The Taliban Courts in Afghanistan: Waging War by Law explores how the Taliban used the law as a resource in its conflict with militarily and technologically superior Western armies. While the international coalition set up an inadequate and corrupt legal system, the Taliban set up hundreds of courts in the countryside. By insisting on due process, impartiality of judges, and the enforcement of verdicts, this system of justice established itself as one of the few sources of predictability in the daily lives of Afghans. The armed movement used law to substantiate their claim to embody the state, disseminate their vision of society, and establish local legitimacy. Their courts attempted to balance the political agenda of the movement, the demands of Islamic law, the needs of the population, and the expectations of international legal actors whose implicit recognition they desired. In contemporary civil wars, where dispensing justice is at once a juridical activity, a political weapon, and a stake in the war, this book thus accounts for why the West lost the war and how the Taliban took over the country. Based on the author's extensive fieldwork in various provinces in Afghanistan and unique access to Taliban judges and court users, this socio-legal investigation offers new perspectives on a country that was at war for over four decades. Baczko proposes an innovative reflection on the place of law and courts in civil wars as well as a stark reminder of the dangers of foreign intervention.

What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

    Abstract: "Feminist AI: Critical Perspectives on Data, Algorithms and Intelligent Machines is the first volume to bring together leading feminist thinkers from across the disciplines to explore the impact of artificial intelligence (AI) and related data-driven technologies on human society. Recent years have seen both an explosion in AI systems and a corresponding rise in important critical analyses of these technologies. Central to these analyses has been feminist scholarship, which calls upon the AI sector to be accountable for designing and deploying AI in ways that further, rather than undermine, the pursuit of social justice. Feminist AI showcases the vital contributions of feminist scholarship to thinking about AI, data, and intelligent machines as well as laying the groundwork for future feminist scholarship on AI.     Abstract: Sovereignty, International Law, and the Princely States of Colonial South Asia examines the role the doctrine of sovereignty played in debates over the legal status of the princely states of colonial South Asia, illustrating how different interpretations have shaped current understandings of international law and the modern Indian nation-state.This book examines the relationship between colonialism and international law by focusing on debates surrounding the legal status of the 'princely states' of colonial South Asia. The princely states were ruled by indigenous rulers and were not considered to be British territory. Instead, they remained subject to British influence exercised through political officers, resulting in enduring controversies over whether they were 'sovereign states'. This book traces how the language of sovereignty became the discourse for debating the legal status of the princely states and, in this way, mediated the exercise of political power in colonial South Asia. Focusing on the period between the mid-eighteenth and mid-twentieth centuries, it examines how international lawyers, British politicians, colonial officials, rulers and bureaucrats of princely states, and anticolonial nationalists continually redefined the concept of sovereignty. Assertions of sovereignty enabled these players to rely on the vocabulary of international law to resolve questions of legal status, the extent of rights, and the proper exercise of powers, and to construct a political order that was in line with their interests and aspirations. By invoking the vernacular of sovereignty in contrasting ways to support their differing visions of world order, these actors also attempted to reconfigure the boundaries among the spheres of the national, the imperial, and the international. Exploring the disputes and debates over the princely states is, therefore, key to understanding the history of sovereignty, the construction of the modern Indian nation-state, and the scope and stakes of international law itself.

    Abstract: This work is the first major attempt since the 1970s to challenge the idea that the essential engine of medical (and scientific) change in seventeenth-century Britain emanated from puritanism. It seeks to reaffirm the crucial role of the period of the civil wars and their aftermath in providing the most congenial context for a re-evaluation of traditional attitudes to medicine. In the process, it rejects the idea that such initiatives were the special preserve of a small religious elite (puritans), claiming instead that enthusiasm for change can be found across the religious spectrum. At the same time, the work demonstrates that medical practitioners were increasingly drawn into contemporary religious and political debates in a way that led to a fundamental politicization of the ‘profession’. By the end of the seventeenth century, it was now commonplace to see doctors, apothecaries and surgeons fully engaged in everyday political and civic life. At the same time, religious and political orientation often became an important factor in the career development of medics, especially in towns and cities, where substantial benefits might accrue to those who found themselves in favour with the ruling elites, be they Whig or Tory. The body politic, a Renaissance commonplace, was now peopled by medical practitioners who often claimed a special authority when it came to diagnosing the ills of late seventeenth-century society

    Abstract: Why have most African countries not achieved greater political liberalization? What explains the lack of progress toward the ideals of liberal democracy across the region? This book advances ongoing debates on democratic backsliding with specific reference to Africa. In examining how incumbent leaders in African countries attempt to contain societal pressures for greater democracy, the chapters explain how governments go beyond the standard tools of manipulation, such as electoral fraud and political violence, to keep democracy from unfolding in their countries. The book emphasizes two distinct strategies that governments frequently use to reinforce their hold on power, but which remain overlooked in conventional analyses; —the legal system and the international system. It—documents how governments employ the law to limit the scope of action among citizens and civil society activists struggling to expand democratic liberties, including the use of constitutional provisions and the courts. The work further demonstrates how governments use their role in international relations to neutralize pressure from external actors, including sovereigntist claims against foreign intervention and selective implementation of donor-promoted policies. While pro-democracy actors can also employ these legal and international strategies to challenge incumbents, in some cases to prevent democratic backsliding, the book shows why and how incumbents have enjoyed institutional advantages when implementing these strategies through the six country case studies of Ghana, Kenya, Malawi, Uganda, Zambia, and Zimbabwe

    Abstract: When Martin Luther King Jr. argued on behalf of civil rights he was told that he was 'too soon.' Today, those demanding reparations for slavery are told they are 'too late.' What time is it? Or perhaps the appropriate question is: whose time is it? These questions point to a phenomenon of segregated time: how certain political subjects are viewed as occupants of different time zones, how experiences of time diverge across peoples, and how these divergent temporal spheres entwine to serve white supremacy. While racial segregation and inequality are typically conceived in terms of space, 'Segregated Time' explores how they are also sustained through impositions on human time. In this study, P.J. Brendese takes a time-sensitive approach to race as it pertains to the acceleration of human disposability, dynamic identity formation, and the production and allocation of economic goods.

    Abstract: In Social Movements: A Theoretical Approach, Dieter Rucht offers a theoretically and historically informed approach to social movements as a phenomenon of modern societies. He links the analysis of social movements to general theories of society and processes of social change, and combines three basic perspectives: interactionist, constructivist, and process-oriented (ICP-approach). Drawing mainly on ideas from Jürgen Habermas, Pierre Bourdieu, and Anthony Giddens, Rucht recommends several revisions and highlights the important role of the public sphere as the central stage for social movements.     Abstract: Muslims formed a disparate and unwieldy 'community' in Bombay in the 19th century. The Islam that was professedly held in common by various groups could barely provide a sense of unity or cohesion to people so widely diverse in terms of language, customs, and also of forms and practices of belief. By the middle of the 19th century, a class of wealthy ship owners, ship-builders, and merchants, belonging to the varied communities that constituted the city, of which Muslims formed an important part, had emerged. This class was outward-looking, 'modern', and generally reformist in outlook. The questions that were being raised in the social turmoil of the period amongst Hindus were over issues of female education, the age of marriage, widow remarriage, and female seclusion.

    Abstract: In this text, Zein Murib looks at the LGBT community in the US as it formed into an identity-based social and political group. Drawing on an extensive archive of movement documents and publications, Murib argues that the strategic use of 'rightful citizenship claims,' or the assertion that lesbians, gay men, bisexuals, and transgender people are owed rights as citizens, created opportunities for the recognition of white, gender-normative, monogamously partnered gay men and lesbians at the expense of other community members. 'Terms of Exclusion' shows that within-group marginalization is not an accident of political expediency or due to relatively fewer resources, but rather a discursive strategy employed by political actors to make a group palatable to lawmakers and the general public.

    Abstract: Kant scholars have paid relatively little attention to his raciology. They assume that his racism, as personal prejudice, can be disentangled from his core philosophy. They also assume that racism contradicts his moral theory. Philosopher Huaping Lu-Adler challenges both assumptions. She shows how Kant's raciology - divided into racialism and racism - is integral to his philosophical system. She also rejects the individualistic approach to Kant and racism. Instead, she uses the notion of racism as ideological formation to demonstrate how Kant, from his social location both as a prominent scholar and as a lifelong educator, participated in the formation of modern racist ideology.

Lamming's London was marked by the violent currents of racism - some seen, many disavowed. 'Colonized by Humanity' is a study of racial liberalism at the end of empire. It uncovers the projects to cultivate racial integration developed in the two decades between the arrival of the Empire Windrush and the passage of the first Race Relations Act.

    Abstract: In order to understand geek identity's exclusionary tendencies, we need to know the history of the overwhelmingly white communities of tabletop gaming hobbyists that preceded it. It begins by looking at how the privileged networks of model railroad hobbyists in the early twentieth century laid a cultural foundation for the scenes that would grow up around war games, role-playing games, and board games in the decades ahead. These early networks of hobbyists were able to thrive because of how their leisure interests and professional ambitions overlapped. Yet despite the personal and professional strides made by individuals in these networks, the networks themselves remained cloistered and homogeneous-the secret playgrounds of white men.

    Abstract: Suzy Kim excavates the transnational linkages between women of North Korea and a worldwide women's movement. Women of Asia, especially those espousing communism, are often portrayed as victims or pawns of a patriarchal Confucian state. Kim undercuts this standard analysis through detailed archival work in the international women's press, and finds that North Korean women asserted themselves in unexpected places from the late 1940s - just before the official beginning of the Korean War - to 1975, the year designated by the UN as International Women's Year. By centering North Korea and the 'East,' she defies convention to offer a new genealogy of the global women's movement.

    Abstract: How does governing work today? How does society (mis)handle pressing challenges such as armed violence, cultural difference, ecological degradation, economic restructuring, geopolitical shifts, global pandemics, migration flows, and technological change in ways that are (not) democratic, effective, fair, peaceful, and sustainable? This volume addresses these key questions with reference to the theme of 'polycentrism', i.e. the idea that contemporary governing is dispersed, fluctuating, messy, elusive, and headless. Chapters develop this notion of polycentrism from the perspectives of a broad spectrum of academic disciplines and theoretical approaches, offering comprehensive coverage of exciting new thinking about how today's world is (mis)ruled. The book identifies four paradigms of knowledge about polycentric governing - organizational, legal, relational, and structural - and pursues conversations across the divides that normally keep these approaches within separate research communities. These exceptional inter-paradigm exchanges focus particularly on issues of techniques (how governing is done), power (what forces drive governing), and legitimacy (whether governing is rightful). Comparisons between the multiple perspectives on polycentric governing highlight, and help to clarify, the distinctive emphases, potentials, and limitations of each approach. In addition, various combinations of the different theories generate promising novel avenues of thought about polycentrism. The book will allow readers to develop and refine their own understandings of governing today and hence to become more empowered political subjects.
