Abstract: "Religious freedom has become an emblematic value in the West. Embedded in constitutions and championed by politicians and thinkers across the political spectrum, it is to many an absolute value, something beyond question. Yet how it emerged, and why, remains widely misunderstood. Tracing the history of religious persecution from the Fall of Rome to the present-day, [the authors] provide an...explanation of the birth of religious liberty. This book treats the subject in an integrative way by combining economic reasoning with historical evidence from medieval and early modern Europe. The authors elucidate the economic and political incentives that shaped the actions of political leaders during periods of state building and economic growth."--

Abstract: As Europe deals with a so-called 'refugee crisis', Australia's harsh border control policies have been suggested as a possible model for Europe to copy. Key measures of this system such as long-term mandatory detention, intercepting and turning boats around at sea, and the extraterritorial processing of asylum claims were actually used in the United States long before they were adopted in Australia. The book examines the process through which these policies spread between the United States and Australia and the way the courts in each jurisdiction have dealt with the measures. Daniel Ghezelbash's innovative interdisciplinary analysis shows how policies and practices that 'work' in one country might not work in another. This timely book is a must-read for those interested in preserving the institution of asylum in a volatile international and domestic political climate.

Abstract: Comparative constitutional law has a long pedigree, but the comparative study of constitution-making has emerged and taken form only in the last quarter-century. While much of the initial impetus came from the study of the American and French constituent assemblies in the late eighteenth century, this volume exemplifies the large comparative scope of current research. The contributors discuss constituent assemblies in South East Asia, North Africa and the Middle East, Latin America, and in Nordic countries. Among the new insights they provide is a better understanding of how constituent assemblies may fail, either by not producing a document at all or by adopting a constitution that fails to serve as a neutral framework for ordinary politics. In a theoretical afterword, Jon Elster, an inspirational thinker on the current topic, offers an analysis of the micro-foundations of constitution-making, with special emphasis on the role of crises-generated passions.

Abstract: "This volume contains a collection of papers presented at the twenty-second British Legal History Conference held at the University of Reading. The conference coincided with the 800th anniversary of Magna Carta; the conference was thus concerned not only with Magna Carta itself but also with its enduring legacy. The theme around which this legacy is explored is that of challenges to authority and how these challenges result in the recognition of rights. Magna Carta now occupies a quasi-mythical status - particularly within common law jurisdictions - as an instrument which gave people liberty. Lord Denning described it as 'the greatest constitutional document of all times... the spirit of individual liberty which has influenced our people ever since'. Such a description omits the struggle which gave rise to these rights"--

Abstract: The Beginnings of Islamic Law is a major and innovative contribution to our understanding of the historical unfolding of Islamic law. Scrutinizing its historical contexts, the book proposes that Islamic law is a continuous intermingling of innovation and tradition. Salaymeh challenges the embedded assumptions in conventional Islamic legal historiography by developing a critical approach to the study of both Islamic and Jewish legal history. Through case studies of the treatment of war prisoners, circumcision, and wife-initiated divorce, she examines how Muslim jurists incorporated and transformed 'Near Eastern' legal traditions. She also demonstrates how socio-political and historical situations shaped the everyday practice of law, legal education, and the organization of the legal profession in the late antique and medieval eras. Aimed at scholars and students interested in Islamic history, Islamic law, and the relationship between Jewish and Islamic legal traditions, this book's interdisciplinary approach provides accessible explanations and translations of complex materials and ideas

Abstract: "The 'long nineteeenth century' (1776-1914) was a period of political, economic, military and cultural revolutions that re-forged both domestic and international societies. Abstract: "One of the most remarkable aspects pertaining to the legal bans and societal debates on the face veil in Europe is that they rely on assumptions which lack any factual basis. To rectify this, Eva Brems researched the experiences of women who wear a face veil in Belgium, and brought her research results together with those of colleagues who did the same in four other European countries. Their findings, which are outlined in this volume, move the current discussion on face veil bans forward by providing a much-needed insider perspective"--

Abstract: "From an exotic specialization on the fringes of the law school, international law has turned during the last century into a ubiquitous presence in global policy-making as well as in academic and journalistic commentary on such policy-making. With internationalization first, globalization later, questions about the legality under international treaties or customary law of this or that action were posed with increasing urgency in the media and by citizen activists as well as by governments and international institutions"--
Abstract: "This intellectually rigorous introduction to international law encourages readers to engage with multiple aspects of the topic: as 'law' directing and shaping its subjects; as a technique for governing the world of states and beyond statehood; and as a framework within which several critical and constructivist projects are articulated. The articles situate international law in its historical and ideological context and examine core concepts such as sovereignty, jurisdiction and the state. Attention is also given to its operation within international institutions and in dispute settlement, and a separate section is devoted to international law's 'projects': protecting human rights, eradicating poverty, the conservation of resources, the regulation of international trade and investment and the establishment of international order. The diverse group of contributors draws from disciplinary orientations ranging from positivism to postmodernism to ensure that this book is informed theoretically and politically, as well as grounded in practice"--

Abstract: Auch angekündigt als: The Cambridge dictionary of Jewish history, religion, and culture. - "This book is an authoritative reference work for a twenty-first century audience. Its entries, written by eminent scholars, define the spiritual and intellectual concepts and movements that distinguish Judaism and the Jewish experience. The book discusses central figures and literary works, formative historical events, Jewish rituals and practices, and it illuminates the lives of ordinary Jewish men and women. But what makes this dictionary different is its broad exploration of the Jewish experience beyond Judaism, including literature, art, music, theater, dance, film, broadcasting, sports, and ecology, among many other topics from the Bible to the internet"-- Provided by publisher
