    Abstract: "China and Islam examines the intersection of two critical issues of the contemporary world: Islamic revival and an assertive China, questioning the assumption that Islamic law is incompatible with state law.     Abstract: "This book is the first detailed reconstruction of the late work of John Rawls, who was perhaps the most influential philosopher of the twentieth century. Rawls's 1971 treatise, A theory of justice, stimulated an outpouring of commentary on "justice-as-fairness," his conception of justice for an ideal, self-contained, modern political society. Most of that commentary took Rawls to be defending welfare-state capitalism as found in Western Europe and the United States. Far less attention has been given to Rawls's 2001 book, Justice as fairness: a restatement. In the Restatement, Rawls not only substantially reformulates the "original position" argument for the two principles of justice-as-fairness but also repudiates capitalist regimes as possible embodiments.     Abstract: Nations often turn to international courts to help with overcoming collective-action problems associated with international relations. However, these courts generally cannot enforce their rulings, which begs the question: how effective are international courts? This book proposes a general theory of international courts that assumes a court has no direct power over national governments. Member states are free to ignore both the international agreement and the rulings by the court created to enforce that agreement. The theory demonstrates that such a court can, in fact, facilitate cooperation with international law, but only within important political constraints. The authors examine the theoretical argument in the context of the European Union. Using an original data set of rulings by the European Court of Justice, they find that the disposition of court rulings and government compliance with those rulings comport with the theory's predictions--

    Abstract: The causal complexity that characterizes the social world hampers causal inference. In table 1, we compare traditional science-derived concepts of causality to the logic of causality in the social world. We stress that the traditional concept of causality used in the social sciences comes from traditional physics. It does not necessarily apply to other sciences and is increasingly questioned even by physicists as the rise of quantum physics testifies. We employ it as a backdrop to illustrate how ill it fits to the social world despite many modern social science methodologists putting their faith in inferential techniques that would be well suited only to the traditional science-derived concept of causality.

    Abstract: To what extent is the language of judicial opinions responsive to the political and social context in which constitutional courts operate? Courts are reason-giving institutions, with argumentation playing a central role in constitutional adjudication. However, a cursory look at just a handful of constitutional systems suggests important differences in the practices of constitutional judges, whether in matters of form, style, or language. Focusing on independently-verified leading cases globally, a combination of qualitative and quantitative analysis offers the most comprehensive and systematic account of constitutional reasoning to date. This analysis is supported by the examination of eighteen legal systems around the world including the European Court of Human Rights and the European Court of Justice. Universally common aspects of constitutional reasoning are identified in this book, and contributors also examine whether common law countries differ to civil law countries in this respect.--

    Abstract: "An innovative history of the politics and practice of the Caribbean spiritual healing techniques known as obeah, and its place in everyday life in the region. Spanning two centuries, the book results from extensive research on the development and implementation of anti-obeah legislation. It includes analysis of hundreds of prosecutions for obeah, and an account of the complex and multiple political meanings of obeah in Caribbean societies. Diana Paton moves beyond attempts to define and describe what obeah was, instead showing the political imperatives that often drove interpretations and discussions of it. She shows that representations of obeah were entangled with key moments in Caribbean history, from eighteenth-century slave rebellions to the formation of new nations after independence.     Abstract: In this innovative legal history of economic life in the Western Indian Ocean, Bishara examines the transformations of Islamic law and Islamicate commercial practices during the emergence of modern capitalism in the region. In this time of expanding commercial activity, a mélange of Arab, Indian, Swahili and Baloch merchants, planters, jurists, judges, soldiers and seamen forged the frontiers of a shared world. The interlinked worlds of trade and politics that these actors created, the shared commercial grammars and institutions that they developed and the spatial and socio-economic mobilities they engaged in endured until at least the middle of the twentieth century. This study examines the Indian Ocean from Oman to India and East Africa over an extended period of time, drawing together the histories of commerce, law and empire in a sophisticated, original and richly textured history of capitalism in the Islamic world

    Abstract: Multinational Maids offers an in-depth investigation into the international migrations of Filipino and Indonesian migrant domestic workers. The author taps on her rigorous study of more than 1,200 subjects' migration trajectories to reveal how these migrants work in a series of overseas countries to improve their lives and, in some cases, seek permanent residence in another country. Challenging the portrayal of Asian migrant domestic workers as victims of globalization, Multinational Maids reveals migrants' agency and strategic thinking under conditions of constraint. At the market level, the establishment of guestworker programs for migrant domestic workers in multiple countries has created a global labor market. A transnational diaspora shapes migrants' evolving destination imaginaries, while manpower recruitment and placement agencies create transnational mobility structures. In addition, differing destination hierarchies and degrees of access to resources lead to the adoption of divergent stepwise trajectories. What implications do these normative strivings have in relation to colonial injustice? Examining cases of colonial war, genocide, forced sexual labor, forcible incorporation, and dispossession, Lu demonstrates that international practices of justice and reconciliation have historically suffered from, and continue to reflect, colonial, statist and other structural biases. The continued reproduction of structural injustice and alienation in modern domestic, international and transnational orders generates contemporary duties of redress. How should we think about the responsibility of contemporary agents to address colonial structural injustices and what implications follow for the transformation of international and transnational orders? Redressing the structural injustices implicated in or produced by colonial politics requires strategies of decolonization, decentering, and disalienation that go beyond interactional practices of justice and reconciliation, beyond victims and perpetrators, and beyond a statist world order.

    Abstract: "Are politics local? Why? Where? When? How do we measure local versus national politics? And what are the effects? This book provides answers to these questions, within an explicitly comparative framework, including both advanced and developing democracies. It does so by using a statistically-based and graphical account of party nationalization, providing methodology and data for legislative elections covering scores of parties across dozens of countries. The book divides party nationalization into two dimensions - static and dynamic - to capture different aspects of localism, both with important implications for representation. Static nationalization measures the consistency in a party's support across the country and thus shows whether parties are able to encompass local concerns into their platforms. Dynamic nationalization, in turn, measures the consistency among the districts in over-time change in electoral results, under the presumption that where districts differ in their electoral responses, local factors must drive politics. Each of the two dimensions, in sum, considers representation from the perspective of the mix of national versus local politics"--
    Abstract: "I operationalize "local politics" as the inverse of party nationalization, which I measure across two dimensions, termed static and dynamic, using analyses of district-level data from legislative elections. A central thesis is that together the two dimensions provide a window into the relative importance to voters of local versus national concerns, and thus explain much about representation, legislative elections, party strategy and organization, and parliamentary politics.     Abstract: "This book examines racial and ethnic coalition building in local elections and considers Black and Latino political incorporation more broadly. Although many argue that Black and Latino voters have much to gain from alliances that advance shared interests, coalitions between the two groups have not always formed easily or been stable over time. Recent mayoral elections across the country show different patterns of out-group candidate support. This book seeks to explain these variations and the specific conditions under which Blacks and Latinos vote for the same candidate. Drawing on large-n observational data, survey experiments, and qualitative case studies, Benjamin develops a theory of co-ethnic endorsements, which points to the significance of elite cues from Black and Latino leaders. The book demonstrates that voters use elite co-ethnic endorsements to help inform their votes, that they do so particularly when race is salient in an election, and that this has real implications for representation and access to political benefits"--
