    Abstract: Class action lawsuits--allowing one or a few plaintiffs to represent many who seek redress--have long been controversial. The current controversy, centered on lawsuits for money damages, is characterized by sharp disagreement among stakeholders about the kinds of suits being filed, whether plaintiffs' claims are meritorious, and whether resolutions to class actions are fair or socially desirable. Ultimately, these concerns lead many to wonder, "Are class actions worth their costs to society and to business? Do they do more harm than good?" To describe the landscape of current damage class action litigation, elucidate problems, and identify solutions, the RAND Institute for Civil Justice conducted a study using qualitative and quantitative research methods. The researchers concluded that the controversy over damage class actions has proven intractable because it implicates deeply held but sharply contested ideological views among stakeholders. Nevertheless, many of the political antagonists agree that class action practices merit improvement. The authors argue that both practices and outcomes could be substantially improved if more judges would supervise class action litigation more actively and scrutinize proposed settlements and fee awards more carefully. Educating and empowering judges to take more responsibility for case outcomes--and ensuring that they have the resources to do so--can help the civil justice system achieve a better balance between the public goals of class actions and the private interests that drive them

    Abstract: The years 1989/1990 saw the fall of the Iron Curtain. Following forty years of significant restrictions, legal and non-bureaucratic travel from East-Central and Eastern European countries was once again possible and travelling and returning to those countries became just as easy. Immediately following the end of the East-West conflict, people from East-Central and Eastern European countries took advantage of their new freedom of travel. Many sought to emigrate to Western countries. However, when faced with such immigration, the euphoria which met the end of the political divisions in the West evaporated quickly. Several polls and surveys, projections and prognoses served to unsettle people more than the reality of immigration. This gave rise to a sometimes blind and specious – yet nevertheless politically effective – fear of a new mass migration of peoples. Now, more than ten years after the fall of the Iron Curtain, the actual scale and development of the East-West migration in Europe be clearly evaluated. This book attempts to do just that, including a comprehensive overview and eleven country-specific chapters. Each chapter includes a historical review, an account of the most important changes since 1989/1990 and a forecast of future migration developments. 1989/90 fiel der Eiserne Vorhang. Nach mehr als 40 Jahren erheblicher Einschränkungen wurde die legale und unbürokratische Anreise aus den Staaten Ostmittel- und Osteuropas wieder möglich. Genauso leicht wurde die Ein- und Rückreise dorthin. Unmittelbar nach Ende des Ost-West-Konflikts begannen die Bürger Ostmittel- und Osteuropas, von dieser neuen Reisefreiheit Gebrauch zu machen. Etliche versuchten, in ein westliches Land auszuwandern. Angesichts solcher Zuwanderung verflog die Euphorie über das Ende der politischen Spaltung Europas im Westen relativ rasch. Mehr noch als die tatsächliche Migration beunruhigten aber diverse Umfragen, Hochrechnungen und Prognosen die öffentliche Meinung. Es entstand eine teilweise unreflektierte und vordergründige, aber politisch höchst wirksame Angst vor einer neuen Völkerwanderung in Europa.     Abstract: Why do students have different achievement levels across states? Is math achievement improving across states? Differences in average achievement levels across states are mainly traceable to differing family characteristics. However, students from similar families also score differently across states. These differences are related to differences in resource levels and in how resources are spent. States with high spending per pupil, lower pupil-teacher ratios, higher participation in public prekindergarten and higher reported teacher resources have higher achievement. Disadvantaged children are the most sensitive to low resource, and additional resources could substantially their scores. Between-state, rather than within-state, differences in resources appear to be the main reason for inequitable resource levels for students of lower socioeconomic status. The conclusion is that significant math gains are occurring across most states that cannot be traced to resource changes, that the rate of gain varies significantly by state, and that reform efforts are the likely cause of these gains. The results certainly challenge the traditional view of public education as "unreformable

    Abstract: The book asks whether transplanting banks can solve the problems involved in creating a well-functioning market economy from outside, looking especially at the virtually complete takeover of East German banks by their Western counterparts after unification. Drawing on a wide range of English and German sources, and fieldwork interviews across Germany, it argues that there are no quick fix solutions to transition to a market. Implications are discussed for East Germany and for other previously centrally planned economies, and the global implications of foreign ownership in banking are considered.

    Abstract: This volume analyzes the import patterns of selected countries to determine which nations are active importers and which ones import much less than expected. The majority of the work focuses on the industrialized countries, which are at the center of the international trading system, determining which are very active importers and which are not. Controls for wealth, size, and membership in customs areas are included. Countries importing at levels below predicted ones are the countries likely to be most effective at protecting domestic industries from foreign competition. For example, the results permit an evaluation of the arguments that Japan has consistently imported less than would be expected due to the presence of barriers protecting the domestic market

    Abstract: This study focuses in detail on the environmental compliance/competitiveness relationship with respect to the regulation of packaging waste. An important and innovative feature of the study is its emphasis on backward and forward linkages. An entire supply chain is considered: packaging manufacturers and suppliers, food processors and the food retail sector, to study the competitive effects of environmental standards on manufacturing companies and the vertical links and supply responses. A variety of regulatory regimes is represented by including within the study companies from Germany, Italy, the Republic of Ireland and the United Kingdom. While it is of note that the relatively strong regulation in Germany has indeed had effects on company behaviour, there is no evidence that environmental regulations hindered companies from achieving competitive performance. Analyses consider: the response of individual firms to different levels of regulation; the cost of compliance; impact on employment; the influence of the supply chain on environmental and competitive performance; the importance of firm size and ownership; and the impact of regulation on competitiveness, and firm competitiveness on the efficiency of adjustment to regulation

    Abstract: The role of the stock market in the recent global financial crisis has led many to question the way in which the modern international financial system operates. This highly topical book offers important insights into the stock market, contrasting the speculative explanation of stock market fluctuations with the conventional efficient markets hypothesis. After summarising economists' views on stock market behavior from the classical period to the present day, the authors focus on two particular explanations of stock price fluctuations. They examine in detail the mainstream neo-classical theory with its emphasis on the efficient markets hypothesis. They then compare this with the theories of Veblen, Galbraith and Keynes who consider markets as being inherently prone to speculation and crisis, in contrast to the neo-classical approach which largely ignores the instability of stock markets and particularly the crashes that have recently occurred. The authors go on to develop a speculative model to account for stock market fluctuations which provides a useful and realistic explanation of how stock price expectations are formed. This book will be welcomed by bankers, financial and monetary economists, historians of economic thought and all those interested in the causes of the recent market crashes

    Abstract: La Reforma Regulatoria ha sido clave para la transformación de la economía mexicana en los últimos quince años. De una economía cerrada y sobreregulada, la economía mexicana es ahora en gran medida abierta y fundada en principios de mercado. El ritmo acelerado, el amplio alcance y la profundidad de las reformas regulatorias exceden a aquéllas de la mayoría de los países miembros de la OCDE. Estas reformas han ya producido importantes beneficios para México, y en particular han incrementado su flexibilidad económica permitiéndole recuperarse de las crisis económicas. No obstante, los beneficios de la reforma han sido mermados por la crisis macroeconómica de la década de los noventa. Es necesaria ahora una atención sostenida para completar e instrumentar reformas que establezcan las condiciones para una competencia y un acceso al mercado vigorosos, reforzando a la vez la capacidad del Estado mexicano para utilizar instrumentos regulatorios de gran calidad y transparencia para llevar a cabo las políticas públicas. Un período de varios años de estabilidad de las políticas que logre un crecimiento basado en principios de mercado puede producir beneficios amplios y duraderos para los consumidores y las empresas mexicanos. México fue uno de los primeros países de la OCDE en solicitar una revisión detallada por parte de la OCDE sobre sus prácticas y reformas regulatorias. Este reporte - resultado de una extensa evaluación por parte de la OCDE y de la revisión por parte de los países miembros - es único dado que presenta e integra una evaluación de la reforma regulatoria en áreas claves tales como el contexto macroeconómico, la calidad del sector público, la política de competencia y su aplicación, la integración de principios de apertura comercial en los procesos regulatorios y en sectores tal como el de las telecomunicaciones. Las recomendaciones de política presentan un programa de acción balanceado tanto para el corto como para el largo plazo, y están basadas en las mejores prácticas regulatorias internacionales. Este volumen 2 contiene los reportes temáticos que sirvieron de base para la realización del reporte sintético publicado como volumen 1.     Abstract: The use of dynamic models to address the problem of environmental degradation is central to environmental policy because decisions taken now affect not only the current generation but have a profound impact on the future. In this innovative book, Frank Hettich uses dynamic modelling to study the interactions between economic growth, environmental policy and tax reform. He incorporates pollution and abatement technologies into different endogenous growth models that take into account consumer preferences and physical and human capital accumulation.     Abstract: Pourquoi l’OCDE ainsi que d’autres membres de la communauté internationale se sont-ils mobilisés pour combattre la corruption ? La réponse est simple : la corruption ne respecte pas les frontières, ne fait pas de distinctions économiques et gangrène toutes les formes de gouvernement. À long terme, aucun pays ne peut se permettre de supporter les coûts sociaux, politiques ou économiques qu’induit la corruption. Il n’y a pas si longtemps, corrompre des agents publics dans des pays étrangers pour obtenir des marchés constituait une pratique commerciale, sinon acceptable, du moins tolérée dans de nombreux pays de l’OCDE. Aujourd’hui, le dossier de la corruption fait partie des principales préoccupations des pouvoirs publics à l’échelle mondiale car ses répercussions dramatiques sur le développement économique et ses effets corrosifs sur la stabilité politique et les institutions démocratiques sont devenus de plus en plus évidents.En ce nouveau millénaire, l’OCDE et les gouvernements de ses pays Membres, qui représentent plus de 75 % des échanges et de l’investissement dans le monde vont se soumettre à des règles du jeu plus strictes. La Convention sur la lutte contre la corruption d’agents publics étrangers dans les transactions commerciales internationales va bannir la pratique consistant à corrompre des agents publics étrangers, ce qui contribuera à l’équité et à l’ouverture de la concurrence internationale. La corruption dans les transactions commerciales ne représente qu’une partie du problème. Tout un arsenal d’instruments juridiques destinés à combattre la corruption a désormais été mis au point afin d’améliorer les normes éthiques dans le secteur public, de mettre fin à la déductibilité fiscale des pots-de-vin, de faire reculer le blanchiment de capitaux et d’assainir les pratiques en matière de passation de marchés publics. Quant au secteur privé et à la société civile, ils continueront de jouer un rôle déterminant dans le combat pour faire passer ces nouvelles règles dans la réalité. Cet ouvrage apporte les éléments indispensables pour construire et préserver des institutions, des systèmes et des entreprises privées libérés de la corruption.

Les citoyens attendent des agents de la fonction publique qu’ils veillent à l’intérêt public en toute équité et qu’ils gèrent correctement les ressources de l’État au quotidien. S’ils sont équitables et fiables, les services publics inspirent confiance à la population et créent un climat propice aux activités des entreprises, contribuant ainsi au bon fonctionnement des marchés et à la croissance économique. Le respect de l’éthique est une condition préalable implicite pour que l’opinion publique accorde sa confiance à l’administration. Il est aussi un élément capital de la bonne gouvernance. En cette période de consensus croissant entre les pouvoirs publics sur la définition des éléments indispensables d’une stratégie effective et globale de l’éthique, le présent rapport de l’OCDE contient une somme d’informations sur les dispositions en matière de gestion de l’éthique résultant de comparaisons entre les pays de l’OCDE, et dont il n’existe actuellement aucun équivalent. Cet ouvrage est destiné à favoriser l’apprentissage mutuel et à aider les décideurs à élaborer des stratégies modernes en matière d’éthique, tant dans les pays Membres que dans les pays non membres de l’Organisation. Il présente - pour la première fois - un panorama complet des dispositions concernant l’éthique adoptées par les 29 pays membres de l’Organisation, et comprend notamment les tendances générales et les pratiques particulièrement intéressantes.

    Abstract: Over the last decade, labour market policy in the United States has been undergoing a period of significant restructuring. In the face of welfare reform initiatives, persistent unemployment and declines in real income among some groups (particularly the less skilled), and continued economic expansion, there is pressure on the public employment service (PES) to improve effectiveness. But, it must also come to terms with resource limitations. How have reforms fared so far -- what seems to be working well or not so well? Which of the new approaches may require revision in the event of an economic downturn? Where might adjustments lead to improved effectiveness? While considering such questions, this publication provides an in-depth look at the PES and recent policy initiatives in the United States. Areas of concern about recent reforms are outlined and options for making policies more effective are presented.

Une déréglementation économique de grande envergure associée à des efforts pour améliorer la qualité de la réglementation sociale ont contribué à l'édification de l'une des économies les plus innovantes, les plus flexibles et les plus ouvertes de la zone OCDE, tout en maintenant des normes relativement élevées dans les domaines de la santé, de la sécurité et de l'environnement. Pourtant, d'importants problèmes liés à la réglementation persistent aux États-Unis. Un défi fondamental pour assurer sa qualité consiste à améliorer le rapport coût-efficacité et la performance de réglementations sociales et de formalités publiques coûteuses. En un mot, il s'agit moins de réglementer plus que de bien réglementer.     Abstract: In Russia and other transition economies that have implemented voucher privatization programs, how can one account for the puzzling behavior of insider-managers who, in stripping assets from the very firms they own, appear to be stealing from one pocket to fill the other? - How can one account for the puzzling behavior of insider-managers who, in stripping assets from the very firms they own, appear to be stealing from one pocket to fill the other? Desai and Goldberg suggest that such asset-stripping and failure to restructure are the consequences of interactions between insiders (manager-owners) and regional governments in a particular property rights regime. In this regime, the ability to realize value is limited by uncertainty and illiquidity, so managers have little incentive to increase value. As the central institutions that rule Russia have ceded their powers to the regions, regional governments have imposed various distortions on enterprises to protect local employment. Prospective outsider-investors doubt they can acquire the control rights they need for restructuring firms and doubt they can avoid the distortions regional governments impose on the firms in which they might invest. The result: little restructuring and little new investment. And regional governments, knowing the firms' taxable cash flows will have been reduced through cash flow diversion, have responded by collecting revenues in kind. To disentangle these vicious circles of control, Desai and Goldberg propose a pilot for transforming ownership in insider-dominated firms through a system of simultaneous tax-debt-for-equity conversion and resale through competitive auctions. The objective: to show regional governments, by example, that a more sustainable way to protect employment is to give managers incentives to increase enterprises' value by transferring effective control to investors. The proposed mechanism would provide cash benefits to insiders who agree to sell control to outside investors. The increased cash revenue (rather than in-kind or money surrogates) would enable regional governments to finance safety nets for the unemployed and to promote other regional initiatives.
