Zudem erliegen Menschen schädlichen Versuchungen und neigen zu Süchten. Schließlich agieren Verbraucher oft egoistischer oder weniger nachhaltig, als sie von sich selbst behaupten. Die Beiträge in diesem Buch knüpfen an dieses Generalthema an, widmen sich den dunklen Seiten und regen an, dass Nachfrager und Anbieter manche Verhaltensweisen überdenken und auch Gegenstrategien entwickeln sollten.     Abstract: About 30 years ago, the metaphor of ‘the dark sides of consumer behaviour’ was introduced in consumer behaviour research. Consumers sometimes knowingly place themselves in the wrong with their behaviour (as in the case of fraudulent returning of products, for example), but regard their misdemeanours as ‘smart peccadilloes’. In addition, people succumb to harmful temptations and tend towards addictions (e.g. in the form of gambling). Finally, consumers often act more selfishly (or less sustainably) than they claim to. The contributions in this book examine this general topic, address the dark sides of consumerism and encourage both consumers and companies to rethink some of their behaviour and also develop counter-strategies to it.     Abstract: Movement of people has been a key feature in the whole history of European integration. While existing literature has mostly adopted national viewpoints and a socioeconomic perspective, this book integrates these existing fragmented analyses, views them from a broader perspective and places them in the wider context of the social and demographic transformation of Europe and the political and economic narrative of continental integration. It highlights the impact made by EC/EU immigration policies on the external political and economic relations of Europe and acknowledges that pre-1989 migration from East European countries is part of European integration. By showing that migration policies and their impact on European national societies and economies cannot be fully understood without taking into account the EC framework, this book, therefore, contributes to migration studies as a whole.

    Abstract: Up to now there have been scarcely any publications on Leibniz dedicated to investigating the interrelations between philosophy and mathematics in his thought. In part this is due to the previously restricted textual basis of editions such as those produced by Gerhardt.     Abstract: The notion of “natural law” has repeatedly furnished human beings with a shared grammar in times of moral and cultural crisis. Stoic natural law, for example, emerged precisely when the Ancient World lost the Greek polis, which had been the point of reference for Plato's and Aristotle's political philosophy. In key moments such as this, natural law has enabled moral and legal dialogue between peoples and traditions holding apparently clashing world-views. This volume revisits some of these key moments in intellectual and social history, partly with an eye to extracting valuable lessons for ideological conflicts in the present and perhaps near future. The contributions to this volume discuss both historical and contemporary schools of natural law. Topics on historical schools of natural law include: how Aristotelian theory of rules paved the way for the birth of the idea of "natural law"; the idea's first mature account in Cicero's work; the tension between two rival meanings of “man’s rational nature” in Aquinas’ natural law theory; and the scope of Kant’s allusions to “natural law”.     Abstract: This book is a comparative study of the exclusion of illegally gathered evidence in the criminal trial , which includes 15 country studies, a chapter on the European Court of Human Rights, and a comparative synthetic conclusion. No other book has undertaken such a broad comparative study of exclusionary rules, which have now become a world-wide phenomenon. The topic is one of the most controversial in criminal procedure law, because it reveals a constant tension between the criminal court’s duty to ascertain the truth, on the one hand, and its duty to uphold important constitutional rights on the other, most importantly, the privilege against self-incrimination and the right to privacy in one's home and one's private communications. The chapters were contributed by noted world experts on the subject for the XVIII Congress of the International Academy of Comparative Law in Washington in July 2010.

    Abstract: Is there universalism of human rights? If so, what are its scope and limits? This book is a doctrinal attempt to define universalism of human rights, as well as its scope and limits. The book presents tests of universalism on international, regional and national constitutional levels. It is maintained that universalism of human rights is both a concept and a normative reality. The normative character of human rights is scrutinized through the study of international and regional agreements as well as national constitutions. As a consequence, limitations of normativity are identified, usually on the international level, and take the form of exceptions, reservations, and interpretations. The book is based on the General and National Reports which were originally presented at the 18th International Congress of the International Academy of Comparative Law in Washington D.C. 2010.

    Abstract: Relevant to, and drawing from, a range of disciplines, the chapters in this collection show the diversity, and applicability, of research in Bayesian argumentation. Together, they form a challenge to philosophers versed in both the use and criticism of Bayesian models who have largely overlooked their potential in argumentation. Selected from contributions to a multidisciplinary workshop on the topic held in Lund, Sweden, in autumn 2010, the authors count legal scholars and cognitive scientists among their number, in addition to philosophers. They analyze material that includes real-life court cases, experimental research results, and the insights gained from computer models.The volume provides a formal measure of subjective argument strength and argument force, robust enough to allow advocates of opposing sides of an argument to agree on the relative strengths of their supporting reasoning. With papers from leading figures such as Mike Oaksford and Ulrike Hahn, the book comprises recent research conducted at the frontiers of Bayesian argumentation and provides a multitude of examples in which these formal tools can be applied to informal argument. It signals new and impending developments in philosophy, which has seen Bayesian models deployed in formal epistemology and philosophy of science, but has yet to explore the full potential of Bayesian models as a framework in argumentation.     Abstract: This book offers its readers an overview of recent developments in the theory of legal argumentation written by representatives from various disciplines, including argumentation theory, philosophy of law, logic and artificial intelligence. It presents an overview of contributions representative of different academic and legal cultures, and different continents and countries. The book contains contributions on strategic maneuvering, argumentum ad absurdum, argumentum ad hominem, consequentialist argumentation, weighing and balancing, the relation between legal argumentation and truth, the distinction between the context of discovery and context of justification, and the role of constitutive and regulative rules in legal argumentation. It is based on a selection of papers that were presented in the special workshop on Legal Argumentation organized at the 25th IVR World Congress for Philosophy of Law and Social Philosophy held 15-20 August 2011 in Frankfurt, Germany.

    Abstract: This book examines the notion of children having full citizenship. It does so historically, through intellectual discourse, beliefs, and moral and ideological positions on children. It looks at the status and extent of knowledge of the position of children covering about 2500 years. The book takes European and other cultures, traditions and beliefs into consideration. It reflects on the topic from a variety of disciplines, including social sciences, theology and philosophy. The book places children’s citizenship in the centre of children’s rights discourse. Part of the work is a critical appraisal of ‘children’s participation’ because it diverts attention away from children as members of society toward being a separable group. The book moves on from child participation using a children’s rights based argument toward examination of the relationship of the child with the state, i.e. as potentially full member citizens

    Abstract: Lateinamerikanische Gesellschaften sind seit Langem durch extreme soziale Ungleichheiten gekennzeichnet. Unterschiedliche Wirtschaftsmodelle haben die Beharrungskraft dieser Disparitäten ebenso wenig berührt wie verschiedene politische Regime. Auch die seit mittlerweile drei Dekaden regierenden Demokratien konnten hier bisher keine nennenswerten Erfolge erzielen. Der Band spürt unter Verwendung neuester Daten und Kenntnisse sowie dem Einsatz neuer methodischer Konzepte der bemerkenswerten Beharrungskraft dieser Ungleichheiten nach. Er betrachtet die Partikularitäten der Region aus verschiedener Perspektive und diskutiert die Frage, ob die Ungleichheiten primär als Ausdruck von politischen und ökonomischen Defiziten verstanden werden sollten, oder stattdessen sogar Ausdruck sehr erfolgreicher Politiken sind.     Abstract: Das Verhalten Israels im Konflikt mit den Palästinensern gibt der Forschung zum demokratischen Frieden Rätsel auf: Es ist eine Demokratie, die an der Besatzung fremden Territoriums festhält und auch vor dem Einsatz militärischer Gewalt nicht zurückschreckt. Die Studie geht der These nach, dass die jüdische Siedlerbewegung und ihr Milieu, der religiöse Zionismus, mitverantwortlich sind für das Scheitern des Osloer Friedensprozesses. Weil die Theorien des demokratischen Friedens jedoch fest im Säkularisierungsparadigma der liberalen Moderne verankert sind, ist die politisierte Religion als mögliche Gefährdung der demokratischen Friedensneigung bislang nicht in den Blick geraten. Die Untersuchung setzt sich kritisch mit dieser historisch bedingten, säkularistischen Hintergrundüberzeugung auseinander. Religionssoziologische Theorien und die neueren Erkenntnisse zur ambivalenten Rolle von Religion in Konflikten werden herangezogen, um die Forschung zu demokratischer Außenpolitik um die Dimension politisierter Religion zu erweitern. Die Analyse des Friedensprozesses zeigt, wie die Siedlerbewegung die Strukturen der israelischen Demokratie nutzte, um den Friedensprozess nachhaltig zu stören

    Abstract: Der vorliegende Band umfasst ausgewählte Beiträge der internationalen interdisziplinären Roundtable-Konferenz "The Percetions of China: Images of a Global Player", die im März 2006 in Hongkong stattfand. Die Beiträge befassen sich in vier Schwerpunktbereichen "Wirtschaft" (Economics), "Politik" (Political Science), "Recht" (Law Studies) und "Kultur" (Cultural Studies) mit den unterschiedlichen Bildern und Wahrnehmungen von China in Geschichte und Gegenwart. Sie analysieren hierbei die "Macht der Bilder" (Images) sowohl aus der westlichen (deutschen, europäischen, nordamerikanischen) als auch der östlichen (VR-chinesischen und HK-chinesischen) Perspektive.     Abstract: Sterben und Tod stellen in der Gegenwartsgesellschaft einen komplexen Problembereich dar, der verschiedenste gesellschaftliche Bereiche und Diskurse – private wie öffentliche, theoretische wie praktische – betrifft. Im vorliegenden Band wird durch ein interdisziplinäres Spektrum der aktuelle Stand der medizinisch-ethischen und juristischen wie auch der geistes- und kulturwissenschaftlichen Diskussion und Forschung dargestellt. Zum anderen wird die grundsätzliche Haltung unserer auf menschliche und technische Leistung und Fortschrittsgläubigkeit ausgerichteten Gesellschaft gegenüber dem Phänomen Tod und die Problematik einer heute erschwerten sinnhaften Deutung des Todes erörtert. Zwei interkulturelle Fallbeispiele ergänzen die wissenschaftlichen Beiträge.
