Human Rights in Thick and Thin Societies uncovers the original intentions of the drafters of the Universal Declaration of Human Rights, finds inspiration from early leaders in the field like Eleanor Roosevelt, and examines the implications of recent advances in cultural psychology for understanding difference. The case studies included illustrate the need to vary the application of human rights in differing cultural environments, and the book suggests a new framework: a flexible universalism that returns to basics-focusing on the great evils of the human condition. This approach will help the human rights movement succeed in a multipolar era.

    Abstract: This book provides an account and explanation of a fundamental dilemma facing secular states: the "legitimacy gap" left by the withdrawal of religion as a source of legitimacy. Legitimacy represents a particular problem for the secular state. The "secular" in all its manifestations is very much linked to the historical rise of the modern state. It should not be seen as a category that separates culture and religion from politics, but rather as one that links these different dimensions. In the first part of the book, Depaigne explains how modern constitutional law has moved away from a "substantive" legitimacy, based in particular on natural law, towards a 'procedural' legitimacy based on popular sovereignty and human rights. Depaigne examines three case studies of constitutional responses to legitimacy challenges which articulate the three main sources of "procedural" legitimacy (people, rights, and culture) in different ways: the "neutral model" (constitutions based on the "displacement of culture"); the "multicultural model" (constitutions based on diversity and pluralism); and the "asymmetric model" (constitutions based on tradition). Even if secularization can be considered European in its origin, it is best seen today as a global phenomenon, which needs to be approached by taking into account the particular cultural dimension in which it is rooted. Depaigne's detailed study shows how secularization has moved either towards "nationalization" linked to a particular national identity (as in France and, to some extent, in India)-or towards "de-secularization", whereby secularism is displaced by particular cultural norms, as in Malaysia --Front flap of book

    Abstract: "This volume aims to introduce cultural rights and cultural diversity to a non-legal audience as well as to legal and human rights specialists who may not be very familiar with this area of law - which has been termed the Cinderella of the human rights family. Cultural rights and the associated notion of cultural diversity are under-conceptualized from a theoretical viewpoint and poorly understood by governments and rights-holders and thus not implemented as well as they might be. It is therefore necessary to specify clearly the content, and scope of these rights and their relationship to other human rights as well as the various domains in which they are important. Underlying this work is the belief that cultural rights and cultural diversity are increasingly implicated in important areas of policy and legal development and so need to be better understood by governments, governmental authorities, cultural specialists and the rights-holders themselves. Over recent years, the subject of cultural rights has expanded greatly, from that of a national culture available to all citizens to the non-material elements of heritage which, in turn, involves the idea of active public participation in the decision-making process and of citizens being able to contribute actively to their culture. As a result, there is increasing demand for better promotion and protection of cultural rights as an integral part of human rights. The book is divided into two parts. The first section sets out the broader context in which cultural rights and diversity operate, and examines in detail the concept of cultural diversity and its applications, introducing the potential scope for and content of cultural rights and specific challenges they pose to human rights theory. The second section includes in summary form various texts (treaties, other legal instruments and political texts) relevant to cultural rights and cultural diversity. This volume therefore provides the reader with a detailed discussion of cultural rights and diversity combined with the main legal and political primary sources supporting it"--Back cover
