that is currently underway in the country. The book examines a variety of risks that can and do emerge in the course of undertaking space activities. It does this by presenting a series of space risk case studies. There are chapters devoted to examining commercial space risks, space insurance, the risks posed by space debris, cybersecurity and space assets, light pollution as a risk for astronomy and the risks inherent in landing objects on the Moon. The work contained in this book is intended to provide a clear, practical and informed approach to understanding risk management in outer space activities. It will appeal to policy makers, risk professionals, space lawyers, national space agencies as well as academics, researchers and students.

Kurzfassung: This book focuses on the PRC’s cross-border data transfer legislation in recent years, as well as the implications for international trade law. The book addresses the convergence of industries and technologies notably caused by digitization; the issue of conflicts between goods and services; and the General Agreement on Tariffs and Trade (GATT) and General Agreement on Trade in Services (GATS) as well as the difficulty of classifying service sectors under WTO members’ commitments. The book also examines the FTAs that entered into force after 2012 that regulate digital trade beyond the venue of the WTO and analyzes their rules of relevance for cross-border data flows and international trade. It asks whether and how these FTAs have deliberately reacted to the increasing importance of data flows as well as to the trouble of governing them in the context of global governance.

Conclusion: Gandhi and Ambedkar: Philosophical divergences and convergences. .
Kurzfassung: This book reconstructs the philosophical issues informing the debate between the makers of modern India: Ambedkar and Gandhi. At one level, this debate was about a set of different but interconnected issues: caste and social hierarchies, untouchability, Hinduism, conversion, temple entry, and political separatism. The introduction to this book provides a brief overview of the engagements and conflicts in Gandhi and Ambedkar's central arguments. However, at another level, this book argues that the debate can be philosophically re-interpreted as raising their differences on the following issues: The nature of the self, The relationship between the individual self and the community, The appropriate relationship between the constitutive encumbrances of the self and a conception of justice, The relationship between memory, tradition, and self-identity. Ambedkar and Gandhi’s contrary conceptions of the self, history, itihaas, community and justice unpack incommensurable world views. These can be properly articulated only as very different answers to questions about the relationship between the present and the past. This book raises these questions and also establishes the link between the Ambedkar--Gandhi debate in the early 20th century and its re-interpretation as it resonates in the imagination and writing of marginalized social groups in the present times.

Kurzfassung: This volume is the most comprehensive and up-to-date compilation of in-depth analyses on human rights violations committed in war. It offers myriad perspectives on the content and application of legal protections offered to civilians, including women, children and the elderly, and to others who are ‘no longer active in the fight.’ A series of carefully researched case studies illustrates the extent to which human rights violations occur in recent and current armed conflict, and signals the ways in which these violations are dealt with. Each of the contributing authors has been selected on the basis of their international academic reputation and/or professional standing within the human rights field. Given the alarming numbers of people harmed in recent and current armed conflict, this book will be of great interest to researchers, policymakers and opinion-shapers alike.

Kurzfassung: This book discusses human rights law, focusing on Chinese contributions to international human rights viewed from a perspective of global governance. The original research presented here integrates a variety of research methods: inter-disciplinary approaches, historical and comparative methods, documentary research and so on. The research findings can be described briefly as follows: In global governance, the Universal Declaration of Human Rights (UDHR) serves as a historic cross-cultural heritage, while Pengchun Chang, the Chinese representative, made great contributions to the establishment of the international human rights system. After examining the characteristics of the Chinese discourse on human rights in global governance, the book suggests fundamental principles for improving human rights standards in China. In addition, it explores Chinese concepts of human dignity concerning the Declaration on Human Dignity for everyone, everywhere. The target readers are global scholars and students of law, politics, philosophy, international relations, human rights law, religion and culture. The book will provide these readers a vivid picture of China’s contributions to international human rights, and a better understanding of the significance of traditional Chinese culture and wisdom. .

Kurzfassung: Climate change is one of the most serious global challenges facing humankind. Climate change has enormous environmental and economic implications, and finding a solution is a daunting task. The purpose of this book is to look at the global problem of climate change through the prism of an individual country's attempt to tackle this problem. This book begins with a discussion of the origins of climate change and the evolution of the international response to climate change. Key climate change mitigation actions and policies are considered to provide the necessary framework for analysing Australia's approach to climate change. Australia's climate change policy development is considered from a historical perspective. The book traces the evolution of the response to climate change, focusing on Australia as one of the Federal countries unable to adequately reduce greenhouse gas emissions due to the systematic failure of the Australian government to develop a common and effective approach to the problem of climate change. The book will be of interest to scholars and students of environmental law and the contemporary International and Australian climate change law.

In contrast to previous studies, it systematically collects a large sample of judicated securities fraud cases and public sanctions as disclosed by the listed companies. The enforcement regime is further divided into the private enforcement exemplified by the civil litigation imitated by harmed investors and public enforcement by sanctions proceedings initiated by public agencies. Academic researchers, policy makers and practitioners, who are interested in the securities market and regulation could find the information provided in this book interesting. .

Kurzfassung: “These well-researched articles draw a striking and timely picture, at the ground level, of a regime that has become a conduit for plunder and dispossession. The authors describe an arena where authoritarian repression of criticism and opposition has grown, but resistance has also been mounting. The unique focus on resistance of this excellent collection injects a much-needed note of optimism into the literature.” – Çağlar Keyder, Professor of Sociology, State University of New York, Binghamton “Has neoliberalism been in decline in the past decade? Is resistance against authoritarian governments no longer possible? In response to both questions, Authoritarian Neoliberalism and Resistance in Turkey convincingly says no!” – Deniz Yükseker, Editor, New Perspectives on Turkey “This exemplary edited collection adds depth and clarity to our understanding of the dynamics of authoritarian neoliberalism in Turkey, as well as providing insights applicable beyond the Turkish case. It does so through the combination of a clear and systematic conceptual framework on consolidating and contesting authoritarian neoliberalism.” – Yunus Sözen, Assistant Professor of Political Science, Le Moyne College This book offers new clarity on three important political concepts: authoritarianism, neoliberalism, and resistance. While debates on authoritarian resurgence have been limited to the examination of political factors (e.g., polarisation, conflict) until recently, the rising literature on ‘authoritarian neoliberalism’ highlights how the neoliberal restructuring of political economy bolsters the authoritarian tendencies of elected governments both in the Global South and the Global North. This book will be an invaluable resource not only to scholars of Turkey and the Middle East but also to researchers into authoritarianism and neoliberalism around the world. Kurzfassung: This book discusses how tensions and unknowns may impact future relations between a post-Brexit UK, the EU and the countries of the Gulf, including Iran. The authors of this book consider, in different ways, whether British and EU27 relations with the Gulf States may change or whether the traditions and the weight of their history reinforce the preexisting patterns of these relationships. Ongoing changes in the Gulf, the present disputes and the trajectories economic reform also influence these discussions. The book analyses the changing positions of the US, China and Russia that are likely to impact Europe’s interests. It explores outcomes of ongoing world challenges, such as the COVID-19 pandemic and the crash of oil prices, to further examine Post-Brexit Europe and UK policy challenges towards Iran and the GCC States. Kurzfassung: This book explores the emergent concept of 'human security' within the political context of COVID-19 Chinese politics. For decades, Western nations have used 'human rights' as a rubric with which to scold Chinese leaders, betraying a fundamental unwillingness to accept diversity of governance systems. As COVID-19 has demonstrated, different governance systems yield different outcomes—the freedom of circulation, speech and movement in Western democracies yielding one, and use of surveillance, lockdowns, and private–public collaboration in China and Asian societies such as Korea and Singapore yielding another. Chinese political scientists have become fixated on the notion of 'human security,' a utilitarian concept which insists on the importance of protecting and extending human life via health care, technology, and a wide range of other systems—sometimes, in ways which contradict Western notions of human rights, even as they demonstrably achieve superior outcomes for the humans involved. Being the first English language book to explore these issues, this book aims to generate a sustained theoretical relevance in the aftermath of the crisis which is likely to have lasting effects on how people live and will be of note for political scientists, China scholars, and economists. Chi Zhang is British Academy Postdoctoral Fellow at the University of St Andrews and an Associate Member of the Handa Centre for the Study of Terrorism and Political Violence. The Fundamentals of Social Impact Management -- Chapter 4. How to strategize and apply CSR. Activities -- Chapter 5. Towards Competitive Advantage and Sustainability -- Part II: Case Studies -- 20 cases from all over the world covering both developed and emerging economies.
Kurzfassung: This casebook argues that corporate sustainability agendas should look beyond stakeholder demands and desires, towards strategic opportunities to achieve social and commercial benefits simultaneously. It encourages shifting focus from a strategic approach to a sustainable business practice. As the cases in the book highlight, it is in every company’s best interest to identify a manageable number of sustainability initiatives whose shared benefits—for society at large and the company—are significant and also substantially help the company strategically position itself in the competitive marketplace. Strategic sustainable business practices can lead to shared value creation, strengthening the company’s competitiveness and establishing a symbiotic relationship. Companies can achieve solid profits by doing good things for the environment; it is a “win-win” for society and for business. This casebook provides examples of multi-stakeholder partnerships that aim to create sustainable enterprises. Ideal for teaching purposes, after a brief introduction to the case method, the cases are presented with no comments or criticisms.

Kurzfassung: This book examines aesthetic issues based on humanities principles and creates a theory of Chinese aesthetics from a global perspective by applying China’s traditional and cultural history to a Western theoretical framework. In particular, this book emphasizes the shared features of Confucianism, Daoism, and Buddhism, namely the unity of heaven and men, unity of nature and society, and the materialization of human feelings and humanization of material things. It also highlights the dominant role of humans in the aesthetic relationship between human and object, while placing imagery in a focal position. .

Kurzfassung: This edited volume starts from the perspectives of Beijing in how it sees that religion should serve the interests of the state. From China’s viewpoint, religion should act as a stabilizing force of society, or else the Christian Churches will lose their reason for existence. This might be incomprehensible to Western Christians, who believe in the freedom of religion and their right to embrace their faith. This collection of articles represents the concerted efforts of Chinese, Italians, and an American—who live in China, Europe, and the United States and belong to different disciplines, such as History, Religious Studies, and Language Studies—to promote a better understanding of the Catholic Church in the world and in China.

Further, it introduces readers to the cultural and ideological differences between Mongolian shamanists, who believe in the Eternal Blue Sky, and modern Mongols, who follow Buddhist teachings. In closing, the authors put forward the idea that Mongolian shamanism could have helped build great empires, emphasizing, e.g., shamanism’s influence on Mongolian culture and literature in the Middle Ages.

Kurzfassung: This book examines interactions and discusses intersectionality between public international law and private international law. With contributions from scholars from USA, Canada, Australia, India and EU, this book brings out truly international perspectives on the topic. The contributions are arranged in four themes—Public international law and private international law: historical and theoretical considerations of the boundary; Harmonisation of private international law by public international law instruments: evaluation of process, problems, and effectiveness; Case studies of intersectionality between public international law and private international law; Future trends in the relationship between public international law and private international law. The ultimate aim of this book is to analyse whether these two legal disciplines become convergent or they are still divergent as usual. With wide coverage spanning across these four themes, the book has takeaways for a wide readership. For scholars and researchers in the fields of public international law and private international law, this book sparks further thoughts and debates in both disciplines and highlight areas for continuing research. For practitioners, this book offers fresh insights and perspectives on contemporaneous issues of significance. This book is also be a great resource for students at both undergraduate and postgraduate levels taking subjects such as public international law or private international law or some related disciplines such as international sale of goods, international trade law or international investment law to advance their knowledge and understanding of the disciplines.

Kurzfassung: Introduction -- Theoretical Framework of IPH Study -- Perpetrator and Victim of IPH -- Intimate Relationship between Perpetrator and Victim -- Main Findings and Implications for Practice, Research, and Policy.
Kurzfassung: This book is devoted to illustrating the significance of perpetrator-victim relationship, including its status and state, in understanding intimate partner homicide (IPH) in the context of China today after comparing with the findings in the previous studies. By analyzing the correlation between intimate relationships as a focal variable and other variables such as IPH characteristics and risk factors, a deeper understanding of IPH in China today has emerged. Finally, this book shows that many perpetrators and victims had intimate relationships with people outside their marriages as the main reason for the rapid increase in the number of instances of IPH, which seems to be in tandem with China’s rapid modernization and urbanization. Presenting the sole academic research that closely investigates the characteristics of intimate partner homicide in modern China, the book is a valuable resource for not only for the Chinese government but also for Chinese and international researchers.

Kurzfassung: This book meets the present and future needs for the interaction between various science and technology/engineering areas on the one hand and different branches of soft computing on the other. Soft computing is the recent development about the computing methods which include fuzzy set theory/logic, evolutionary computation (EC), probabilistic reasoning, artificial neural networks, machine learning, expert systems, etc. Soft computing refers to a partnership of computational techniques in computer science, artificial intelligence, machine learning, and some other engineering disciplines, which attempt to study, model, and analyze complex problems from different interdisciplinary problems. This, as opposed to traditional computing, deals with approximate models and gives solutions to complex real-life problems. Unlike hard computing, soft computing is tolerant of imprecision, uncertainty, partial truth, and approximations. Interdisciplinary sciences include various challenging problems of science and engineering. Recent developments in soft computing are the bridge to handle different interdisciplinary science and engineering problems. In recent years, the correspondingly increased dialog between these disciplines has led to this new book. This is done, firstly, by encouraging the ways that soft computing may be applied in traditional areas, as well as point towards new and innovative areas of applications and secondly, by encouraging other scientific disciplines to engage in a dialog with the above computation algorithms outlining their problems to both access new methods as well as to suggest innovative developments within itself.

Kurzfassung: 1. Introduction -- 2. Development and Dualism -- 3. Agglomeration, Institutions, and Social Capital: Main Concepts & Methodologies -- 4. Mitigating Dualism and Exploiting the Interplay of Policy-Social Capital -- 5. Summary.
Kurzfassung: This open access book analyzes the dualism and inequality insofar as how it is manifested in interregional disparity and small enterprises. Using the case of Indonesia, the author considers how the general direction of policy should be to mitigate the effects of agglomeration forces leading towards concentration, and exploit the same forces by encouraging small businesses to operate in a cluster for collective action. The book addresses these issues by focusing on the role of interactions between policies and institutions, of which social capital is an important part. “Iwan Azis’ new book has all the elegance of his deep understanding of institutions and policies……(it) has widespread interest for those working on problems of the populous countries of the Third World.” —Yoginder. K. Alagh, Former Minister of Power, Planning & Science & Technology of India “Given that inequality is expected to rise with the pandemic, this is a timely publication.” —Mari E Pangestu, Managing Director of Development Policy and Partnerships, World Bank “The value of the book lies in the fact that the recommendations about policy are based on real cases.” —Taeho Bark, Former Trade Minister of Korea “This path-breaking book by one of Indonesia’s most experienced economists focuses on how MSMEs can drive development and reduce both forms of inequality.…..Essential reading.” —Howard Dick, University of Melbourne “Just listen to them. This is the striking conclusion of this excellent study of the interface between policy and social capital in nurturing MSMEs.” —Ravi Kanbur, Cornell University Iwan J Azis, Professor of Emerging Markets within the Dyson School of Applied Economics and Management, Cornell University, and University of Indonesia. He has addressed and published topics on the interlink between macro-financial economics, social-institutional issues, and spatial inequalities in emerging markets.

Kurzfassung: This open access book explores the impact of deep regional economic integration on spillovers of knowledge and technology across countries. Deep integration through signing deep regional trade agreements (DRTAs), which cover various policy areas in addition to tariff reductions, may or may not facilitate technology spillovers among their signatories. To understand the mechanism of the impact of deep integration on technology spillovers, this book starts by analyzing the behavior of global firms. Factors that affect global firms’ activities, such as export, foreign direct investment (FDI), offshore outsourcing, are examined. Micro data on Japanese firms are employed for the analysis. Then, the relationships between bilateral trade patterns and technology spillovers and between types of FDI and technology spillovers are investigated in detail. Patent citation data are used to measure technology spillovers. Finally, the impact of DRTAs on international technology spillovers is analyzed. This book is highly recommended to readers who are interested in the effects of deep regional integration, including academic scholars, policymakers, and graduate students.

Kurzfassung: This book is focused on the impact of the COVID-19 pandemic on different sectors, i.e., education, real estate, health, and agriculture. The lockdown has been announced to control the spread of COVID-19 infections, however people/industries/organizations were not ready for lockdown and it has greatly affected their growth. The front workers in the healthcare sector suffered a lot as major responsibilities they needed to carry on. The education sector is also hampered due to the pandemic as schools, colleges were closed and teaching, examinations were carried out on online platforms. These platforms were new to teachers as well as students. The real estate sector faced tremendous loss in this pandemic as people were scared and no one ready to invest their money in such an uncertain time. The agriculture filed is also suffered as raw materials required for agriculture were not available readily due to pandemic. This book presents a survey that is conducted to understand the impact of COVID-19 on the quality of work-life in various sectors. The survey is focused majorly on four sectors, i.e. education, healthcare, real estate and agriculture. Data analysis is done based on responses of survey and mathematical modeling is provided for each case study.
