    Abstract: This book offers its readers an overview of recent developments in the theory of legal argumentation written by representatives from various disciplines, including argumentation theory, philosophy of law, logic and artificial intelligence.     Abstract: This book is a comparative study of the exclusion of illegally gathered evidence in the criminal trial , which includes 15 country studies, a chapter on the European Court of Human Rights, and a comparative synthetic conclusion. No other book has undertaken such a broad comparative study of exclusionary rules, which have now become a world-wide phenomenon. The topic is one of the most controversial in criminal procedure law, because it reveals a constant tension between the criminal court’s duty to ascertain the truth, on the one hand, and its duty to uphold important constitutional rights on the other, most importantly, the privilege against self-incrimination and the right to privacy in one's home and one's private communications. The chapters were contributed by noted world experts on the subject for the XVIII Congress of the International Academy of Comparative Law in Washington in July 2010.

    Abstract: The rate of social change has speeded up in the last three decades, but how do we explain this? This volume ventures what the generative mechanism is that produces such rapid change and discusses how this differs from late Modernity. Contributors examine if an intensification of morphogenesis (positive feedback that results in a change in social form) and a corresponding reduction in morphostasis (negative feedback that restores or reproduces the form of the social order) best captures the process involved. This volume resists proclaiming a new social formation as so many books written by empiricists have done by extrapolating from empirical data. Until we can convincingly demonstrate that a new generative mechanism is at work, it is premature to argue what accounts for the global changes that are taking place and where they will lead. More concisely we seek to answer the question whether or not current social change can be regarded as social morphogenesis. Only then, in the next volumes will the same team of authors be able to remove the question mark

    Abstract: Relevant to, and drawing from, a range of disciplines, the chapters in this collection show the diversity, and applicability, of research in Bayesian argumentation. Together, they form a challenge to philosophers versed in both the use and criticism of Bayesian models who have largely overlooked their potential in argumentation. Selected from contributions to a multidisciplinary workshop on the topic held in Lund, Sweden, in autumn 2010, the authors count legal scholars and cognitive scientists among their number, in addition to philosophers. They analyze material that includes real-life court cases, experimental research results, and the insights gained from computer models.The volume provides a formal measure of subjective argument strength and argument force, robust enough to allow advocates of opposing sides of an argument to agree on the relative strengths of their supporting reasoning. With papers from leading figures such as Mike Oaksford and Ulrike Hahn, the book comprises recent research conducted at the frontiers of Bayesian argumentation and provides a multitude of examples in which these formal tools can be applied to informal argument. It signals new and impending developments in philosophy, which has seen Bayesian models deployed in formal epistemology and philosophy of science, but has yet to explore the full potential of Bayesian models as a framework in argumentation. In doing so, this revealing anthology looks destined to become a standard teaching text in years to come.

    Abstract: Is there universalism of human rights? If so, what are its scope and limits? This book is a doctrinal attempt to define universalism of human rights, as well as its scope and limits. The book presents tests of universalism on international, regional and national constitutional levels. It is maintained that universalism of human rights is both a concept and a normative reality. The normative character of human rights is scrutinized through the study of international and regional agreements as well as national constitutions. As a consequence, limitations of normativity are identified, usually on the international level, and take the form of exceptions, reservations, and interpretations. The book is based on the General and National Reports which were originally presented at the 18th International Congress of the International Academy of Comparative Law in Washington D.C. 2010.

    Abstract: Education is the transmission of knowledge and skill from one generation to another, and is vitally significant for the growth and unfolding of the living individual. It manifests the quintessential ability of the logos to differentiate life in self-individualization from within, and in its spread through inter-generative networks. Without reaching the evolutive phase of the human creative condition, the human being establishes a unique creative platform on which to conduct its co-existence. On this platform the progress of life is being transformed from a natural ontopoietic accomplishment into an autonomous achievement of the creative planning of the human mind. Specifically, human education focuses upon creative planning moving like a pendulum between nature and freedom.     Abstract: This book examines economic aspects of the role of women's education in the postponement of maternity in ten industrialized countries or regions: Sweden, Norway, Italy, Spain, Ireland, the Netherlands and Western Germany, the Czech Republic and Eastern Germany, and the United States. Each is investigated using survey data relating age at motherhood with the investment in education of the mother. The result is a detailed picture of the economics of fertility decisions.

    Abstract: The main aim of the book is to provide an interdisciplinary treatment of a set of key issues of current ageing research, i.e., health, competence, and well-being. These key issues are addressed based on three converging research streams: social-ecological research, which assumes that major processes and outcomes of ageing such as day-to-day competence are shaped by social and physical-spatial environments, geropsychology research, which is driven by a life-span developmental conception of ageing, and epidemiology, which offers most fundamental disease, function and prevention-related data. Each of the three major research directions are outlined by a short introduction, followed by three chapters treating in an empirical manner most recent key research questions. All chapters are then also discussed by renowned ageing experts. This volume links ageing research with policy considerations and implications and establishes a link between European research and the knowledge base of the international scientific community concerned with ageing. This book will be of great interest to scholars and graduate students in ageing research, in the social and behavioural field as well as in epidemiology, geriatrics, geropsychiatry, demography, and biogerontology.
