    Abstract: This open access volume of LIDC contributions focuses on how competition and intellectual property laws incorporate sustainability objectives. Businesses are increasingly embracing sustainability objectives, driven by the international community. Although competition and intellectual property law are certainly not the only tools for addressing sustainability issues, they can play a role in moving toward a more sustainable society. Sustainability has gained prominence in competition law in all jurisdictions covered in this volume. The contributions focus on classic questions such as whether sustainability agreements restrict competition and, if so, to what extent businesses can be exempted on efficiency grounds. The papers also raise a number of questions, in particular concerning the treatment of non-market efficiencies. The soft law and case law produced by competition authorities are examined, and the leadership role of some competition authorities in the field – from advocacy to policy papers and sustainability guidelines – is highlighted. The authors call for more individual guidance to provide enhanced transparency and clarity to industry, advisors and society at large on sustainability issues, with guidelines or sustainability-related block exemptions providing even greater legal certainty. With regard to intellectual property, the contributions examine various important issues, such as the need for intellectual property rights to remain technology-neutral, ways to promote the use of sustainable technologies and incentives for licensing, and ways to promote the dissemination of sustainable technologies, including compulsory licensing, cross-licensing, open source or FRAND licensing, and replacing the destruction of counterfeit goods with recycling. The papers also discuss greenwashing and how it can be addressed through revisions to trademarks and related rights

    Abstract: This open access book studies how foreign models of economic development can be effectively learned by and applied to today’s latecomer countries. Policy capacity and societal learning are increasingly stressed as pre-conditions for successful catch-up. However, how such learning should be initiated by individual societies with different features needs to be explained. The book answers this pragmatic question from the perspective of Japan’s past experience and its extensive development cooperation in Asia, Africa, and Latin America. Since the late nineteenth century, Japan has developed a unique philosophy and method for adopting advanced technologies and systems from the West; the same philosophy and method govern its current cooperation with the developing world. The key concepts are local learning and translative adaptation. Local learning says that development requires the learner to adopt a proactive mindset and the goal of graduating from receiving aid. Meanwhile, translative adaptation requires foreign models be modified to fit local realities given the different structures of the home and foreign society. The development process must be wholly owned by the domestic society in rejection of copy-and-paste acceptance. These ideas not only informed Japan but are key to successful development for all. The book also asks how this learning method should—or should not—be revised in the age of SDGs and digitalization. Following the overview section that lays out the general principles, the book offers many real cases from Japan and other countries. The concrete actions outlined in these cases, with close attention to individual growth “ingredients” as opposed to general theories, are crucial to successful policy making. The book contains materials that are highly useful for national leaders and practitioners within developing countries as well as students of development studies

    Abstract: In this open access book, Mikael Hård tells a story of how people around the world challenged the production techniques and products brought by globalization. Retaining their autonomy and freedom, creative individuals selectively adopted or rejected modern gadgets, tools, and machines. In standard historical narratives, globalization is portrayed as an unstoppable force that flattens all obstacles in its path. Modern technology is also seen as inexorable: in the nineteenth century, steamships, telegraph lines, and Gatling guns are said to have paved the way for colonialism and other forms of dominating people and societies. Later, shipping containers and computer networks purportedly pulled the planet deeper into a maelstrom of capitalism. Hård discusses instances that push back against these narratives. For example, in Soviet times, inhabitants of Samarkand, Uzbekistan, preferred to remain in—and expand—their own mud-brick houses rather than move into prefabricated, concrete residential buildings. Similarly, nineteenth-century Sumatran carpenters ignored the saws brought to them by missionaries—and chose to chop down trees with their arch-bladed adzes. And people in colonial India successfully competed with capitalist-run Caribbean sugar plantations, continuing to produce their own muscovado and sell it to local consumers. This book invites readers to view the history of technology and material culture through the lens of diversity.     Abstract: This open access book aims to elaborate on the legal prerequisites to establish the liability of corporations for transboundary environmental harm, not only by identifying existing liability rules, principles and standards but also by analysing their potential for further legal development. The authors consider international and transboundary liability law to currently be an underutilised tool for international environmental protection. The book seeks to address this by exploring what is needed in terms of legislative action and identifying options for judicial pliability, thereby providing an important legal contribution in furthering the development of an effective international and transnational environmental liability law regime.

    Abstract: Seit dem Mord an George Floyd durch den Polizeieingriff in den Vereinigten Staaten im Mai 2020 und der daraus erwachsenen (Social Media-)Bewegung #blacklivesmatter hat auch die Beschäftigung mit den verschiedenen Formen von Rassismus in Deutschland zugenommen. Konnte der Begriff vor wenigen Jahren in wissenschaftlichen wie öffentlichen Diskursen weitgehend nur schwierig oder selten genutzt werden, hat er sich inzwischen hierzulande auch als Gegenbegriff zur globalen Wirkmächtigkeit rechter Ideologien, die besonders Identitätskategorien zur Legitimation mörderischer Gewalt heranziehen, sowie im Kontext globaler Diversifizierungsmaßnahmen im Diskursmainstream durchgesetzt. Dieser Erfolg des Begriffs lässt auch die filmischen Produktionen zu Themen von Menschenfeindlichkeit, die auf Repräsentationskategorien basieren, in einem neuen Licht erscheinen. Filme zu Themen des Rassismus versuchen, Aufklärungsarbeit im Sinne anti-rassistischer Praxis zu leisten, während beispielsweise propagandistische Videos rechter und dschihadistischer Kreise zur (re-)produktiven Verhandlung von Rassismus beitragen. Andererseits lassen sich Filme, die scheinbar nichts mit Rassismus zu tun haben, bei einem genaueren analytischen Blick sehr wohl als Verstärkungs-, Reproduktions- oder Verschleierungsakteure von Rassismen verstehen. So sind Filme immer schon im Sinne von (Un-)Sichtbarkeitsmaschinen dazu geeignet, soziale Verhältnisse zu veräußerlichen und so ungedachte Zusammenhänge zu denken. In dieser argumentativen Bi-Perspektivität – Sichtbarwerden der Rassismusdiskurse und Filme als Sichtbarkeitsmedien sozialer Verhältnisse – geht der vorliegende Sammelband Diskursformen des Rassismus, seiner Filmkulturen und Möglichkeiten des (anti-rassistischen) Widerstands besonders/aber nicht nur im deutschsprachigen Kontext nach. Daran schließen sich folgende Fragen an: Wie sieht der Zusammenhang von (fiktionalen) Filmen und Formen des Rassismus in Film-kulturen aus? Wie gehen fiktionale Formate mit Antisemitismus, Rechtsradikalismus, antimuslimischem Rassismus, Antiziganismus und whiteness um? Und wie versuchen aktuelle (auch experimentelle) filmische Formate, Rassismus entgegenzutreten? Im Zentrum des Sammelbandes stehen die Filme und ihre Geschichten selbst.     Abstract: Thirty years after the collapse of Communism, and at a time of increasing anti-migrant and anti-Roma sentiment, this book analyses how Roma identity is expressed in contemporary Europe. From backgrounds ranging from political theory, postcolonial, cultural and gender studies to art history, feminist critique and anthropology, the contributors reflect on the extent to which a politics of identity regarding historically disadvantaged, racialized minorities such as the Roma can still be legitimately articulated.

    Abstract: This volume adds to the plurality of global histories by locating the global through its articulation and manifestation within particular localities. It accomplishes this by bringing together interlinked case-studies that analyse various temporal and spatial dimensions of the global in the local and the interactions between the local and the global. The case-studies apply a spatial approach to analyse how global questions of space, movement, networks, borders, and territory are worked out at a local level. The material draws on the Nordic countries, Europe, the Atlantic world, Africa, and Australia and ranges from the seventeenth to the twentieth century. It is further divided into sections that address topics such as the translocality of humans and goods, local articulations of identities and globalities, parliamentarism and anti-colonialism, the organization of knowledge and the construction of spaces of representation and memory
