    Abstract: Key indicators show Germany belonging to the countries in the OECD with strong innovation activity even though some weakening in Germany’s position relative to other OECD countries has occurred recently. While the redirection of resources towards unification-related spending as well as low economic growth have contributed to this development, more fundamental structural issues have also played a role. Germany has benefited less than other high-performing countries from the surge in new technologies, such as ICT and biotechnology, as innovation activities continue to focus on sectors, such as machinery and automobiles, in which Germany has a long record of strong export performance. Some features of the regulation of capital, product and labour markets are hampering the supply of risk capital, the creation of new firms and the reallocation of labour.     Abstract: Launch activities performed by private entities deal with a complex legal environment. The Space Treaties provide a general liability framework. Launch participants are subject to regulatory or institutional control, and to domestic liability laws. Specific contractual practice has developed due to insurance limitations, the inter-participants' waivers of liability and claims. This book synthesizes information on the norms of play, to allow the grasp of their relative weight and interactions in the assessment of liability risk for launch activities. It reveals a legal framework presently lacking sufficient predictability for an efficient liability risk management: the waivers of liability suffer weaknesses as do all such clauses, and lack uniformity and reliability; and the Space Treaties contain ambiguous terms preventing predictable determination of the States responsible for authorizing and supervising launch activities and for damage compensation, and do not reflect the liability of launch operators. This book offers suggestions of new approaches for: harmonizing waivers of liability to improve their consistency, validity and flow-down; and improving the Space Treaties for their implementation to non-governmental launch activities. In the launch community, the need for lawmaking is less compelling than in fields such as aviation. Nevertheless, adjustments to the present framework are proposed through model clauses and an international instrument, for further thinking and contribution by those sharing the opinion that creative lawmaking is needed now to prepare for tomorrow's endeavors.

    Abstract: Welche Auswirkungen haben interne Migrationskontrollen auf Migrantinnen und Migranten ohne regulären Aufenthaltsstatus - auf Sans Papiers? Dieser Frage geht das Buch mit einem Vergleich zwischen den Vereinigten Staaten und Deutschland nach. Anhand von Expertengesprächen und vierzig qualitativen Interviews mit Sans Papiers werden polizeiliche Kontrollen und Kontrollen in den Bereichen Arbeitsmarkt, Gesundheitsversorgung, Wohnen sowie Schule und Kinderbetreuung eingehend untersucht. Das Buch diskutiert, ob globale ökonomische, politische und soziale Prozesse die Fähigkeit von Nationalstaaten einschränken, Migration zu kontrollieren. Es wird gezeigt, dass sich die Migrationspolitik der OECDStaaten in den vergangenen Jahren zwar auf der Ebene der Leitlinien und Gesetze angeglichen hat. Bei der Implementation von Kontrollen bestehen aber nationale Unterschiede fort. Die Interviews belegen, dass Sans Papiers in den USA weiterhin vielfältige Möglichkeiten zur gesellschaftlichen Partizipation haben. Im Gegenzug zeigt das Beispiel Deutschland, dass angesichts der weitgehenden Exklusion von Sans Papiers keine Rede von einem Kontrollverlust sein kann.
    Abstract: What are the effects of internal migration controls on migrants without a regular residence permit – on “sans papiers”? The book gives an answer to this question with a comparative study of the United States and Germany. Based on expert interviews and in-depth interviews with forty sans papiers, police controls as well as controls in areas such as labor market, health care, housing, schooling and childcare are carefully analysed. The book discusses whether global economic, political or social processes have restricted the ability of advanced capitalist countries to control migration. It argues that migration policy in the OECD countries has become more similar, but this convergence only takes place at the level of policy goals and legal norms. At the level of implementation, national differences persist. The interviews show that sans papiers in the U.S. continue to have many possibilities to participate in society. In contrast, the comprehensive exclusion of sans papiers in Germany confi rms that there is no general “loss of control”

    Abstract: This book provides a detailed introduction to how the Länder (the sixteen states of Germany) function not only within the country itself but also within the wider context of European political affairs. Some knowledge of the role of the Länder is essential to an understanding of the political system as well as of German federalism. This book traces the origin of the Länder. It looks at their place in the constitutional order of the country and the political and administrative system. Their organization and administration are fully covered, as is their financing. Parties and elections in the Länder and the controversial roles of parliaments and deputies are also examined. Because of their role in the Bundesrat, the second legislative chamber, the Länder are clearly an important part of the national legislative process. They participate in policy-making with regard to the European Union, and have limited influence on Germany's foreign affairs outside of Europe. This is the first English language book that considers the Länder in this depth

    Abstract: Contingent Employment in Europe and the United States examines the developments in labour markets in advanced economies in the 21st century, as regards contingent employment. This is defined as employment relationships that can be terminated with minimal costs within a predetermined period of time. This includes fixed-term contracts, temporary agency work and self-employment. Contingent employment has been the subject of much legislative activity in the last decade, at both the national and European level. Temporary agency work, in particular, has recently been extensively deregulated in most European countries and currently we await the fate of a proposed EU directive on agency work.     Abstract: This is an extremely important book containing a wealth of ideas and insights and raising important questions for discussion and further exploration. In a lucid and cogently argued analysis, the author both challenges dominant ideas and interp- tations and provides some alternative innovatory perspectives. These include, the making and meaning of policy; the varied and complex ways in which inclusion and exclusion can be understood; the nature and function of categorisation, labelling and discursive practices within official discourse and procedures and the position and relationship between space, place and identities in relation to the experience of marginalized people including disabled children and young people. Drawing on concepts and insights from social and cultural geography Armstrong is able to seriously examine and discuss daily activities within institutional and social settings in England and France from several different angles. In sensitive, thoughtful and imaginative ways the micro-politics of social settings and encounters are explored through a process of deconstruction and reconstruction. Subtle, overt and contradictory features of interactions are carefully identified and critically discussed. This covers how meanings, decisions and outcomes of such encounters are developed, challenged and changed. Both in relation to discussions of the history of special education and her cri- cal self-reflections on the research process, the author challenges homogeneous conceptions and sanitized accounts of what, she argues, is an essentially messy process. It is the unevenness, discontinuities and contradictions of social conditions and relations that are depicted in insightful and disturbing ways.

    Abstract: This book provides coherent theoretical and empirical analysis of firms' investment and financing decisions. It assesses the role of uncertainty, financial imperfections, corporate governance and taxation. Evidence is obtained using several unique and high quality microeconomic data-sets, which explore features seldom addressed. Overall, the empirical results confirm theoretical precedents. Some firms are indeed financially constrained, for fixed investment as well as for R&D projects. The 'free cash-flow' hypothesis holds, that is managers divert excess funds away for their own interests, but less so in closely controlled companies. In accordance with the real option theory, the results suggest that uncertainty leads firms to adopt a 'wait and see' strategy which eventually reduces investment, especially for irreversible investment. Corporate governance features are shown to affect managers, discipline and companies' restructuring plans. Finally, different tax reforms are evaluated, and an alternative tax structure that would stimulate growth is proposed. Scholars, including those with an interest in microeconomics and econometrics, and staff within central banks and national and international organisations will also find the book of interest, as will policymakers and decision-makers concerned with the role of financing, corporate governance and taxation on firm's decisions

    Abstract: Die Strategiegenese in kleinen und mittleren Unternehmen (KMU) ist durch eine Konzentration auf die jeweilige Situation und durch eine hohe Dynamik gekennzeichnet. Wichtige Entscheidungen werden spontan und auf den ersten Blick "unüberlegt" gefällt, Strategien sind offensichtlich selbst auf der operativen Ebene nicht (immer) vorhanden. So haben mehr als die Hälfte aller KMU in Deutschland keine Konzepte für die Geschäftsführung, ein Viertel verfügt über wenigstens einjährige Konzepte, nur knapp 22 vH - zumeist größere Unternehmen - über mehrjährige Überlegungen. Brauchen KMU keine Strategien? Wissenschaftliche Untersuchungen dazu kommen zu widersprüchlichen Ergebnissen. Vor diesem Hintergrund beschäftigt sich Friederike Welter in der vorliegenden Veröffentlichung (Habilitationsschrift) mit dem Phänomen strategischen Verhaltens von KMU. Theoretisch und anhand eigener Erhebungen untersucht sie, wie sich Handlungsmuster und Strategien in KMU entwickeln und welchen Einfluss dabei das jeweilige wirtschaftliche, politische und kulturelle Umfeld hat. Dabei kommt die Autorin zu der Erkenntnis, dass die Frage nach der Notwendigkeit von Strategien für KMU weder mit einer isolierten Betrachtung einzelner Einflussfaktoren beantwortet werden kann, noch Strategien in KMU auf schriftlich niedergelegte Pläne reduziert werden können. Politische Faktoren wie der Entwicklungsstand von Marktwirtschaften spielen ebenso eine Rolle wie das sozio-kulturelle Umfeld und die Wirtschaftspolitik. Die empirische Betrachtung verdeutlicht, dass Strategien erlernt oder übernommen werden, aber ebenso aus der Situation heraus entstehen

    Abstract: Following the decolonization movements that swept the globe after World War II, between four and six million people were 'returned' to Europe from the colonies. From an exporter of people, Europe turned to a site of immigration for the first time in the twentieth century. Until now, these migrations have been overlooked as scholars have highlighted instead the parallel migrations of former 'colonized' peoples. Europe's Invisible Migrants corrects this bias. This multidisciplinary volume presents essays by prominent sociologists, historians, and anthropologists on their research with these 'invisible' migrant communities. Their work highlights the experiences of colonists returning to France, Portugal and the Netherlands, the intersection of race, citizenship, and colonial ideologies, and the ways these migrations reflect the return of the 'colonial' to Europe. This volume offers fresh insights into immigration, racism and ethnic conflict in post-colonial Europe by presenting colonial repatriates as another 'immigrant' population.

    Abstract: Thisbook is the fruit of a number of years of assimilating another culture and learning about the evolution of its institutions, altogether an incr- iblyrich andrewarding experience. Ihopetopassonto the reader some of that richness in the belief that, even in a “globalizing” context, learning about other nations and cultures is more and more necessary. The reasons andvalues behind this belief are perhaps evident,but I amconvincedthat they bear repeating here. To begin with, the hasty generalizations that often liebehind the cynicism—and ultimately the violence—of ethnocentrism and xe- phobia are still being aired today and still need to be fought, even in “unified and advanced” regions of the world like Europe and the United States. The historical and social sciences disciplines need to be solicited constantly in this combat, even though they themselves are terrains of controversy and contestation. I personally have not lost faith in their “progressive” potential and character. Second, my belief is that only through this process of appeal to these disciplines and their findings can we resist a dangerous contemporary slide into simplisticand sensation- ist pictures of the world—viewpoints often associated with an implicit assumption that social and economic change are linear processes, so- how unfolding according to the same neat “logic” wherever they are at work.

Auf dieser Basis analysiert sie, wie im Austausch mit einer dominierenden nicht-islamischen Kultur und in der Distanz zu einer traditionellen islamischen Kultur individuelle Prozesse der Konstituierung eines universalistisch orientierten islamischen Selbstes verlaufen.

    Abstract: On the occasion of the celebration of “Twenty Years of Didactique of Ma- ematics” in France, Jeremy Kilpatrick commented that though the works of Guy Brousseau are known through texts referring to them or mentioning their existence, the original texts are unknown, or known only with difficulty, in the non-Fren- speaking world. With very few exceptions, what has been available until now have been interpretations of the works of Brousseau rather than the works themselves. It was in response to this need that two of us, in the euphoria of an unforgettable Mexican evening at the time of the 1990 PME conference, decided to undertake the task of translating into English most of the works of Guy Brousseau. The ceuvre is immense, and once past the initial moments ofenthusiasm, with the accompanying ambition to produce the entire of it, we recognized the need to choose both the texts and a method of proceeding. As far as the texts go, we chose to take the period from 1970 to 1990, in the course of which it seemed to us that Brousseau had forged the essentials of the Theory of Didactical Situations. But even there the collection is huge. So, after an initial translation of most of the publications of the period, we carved out a selection, retaining the texts which gave the best presentation of the principles and key concepts of the Theory.

    Abstract: Die Medien repräsentieren den älteren türkischen Migranten oft als traditionalistischen "Islam-Macho", der die Integration seiner Frau und seiner Töchter in die Gastgesellschaft bremst oder aktiv behindert. Diese weit verbreitete Stereotype beruht überwiegend auf "Bildern aus zweiter Hand". Im Unterschied dazu rückt die Publikation von Margret Spohn die türkischen Männer der ersten Migrantengeneration explizit in den Mittelpunkt der Analysen, wo sie als "Experten ihrer eigenen Geschichte" ausführlich selbst zu Wort kommen. Das feine Geflecht der hier erzählten und sensibel interpretierten Lebensgeschichten gibt Raum für die Reflexionen der Befragten über ihr Verhältnis zu den eigenen Eltern, zur Ehefrau, zu den Kindern und zu ihrem Leben in "zwei Heimaten". Damit liefert die Arbeit einen Schlüssel zu einem besseren Verständnis der Männer dieser Migrantengeneration, die vor fast einem halben Jahrhundert das Wagnis auf sich genommen haben, sich und ihren Familien in einem fremden Land eine Zukunft aufzubauen

    Abstract: In the second half of the eighteenth century, German philosophy came for a while to dominate European philosophy. It changed the way in which not only Europeans, but people all over the world, conceived of themselves and thought about nature, religion, human history, politics, and the structure of the human mind. In this wide-ranging book, Terry Pinkard interweaves the story of 'Germany' - changing during this period from a loose collection of principalities into a newly-emerged nation with a distinctive culture-with an examination of the currents and complexities of its developing philosophical thought. He examines the dominant influence of Kant, with his revolutionary emphasis on 'self-determination', and traces this influence through the development of romanticism and idealism to the critiques of post-Kantian thinkers such as Schopenhauer and Kierkegaard.     Abstract: "The Holocaust is considered a singularly atrocious event in human history, and many people have studied its causes. Yet few questions have been asked about the ways in which West Germans have "forgotten," unlearned, or reconstructed the racial beliefs at the core of the Nazi state in order to build a democratic society. This study looks at ethnic drag as one particular kind of performance that reveals how postwar Germans lived, disavowed, and contested "Germanness" in its complex racial, national, and sexual dimensions. Using engaging case studies, Ethnic Drag traces the classical and travestied traditions of Jewish impersonation from the eighteenth century onward to construct a pre-history of postwar ethnic drag. It examines how shortly after World War II mass culture and popular practices facilitated the repression and refashioning of Nazi racial precepts. During a time when American occupation authorities insisted on remembrance and redress for the Holocaust, the Wild West emerged as a displaced theater of the racial imagination, where the roles of victim, avenger, and perpetrator of genocide were reassigned"--Publisher's description...

    Abstract: Privatisierung ist ein Zeichen tiefreichender Wandlungsprozesse im Verhältnis von Staat und Gesellschaft sowie in den Bereichen des öffentlichen und des Privatrechts. Verbreitet ist die Hoffnung, der unter seinen Kompetenz- und Finanzlasten schwerfällig gewordene Staatskoloß könne wieder 'schlank' werden, wenn er sich zugunsten gesellschaftlicher Kräfte aus Tätigkeitsbereichen zurückziehe. Wichtige Privatisierungsimpulse gehen nach wie vor von den Wettbewerbsbestimmungen des Europäischen Gemeinschaftsrechts aus. Auf kommunaler Ebene ist die 'Organisationsprivatisierung' verbreitet. Mit der Novellierung der Kommunalverfassungen versuchen die Landesgesetzgeber, dem Trend zur kommunalen Eigengesellschaft Einhalt zu gebieten, verletzen jedoch mitunter die Vorgaben des Gesellschaftsrechts. Jörn Axel Kämmerer weist nach, daß sich der Staat im Zuge des Privatisierungsprozesses keineswegs ganz zurückzieht. Vielmehr nimmt der Staat seine grundlegenden verfassungsrechtlichen Aufgaben auch in der 'Privatisierungsfolgenphase' weiterhin wahr – wenn auch nicht mehr durch eigene Leistungen, sondern als Garant und Regulator. Dabei wächst der Spielraum für 'private Grundrechtseingriffe', und die Grundrechte selbst wandeln sich zu Schutzpflichten. Zugleich bringt 'Organisationsprivatisierung', die Begründung privatrechtlich organisierter Wirtschaftsunternehmen der öffentlichen Hand ohne öffentlich-rechtliche Befugnisse, die Grenzen zwischen Staat und Gesellschaft zum Verschwimmen. Letztlich hat der Staat eine Gratwanderung vor sich, bei der er weiterhin als ausgleichende Instanz für eine komplexe, zur Selbstregulierung unfähige, aber in den transnationalen Bereich ausgreifende Gesellschaft agieren können muß, ohne in ihr aufzugehen.

    Abstract: The economic integration of the eastern German states has progressed rapidly in many respects. The infrastructure has been rapidly built up and modernised. A strong trend to modernise the business capital stock has been established, aided by financial assistance from the west. Already at the beginning of the 1990s the elaborate western German social security system had been extended to the new states. Incomes of both the employed and the non-employed, in particular retirees, have risen fast, and have approached west German levels. There has also been a high degree of structural change, as witnessed by high growth rates in manufacturing, increasing export shares, the rapid expansion of the service sector and the down-sizing of the construction sector after very high -- and largely policy-induced -- growth rates in the first half of the 1990s.     Abstract: This study focuses in detail on the environmental compliance/competitiveness relationship with respect to the regulation of packaging waste. An important and innovative feature of the study is its emphasis on backward and forward linkages. An entire supply chain is considered: packaging manufacturers and suppliers, food processors and the food retail sector, to study the competitive effects of environmental standards on manufacturing companies and the vertical links and supply responses. A variety of regulatory regimes is represented by including within the study companies from Germany, Italy, the Republic of Ireland and the United Kingdom. While it is of note that the relatively strong regulation in Germany has indeed had effects on company behaviour, there is no evidence that environmental regulations hindered companies from achieving competitive performance. Analyses consider: the response of individual firms to different levels of regulation; the cost of compliance; impact on employment; the influence of the supply chain on environmental and competitive performance; the importance of firm size and ownership; and the impact of regulation on competitiveness, and firm competitiveness on the efficiency of adjustment to regulation

    Abstract: In der andauernden Auseinandersetzung um die Bedingungen des Ausstiegs aus der Nutzung der Kernenergie zur Stromerzeugung sind auch die verfassungsrechtlichen und europarechtlichen Rahmendaten umstritten. Auf Seiten der Kernkraftwerks-Betreiber wird die geplante Stillegung der Anlagen als eine grundsätzlich entschädigungspflichtige Enteignung angesehen. Demgegenüber kommt Erhard Denninger in seiner Studie zu dem Ergebnis, daß ein »Ausstiegsgesetz«, das die gewerbliche Nutzung der Atomenergie für die Zukunft überhaupt untersagt, eine verfassungsrechtlich zulässige Inhalts- und Schrankenbestimmung des Eigentums darstellt. Allerdings muß das schutzwürdige Vertrauen der bisherigen Kraftwerksbetreiber nach dem Grundsatz der Verhältnismäßigkeit berücksichtigt werden. Dies kann durch entsprechende Gestaltung der »Restlaufzeiten« geschehen. Die Arbeit beruht auf einem Rechtsgutachten für das Bundesumweltministerium.     Abstract: This book investigates the perceptions of political actors towards the creation of Economic and Monetary Union (EMU) in Europe. The research is largely based on personal interviews conducted with key informants in central banks, finance ministries, employers' organizations and trade unions in Britain, France and Germany. It examines why actors perceived EMU to serve or frustrate their interests. It concludes that actors favoured EMU for a variety of reasons. The book contributes to the literature of European integration and incorporates economic, political and historical facts
