    Abstract: Wie ist mit Kulturgut umzugehen, das in der Sowjetischen Besatzungszone und in der DDR entzogen wurde? Das vom Deutschen Zentrum Kulturgutverluste beauftragte Rechtsgutachten ermöglicht öffentlichen Institutionen und ihren Trägern eine Einschätzung der rechtlichen Situation von Sammlungsgut, das in SBZ und DDR entzogen wurde, und zeigt rechtspolitische Handlungsoptionen auf. Thomas Finkenauer und Jan Thiessen legen ein Kompendium vor, das 13 Fallgruppen in deren historische Entziehungsumstände rechtlich einordnet. Mit dem in dieser Form bisher noch nicht vorhandenen Überblick dient das Gutachten auch der Provenienzforschung.

    Abstract: Über »Rasse« im Grundgesetz wird derzeit viel gestritten. Ist es ein rassistisches Wort, das es zu ersetzen gilt, oder eine für die Bekämpfung von Diskriminierung notwendige Kategorie? Doris Liebscher geht der Frage historisch, rassismustheoretisch und rechtsdogmatisch auf den Grund. Sie rekonstruiert, wie der Begriff ins Grundgesetz kam, und untersucht, wie Gerichte und Rechtswissenschaft heute das auf »Rasse« bezogene Diskriminierungsverbot aus Artikel 3 GG auslegen. Auch das Recht der DDR sowie europäische, US-amerikanische und weitere internationale Rechtsdebatten unterzieht sie einer kritischen Analyse, um schließlich für ein postkategoriales Antidiskriminierungsrecht zu plädieren: die Ersetzung des Rechtsbegriffs »Rasse« durch »rassistisch«

    Abstract: In Yemen, "tribe" is a historically rooted, emic concept of social representation. Rooted in remotest antiquity, over the last centuries the concept of tribe in Yemen has undergone transformations, but also featured aspects of continuity. Today, with the emergence of massive political change, the eruption of popular uprisings, armed conflicts, external military intervention and the associated weakness of the state, tribalism seems to be gaining in importance once again, filling the void created by a retreating state. This collective volume explores the longevity and diversity of manifestations of tribalism in present-day Yemen. It aims at updating and rethinking research on tribes and tribalism in Yemen and providing new input for the discussion of tribalism in contemporary Middle East.

    Abstract: »Schuld« ist ein Basisbegriff in vielen Wissenschaftszweigen. Offensichtlich ist die Funktion von Schuld in der Rechtswissenschaft, wo sie einerseits im Strafrecht und andererseits im Zivilrecht das Fundament für die Rechtsmaterie bildet. In der Philosophie befasst sich vor allem die Ethik mit der wie auch immer definierten Schuld. Die antiken Tragödien drehen sich um verschuldetes wie unverschuldetes Unheil. In der Geschichtswissenschaft wird etwa die Frage nach der Kriegsschuld seit jeher intensiv erörtert. In der Wissenschaftsgeschichte wird über die mit wissenschaftlichen Entdeckungen einhergehende Schuld disputiert. Soziologie, Kunst- und Kulturwissenschaften befassen sich mit in den heutigen pluralistischen Gesellschaften medial und diskursiv präsenten Formen von Schuld. In der Medizin und in den Naturwissenschaften wird die Quantifizierung und Messbarkeit von Schuld sowie ihr eventueller evolutionärer Vorteil erforscht. Und in der Theologie ist die persönliche Schuld Maßstab für die Beurteilung des Menschen am dies irae. Diese Wissensfelder werden in dem vorliegenden Band miteinander in Beziehung und somit ein fruchtbarer interdisziplinärer Diskurs ins Werk gesetzt.

    Abstract: "Between 2009 and 2014, an anti homosexuality law circulating in the Ugandan parliament attracted global attention for the draconian nature of its provisions and for the involvement of US antigay evangelical Christians who were reported to have lobbied for its passage. This book makes three contributions to our understanding of these developments. First, it offers an account of the international relations that anticipated and followed the Anti Homosexuality Act. Journeying through encounters between the kingdom of Buganda and British colonialism, between the Ugandan state and its international donors, and between LGBTI activists in the global South and North, the book illuminates the frictional collaborations across geopolitical divides that produce and contest contemporary queerphobias. Second, it explores the dialectic produced by two opposed statements that mark queer postcolonial disagreements-'homosexuality is Western' and 'homophobia is Western'. Arguing that both statements are true but trivial, the book demonstrates how their opposition produces distinctive forms of temporal politics in the queer postcolony. In this register, the book explores the afterlives of colonialism and the queer futures enabled by it in Uganda, India, and Britain. Third, in shifting the scenes of encounter that it investigates from one chapter to the next, the book reveals how queerness mutates in different configurations of power to become a metonym for other categories such as nationality, religiosity, race, class, and caste. It argues that these mutations reveal the grammars forged in the originary violence of the state and social institutions in which queer difference struggles to find place"--

    Abstract: "This book is concerned with refugee status determination in the context of 'natural' disasters and climate change. Considering evidence that the legal predicament of people who seek recognition of refugee status in this connection has been inconsistently addressed by judicial bodies in leading refugee law jurisdictions, and identifying epistemological as well as doctrinal impediments to a clear and principled application of international refugee law in this connection, the book develops a methodlogy that is theoretically informed by decades of scholarship in disaster risk reduction and doctrinally guided by a human rights-based approach. When disasters are understood as purely reflecting the indiscriminate forces of nature, it is difficult to imagine how a person may establish a well-founded fear of being persecuted, as required by Article 1A(2) of the Refugee Convention. However, when disasters are understood as the consequence of natural hazards interacting with exposed and vulnerable social conditions, the kinds of circumstances in which a person may establish eligibility for recognition of refugee status become much clearer. However, applying the dominant human rights-based approach in the context of disasters and climate change reveals deeply rooted assumptions about the meaning of core elements of the refugee definition, and a recalibrated human rights-based interpretation of general application as developed"--

    Abstract: "This book analyses the mobilisation of race, rights and the law in Malaysia. It examines the Indian community in Malaysia, a quiet minority which consists of the former Indian Tamil plantation labour community and the urban Indian middle-class. The first part of the book explores the role played by British colonial laws and policies during the British colonial period in Malaya, from the 1890s to 1956, in the construction of an Indian "race" in Malaya, the racialization of labour laws and policies and labour-based mobilisation culminated in the 1940s. The second part investigates the mobilisation trends of the Indian community from 1957 (at the onset of Independent Malaya) to 2018. It shows a gradual shift in the Indian community from a "quiet minority" into a mass mobilising collective or social movement, known as the Hindu Rights Action Force (HINDRAF), in 2007. The author shows that activist lawyers and Indian mobilisers played a crucial part in organizing a civil disobedience strategy of framing grievances as political rights and using the law as a site of contention in order to claim legal rights through strategic litigation. Highly interdisciplinary in nature, this book will be of interest to scholars and researchers examining the role of the law and rights in areas such as sociolegal studies, law and society scholarship, law and the postcolonial, social movement studies, migration and labour studies, Asian law and Southeast Asian Studies"--

    Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Abstract: By executive order, the US has adopted an immigration policy that looks remarkably similar to a Muslim ban, and there are new threats to deport long-settled residents, such as the so-called Dreamers. Our defunct refugee system has not dealt adequately with increased refugee flows, forcing desperate people to undertake increasingly risky measures in efforts to reach safe havens. Meanwhile increased migration flows over recent years appear to have contributed to a rise in right-wing populism, apparently driving phenomena such as Brexit and Trumpism. In this original and insightful book Gillian Brock offers answers and tools that assist us in evaluating current migration policy and in helping to determine which policies may be permissible and which are normatively indefensible. She offers a comprehensive framework for responding to the many challenges which have recently emerged, and for delivering justice for people on the move along with those affected by migration

    Abstract: "The forms of liberal government that emerged after World War II are in the midst of a profound crisis. In I Am the People, Partha Chatterjee reconsiders the concept of popular sovereignty in order to explain today's dramatic outburst of movements claiming to speak for "the people." To uncover the roots of populism, Chatterjee traces the twentieth-century trajectory of the welfare state and neoliberal reforms. Mobilizing ideals of popular sovereignty and the emotional appeal of nationalism, anticolonial movements ushered in a world of nation-states while liberal democracies in Europe guaranteed social rights to their citizens. But as neoliberal techniques shrank the scope of government, politics gave way to technical administration by experts. Once the state could no longer claim an emotional bond with the people, the ruling bloc lost the consent of the governed. To fill the void, a proliferation of populist leaders have mobilized disaffected groups into a battle that they define as the authentic people against entrenched oligarchy. Once politics enters a spiral of competitive populism, Chatterjee cautions, there is no easy return to pristine liberalism. Only a counter-hegemonic social force that challenges global capital and facilitates the equal participation of all peoples in democratic governance can achieve significant transformation. Drawing on thinkers such as Antonio Gramsci, Michel Foucault, and Ernesto Laclau and with a particular focus on the history of populism in India, I Am the People is a sweeping, theoretically rich account of the origins of today's tempests

    Abstract: Nach der Islamischen Revolution 1979 haben die patriarchalen religiös orientierten Vorschriften die Frauen in ihren Rechten benachteiligt und änderten somit ihre Stellung in Gesellschaft und Politik. Islamischer Feminismus in Iran als ein postrevolutionärer Diskurs befasst sich mit dieser Thematik und sucht gleichzeitig nach einer neuen Möglichkeit für die zeitgemäße Interpretation der religiösen und religiös geprägten Normen.Hierfür reflektiert die Autorin die Denkrichtungen und Argumentationshintergründe der männlichen Denker in der Debatte um die Frauenrechte in Iran seit der Entstehung der Islamischen Republik. Weiterhin soll aus dem Werdegang, der Biographie sowie den Publikationen der jeweiligen Akteure rekonstruiert werden, worauf sie sich bei ihren Argumenten stützen und aus welcher Perspektive sie ihre Standpunkte untermauern - was wiederum ihre Positionen in der Frauenrechtsdebatte für die Verwirklichung einer Reform bestimmt. Abgesehen von den Konservativen mit ihrer klaren Vorstellung von Frauenrechten, setzen die religiös-progressiven und liberal-säkularen Denker die Befreiung der Frau von einem vorgeschriebenen patriarchalen System und die Wiederherstellung des Selbstbewusstseins der Frau in den Mittelpunkt der politischen und gesellschaftlichen Öffentlichkeit.
    Abstract: After the Islamic Revolution in 1979, patriarchal, religiously oriented rules discriminated against women’s rights and changed their position in society and politics. Islamic feminism in Iran as a post-revolutionary discourse deals with this issue and, at the same time, seeks a new alternatives in the contemporary interpretation of religious norms and those influenced by religion.This work reflects on the mindset and argumentation of various social actors in the debate on women’s rights in Iran since the emergence of the Islamic Republic, in particular on the positions of male thinkers. Furthermore, using the career, biography and publications of each respective actor, the study reconstructs what they base their arguments on and from which perspective they substantiate their points of view. The mindset and reasoning of these thinkers determine their positions in the women’s rights debate on the realisation of reform. In contrast to conservatives, with their clear notion of women’s rights, religiously progressive and liberal secular thinkers place the liberation of women from a prescribed patriarchal system and the restoration of women’s self-confidence at the centre of political and social life.

    Abstract: "Long-standing political tensions between Iran and the United States that intensified in the post-9/11 period and the Global War on Terror set the stage for women's rights activists both inside and outside Iran as they seek full legal equality under the Islamic Republic. Through discourse analysis and ethnographic research, Catherine Sameh demonstrates how despite limited success in overturning discriminatory laws under conservative and reform governments, women's rights activists have imprinted a gender equality perspective onto the state and society in defining modern Islamic democracy. Sameh engages with activist work both inside Iran and in the diaspora, through analysis of the One Million Signatures Campaign to End Discriminatory Law (a transnational campaign started in 2006 to reform Iranian Muslim family law), the work of Nobel Prize-winning Shirin Ebadi, and the independent, alterative internet streaming television channel Zanan TV, founded by longtime women's rights activist Mahboubeh Abbasgolizadeh.     Abstract: Sergio Fabbrini proposes a way out of the EU's crises, which have triggered an unprecedented cleavage between 'sovereignist' and 'Europeanist' forces. The intergovernmental governance of the multiple crises of the past decade has led to a division on the very rationale of Europe's integration project. Sovereignism (the expression of nationalistic and populist forces) has demanded more decision-making autonomy for the EU member states, although Europeanism has struggled to make an effective case against this challenge. Fabbrini proposes a new perspective to release the EU from this predicament, involving the decoupling and reforming of the EU: on the one hand, the economic community of the single market (consisting of the current member states of the EU and of others interested in joining or re-joining it); and on the other, the political union (largely based on the eurozone reformed according to an original model of the federal union).

    Abstract: While it might have been viable for states to isolate themselves from international politics in the nineteenth century, the intensity of economic and social globalisation in the twenty-first century has made this impossible. The contemporary world is an international world - a world of collective security systems and collective trade agreements. What does this mean for the sovereign state and 'its' international legal order? Two alternative approaches to the problem of 'governance' in the era of globalisation have developed in the twentieth century: universal internationalism and regional supranationalism. The first approaches collective action problems from the perspective of the 'sovereign equality' of all States. A second approach to transnational 'governance' has tried to re-build majoritarian governmental structures at the regional scale. This collection of essays wishes to analyse - and contrast - the two types of normative and decisional answers that have emerged as responses to the 'international' problems within our globalised world.

    Abstract: Im Zentrum dieser Arbeit stehen die Begriffe der Fremdheit, Religion, Kultur und Toleranz als Gegenstände der rechtlichen Analyse des Umgangs mit dem Phänomen religiös-kultureller Fremdheit.Fremdheit jedweder Art stellt seit jeher, spätestens jedoch mit dem verstärkten Auftauchen „fremder“ Religionen, allen voran die des Islam, eine ebenso brisante wie umstrittene Thematik dar. Sowohl die Flüchtlingswellen der letzten Jahre als auch religiöse Einzelphänomen wie das muslimische Kopftuch machen die Art des Umgangs mit religiös-kultureller Andersartigkeit wichtiger denn je. Die vorbehaltlose Ausgestaltung des Art. 4 I, II GG sowie ihr sehr enger Bezug zur Menschenwürde lässt die Religionsfreiheit bzw. ihre Gewährleistung zum Dreh- und Angelpunkt des Schutzes besonders gefährdeter, aber auch religiöser Minderheiten und damit zur Nagelprobe für Toleranz werden.Die Arbeit erhebt weder den Anspruch noch verfolgt sie das Ziel einer umfassenden Untersuchung des Phänomens der Fremdheit, sondern liefert eine Analyse des rechtlichen sowie in Ansätzen politischen Umgangs mit religiöser als auch kulturell-religiöser Fremdheit im hoheitlichen Bereich. Was ist unter religiöser bzw. kulturell-religiöser Fremdheit zu verstehen? Wie und wann reagierte das Recht historisch und aktuell auf dieses Phänomen und wie sind die bisherigen Ansätze zur Objektivierung höchstpersönlicher Glaubensfragen in den wichtigsten Leitentscheidungen des Bundesverfassungsgerichts zu bewerten? Ist eine staatliche Reaktion auf religiös-kulturelle Fremde in Zeiten zunehmender religiöser, weltanschaulicher sowie sozialer Pluralisierung und tiefer demographischer Veränderungen überhaupt in den gewählten Formen angezeigt oder vielmehr ein Umdenken der bisherigen „Toleranzpraxis“ geboten?Der Schwerpunkt der Arbeit dreht sich im Wesentlichen um diese Fragen und zeigt auf originelle Weise durch semantische, philosophisch-politologische sowie insbesondere rechtliche Zugänge zu der Thematik mögliche Antworten sowie Bilanzen aus dem bisherigen Umgang mit Fremdheit in der Bundesrepublik Deutschland auf.

    Abstract: While it might have been viable for states to isolate themselves from international politics in the nineteenth century, the intensity of economic and social globalisation in the twenty-first century has made this impossible. The contemporary world is an international world - a world of collective security systems and collective trade agreements. What does this mean for the sovereign state and 'its' international legal order? Two alternative approaches to the problem of 'governance' in the era of globalisation have developed in the twentieth century: universal internationalism and regional supranationalism. The first approaches collective action problems from the perspective of the 'sovereign equality' of all States. A second approach to transnational 'governance' has tried to re-build majoritarian governmental structures at the regional scale. This collection of essays wishes to analyse - and contrast - the two types of normative and decisional answers that have emerged as responses to the 'international' problems within our globalised world.

    Abstract: Protracted and bitter resistance by alter- and anti-globalisation movements shows that the globalisation of law transpires as the globalisation of inclusion and exclusion. Humanity is inside and outside global law in all its possible manifestations. But how is this possible? How must legal orders be structured, such that, even if we can now speak of law beyond state borders, no emergent global legal order is possible that does not include without excluding? Is an authoritative politics of boundaries possible that neither postulates the possibility of realising an all-inclusive global legal order nor accepts resignation or political paralysis in the face of the globalisation of inclusion and exclusion? These pressing questions guide this book, opening up a vast field of enquiry that demands integrating sociological, doctrinal and philosophical perspectives and insights.

    Abstract: "Today's convergent media environment offers unprecedented opportunities for sourcing and disseminating previously obscure popular culture content from Japan. However, this presents concerns regarding copyright, ratings and exposure to potentially illegal content which are serious problems for those teaching and researching Japanese popular culture. Despite the enthusiasm for Japanese popular culture, these concerns spark debate about whether it can be judged harmful for youth audiences and could therefore herald the end of 'cool Japan.' This collection brings together Japan specialists in order to identify key challenges in using Japanese popular culture materials in their research and teaching. It addresses issues such as the availability of unofficially translated and transmitted Japanese material; the emphasis on adult-themes, violence, sexual scenes and under-age characters; and the high levels of discrepancy in legislation and ratings systems across the world. Considering how these issues affect researchers, teachers and fans in the US, Canada, Australia, China, Japan and elsewhere in Asia, the contributors discuss the different ways in which academic and fan practices are challenged by local regulations. Illustrating from personal experience the sometimes fraught nature of teaching about 'cool Japan,' they suggest ways in which Japanese Studies as a discipline needs to develop clearer guidelines for teaching and research, especially for new scholars entering the field. As the first collection to identify some of the real problems faced by teachers and researchers of Japanese popular culture as well as the students over whom they have a duty of care, this book will be of great interest to students and scholars of Japanese Studies and Culture Studies"--Provided by publisher

    Abstract: "Contemporary slavery has recently and unexpectedly emerged as a key source of both popular fascination and political mobilization. This volume brings together a cast of leading experts to carefully explore how the history and iconography of slavery has been invoked to support a series of government interventions, activist projects, legal instruments, and rhetorical performances. However well-intentioned these interventions might be, they nonetheless remain subject to a host of limitations and complications. Recent efforts to combat contemporary slavery are too often sensationalist, self-serving, and superficial. The widely held notion that anti-slavery is one of those rare issues that "transcends" politics or ideology is only sustainable because the underlying issues at stake have been constructed and demarcated in a way that minimizes direct challenges to dominant political and economic interests. This must change. By providing an original approach to the underlying issues at stake, this book will help readers understand the political practices that have been concealed beneath the popular rhetoric and establishes new conversations between scholars of slavery and trafficking and scholars of human rights and social movements."--
