    Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

Das bekannteste Beispiel hierfür sind die zakāt-Pflichtabgabe auf Geld- und Sachvermögen sowie das ribā-Verbot, das allgemeinhin als Zinsverbot interpretiert und übersetzt wird. Erst eine Auseinandersetzung mit den Grundfragen des Geldes ermöglicht es aber, das Wirtschaftsdenken im islamischen Recht vom Grund her zu erschließen. Der vorliegende Band befasst sich mit den Fragen nach dem Geld, seinen morphologischen Charakteristika, seiner gesellschafts- und marktbezogenen Relevanz sowie seiner vertragstypologischen Einordnung. Mit diesem Anliegen lenkt der Autor die Perspektive auf ein Thema, das in der gegenwärtigen Debatte um „islamisch-ökonomische“ Vorstellungen relativ wenig wissenschaftliche Beachtung gefunden hat, und stellt zugleich die Weichen für ein neues Verständnis der gesamten „islamischen Wirtschaftstheorie“. Seine konzeptionellen Ausführungen zu den Grundfragen des Geldes basieren auf zahlreichen Primärquellen, die im binnendisziplinären Vergleich und mithilfe der Ansätze der neoklassischen Ökonomie untersucht wurden. Die daraus resultierenden Erkenntnisse beziehen sich insbesondere auf den Gütertausch (muʿāwaḍa), das ribā-Verbot sowie die Kooperationsformen šarika und muḍāraba."

    Abstract: Abstract: Women‘s movements in Islamic countries have had a long and arduous journey in their quest for the realization of human rights and genuine equality. The author examines whether discriminatory laws against women do in fact originate from Islam and, ultimately, if there is any interpretation of Islam compatible with gender equality. She investigates women’s rights in Iran since the 1979 Revolution from the perspectives of the main currents of Islamic thought, fundamentalists, reformists, and seculars, using a sociological explanation. The disputes about human reason and its relation to revelation can be traced in various Islamic schools of thought since the eighth century AD.     Abstract: "In 'Coercion and Responsibility in Islam', Mairaj Syed explores how classical Muslim theologians and jurists from four intellectual traditions argue about the thorny issues that coercion raises about responsibility for one's action. This is done by assessing four ethical problems: whether the absence of coercion or compulsion is a condition for moral agency; how the law ought to define what is coercive; coercion's effect on the legal validity of speech acts; and its effects on moral and legal responsibility in the cases of rape and murder. Through a comparative and historical examination of these ethical problems, the book demonstrates the usefulness of a new model for analyzing ethical thought produced by intellectuals working within traditions in a competitive pluralistic environment. The book compares classical Muslim thought on coercion with that of modern Western thinkers on these issues and finds significant parallels between them.     Abstract: Both Muslims and non-Muslims see women in most Muslim countries as suffering from social, economic and political discrimination, treated by law and society as second-class citizens subject to male authority. This discrimination is attributed to Islam and Islamic law, though it varies considerably in its impact, according to both class and region.
