    Abstract: In dem vorliegenden Buch werden die Interessenkonflikte der betrieblichen und behördlichen Datenschutzbeauftragten analysiert. Im Mittelpunkt steht eine ausführliche praxisbezogene Analyse der möglichen Interessenkonflikte der Datenschutzbeauftragten. Es wird herausgearbeitet, wie sich diese Interessenkonflikte auf die Praxis der betrieblichen und behördlichen Datenschutzbeauftragten auswirken und welche Unterschiede sich bei einer internen oder externen Benennung des Datenschutzbeauftragten ergeben. Art. 38 Abs. 6 S. 1 DSGVO sieht ein Verbot der Zuweisung konfligierender Aufgaben vor – die Möglichkeiten eines Interessenkonflikts des Datenschutzbeauftragten gehen jedoch weit über diese normierte Konfliktmöglichkeit hinaus. Konkret werden in der Arbeit Interessenkonflikte in Bezug auf die unabhängige Stellung, die Aufgaben, die Pflichten und die Rechtsbeziehungen des Datenschutzbeauftragten betrachtet. Bei der Analyse der Interessenkonflikte wird berücksichtigt, dass der Datenschutzbeauftragte zugleich dem Verantwortlichen, den Betroffenen, den Aufsichtsbehörden und dem Datenschutz als abstraktes Schutzgut verpflichtet ist. Schließlich wird in der Arbeit aufgezeigt, welchen Verbundenheiten sich der Datenschutzbeauftragte ausgesetzt sieht und welche Antworten des Rechts den Interessenkonflikten gegenüberstehen.

    Abstract: "The Politics of the Eurogroup provides an intriguing look inside the euro crisis and the secretive forum of finance ministers that came to dominate it. The history of the European Union is a history of crises and the leaps of integration they triggered. As the pandemic, the war in Ukraine, and global power competition are clouding the prospects of the European economies, the member states are looking for solutions. Yet they find their options highly constrained by the economic and political realities created in the decade of the euro crisis. This book fuses a critical political economy perspective on structural relations within the Economic and Monetary Union with a power-based approach to its institutions. It explains why a political project of European austerity emerged from the Eurogroup and side-lined alternative policies, with repercussions still felt today. The author introduces a series of interviews with key decision-makers - ministers, central bankers, EU officials - as well as leaked audio recordings from Eurogroup meetings to give an authentic report of the power struggles between finance ministers. The book retraces how the Eurogroup rose to prominence in the crisis and how a few northern countries - led by the German and Dutch finance ministries - were able to exploit the group's informal processes to shape the Economic and Monetary Union to their advantage. With its interdisciplinary and investigative approach, this book will be of great interest for scholars and students concerned with European integration, international political economy, economics, institutionalism, and governance.     Abstract: After the break-up of the Soviet Union, the escalating rivalry between the EU and Russia in their shared neighbourhood created major economic, political and security challenges for the two states that border them: Belarus and Ukraine. Both countries were made integration offers by the EU and Russia. Their responses, and the consequences of these choices, were driven by a complex range of domestic and foreign policy factors. Drawing widely on extensive empirical research, Dr Leukavets shows how the EU’s and Russia’s rival integration projects challenged the leaders of Belarus and Ukraine to make major strategic choices while aiming to ensure the independence and sovereignty of their countries. The study sheds important light on the genesis of the 2020 Belarus crisis and the 2022 Russia-Ukraine war.

    Abstract: Waiting for the Revolution to End explores the Syrian revolution through the experiences of citizens in exile. Based on more than three years of embedded fieldwork with Syrians displaced in the border city of Gaziantep (southern Turkey), the book places the Syrian revolution and its tragic aftermath under ethnographic scrutiny. It charts the evolution from peaceful uprising (2011) to armed confrontation (2012), descent into fully fledged conflict (2013) and finally to proxy war (2015), to propose an understanding of revolution beyond success and failure. While the Assad regime remains in place, the Syrian revolution (al-thawra) still holds a transformational power that can be located on intimate and world-making scales. Charlotte Al-Khalili traces the unintended consequences of revolution and its unexpected consequences to reveal the reshaping of Syrian life-worlds and exiles’ evolving theorizations, experiences and imaginations of al-thawra. She describes the in-between spatio-temporal realm inhabited by Syrians displaced to Turkey as they await the revolution’s outcomes, and maps the revolution’s multidimensional and multi-scalar effects on their everyday life. By following the chronology of events inside Syria and Syrians’ geography of displacement, the book makes the relation between revolution and displacement its centerpiece, both as an ethnographic object and an analytical device.     Abstract: This book critically explores how and to what extent artificial intelligence (AI) can infringe human rights and/or lead to socially harmful consequences and how to avoid these. The European Union has outlined how it will use big data, machine learning, and AI to tackle a number of inherently social problems, including poverty, climate change, social inequality and criminality.     Abstract: This book provides a pre-history of Russia's war on Ukraine and Europe’s relations to it, illuminating the deep roots of the EU’s neighbourhood crisis as well as the migration crises it created in the last decade. To do so, the book employs a new and innovative framework that allows for a comprehensive, yet nuanced analysis of borders and a more cogent interpretation of their socio-political consequences. Drawing on interdisciplinary scholarship the book analytically examines the key common elements of borderscapes and links them in related arrays to allow for nuanced evaluation of both their particular and cumulative effects, as well as interpretation of their overall consequences, particularly for issues of identities and orders. The book offers a significant conceptual and theoretical advance, providing a transferable conceptualization of borderscape to guide research, analysis, and interpretation. Drawing on the author’s experience in policy, practice and academia, it also makes a methodological contribution by pushing the boundaries of reflexivity in interpretive International Relations (IR) research. Analyzing three main sites in Central and Eastern Europe (CEE), the book challenges conventional critical wisdom on EU bordering in the Schengen zone, at its external frontiers, and in its Eastern neighborhood. In so doing, it sheds new light on the post-communist transitions as well as the contemporary politics of CEE. It also shows how European Union bordering and its relations to identities and orders created great benefits for many Europeans, but also hindered the lives of many others and became self-defeating. This book is a must-read for scholars, students, and policy-makers, interested in a better understanding of Critical Border Studies (CBS) in particular, and International Relations in general. It will also appeal to anyone interested in CEE or wishing to get a deeper understanding of Russia’s war and the fight for Europe’s future.

    Abstract: While the ambitious objectives outlined in the EU’s Green Deal aim at making Europe the first climate-neutral continent by 2050, national implementation greatly varies depending on local geographies, history, culture, economics, and politics. This book analyses Member States’ and EU neighbours’ national efforts to combat climate change. It subsequently draws on these factors to highlight local challenges, tensions, and opportunities on the road towards climate neutrality. In the context of inter-country dependencies following Russia’s war against Ukraine, it addresses strategic questions regarding EU integration, the transformation of our economies, the reduction of energy dependencies, and public perception of the above. The book also makes concrete recommendations, in various policy areas, on how individual countries and the EU as a whole should deal with the climate crisis. The Editors Dr. Michael Kaeding holds a Jean Monnet Chair for European Integration and European Union Politics at the Institute of Political Science, University of Duisburg-Essen, Germany. He is a visiting fellow of the European Institute of Public Administration in Maastricht and member of the flying faculties of the College of Europe, Bruges, and the Turkish-German University in Istanbul. From 2016 to 2019 he was the chairman of the Trans European Policy Studies Association. Dr. Johannes Pollak is a Professor of International Relations and rector of Webster Vienna Private University, Austria. Prior to this position, he headed the Department of Political Science at the Institute for Advanced Studies in Vienna. In summer 2019, he was elected Chairperson of the Board of the Institute of European Politics in Berlin. Paul Schmidt is the Secretary General of the Austrian Society for European Politics, which promotes and supports the analysis of and communication on European affairs. Prior to that he has worked at the Oesterreichische Nationalbank, both in Vienna and at its office in Brussels at the Permanent Representation of Austria to the European Union.

    Abstract: This open access book is the product of three years of academic research that has been carried out in the EU-funded Jean Monnet Network on “Post-Truth Politics, Nationalism and the Delegitimation of European Integration” since 2019. Drawing on the multidisciplinary expertise of the network’s members, the book explores the impact of the phenomenon of post-truth politics on European integration and the European Union. It places particular emphasis on how post-truth politics has played out in the public sphere and asks what impact the phenomenon has had on public deliberation, but reflects also on its implications for democracy in a wider sense. This book is primarily written for audiences with an interest in politics and policy making, including academics, policy makers and civil-society actors. Thanks to its accessible style, the book should however also be an asset to wider audiences.

    Abstract: The European Union (‘EU’) is promoting a suite of innovations in international economic regulation—among them, reforms for secure and sustainable investment, a comprehensive approach to the mutual recognition of professional qualifications, a viable carbon border adjustment mechanism, heightened intellectual property rights protection, the arm’s length principle in taxation, and an increased commitment to non-economic vales. Through a critical analysis of key regulations and policies, this volume explores the evolving architectures of international economic agreements in light of EU practice. A comprehensive analysis indicates that novelties are rooted in geoeconomic considerations, through which a fundamental shift is underway towards the adoption of comprehensive bilateral trade agreements. Whilst innovation has the potential to significantly harmonise cross-border regulatory frameworks, it can also trigger significant fractures, particularly when applied restrictively and asymmetrically. Arguably, the ‘Brussels effect’ will to a certain extent foster a progressive development of international economic regulation, while in some respects being constrained by the status quo of the international economic regime. This volume is part of the Jean Monnet project Third Country Engagement with EU Trade Policy led by the ANU Centre for European Studies at the Australian National University, and supported by the European Commission under the Erasmus+ actions. The project seeks to explore and improve understanding of the EU’s evolving trade policy and its implications for third countries, including Australia and countries in the Asia-Pacific region.

    Abstract: How does governing work today? How does society (mis)handle pressing challenges such as armed violence, cultural difference, ecological degradation, economic restructuring, geopolitical shifts, global pandemics, migration flows, and technological change in ways that are (not) democratic, effective, fair, peaceful, and sustainable? This volume addresses these key questions with reference to the theme of 'polycentrism', i.e. the idea that contemporary governing is dispersed, fluctuating, messy, elusive, and headless. Chapters develop this notion of polycentrism from the perspectives of a broad spectrum of academic disciplines and theoretical approaches, offering comprehensive coverage of exciting new thinking about how today's world is (mis)ruled. The book identifies four paradigms of knowledge about polycentric governing - organizational, legal, relational, and structural - and pursues conversations across the divides that normally keep these approaches within separate research communities. These exceptional inter-paradigm exchanges focus particularly on issues of techniques (how governing is done), power (what forces drive governing), and legitimacy (whether governing is rightful). Comparisons between the multiple perspectives on polycentric governing highlight, and help to clarify, the distinctive emphases, potentials, and limitations of each approach. In addition, various combinations of the different theories generate promising novel avenues of thought about polycentrism. The book will allow readers to develop and refine their own understandings of governing today and hence to become more empowered political subjects.

    Abstract: Dieses Open-Access-Buch untersucht, inwieweit Anbieter im Online-Vertrieb das technische Erkenntnisverfahren Profiling zum Zwecke der Preispersonalisierung einsetzen und welche rechtlichen Rahmenbedingungen dabei gelten. Preispersonalisierung liegt vor, wenn der Preis für ein Gut oder eine Dienstleistung an die Zahlungsbereitschaft des einzelnen Kunden angepasst wird. Dafür ist u.a. die zielgerichtete Verarbeitung personenbezogener Daten notwendig. Preispersonalisierung unterscheidet sich damit von dynamischen Preissetzungsmethoden, die bloßer Ausdruck von Angebot und Nachfrage sind. Entgegen weitverbreiteter Einschätzung kommen personalisierte Preise (noch) äußerst selten vor: Technische und wettbewerbliche Hindernisse schränken den Handlungsspielraum der Anbieter ein. Hinzu kommt, dass die individuelle Zahlungsbereitschaft situationsabhängig und oftmals irrational ist. Auch der Betroffene kann sie nicht immer konkret beziffern. Der Schwerpunkt dieser wirtschaftsrechtlichen Untersuchung liegt auf dem Datenschutz- und dem Antidiskriminierungsrecht. Sie berücksichtigt zugleich wettbewerbs- und verbraucherschutzrechtliche Aspekte. Zudem entwickelt sie ein 3-stufiges Modell, welches einen eigenständigen methodischen Ansatz darstellt. Dies macht es möglich, Lebenssachverhalte im Kontext von Profiling und automatisierten Entscheidungen zu strukturieren und so einer rechtlichen Bewertung zugänglich zu machen. Die Untersuchung greift umfassend auf andere Disziplinen zurück, indem sie u.a. ökonomische, technische, empirische und psychologische Erkenntnisse berücksichtigt. Das Buch untersucht, wie datenbasiertes Profiling und automatisierte Entscheidungen funktionieren, funktional miteinander zusammenhängen und reguliert sind. Im Anschluss analysiert es, wie Profiling genutzt werden kann, um im Online-Handel Preise zu personalisieren. Schließlich behandelt es die Frage, ob das geltende materielle Recht ausreichende Schutzmechanismen gegen Diskriminierung bereithält, die aus der Zugehörigkeit zu geschützten Gruppen resultiert und in einer systematischen preislichen Schlechterstellung zum Ausdruck kommt.

    Abstract: Data Governance kann in den Dimensionen Technik, Ökonomie, Nachhaltigkeit und Recht als Steuerung der Nutzung, des Teilens und der Weiterverwendung von Daten definiert werden. Der sich entwickelnde Rechtsrahmen der Europäischen Union zum Datenrecht, insbesondere der Data Governance Act, der Data Act, der Digital Markets Act sowie bereits bestehende Gesetze wie die Datenschutzgrundverordnung schaffen einen Ordnungsrahmen für Dateninhaber, Datennutzer und Datensubjekte. Daneben erfordert die ESG-Gesetzgebung in den Bereichen Nachhaltigkeit und Umweltschutz die rechtskonforme Erfassung und Nutzung von Daten. Vor diesem Hintergrund wird der Binnenmarkt für Daten als Produkte oder Dienstleistungen dauerhaft nur wachsen, wenn technische Innovationen und Standards eine nachhaltige, rechtskonforme, aber auch wertschöpfende Datennutzung für die Marktteilnehmer ermöglichen. Dieses Werk löst die Frage, wie ein ökonomischer Mehrwert durch die Nutzung von Daten erzeugt werden kann, der die aktuellen technischen Möglichkeiten, Ziele der Nachhaltigkeit und das rechtlich Zulässige verbindet.

Darüber hinaus werden Forderungen nach einer grundlegenden Neuausrichtung der Politischen Theorie behandelt. Der Band analysiert hierzu die integrationstheoretischen Spezifika ihrer Genese, die funktionalen Besonderheiten ihrer Governance im Hinblick auf die dezentrale Integration unterschiedlicher politisch-administrativer, rechtlicher und kultureller Systeme sowie die Muster eines emergenten, transnationalen territorialen Institutionalismus. Abschließend werden verwaltungswissenschaftliche Perspektiven zur Erforschung grenzüberschreitender Zusammenarbeit als horizontaler Ebene des Europäischen Verwaltungsraums aufgezeigt.
    Abstract: The European border regions perform a specific horizontal integration function. From the perspective of public administration theory, this publication lays the foundations for conceptualising the policy area of cross-border cooperation in Europe as a horizontal level of integration. To this end, the volume analyses the integration theory specifics of its genesis, the functional particularities of its governance with regard to the decentralised integration of different political–administrative, legal and cultural systems, as well as the patterns of emergent, transnational territorial institutionalism. Finally, administrative perspectives on the study of cross-border cooperation as a horizontal level of the European Administrative Area are also presented.

    Abstract: The past two decades have seen a radical change in the online landscape with the emergence of GAFAM (Google, Amazon, Facebook, Apple and Microsoft). Facebook, specifically, has acquired a unique monopoly position among social media, and is part of the digital lives of billions of users. A mutual influence between Facebook and the legal framework has gradually emerged, as EU legislators and judges are on the one hand forced to accept the reality of new, widespread behaviors and practices and on the other have constructed a legal framework that imposes limits and rules on the use of the social network. This book offers a unique perspective on this relationship, exploring the various activities and services proposed by Facebook and discussing the attendant legal issues. Accordingly, questions concerning the GDPR, its principles, rights and obligations are in the center of the discussions. However, the book does not limit its scope to data protection: Facebook has also greatly contributed to a liberalization and democratization of speech. In accordance, the classic principles of media law must be revisited, adapted or suitably enforced on the platform. Intellectual property law governs what is owned and by whom, no matter whether raw data or informational goods are concerned. Frameworks on hate speech and fake news are the result of coregulation principles of governance, whereas defamation jurisprudence continues to evolve, considering the consequences of merely “liking” certain content. The economic model of advertising is also governed by strict rules. Above all, Facebook is currently caught in a dilemma of substantial interest for society as a whole: is it a neutral online intermediary, i.e., merely a passive player on the Internet, or is it transforming against its will into an editorial service? In conclusion, the book has a dual purpose. First, it proposes a global and practical approach to the EU legal framework on Facebook. Second, it explores the current limits and the ongoing transformation of EU Internet law as it steadily adapts to life in the new digital world.

    Abstract: This volume analyzes the development of the reactions to Covid-19 by governments, the public and the crime patterns in 16 European countries. All countries are members of the European Union and share common European norms and values, but the Covid-19 pandemic can serve as an example of how these norms and values are interpreted differently with regard to people’s trust in public institutions, governmental control strategies, dealing with fear, anxiety and other emotional responses to the new virus, crime patterns and law enforcement priorities to prevent and combat them. The volume provides empirical data based on available statistics, media analysis and qualitative data from interviews and observations, and examines the similarities and differences in crime patterns and the consequences for local communities and law enforcement priorities. .

    Abstract: This book considers contested responsibilities between the public and private sectors over the use of online data, detailing exactly how digital human rights evolved in specific European states and gradually became a part of the European Union framework of legal protections. The author uniquely examines why and how European lawmakers linked digital data protection to fundamental human rights, something heretofore not explained in other works on general data governance and data privacy. In particular, this work examines the utilization of national and European Union institutional arrangements as a location for activism by legal and academic consultants and by first-mover states who legislated digital human rights beginning in the 1970s. By tracing the way that EU Member States and non-state actors utilized the structure of EU bodies to create the new norm of digital human rights, readers will learn about the process of expanding the scope of human rights protections within multiple dimensions of European political space. The project will be informative to scholar, student, and layperson, as it examines a new and evolving area of technology governance – the human rights of digital data use by the public and private sectors. Rebekah Dowd is an Assistant Professor of Political Science at Midwestern University in Texas. Rebekah’s research focuses on human rights within data policy, the online behavior of individuals and states, and policy decision-making by European politicians. Dr. Dowd teaches courses in global studies, international relations, comparative and foundational politics, European politics, and international political economy.

    Abstract: Klappentext: Der Ruf nach einer koordinierten Asylpolitik wird angesichts der ungleichen Bedingungen, die Geflüchtete vor und in Europa vorfinden, immer lauter. In diesem Sinne arbeitet die Europäische Union seit Jahren an einem "Gemeinsamen Europäischen Asylsystem", das gerade auch das Verwaltungshandeln vor Ort verändern soll. Dieser Band stellt die Ergebnisse einer Forschungsstudie vor, die das praktische Arbeiten in deutschen und schwedischen Asylbehörden vergleichend untersucht. Im Fokus stehen der behördliche Umgang mit den Vorgaben der europäischen Asylpolitik, das Ausmaß einer Europäisierung des lokalen Verwaltungshandelns und die Schwierigkeiten einer grenzüberschreitenden Verwaltungskooperation.

    Abstract: Der Euromaidan, die Annexion der Krim und der Krieg im Donbas als Glieder einer komplexen Ereigniskette haben die internationale Gemeinschaft und insbesondere die Europäische Union beträchtlich herausgefordert. Auf der Suche nach einer Lösung des ukrainisch-russischen Konflikts zeigte die EU, dass sie politische Entscheidungen und Maßnahmen, ausgerichtet auf die Beilegung internationaler Konflikte, zwar verabschieden und umsetzen kann. Bei näherer Betrachtung jedoch ist sie aufgrund zahlreicher interner Einflussfaktoren nach wie vor kein starker außenpolitischer Akteur. Iuliia Barshadska analysiert ein aktuelles Beispiel der Problemfelder, mit denen sich die EU auseinandersetzen muss, um ihre Qualität als Akteur in Krisen- und Konfliktsituationen zu stärken sowie ihre außenpolitische Autonomie zu erhöhen. Die Studie leistet damit einen wichtigen Beitrag zur laufenden Diskussion über die Delegationsbeziehungen innerhalb der EU sowie ihre Handlungsfähigkeit im ukrainisch-russischen Konflikt und die Beilegung internationaler Konflikte im Allgemeinen. Barshadska hilft uns, die Komplexität des Konflikts in und um die Ukraine seit Beginn der Euromaidan-Revolution Ende 2013 besser zu verstehen – einschließlich politischer, wirtschaftlicher und kultureller Zusammenhänge sowie der Besonderheiten des Handelns der EU im Kontext hochsensibler außenpolitischer Themen.

    Abstract: In diesem Open-Access-Buch untersucht L. Constantin Wurthmann die sehr enge Beziehung zwischen Wertorientierungen und Wahlverhalten. Obwohl Wertorientierungen und gesellschaftliche Wertorientierungen im Speziellen zu den zentralsten Konzepten empirischer Sozialforschung gehören, wurde ihre Wirkungsweise im Wahlverhalten bisweilen stiefmütterlich behandelt. Die vorliegende Studie entwickelt einen Vorschlag zur konzeptionellen Erfassung gesellschaftlicher Wertorientierungen und deren Einfluss auf das Wahlverhalten der bundesdeutschen Bevölkerung, welcher anschließend mit Daten der German Longitudinal Election Study (GLES) für die Bundestagswahlen 2009, 2013 und 2017 überprüft wird. Dabei lassen sich strukturelle Veränderungen gesellschaftlicher Wertorientierungen in den Wählerschaften deutscher Parteien nachweisen
