    Abstract: This is an open access book. Europe faces significant challenges in the coming decades: geopolitical, demographic, technological, increased competition, climate-related, and health issues due to an aging population, to mention a few. Given these challenges, technological progress and new ways of handling complex issues will be key to continued prosperity and growth. To accomplish a growth process driven by innovation and entrepreneurship, the institutional environment must take into account a multitude of different policy areas that interact to either strengthen or weaken an economy's innovative potential. Innovation is not only about R&D and higher education but is also intimately related to entrepreneurship. Similarly, entrepreneurship is not only about low start-up costs and favorable tax rates. Hence, a consistent and coordinated policy environment conducive to innovation and entrepreneurship is required to translate innovation into high-growth firms and macro-level growth. This book presents the basic cornerstones required to provide a policy regime that can nurture such dynamics. The authors draw extensively on empirical analysis of the development of the Swedish economy, which has been transformed from a so-called "sclerosis" state in the 1980s until the early 1990s to an economy characterized by successful entrepreneurship and innovation. This transformation resulted from a reform agenda that has been gradually rolled out, beginning in the mid-1980s. The authors argue that the Swedish experience provides useful lessons for other nations as well.

    Abstract: This volume explores Hans-Georg Gadamer's philosophical hermeneutics within a musical context. It features contributions from philosophers, musicians, educators, and musicologists from a variety of backgrounds, and sheds light on both the hermeneutic nature of music and the musicality of hermeneutics. Contributors to this volume hermeneutically think with music to uncover its fundamentally hermeneutic character, and by thinking with Gadamer in a musical context, explore ways in which hermeneutics may be understood to possess an inherent musicality. Gadamer's thought is taken up in a variety of musical contexts including improvisation, musical performance, classical music, jazz, and music criticism.     Abstract: Can we regulate something that doesn’t exist yet? Can Europe create its own Silicon Valley? Who gets to create technological value in today’s world? Whatever happened to the once-flourishing idea of rags to riches? Will new and exciting innovations only ever come from big tech companies? Can the EU establish its own flexible framework for boosting innovation, e.g. by facilitating the transformative use of technologies and data? This book seeks to answer these questions by exploring the differences in copyright culture in Europe and the United States, with its flexible fair use framework. The findings are anything but obvious, and decades of case law on both sides of the Atlantic tell a story of judges going to great lengths to deal with new challenges while navigating the imperfections of statutory law – both where it is too broadly formulated and where it is too prescriptive. Pursuing a multidisciplinary approach, the book thoroughly explores the issue of media intrusions into people’s privacy through thematic media content analysis and highlights the significant impacts of these intrusions on victims’ lives.     Abstract: Based on a deliberative democracy, this book uses a hermeneutic-critical methodology to study bibliographical sources and practical issues in order to analyse the possibilities, limits and consequences of the digital transformation of democracy.     Abstract: In this book Diogo, a renowned biologist and anthropologist, addresses a question that is critical for the understanding of science, beliefs, idolization, systemic racism and sexism, and our societies in general: why has Darwin been idolized in such a unique way, particularly by Western scholars? Diogo shows that many evolutionary 'facts' stated in Darwin's works, particularly about human evolution, are inaccurate constructions based on Victorian biases and stereotypes: non-Europeans are inferior, women have a lower intelligence than men, Victorian society was the pinnacle of evolution, and so on. Importantly, such inaccurate biased statements about our evolution are markedly in contrast with the mostly accurate, and often brilliant, ideas put forward by Darwin concerning non-human organisms. Importantly, it was precisely the combination of such brilliant ideas, the use of simplistic and sometimes exaggerated metaphors that were catchy and easily absorbed by the general public, and Darwin's intellectual conservatism and biased ideas about women and non-European peoples that led to Darwin's idolization, particularly by Western scientists, as well as to the darkest societal repercussions of his works. By portraying such biased ideas as “evolutionary facts”, Darwin provided easy ammunition for populist political leaders, authoritarians, colonialists, and white supremacists to 'scientifically' defend social hierarchies, sexism, racism, discrimination, oppression, and segregation. A typical argument used to defend Darwin from portraying such erroneous sexist and racist ideas as “facts” is that ‘back then’ everybody was racist and sexist. Diogo deconstructs this argument by providing enthralling case studies and travel descriptions by authors such as Wallace and Humboldt, who often praised the indigenous peoples that repulsed - and criticized the social hierarchies and Western imperialism that marveled - Darwin. The aim of this book is therefore not to 'cancel' Darwin or argue that he was always wrong: not at all, in general he was an extraordinary biologist, but was a much less successful anthropologist due in great part to his Victorian biases. Instead, the book discusses Darwin's writings, ideas, and their repercussions in a broader way, without taboos, omissions, idolization or demonization in order to show Darwin, and science in general, in all their complexity. This is because, if we fail to acknowledge and emphasize the biases, prejudices, inaccuracies, and abuses of our past, and merely continue to blindly idealize it, our kids will be condemned to undertake or suffer similar societal abuses in the future.

    Abstract: Contemporary policymakers, as their predecessors, continue to view nomadic people as a weak minority, and their way of life and raising livestock as a backward and inefficient paradigm. Wherever nomads are not the dominant group, the trend to settle them continues even today as in the past. This book describes the changes forced upon formerly nomadic groups and how they still attempt to maintain their traditional, social, and cultural practices in their new settings. The book deals with the several modes of livelihood of these communities, including entrepreneurship, and demonstrates the impact of investment-oriented urbanization policies leading to eviction from ancestral lands, and hurdles for nomadic mobility, ultimately threatening their survival. The book illustrates how some groups like the Borana and the Maasai practice livelihood diversity and raise productive livestock, and how other groups migrate to urban centers in search of employment and remit money to family members left in the rural areas. The book aims to raise awareness among the research community, especially those who work on regional and demographic labor policies.     Abstract: It is wrong when someone cannot exercise their rights in a court of law because they have no money to pay for a good lawyer, because they are too scared of the possible consequences, or because they simply don’t know that the law protects them. But does that mean governments have an obligation to intervene? And if so, how? This book provides the first systematic philosophical theory of equal access to justice. It begins by identifying the content of claims to equal access to justice. Then, it reviews traditional political and legal arguments on the right of access to justice, which it argues are both illuminating and insufficient. The best comparative way to approach equal access to justice, the book argues, is to think through the requirements of a moral, pre-political, duty to – at times and provisionally – pause, cool down and listen: in other words, we ought to demand that governments step in and protect access rights, because we have a moral and pre-political interest in cultivating our ability to comply with this duty. It is the recognition of this duty which best explains both law’s potential for promoting, as well as its potential for endangering, equal justice. In closing, the book tests this novel theory of equal access to justice against contemporary trends and reforms in procedural law. .

    Abstract: Dispositionalism, perhaps the most popular variant of non-Humean metaphysics, submits that dispositions, powers, or capacities, are part of the furniture of the world. In this book I advance an original approach to dispositionalism revolving around the notion of Dispositional Reality; the novelty lies in the fact that the account, unlike most alternatives on the market, does not require the reification of objects, facts, properties, nor their dispositional essences – and is in fact compatible with a far more deflationary approach to dispositions, while still being true to the non-Humean spirit of the proposal. This power metaphysics without powers allows one to dispel several puzzles in recent literature, or recast them under a new light. Albeit with its own peculiarities, this proposal constitutes a variant of explanatory dispositionalism, according to which realism about dispositions ought not to be understood as an ontological inflation, but as an explanatory inversion within the nomic and modal family. Some of these explanations are hereby attempted, and a study of various types of non-causal explanation will be provided.

    Abstract: This book critically analyzes both the negative and positive impacts of the Coronavirus pandemic, focusing on changes in families, gender developments, and the evolution of social inequality structures. The Corona pandemic, with its unprecedented restrictions on contact, has meant that families have been challenged in their functioning in a very special way. International studies show that socioeconomic factors such as education, income, but also the geographic center of life of families and women in particular, had an important influence on the management of the pandemic. Despite all negative side effects of the Corona pandemic, there were nevertheless also innovative impulses, especially in the field of social work, particularly work with families. The book's 18 chapters, organized in six sections, highlight not only short-term changes but also longer-term developments that either require a corresponding concept of measures or action or can be evaluated as drivers of innovation in the pandemic.     Abstract: This book discusses the role played by powerful global institutions such as the IMF, the World Bank, the World Trade Organisation, multinational corporations, and the international credit rating agencies in keeping Africa marginalised in the world economy. The book focuses on the intrusive roles of these institutions as enablers and beneficiaries of capital outflows and financial subordination in Africa. Diverging from the official narrative that touts China and the other emerging economies as global reformers that are poised to partner Africa in its fight against financial subjugation, the book instead argues that, like the Western powers, the emerging economies are benefiting prodigiously from a rigged global financial system that keeps Africa as a net creditor to the rest of the world. The book draws its theoretical framework from the repressed heterodox theories including dependency, core-periphery, world systems and Marxist theories as well as the decolonial approach. It concludes with a call for a decolonial African agency that should champion an epistemic rebellion against the neo-liberal and neo-classic economic traditions that have been historically deployed to justify Africa’s subordinated position in the global economic governance. This book comes at moment in time when Africa is ready to become a Rule Maker not a Rule Taker.     Abstract: This book addresses central issues in the philosophy and metaphysics of science, namely the nature of scientific theories, their partial truth, and the necessity of scientific laws within a moderate realist and empiricist perspective. Accordingly, good arguments in favour of the existence of unobservable entities postulated by our best theories, such as electrons, must be inductively grounded on perceptual experience and not their explanatory power as most defenders of scientific realism claim. Similarly, belief in the reality of dispositions such as causal powers which ground the natural necessity of scientific laws must be based on experience.     Abstract: This is the second volume of a two-part series on Concordian economics, an innovative paradigm that builds upon the Aristotelian-Aquinian tradition of economic justice. Having introduced Concordian economics in the first volume as a compelling research paradigm that addresses the limitations of mainstream economics, this second installment takes the exploration further by examining its real-world applications in four policy areas.     Abstract: The book provides a discursive reflection on the current challenges facing administrative law, based on a key idea: the defence of the liberal model of society. The author describes the content of her book as a turning point on the traditional standards of the rule of law and the way it impacts on the administrative state and administrative law. Considering the current use (and abuse) of emergency law by governments – based on economic crisis, environmental crisis, pandemic, and the economic situation caused by the Ukraine war – she devises a different balance or equilibrium on the usual separation of powers. Many reasons contribute to this turning point: i) the weaknesses of an open society easily swayed by social networks; ii) social “tribalism” replaces common good and general interest; iii) social tribalism leads to illiberal society, which causes illiberal democracies; iv) illiberal democracies lead to ungovernability which reinforces the role of the government, the emergency law, and some de facto measures. The author looks at many recent decisions from the ECJ and the ECHR and some constitutional and administrative courts, which extends the interest of this work to a wide range of professionals, from scholars to students, from judges to lawyers, filling the gap from an administrative law perspective of the current issues.

    Abstract: The sometimes complex and controversial relation between the fundamental rights of the European Union, as enshrined in the EU Charter of Fundamental Rights (CFR), and national fundamental rights in the context of constitutional review is reflected in a series of landmark decisions in the multilateral cooperation of European courts, which have reshaped the fundamental rights architecture in the multilevel system in recent decades. This book aims to contribute to a systematic and comprehensive analysis of the EU and constitutional law issues involved, thus serving as a reference point for scholars and practitioners dealing with this emerging topic in depth. Following this approach, it sheds light on the broader Union legal context of these developments, examines the role of the CFR for Constitutional Courts, the relationship between constitutional and ordinary courts, and assesses the key decisions concerning the application of the CFR as a standard of constitutional review. It also draws some initial conclusions on the development of the European fundamental rights architecture, its prospects and possible implications for the Union’s legal order. The book contains several contributions by European legal experts from academia and the judiciary, who examine the different methods of constitutional application of the CFR from a comparative law perspective. These contributions deal with the following aspects: first, the role of the CFR for the respective Constitutional Court with regard to the application of EU law as well as national law falling within the scope of the CFR; second, the relationship between the respective Constitutional Court and the ordinary courts with regard to the application of the CFR; third, the relevant facts and legal reasoning of the most important Constitutional Court decisions on the application of the CFR as a relevant standard of constitutional review; fourth, the relevant case law of the CJEU on the relationship between Union and national fundamental rights, as well as its broader implications for the multilateral cooperation of European courts.     Abstract: In the automotive sector, digitalisation, connectivity and automation are rapidly expanding. In tomorrow’s vehicles, human beings will merely be passengers – which raises a host of complex legal issues regarding accidents involving self-driving vehicles. This book is the first to offer a comprehensive, global overview of civil liability regimes for all levels of vehicle automation in jurisdictions that represent some of the most important markets for the automotive industry. After a technical introduction to how self-driving cars work, the individual chapters analyse the liability for driving automation at SAE J3016 levels 0 through 5 from a country-specific perspective.     Abstract: This collection responds to widespread, complex, and current environmental challenges by presenting eleven original essays on a new elemental-embodied approach in environmental humanities. It critically examines the consequences of the non-recognition of Muslim marriages within the civil legal framework and underscores the ambiguous intersections of MPL with broader legal systems, which leaves women in a precarious legal state overshadowed by religious doctrines.
