Iconic und Pictorial Turn (u.a. W.J.T. Mitchell, Gottfried Boehm) - 2. Bildtheorien (u.a. Bernhard Waldenfels, Nelson Goodman) - 3. Visual Culture (u.a. Irit Rogoff, Nicholas Mirzoeff) - 4. Zwischen Kunstgeschichte und Bildwissenschaft (u.a. Aby Warburg, Horst Bredekamp) - 5. Bilder zwischen Wahrnehmungs- und Wissenschaftsgeschichte (u.a. Jonathan Crary, Lorraine Daston/Peter Galison).

Abstract: This Handbook offers a collection of original writings by leading scholars and practitioners in the exciting, rapidly developing field of cultural heritage law. The detailed essays are the product of a multi-year project of the Committee on Cultural Heritage Law of the International Law Association. Following a comprehensive introduction to cultural heritage law, the book turns to the core topic of international trade. The General Agreement on Tariffs and Trade and a 1970 UNESCO convention on illegal trafficking in cultural material formed the foundation for progressive development of an impressive and still-evolving legal framework. Building on these and other instruments, the essays focus on import and export controls within specific national legal regimes. Concluding chapters contextualize additional important issues - including human rights, pluralism and nationalism - from a broader, global perspective. Innovative in its combination of comparative and international dimensions of the subject, this book provides a ready, well-documented reference to national and international regimes of control and a scholarly source for teaching and further research. Students, professors and practitioners of trade law, cultural heritage law and general international law will find this Handbook an invaluable resource

Abstract: "In an era marked by processes of economic, political and legal integration that are arguably unprecedented in their range and impact, the translation of law has assumed a significance which it would be hard to overstate. The following situations are typical. A French law school is teaching French law in the English language to foreign exchange students. Some US legal scholars are exploring the possibility of developing a generic or transnational constitutional law. German judges are referring to foreign law in a criminal case involving an honour killing committed in Germany with a view to ascertaining the relevance of religious prescriptions. European lawyers are actively working on the creation of a common private law to be translated into the 23 official languages of the European Union. Since 2004, the World Bank has been issuing reports ranking the attractiveness of different legal cultures for doing business. All these examples raise in one way or the other the matter of translation from a comparative legal perspective. Yet, in today's globalised world where the need to communicate beyond borders arises constantly in different guises, many comparatists continue not to address the issue of translation. This edited collection of essays brings together leading scholars from various cultural and disciplinary backgrounds who draw on fields such as translation studies, linguistics, literary theory, history, philosophy or sociology with a view to promoting a heightened understanding of the complex translational implications pertaining to comparative law, understood both in its literal and metaphorical senses"--

Abstract: "With a focus on the areas of theory, literature, culture, society and film, this collection of essays examines, questions and broadens the applicability of Postcolonialism and Islam from a multifaceted and cross-disciplinary perspective. Topics covered include the relationship between Postcolonialism and Orientalism, theoretical perspectives on Postcolonialism and Islam, the position of Islam within postcolonial literature, Muslim identity in British and European contexts, and the role of Islam in colonial and postcolonial cinema in Egypt and India. At a time at which Islam continues to be at the centre of increasingly heated and frenzied political and academic deliberations, Postcolonialism and Islam offers a framework around which the debate on Muslims in the modern world can be centred. Transgressing geographical, disciplinary and theoretical boundaries, this book is an invaluable resource for students of Islamic Studies, Cultural Studies, Sociolgy and Literature"--

Abstract: "The issue of gender has had a large influence on the development of international refugee law over the last few decades, most notably with the Gender Guidelines issued in 2002 by the United Nations High Commission for Refugees. This volume assesses the progress toward gender equality in refugee law. It documents the advances made following intense advocacy around the world in the 1990s, and considers the extent to which gender has been successfully integrated into refugee law. Evaluating the research and advocacy agendas for gender in refugee law ten years beyond the UNHCR Gender Guidelines, the book investigates the current status of gender in refugee law. It examines gender-related persecution claims of both women and men, including those based on sexual orientation and gender identity, and explores how the development of an anti-refugee agenda in many Western states increases vulnerability for refugees making gendered claims exponentially. The volume includes contributions from scholars and members of the advocacy community which allow the book to examine both broad conceptual and doctrinal themes arising at the intersection of gender and refugee law, and specific case studies across major Western refugee receiving nations. The book will be of great interest and value to researches and students of asylum and immigration law, international politics, and gender studies"..

Abstract: This book offers an exciting new perspective on the origins of language. Language is conceptualized as a collective invention, on the model of writing or the wheel, and the book places social and cultural dynamics at the centre of its evolution: language emerged and further developed in human communities already suffused with meaning and communication, mimesis, ritual, song and dance, alloparenting, new divisions of labour and revolutionary changes in social relations. The book thus challenges assumptions about the causal relations between genes, capacities, social communication and innovation: the biological capacities are taken to evolve incrementally on the basis of cognitive plasticity, in a process that recruits previous adaptations and fine-tunes them to serve novel communicative ends. Topics include the ability brought about by language to tell lies, that must have confronted our ancestors with new problems of public trust; the dynamics of social-cognitive co-evolution; the role of gesture and mimesis in linguistic communication; studies of how monkeys and apes express their feelings or thoughts; play, laughter, dance, song, ritual and other social displays among extant hunter-gatherers; the social nature of language acquisition and innovation; normativity and the emergence of linguistic norms; the interaction of language and emotions; and novel perspectives on the time-frame for language evolution. The contributors are leading international scholars from linguistics, anthropology, palaeontology, primatology, psychology, evolutionary biology, artificial intelligence, archaeology, and cognitive science.

Abstract: "This volume opens up new ground in the field of social representations research by focusing on contexts involving mass violence, rather than on relatively stable societies. Representations of violence are not only symbolic, but in the first place affective and bodily, especially when it comes to traumatic experiences. Exploring the responses of researchers, educators, students and practitioners to long-term engagement with this emotionally demanding material, the book considers how empathic knowledge can make working in this field more bearable and deepen our understanding of the Holocaust, genocide, war, and mass political violence. Bringing together international contributors from a range of disciplines including anthropology, clinical psychology, history, history of ideas, religious studies, social psychology, and sociology, the book explores how scholars, students, and professionals engaged with violence deal with the inevitable emotional stresses and vicarious trauma they experience. Each chapter draws on personal histories, and many suggest new theoretical and methodological concepts to investigate emotional reactions to this material. The insights gained through these reflections can function protectively, enabling those who work in this field to handle adverse situations more effectively, and can yield valuable knowledge about violence itself, allowing researchers, teachers, and professionals to better understand their materials and collocutors. Engaging Violence: Trauma, memory, and representation will be of key value to students, scholars, psychologists, humanitarian aid workers, UN personnel, policy makers, social workers, and others who are engaged, directly or indirectly, with mass political violence, war, or genocide"--

It uses court transcriptions and observations to discuss how the most contentious marriage-related issues - consent and age of spouses, dower, polygamy, and divorce - are adjudicated. The solutions proposed by different legal systems are reviewed , and some broader questions are addressed: how Islamic principles are harmonized with norms based on gender equality, how parties bargain strategically in and out of court, and how Muslim diasporas align their Islamic worldview with a Western normative narrative"--

Abstract: "The topic of "illegal" immigration has been a major aspect of public discourse in the United States and many other immigrant-receiving countries. From the beginning of its modern invocation in the early twentieth century, the often ill-defined epithet of human "illegality" has figured prominently in the media; in vigorous public debates at the national, state, and local levels; and in presidential campaigns. In this collection of essays, contributors from a variety of disciplines - anthropology, law, political science, religious studies, and sociology - examine how immigration law shapes immigrant illegality, how the concept of immigrant illegality is deployed and lived, and how its power is wielded and resisted. The authors conclude that the current concept of immigrant illegality is in need of sustained critique, as careful analysis will aid policy discussions and lead to more just solutions"--

Abstract: "Transitional justice has gained global significance as an umbrella term for approaches to dealing with the past in the aftermath of violent conflict or dictatorial regimes; a range of mechanisms and institutions, including tribunals, truth commissions and memorial projects seek to redress past wrongs, vindicate the dignity of victims, and provide justice. Despite this global activity and the lively academic debate surrounding it, there have been few attempts to conceptualize transitional justice theoretically. Transitional Justice Theories therefore seeks to deliver a hitherto absent theoretical framework by exploring both normative and critical perspectives from disciplines such as political science, sociology, philosophy, or psychology. Working through such concepts as the social processes of the transitional moment and the differing perspectives on justice (as potentially restorative, transformative, and reparative), this volume highlights the field's interdisciplinary scope while revealing the commonalities, as well as tensions, between the various perspectives. Contributing to the academic debate as well as to the practice of transitional justice, this book is an important contribution to a dynamic field. As such, it will be of immense interest to scholars, students, and practitioners of transitional justice, and more widely of Law, Politics, and Sociology"--
Abstract: "Transitional justice is rapidly gaining significance as an umbrella term for mechanisms and policy instruments for dealing with a violent past in the aftermath of mass atrocities or dictatorial regimes. The practice of transitional justice brings into place institutions and mechanisms addressing systematic human rights abuses in order to promote the transition to a peaceful coexistence. These include retributive measures, such as tribunals and court trials, as well as restorative or transformative initiatives in view of enhancing community relations, such as truth commissions or memory work. Yet, despite the range of activities conducted globally and the vibrant academic debate on the topic, there are but few attempts to conceptualise transitional justice theoretically. Transitional Justice Theories fills this gap. The first part of the book theorises transitional justice through the notion of transition. Using the concepts of social learning, social trust, implicit memory, and collective trauma, the chapters attempt to identify distinct features of the transitional moment and theoretically capture relevant social processes on a micro- and macro-level. The second part focuses on the notion of justice, outlining different understandings, such as restorative, transformative, and reparative; and discussing the use of these concepts in different settings and by different agents. The third part considers the academic as well as political discourses on transitional justice from the perspective of critical social theories, including feminism and postcolonialism. Contributing to the academic debate as well as to the practice of transitional justice, Transitional Justice Theories is an important contribution to this fast growing field"--

Abstract: "While there are many books on Islamic family law, the literature on its enforcement is scarce. This book focuses on how Islamic family law is interpreted and applied by judges in a range of Muslim countries, Sunni and Shi'a, as well as Arab and non-Arab. It thereby aids the understanding of shari'a law in practice in a number of different cultural and political settings. It shows how the existence of differing views of what shari'a is, as well as the presence of a vast body of legal material which judges can refer to, make it possible for courts to interpret Islamic law in creative and innovative ways"--

Abstract: "One of the most remarkable aspects pertaining to the legal bans and societal debates on the face veil in Europe is that they rely on assumptions which lack any factual basis. To rectify this, Eva Brems researched the experiences of women who wear a face veil in Belgium, and brought her research results together with those of colleagues who did the same in four other European countries. Their findings, which are outlined in this volume, move the current discussion on face veil bans forward by providing a much-needed insider perspective"--

Abstract: Global Perspectives on Subsidiarity is the first book of its kind exclusively devoted to the principle of subsidiarity. It sheds new light on the principle and explores and develops the many applications of the principle of subsidiarity. The book provides a comprehensive overview of the principle in all its facets, from its philosophical origins in the writings of Aristotle and Aquinas, to its development in Catholic social doctrine, and its emergence as a key principle in European Union Law. This book explores the relationship between subsidiarity and concepts such as sphere sovereignty and social pluralism. It analyses subsidiarity in light of globalisation, federalism, democracy, individual rights and welfare, and discusses subsidiarity and the Australian, Brazilian and German Constitutions.

Abstract: This book explores the development of both the civil law conception of the Legal State and the common law conception of the Rule of Law. It examines the philosophical and historical background of both concepts, as well as the problem of the interrelation between the two doctrines. The book brings together twenty-five leading scholars from around the world and provides both general and specific jurisdictional perspectives of the issue in both contemporary and historical settings. The Rule of Law is a legal doctrine the meaning of which can only be fully appreciated in the context of both the common law and the European civil law tradition of the Legal State (Rechtsstaat). The Rule of Law and the Legal State are fundamental safeguards of human dignity and of the legitimacy of the state and the authority of state prescriptions

Abstract: The excitement of possible futures found in science fiction has long fired the human imagination, but the genre's acceptance by academe is relatively recent. No longer marginalized and fighting for respectability, science-fictional works are now studied alongside more traditional art forms. Tracing the capacious genre's birth, evolution, and impact across nations, time periods, subgenres, and media, The Oxford Handbook of Science Fiction offers an in-depth, comprehensive assessment of this robust area of scholarly inquiry and considers the future directions that will dictate the terms of the scholarly discourse.

Abstract: Featuring 60 commissioned chapters by eminent rhetoric scholars from 12 countries, The Oxford Handbook of Rhetorical Studies offers students and teachers an engaging but sophisticated one-volume introduction to the multidisciplinary field of rhetorical studies. The Handbook traces the history of Western rhetoric from ancient Greece and Rome to the present and surveys the role of rhetoric in more than 30 academic disciplines and fields of social practice. This combination of historical and topical approaches allows readers to chart the metamorphoses of rhetoric over the centuries while mapping the connections between rhetoric and law, politics, science, education, literature, feminism, poetry, composition, critical race theory, philosophy, drama, criticism, deconstruction, digital media, art, semiotics, architecture, and other fields.

Abstract: This volume focuses on recursion and reveals a host of new theoretical arguments, philosophical perspectives, formal representations, and empirical evidence from parsing, acquisition, and computer models, highlighting its central role in modern science. Noam Chomsky, whose work introduced recursion to linguistics and cognitive science, and other leading researchers in the fields of philosophy, semantics, computer science, and psycholinguistics in showing the profound reach of this concept into modern science. Recursion has been at the heart of generative grammar from the outset. Recent work in minimalism has put it at center-stage with a wide range of consequences across the intellectual landscape. The contributors to this volume both advance the field and provide a cross-sectional view of the place that recursion takes in modern science

Abstract: The work analyzes the impact and implementation of international humanitarian law in judicial and quasi judicial bodies. Moreover, acknowledging the high impact domestic jurisdictions have in the configuration of international law, the book does not rest only in an analysis of the international jurisprudence, but delves also into the question of how domestic courts relate to international humanitarian law issues.
Abstract: International humanitarian law has been perceived till now as encompassing only judicial cases concerning refugee protection or war crimes prosecutions, particularly in domestic fora. Yet, the last decade has witnessed a revolution in the way judicial bodies-international and domestic alike-are ready to tackle complex security aspects pertaining to the laws of war. The present volume follows the international and domestic courts’ jurisprudential evolution as they deal with issues like the classification of armed conflicts, direct participation in hostilities and the nexus between international humanitarian law and human rights law. Projecting the field’s jurisprudential development, the volume examines the role of international humanitarian law also in the realms of quasi-judicial bodies. Abstract: The studies in this volume investigate how multilingual education involves a critical engagement with questions of identity and culture, and a movement towards new ways of being and belonging. It addresses previously under-explored issues, in particular the integration of theories like 'thirdness', and practices of language education and maintenance with relevance to the Asia-Pacific region. The analyses reveal the delicate balance of interests of all stakeholders and offer detailed insights into the reality of multilingual education, with specific examples of Chinese, English, Japanese and Tamil. In a globalised world, effective language education has become increasingly important, and the studies presented here have the potential to inform and advance evidence-based multilingual education through adding important dimensions of theoretical exploration and refreshing empirical resources.

Abstract: This volume collects new contributions to research on mafias, organized crime, money laundering, and other forms of complex crimes, gathering some of the most authoritative and well-known scholars in the field. The chapters for this volume are original peices written in honor of the retirement of Dr. Ernesto U. Savona, highlighting his research and legacy. Throughout his academic career, Professor Ernesto U. Savona has investigated complex crimes ranging from organized crime, to economic crime, to money laundering. In his work, he has tried to bring together academics, policy makers, and practitioners to bring understanding for crime problems and innovative solutions. His passion towards the practical application of the findings of scientific research led him to found Transcrime in 1994, which is today among the most important criminological think-tanks in Europe. This important book is aimed at scholars studying criminal policy and research, particularly in the areas of criminal networks, organized crime, white collar crime, the history of criminology.

Abstract: As the European Union has evolved, it has also begun to address policy questions which are closer to the very heart of the state. From cooperation in Justice and Home Affairs, originally conceived as the third pillar of European cooperation, has emerged the Area of Freedom, Security, and Justice (AFSJ). A unique aspect of policy in this area is the desire to integrate the internal and external dimensions of this policy area. One of the tensions in this policy area has been balancing the protection of fundamental rights and increasing security. The first part of this book focuses on the institutional relations of policymaking in AFSJ, both within member states and between member states, in particular the issues of national executive control, national parliamentary scrutiny and peer review across the member states with regard to AFSJ. The second part focuses on specific policy areas which are part of AFSJ. Two chapters highlight the tension found in this policy area between security and human or fundamental rights, the first related to data retention and the second on policing external borders. The final two chapters are concerned with data exchange among European countries and transatlantically with the US, and the interface between AFSJ and the Common Foreign and Security Policy (CFSP). The chapters contained in the book were presented at the Dutch Ministry of the Interior and Kingdom Relations and the Dutch national parliament (Tweede Kamer), making it of interest to scholars and practitioners alike

Abstract: The papers included in the volume look at how language awareness affects the outcomes of foreign and second language acquisition in advanced learners. The book focuses on questions such as how much linguistic knowledge is open to the learner’s conscious experience, what should and should not be considered the knowledge of language, how language awareness can be enhanced in the classroom, and, most crucially, what effects language awareness has on attained proficiency. Some papers in the volume also address methodological challenges of researching language awareness, such as the difficulty of defining and measuring awareness with sufficient precision

Abstract: New biotechnologies have propelled the question of what it means to be human - or posthuman - to the forefront of societal and scientific consideration. This volume provides an accessible, critical overview of the main approaches in the debate on posthumanism, and argues that they do not adequately address the question of what it means to be human in an age of biotechnology. Not because they belong to rival political camps, but because they are grounded in a humanist ontology that presupposes a radical separation between human subjects and technological objects. The volume offers a comprehensive mapping of posthumanist discourse divided into four broad approaches-two humanist-based approaches: dystopic and liberal posthumanism, and two non-humanist approaches: radical and methodological posthumanism. The author compares and contrasts these models via an exploration of key issues, from human enhancement, to eugenics, to new configurations of biopower, questioning what role technology plays in defining the boundaries of the human, the subject and nature for each. Building on the contributions and limitations of radical and methodological posthumanism, the author develops a novel perspective, mediated posthumanism, that brings together insights in the philosophy of technology, the sociology of biomedicine, and Michel Foucault’s work on ethical subject constitution. In this framework, technology is neither a neutral tool nor a force that alienates humanity from itself, but something that is always already part of the experience of being human, and subjectivity is viewed as an emergent property that is constantly being shaped and transformed by its engagements with biotechnologies. Mediated posthumanism becomes a tool for identifying novel ethical modes of human experience that are richer and more multifaceted than current posthumanist perspectives allow for. The book will be essential reading for students and scholars working on ethics and technology, philosophy of technology, poststructuralism, technology and the body, and medical ethics

Abstract: This book provides the most current thinking on effective interventions in the lives of criminal offenders. Original articles by leading criminologists provide in-depth analyses of “turning points” in the desistance process experienced by criminal offenders. An understanding of the sources of turning points (or interventions) across the life course is vital to assessing their impact on criminal behavior. Three sources of interventions in criminal careers are identified in the literature: structural location, human agency and situated choice. Structural location refers to the social place occupied by an individual in the social structure: including marital and occupational status, education and income, and so on. Human agency means the active will of an individual to change his or her behavior, that is, the decision to stop engaging in criminal activities. In addition, situated choice coordinates the offender’s willingness to end a life of crime with the social structural supports that increase the odds of criminal desistance. This comprehensive book considers all three sources of turning points-structural location, human agency, and situated choice-across the life course of criminal offenders. The book also provides a section on cross-cultural perspectives on the effectiveness of interventions in the careers of criminal offenders. The policy implications of each intervention are considered in individual chapters. In addition, the authors suggest a research agenda to further the understanding of the interplay among the key interventions across the life course. This book will be of interest to researchers studying criminology from a life course perspective, as well as crime prevention, and public policy

Abstract: The book “Criminal proceedings, languages and the European Union: linguistic and legal issues” - the first attempt on this subject - deals with the current situation in the jurislinguistic studies, which cover comparative law, language and translation, towards the aim of the circulation of equivalent legal concepts in systems which are still very different from one another. In the absence of common cultures and languages, in criminal procedure it is possible to distinguish features that are typical of common law systems and features that are typical of civil law systems, according to the two different models of adversarial and inquisitorial trials. Therefore, the most problematic challenges are for the European Union legislator to define generic measures that can be easily implemented at the national level, and for the individual Member States to choose corresponding domestic measures that can best implement these broad definitions, so as to pursue objectives set at the European level. In this scenario, the book assesses the new framework within which criminal lawyers and practitioners need to operate under the Lisbon Treaty (Part I), and focuses on the different versions of its provisions concerning cooperation in criminal matters, which will need to be implemented at the national level (Part III). The book analyses the issues raised by multilingualism in the EU decision-making process and subsequent interpretation of legal acts from the viewpoint of all the players involved (EU officials, civil, penal and linguistic lawyers: Part II), explores the possible impact of the EU legal acts concerning environmental protection, where the study of ascending and descending circulation of polysemantic words is especially relevant (Part IV), and investigates the new legal and linguistic concepts in the field of data retention, protection of victims, European investigation orders and coercive measures (Part V)

Abstract: This volume contributes to the on-going legal discussion on pressing procedural and substantial law issues in the ambit of international human rights and civil liberties. While the 20th century has seen the true awakening of human rights, the 21st century poses new challenges to this ever-unfolding area of law. Not only do international tribunals and quasi-tribunals worldwide and domestic US and European continental courts have to deal with increasing numbers of complaints and petitions from individuals and groups on a vast array of societal problems, the legal issues put to them are sometimes extremely difficult to resolve as they relate to very sensitive issues. This book examines issues ranging from the status of human rights under US law to the status of the ECHR in the broader context of international law. It looks at the role of positive obligations in the case law of the Strasbourg Court, as well the impact of its case-law on childbirth and push-back operation towards boat people, but also at the growing unwillingness of ECHR member states to cooperate with the Strasbourg Court. It explores the new frontiers in US Capital punishment litigation, the first case before the International Criminal Court and the legal effect of judgments of the European Court on third states

Abstract: This volume brings together papers that offer conceptual analyses, highlight issues, propose solutions, and discuss practices regarding privacy and data protection. The first section of the book provides an overview of developments in data protection in different parts of the world. The second section focuses on one of the most captivating innovations of the data protection package: how to forget, and the right to be forgotten in a digital world. The third section presents studies on a recurring, and still important and much disputed, theme of the Computers, Privacy and Data Protection (CPDP) conferences : the surveillance, control and steering of individuals and groups of people and the increasing number of performing tools (data mining, profiling, convergence) to achieve those objectives. This part is illustrated by examples from the domain of law enforcement and smart surveillance. The book concludes with five chapters that advance our understanding of the changing nature of privacy (concerns) and data protection

Abstract: With a Foreword by Michael N. Schmitt, Charles H. Stockton Professor and Chairman, United States Naval War College. Modern technological development has been both rapid and fundamentally transformative of the means and methods of warfare, and of the broader environment in which warfare is conducted. In many cases, technological development has been stimulated by, and dedicated to, addressing military requirements. On other occasions, technological developments outside the military sphere affect or inform the conduct of warfare and military expectations. The introduction of new technologies such as information technology, space technologies, nanotechnology and robotic technologies into our civil life, and into warfare, is expected to influence the application and interpretation of the existing rules of the law of armed conflict. In this book, scholars and practitioners working in the fields critically examine the potential legal challenges arising from the use of new technologies and future directions of legal development in light of the specific characteristics and challenges each technology presents with regard to foreseeable humanitarian impacts upon the battlespace. New Technologies and the Law of Armed Conflict is highly recommended to everyone involved in the ongoing weapons debates, as well as those interested in the broader relationship between law and war. Hitoshi Nasu and Robert McLaughlin are Senior Lecturer and Associate Professor respectively at the ANU College of Law, Australian National University, Canberra ACT, Australia

Abstract: This book is a collection of papers that address a fundamental question: What is the role of civil justice and civil procedure in the various national traditions in the contemporary world? The book presents striking differences among a range of countries and legal traditions, but also points to common trends and open issues. It brings together prominent experts, professionals and scholars from both civil and common law jurisdictions. It represents all main legal traditions ranging from Europe (Germanic and Romanic countries, Scandinavia, ex-Socialist countries) and Russia to the Americas (North and South) and China (Mainland and Hong Kong). While addressing the main issue - the goals of civil justice - the book discusses the most topical concerns regarding the functioning and efficiency of national systems of civil justice. These include concerns such as finding the appropriate balance between accurate fact-finding and the right to a fair trial within a reasonable time, the processing of hard cases, and the function of civil justice as a specific public service. In the mosaic of contrasts and oppositions special place is devoted to the continuing battle between the individualistic/liberal approach and the collectivist/paternalistic approach - the battle in which, seemingly, paternalistic tendencies regain momentum in a number of contemporary justice systems

Abstract: Reports on joint work by researchers from different theoretical and linguistic backgrounds offer new insights on the interaction of linguistic code and context in language production and comprehension. This volume takes a genuinely cross-linguistic approach integrating theoretically well-founded contrastive descriptions with thorough empirical investigations. Authors answer questions on the topic of how we ‘encode’ complex thoughts into linguistic signals and how we interpret such signals in appropriate ways. Chapters combine on- and off-line empirical methods varying from large-scale corpus analyses over acceptability judgements, sentence completion studies, and reading time experiments. The authors shed new light on the central questions related to our everyday use of language, especially the problem of how we construe meaning in and through language in general as well as through the means provided by particular languages. “Language is there to construct meaning. But languages are different -- in their lexicon, in their morphosyntax, also in their ways of constructing discourse and in the extent to which they rely on implicit knowledge and on conversational rules. So, what does this tell us about the meanings constructed by language? Are they the same (as, for example, the two number expressions "1989" and "MCMLXXXIX" mean the same) -- or are they different, due to the way how meanings are constructed? This edited volume provides an ingenious way to discuss differences how meanings are constructed, by focusing on narrowly described phenomena and contrasting two languages per article. It seeks evidence for these differences not only from intuition of speakers and from linguistic corpora, but primarily from experimental studies. Thus, it provides an important contribution of our understanding what linguistic meaning is.” Manfred Krifka, Humboldt-Universität, Berlin & Zentrum für Allgemeine Sprachwissenschaft (ZAS), Berlin

Abstract: The present volume assembles a relevant set of studies of argument by analogy, which address this topic in a systematic fashion, either from an essentially theoretical perspective, or from the perspective of it being applied to different fields like politics, linguistics, literature, law, medicine, science in general, and philosophy. All result from original research conducted by their authors for this publication. Thus, broadly speaking, this is an exception which we find worthy of occupying a special place in the sphere of the bibliography on the argument by analogy. In effect, most of the contexts of the publications on this topic focus on specific areas, for example everyday discourse, science or law theory, while underestimating or sometimes even ignoring other interdisciplinary scopes, as is the case of literature, medicine or philosophy. The idiosyncrasy of this volume is that the reader and the researcher may follow the development of different theoretical outlooks on argument by analogy, while measuring the scope of its (greater or lesser) application to the aforementioned areas as a whole

Abstract: Apocalypticism arose in ancient Judaism in the last centuries BCE and played a crucial role in the rise of Christianity. It is not only of historical interest: there has been a growing awareness, especially since the 2001 terrorist attacks on the United States, of the prevalence of apocalyptic beliefs in the contemporary world. To understand these beliefs, it is necessary to appreciate their complex roots in the ancient world, and the multi-faceted character of the phenomenon of apocalypticism. The Oxford Handbook of Apocalyptic Literature is a thematic and phenomenological exploration of apoc

These studies have challenged the application of the rational-choice model to legal analysis and introduced a more accurate and empirically grounded model of human behavior. This integration of economics, psychology, and law is breaking exciting new ground in legal theory and the social sciences, shedding a new light on age-old legal questions as well as cutting edge policy issues. Abstract: The Oxford Handbook of Ecocriticism explores a range of critical perspectives used to analyze literature, film, and the visual arts in relation to the natural environment. Since the publication of field-defining works by Lawrence Buell, Jonathan Bate, and Cheryll Glotfelty and Harold Fromm in the 1990s, ecocriticism has become a conventional paradigm for critical analysis alongside queer theory, deconstruction, and postcolonial studies. The field includes numerous approaches, genres, movements, and media, as the essays collected here demonstrate. The contributors come from around the globe and, similarly, the literature and media covered originate from several countries and continents. Taken together, the essays consider how literary and other cultural productions have engaged with the natural environment to investigate climate change, environmental justice, sustainability, the nature of "humanity," and more.
