    Abstract: Zur Bewältigung von Organisierter (Drogen)Kriminalität finden zeitlich und finanziell aufwändige, meist verdeckte Ermittlungen gegen eine Vielzahl von Akteuren statt. Um diese Hintergrundermittlungen nicht vorzeitig aufzudecken, wird die sog. ›Legendierte Kontrolle‹ eingesetzt, bei der die Ermittlungsbehörden eine Durchsuchung als allgemeine Verkehrskontrolle tarnen. Die Arbeit ordnet das Instrument in das bestehende System verdeckter und täuschender Ermittlungsmaßnahmen ein. Sie analysiert die verfassungs- und strafverfahrensrechtliche Zulässigkeit des staatlichen Vorgehens, das sich im Grenzbereich zwischen Gefahrenabwehr und Strafverfolgung bewegt. Ein besonderer Schwerpunkt liegt auf der Frage, ob entgegen dem Grundsatz der Aktenwahrheit eine legendierte, also unzutreffende oder unvollständige Aktenführung erlaubt sein kann. Hier werden die Grenzen der staatlichen Täuschungsbefugnis – trotz der Maxime einer effektiven Strafverfolgung – gegenüber Beschuldigten herausgearbeitet

    Abstract: Terrorismus ist noch immer eines der bedrohlichsten Phänomene der heutigen Zeit. In diesem Buch werden mithilfe von Gerichtsakten vom Generalbundesanwalt beim Bundesgerichtshof in Karlsruhe die Radikalisierungsprozesse von 58 deutschen Jihadisten analysiert. Durch das umfassende Datenmaterial ist es möglich, die Wege dieser Personen von der Radikalisierung bis zum Anschluss an eine terroristische Organisation im Ausland (u.a. Islamischer Staat) sowie ausgeübte strafrechtlich relevante Handlungen zu rekonstruieren. Mithilfe einer Netzwerkanalyse wird das radikale Netzwerk untersucht, das aus Deutschland mit Jihadkämpfern im In- und Ausland verbunden gewesen ist. Dabei wird ein Augenmerk auf den Aufbau, die Funktionsweise und die Schlüsselpersonen des Netzwerks gelegt. Auch werden die unterschiedlichen Rollen und Unterstützungshandlungen der Netzwerkmitglieder in den Fokus genommen. Zusätzlich werden strafrechtlich relevante Radikalisierungs- und Mobilisierungsstrategien salafistisch-jihadistischer Prediger entschlüsselt, die weitaus tiefere Verbindungen zu terroristischen Organisationen im Ausland haben als bisher angenommen. Die Autorin Kristin Weber ist Kriminologin, Soziologin und wissenschaftliche Mitarbeiterin im Bereich der Radikalisierungs-, Terrorismus- und Extremismusforschung. An der Deutschen Hochschule der Polizei in Münster-Hiltrup hat sie ihre Dissertation im Rahmen des Projektes X-Sonar "Analyse extremistischer Bestrebungen in sozialen Netzwerken", welches vom Bundesministerium für Bildung und Forschung gefördert wurde, geschrieben.

In How the Earth Feels, Dana Luciano maps the emergence of a "geological fantasy," in which increased knowledge of planetary life was used to racialize Native peoples as fossils and curiosities.     Abstract: Die Tarifparteien der Länder haben 2020 eine geänderte Entgeltordnung vereinbart, wodurch statt bibliotheksspezifischer nun die allgemeinen Tätigkeitsmerkmale für den Verwaltungsdienst auch auf Tätigkeiten in Bibliotheken angewendet werden. Dadurch sowie durch allgemeine aktuelle Entwicklungen im Bibliothekswesen ergeben sich in etlichen Entgeltgruppen Veränderungen.Das neue Standardwerk für die Erstellung von Stellenbeschreibungen und Stellenbewertungen in wissenschaftlichen Bibliotheken führt neben neuen auch umfassend aktualisierte Arbeitsvorgänge auf und versteht sich als Instrument, um Tätigkeiten in Bibliotheken den unbestimmten Rechtsbegriffen bzw. Entgeltgruppen der derzeit gültigen Entgeltordnung zuzuordnen. Ergänzt wird das Werk durch Grundlagenwissen zum Thema Eingruppierung, Stellenbeschreibung und Stellenbewertung.Nachdem Ende 2020 die Arbeitsvorgänge in Bibliotheken, 1. Öffentliche Bibliotheken (AVÖB) erschienen sind, folgt hiermit die Neufassung der Arbeitsvorgänge in wissenschaftlichen Bibliotheken (AVWB) sowie erstmals eine Zusammenstellung von Arbeitsvorgängen in staatlichen Bücherei- und Bibliotheksfachstellen (AVBF).

    Abstract: In der juristischen Literatur wird der Begriff der "Pfadabhängigkeit" zumeist metaphorisch verwendet. Anders ist dies in den benachbarten Gesellschaftswissenschaften, wo das gleichnamige Konzept der Erklärung insbesondere institutioneller Entwicklungsprozesse dient. Nico Schröter geht der Frage nach, ob und wie eine Rezeption dieses Konzepts auch für die Rechtswissenschaft erkenntnisversprechend ist. Dabei kann eine (informierte) Rezeption insbesondere dazu dienen, informelle Strukturbildungsprozesse im Recht besser zu verstehen. So bietet Pfadabhängigkeit eine plausible Erklärung für die relative Stabilität judikativer Entscheidungsstandards und rechtsdogmatischer Sätze sowie - in Ansätzen - auch dafür, inwieweit diese einem Wandel unterliegen. Die Rezeption des Pfadabhängigkeitskonzepts liefert daher eine Antwort auf bestehende Theoriedefizite bei der Erklärung rechtlicher Phänomene

    Abstract: In dem vorliegenden Buch werden die Interessenkonflikte der betrieblichen und behördlichen Datenschutzbeauftragten analysiert. Im Mittelpunkt steht eine ausführliche praxisbezogene Analyse der möglichen Interessenkonflikte der Datenschutzbeauftragten. Es wird herausgearbeitet, wie sich diese Interessenkonflikte auf die Praxis der betrieblichen und behördlichen Datenschutzbeauftragten auswirken und welche Unterschiede sich bei einer internen oder externen Benennung des Datenschutzbeauftragten ergeben. Art. 38 Abs. 6 S. 1 DSGVO sieht ein Verbot der Zuweisung konfligierender Aufgaben vor – die Möglichkeiten eines Interessenkonflikts des Datenschutzbeauftragten gehen jedoch weit über diese normierte Konfliktmöglichkeit hinaus. Konkret werden in der Arbeit Interessenkonflikte in Bezug auf die unabhängige Stellung, die Aufgaben, die Pflichten und die Rechtsbeziehungen des Datenschutzbeauftragten betrachtet. Bei der Analyse der Interessenkonflikte wird berücksichtigt, dass der Datenschutzbeauftragte zugleich dem Verantwortlichen, den Betroffenen, den Aufsichtsbehörden und dem Datenschutz als abstraktes Schutzgut verpflichtet ist.     Abstract: This study addresses the phenomenon of domestic burglary (§ 244 (1) No. 3, (4) German Criminal Code). Particular emphasis is placed on the realities of criminal sentencing for this offense. Based on a multi-perspective analysis of the various appearances of the phenomenon and its legal classification, the study examines the reform of § 244 GCC and the realities of sentencing in criminal courts for the offense. In particular, discrepancies in sentencing that cannot be adequately explained by differences in factual circumstances of the underlying cases, and deficits in the written reasons for sentencing decisions are highlighted. The study reveals a need for action in the field of criminal sentencing
    Abstract: Das Werk widmet sich dem (Privat-)Wohnungseinbruchdiebstahl nach § 244 Abs. 1 Nr. 3, Abs. 4 StGB. Ein besonderer Schwerpunkt liegt auf der Rechtswirklichkeit der Strafzumessung bei dem Delikt. Auf Grundlage einer multiperspektivischen Betrachtung der Erscheinungsformen des Phänomens und seiner rechtlichen Bewertung untersucht die Arbeit die Reform des Tatbestandes und die Praxis der tatgerichtlichen Strafzumessung bei dem Delikt. Insbesondere werden Unterschiede im Strafmaß, die nicht hinreichend durch Sachverhaltsunterschiede der zugrundeliegenden Fälle erklärt werden können, sowie Defizite in der Begründung der Strafzumessungsentscheidungen aufgezeigt.     Abstract: This Open access book is a collection of essays and offers an in-depth analysis of silence as an aesthetic practice and a textual strategy which paradoxically speaks of the unspoken nature of many inconvenient hidden truths of Irish society in the work of contemporary fiction writers. The study acknowledges Ireland’s history of damaging silences and considers its legacies, but it also underscores how silence can serve as a valuable, even productive, means of expression. From a wide range of critical perspectives, the individual essays address, among other issues, the conspiracies of silence in Catholic Ireland, the silenced structural oppression of Celtic Tiger Ireland, the recovery of silenced stories/voices of the past and their examination in the present, as well as millennial disaffection and the silencing of vulnerability in today’s neoliberal Ireland. The book ’s attention to silence provides a rich vocabulary for understanding what unfolds in the quiet interstices of Irish writing from recent decades. This study also invokes the past to understand the present and, thus, demonstrates the continuities and discontinuities that define how silence operates in Irish culture.     Abstract: With the establishment of the European Public Prosecutor's Office (EPPO), a quantum leap in cross-border criminal prosecution in Europe has been achieved. Whether in a property dispute or a trial for murder, the aggrieved and accused would go to lay court where cases were resolved according to custom. What custom meant, however, went through a radical shift in the medieval period. What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

    Abstract: This open access book examines how the form of the list features as a tool for meaning-making in the genre of detective fiction from the nineteenth to the twenty-first century. The book analyzes how both readers and detectives rely on listing as an ordering and structuring tool, and highlights the crucial role that lists assume in the reading process. It extends the boundaries of an emerging field dedicated to the study of lists in literature and caters to a newly revived interest in form and New Formalist approaches in narratological research. The central aim of this book is to show how detective fiction makes use of lists in order to frame various conceptions of knowledge. The frames created by these lists are crucial to decoding the texts, and they can be used to demonstrate how readers can be engaged in the act of detection or manipulated into accepting certain propositions in the text.     Abstract: The unmatched technological achievements in artificial intelligence (AI), robotics, computer science, and related fields over the last few decades can be considered a success story. The technological sophistication has been so groundbreaking in various types of applications that many experts believe that we will see, at some point or another, the emergence of general AI (AGI) and, eventually, superintelligence. This book examines the impact of AI on human rights by focusing on potential risks and human rights legislation and proposes creating a Universal Convention for the Rights of AI Systems (AI Convention). John-Stewart Gordon, PhD in Philosophy, serves as an adjunct full professor at LSMU and has held various academic roles. He's an associate editor at AI & Society, serves on multiple editorial boards, and is the general editor of Brill's Philosophy and Human Rights series. With over 90 publications, John is a prolific contributor to practical philosophy.

    Abstract: This edited collection focuses on the comparative analysis of the application of Shari’a in countries with Muslim minorities (e.g. USA, Australia, Germany and Italy) and majorities (e.g. Malaysia, Bangladesh, Turkey, and Morocco). Most chapters in this new edition have been revised and the book as a whole has been updated to give even more international coverage. This text provides a sociological and global analysis of a phenomenon that goes beyond the ‘West versus the rest’ dichotomy. One example of this is how included are case studies in Muslim minority countries not exclusively located in the West. Although the contributors of this book come from various disciplines such as law, anthropology, and sociology, this volume has a strong sociological focus on the analysis of Shari’a. The final part of the book indeed draws out from all the case studies explored some ground-breaking theories on the sociology of Shari’a such as the application of Black, Chambliss and Eisenstein’s sociological theories. This text appeals to students and researchers working in the sociology of religion. .

    Abstract: This monograph provides the first sustained, chronological account of Northern Irish police officers’ representation in theatre. Importantly, its scope comprises a critical period of national and organisational development, beginning with the Partition of Ireland in 1921 and the founding of the Royal Ulster Constabulary (RUC) one year later in 1922. It progresses through the relevant theatrical and historical events of the century, through the period after the RUC’s dissolution and replacement with the Police Service of Northern Ireland (PSNI) in 2001, and concludes in 2021 to coincide with the centenary of Partition. As such, this project is distinctive in its ability to trace paradigm shifts in perceptions of the police over time, as they intersect with relevant historical events and milestones of political conflict in the province. T. W. Saunders received his PhD from the Queen’s University of Belfast, Northern Ireland, in 2018. He then travelled extensively—to locations including Cyprus, Spain, Chile, Canada, Gibraltar, and the Falkland Islands—while adapting his dissertation into a scholarly monograph and working on various other adjacent projects. He lives in Colorado.

    Abstract: Inclusive Shakespeares: Identity, Pedagogy, Performance responds to the growing concern to make Shakespeare Studies inclusive of prospective students, teachers, performers, and audiences who have occupied a historically marginalized position in relation to Shakespeare's poetry and plays. This timely collection includes essays by leading and emerging scholarly voices concerned to open interest and participation in Shakespeare to wider appreciation and use. The essays discuss topics ranging from ethically-informed pedagogy to discussions of public partnerships, from accessible theater for people with disabilities to the use of Shakespeare in technical and community colleges. Inclusive Shakespeares contributes to national conversations about the role of literature in the larger project of inclusion, using Shakespeare Studies as the medium to critically examine interactions between personal identity and academia at large. Sonya Freeman Loftis (co-editor) is Chair of English and Professor of English at Morehouse College, USA, where she specializes in Renaissance literature and disability studies. She is the author of Shakespeare and Disability Studies (2021), Imagining Autism (2015), and Shakespeare's Surrogates (2013), as well as the co-editor of Shakespeare's Hamlet in an Era of Textual Exhaustion (2017). Her work has appeared in Shakespeare Survey, The Disability Studies Reader, Disability Studies Quarterly, and Shakespeare Bulletin. She currently serves on the editorial boards of Journal of Literary and Cultural Disability Studies, Disability Studies Quarterly, Review of Disability Studies, and Ought: The Journal of Autistic Culture. Mardy Philippian (co-editor) is Associate Professor of English Studies, former Associate Dean for the College of Humanities, Fine Arts, and Communication, and Director of the Literature and Language concentration at Lewis University, USA, where he teaches courses in Shakespeare, Milton, and early modern English literature. Since 2011, he has served as a member of the editorial board of The Oswald Review: International Journal of Undergraduate Research and Criticism in the Discipline of English. His reviews, articles, and book chapters have appeared in Literature and Film Quarterly, Film Criticism, Prose Studies, Forum for World Literature Studies, in the edited collection Recovering Disability in Early Modern England (2013), and in Early Modern Culture. Justin P. Shaw (co-editor) is an Assistant Professor of English at Clark University where his teaching and research explores the intersections of race, emotions, and disability in Shakespeare and early modern English texts. He is completing a book project that examines how disability and racial identity are articulated through melancholic discourse in drama, poetry and prose. Committed to both public and traditional scholarship, his work appears in Early Theatre, White People in Shakespeare (Bloomsbury, 2022), and the forthcoming Oxford Handbook of Race, Travel, and Identity in Early Modern England, 1550-1700. He is a former fellow of the James Weldon Johnson Institute for the Study of Race and Difference, has helped to curate exhibits for the Michael C. Carlos Museum such as Desire & Consumption: The New World in the Age of Shakespeare and First Folio: The Book that Gave Us Shakespeare, and has developed the extensive digital humanities project, Shakespeare and the Players.
