    Abstract: "The issue of gender has had a large influence on the development of international refugee law over the last few decades, most notably with the Gender Guidelines issued in 2002 by the United Nations High Commission for Refugees. This volume assesses the progress toward gender equality in refugee law. It documents the advances made following intense advocacy around the world in the 1990s, and considers the extent to which gender has been successfully integrated into refugee law. Evaluating the research and advocacy agendas for gender in refugee law ten years beyond the UNHCR Gender Guidelines, the book investigates the current status of gender in refugee law. It examines gender-related persecution claims of both women and men, including those based on sexual orientation and gender identity, and explores how the development of an anti-refugee agenda in many Western states increases vulnerability for refugees making gendered claims exponentially. Using the concepts of social learning, social trust, implicit memory, and collective trauma, the chapters attempt to identify distinct features of the transitional moment and theoretically capture relevant social processes on a micro- and macro-level. The second part focuses on the notion of justice, outlining different understandings, such as restorative, transformative, and reparative; and discussing the use of these concepts in different settings and by different agents. The third part considers the academic as well as political discourses on transitional justice from the perspective of critical social theories, including feminism and postcolonialism.     Abstract: This study deals with a constitutional principle of the EU: the rule of law. The EU Treaties leave no doubt that the rule of law is a universal value on which the Union is founded. This value is not bound to remain internal; EU external relations should also be guided by the principle. However, a lack of conceptual and legal clarity on the principle makes it uncertain how it guides external relations. 0The basic question this study poses is therefore what the role of the rule of law is in EU external relations. 0More specifically, this study analyses this role by focussing on the external dimension of EU migration and asylum policy. Over the years the EU has developed this external dimension of an originally internal policy field. Measures such as externalising border control, readmission of migrants to third states or mobility opportunities for third country nationals have been promoted. This relatively new area of EU external relations is characterised by a high degree of operational and human rights sensitive activities. For example, Frontex, the EU border agency, operates beyond Europe`s borders, sometimes on the basis of undisclosed working arrangements with third States

    Abstract: "In an era marked by processes of economic, political and legal integration that are arguably unprecedented in their range and impact, the translation of law has assumed a significance which it would be hard to overstate. The following situations are typical. A French law school is teaching French law in the English language to foreign exchange students. Some US legal scholars are exploring the possibility of developing a generic or transnational constitutional law. German judges are referring to foreign law in a criminal case involving an honour killing committed in Germany with a view to ascertaining the relevance of religious prescriptions. European lawyers are actively working on the creation of a common private law to be translated into the 23 official languages of the European Union. Since 2004, the World Bank has been issuing reports ranking the attractiveness of different legal cultures for doing business. All these examples raise in one way or the other the matter of translation from a comparative legal perspective. Yet, in today's globalised world where the need to communicate beyond borders arises constantly in different guises, many comparatists continue not to address the issue of translation. This edited collection of essays brings together leading scholars from various cultural and disciplinary backgrounds who draw on fields such as translation studies, linguistics, literary theory, history, philosophy or sociology with a view to promoting a heightened understanding of the complex translational implications pertaining to comparative law, understood both in its literal and metaphorical senses"--

    Abstract: "The UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions (CDCE) was adopted in 2005 and designed to allow States to protect and promote cultural policies. The book provides insight in how the normative character of the CDCE may be strengthened through implementation and increasingly recurrent practice based on its provisions.
