    Kurzfassung: This brief maps the available data augmented by expert interviews on the impact of the Covid-19 measures on DV in eight European Member States during the first lock-down. The volume addresses an on-going situation, additionally complicated by renewed lockdown restrictions during autumn and early winter 2020. It assesses the assumptions of an imminent wave of domestic violence against reliable data from crime statistics, surveys, and various institutions responding to domestic violence. Collecting partner country reports from Austria, Finland, France, Germany, Hungary, Portugal, Scotland and Slovenia, it demonstrates the effects that lockdown measures starting March 2020 had on reported DV incidents. It considers the differences between each country with respect to policing, legal systems, social and cultural factors and highlights best practices to prevent conditions resulting from Covid-19 lockdown undermining victims’ security and frontline responders’ capacities to provide services and prevent domestic violence.

    Kurzfassung: This edited book takes an interdisciplinary approach to shed light on the complex dynamics involved in the incidence of online hate speech against migrants in user-generated contexts. The authors draw on case studies from Finland, France, Germany, Italy, Poland and the UK, bringing together qualitative and quantitative analyses on user-generated online comments. The authors argue that online hate speech against migrants must be understood as a symptom of a representation crisis on migration, which can only be fully perceived through the study of the complex linguistic, interactional and connective processes within which it emerges. They focus on representations and shared meanings, community building and otherness, and delve into the role of network ecosystems in the process of the construction of public problems. This book will be of interest to undergraduate and post-graduate students as well as academics working on hate speech and migration studies in a variety of fields, and can also contribute to improving research protocols for automated analyses and detections of online hate speech. Angeliki Monnier is Professor in Information and Communication Sciences at Université de Lorraine, Metz, France, and director of the Centre for Research on Mediations (CREM). Axel Boursier is Associate Professor in Information and Communication Sciences at CY Cergy Paris Université, France, and a member of the “Lexicons, Texts, Discourses and Dictionaries” (LT2D) laboratory. Annabelle Seoane is Associate Professor in Linguistics and Language Teaching at Université de Lorraine, Metz, France, and a member of the Centre for Research on Mediations (CREM).

    Kurzfassung: In dieser rechtsvergleichenden Studie entwickelt Antje G. I. Tölle einen Vorschlag de lege ferenda für den Vertragsschluss im elektronischen Geschäftsverkehr, der auf einer Abwägung zwischen den widerstreitenden Interessen nach Sicherheit und Flexibilität beruht. Dabei ordnet er etwa das Downloadshopping als verbindliches Angebot ein und ermöglicht seine Rücknahme. Weitere Themenkomplexe sind der Zugang und Widerruf eines Angebots, sein Erlöschen durch Zeitablauf, Ablehnung oder Verlust der Geschäftsfähigkeit oder den Tod. Für die Analyse werden insgesamt sechs europäische Rechtsordnungen, namentlich Deutschland, England, Frankreich, die Schweiz, die Niederlande und Ungarn herangezogen. Darüber hinaus berücksichtigt die Studie die europäischen Modellgesetze der PECL, des DCFR und des GEK zusammen mit dem UN-Kaufrecht neben diversen historischen Regelwerken wie etwa dem Allgemeinen Preußischen Landrecht oder dem Bürgerlichen Gesetzbuch Sachsens.     Kurzfassung: Verfassungsgeschichte und Privatrechtsgeschichte gehen gewöhnlich getrennte Wege. Doch werden sie damit ihren Gegenständen nicht gerecht, denn Verfassung und Privatrecht stehen in enger Beziehung zueinander, und das nicht erst, seit im 20. Jahrhundert die Drittwirkung der Grundrechte entdeckt wurde. Die Beziehungen wechseln freilich mit den Begleitumständen. Sie stellten sich in Frankreich, wo der Übergang von monarchischem Absolutismus und ständisch-feudaler Gesellschaftsordnung zur bürgerlichen Staats- und Sozialordnung in einem revolutionären Akt des bereits emanzipierten Bürgertums herbeigeführt wurde, anders dar als in Deutschland, wo die Umstellung von der Obrigkeit ausging und sich in einem langen, rechtsförmigen Prozess evolutiv vollzog. Die Formationsphase der bürgerlichen Gesellschaft zwischen Revolutionen und Restauration enthält dafür vielfältiges Anschauungsmaterial, das auch die Grundlage für Analysen der weiteren Entwicklung des Verhältnisses der beiden

Marie Mercat-Bruns, a Franco-American scholar, examines the differences in how the two countries approach discrimination. Bringing together prominent legal scholars--including Robert Post, Linda Krieger, Martha Minow, Reva Siegel, Susan Sturm, Richard Ford, and others--Mercat-Bruns demonstrates how the two nations have adopted divergent strategies. The United States continues, with mixed success at "colorblind" policies, to deal with issues of diversity in university enrollment, class action sex-discrimination lawsuits, and rampant police violence against African American men and women. In France, the country has banned the full-face veil while making efforts to present itself as a secular republic. Young men and women whose parents and grandparents came from sub-Sahara and North Africa are stuck coping with a society that fails to take into account the barriers to employment and education they face. Discrimination at Work provides an incisive comparative analysis of how the nature of discrimination in both countries has changed, now often hidden, or steeped in deep unconscious bias. While it is rare for employers in both countries to openly discriminate, deep systemic discrimination exists, rooted in structural and environmental causes and the ways each state has dealt with difference in general.     Kurzfassung: This research examines the role of prosecutors within the United States and in Switzerland and is completed by an overview of the prosecution institutions in France and Germany. The research recognizes that despite seemingly very different legal traditions and structures, prosecutors in these systems are similar enough that each system might learn from the others. Drawing upon the experiences of other nations, this research proposes solutions to the problems identified in connection with the position and powers of public prosecutors in the United States. Furthermore, it outlines the problems related to the increase of prosecutorial power and the lessons the European criminal justice systems surveyed can draw from the experience in the US. In terms of methodology, this research not only considers formal legal provisions but also systematic structural factors, academic literature and statistics revealing how the law and governing principles actually work in practice.

    Kurzfassung: "Most incidents of urban unrest in recent decades - including the riots in France, Britain and other Western countries - have followed lethal interactions between the youth and the police. Usually these take place in disadvantaged neighborhoods composed of working-class families of immigrant origin or belonging to ethnic minorities. These tragic events have received a great deal of media coverage, but we know very little about the everyday activities of urban policing that lie behind them. Over the course of 15 months, at the time of the 2005 riots, Didier Fassin carried out an ethnographic study in one of the largest precincts in the Paris region, sharing the life of a police station and cruising with the patrols, in particular the dreaded anti-crime squads. Far from the imaginary worlds created by television series and action movies, he uncovers the ordinary aspects of law enforcement, characterized by inactivity and boredom, by eventless days and nights where minor infractions give rise to spectacular displays of force and where officers express doubts about the significance and value of their own jobs. Describing the invisible manifestations of violence and unrecognized forms of discrimination against minority youngsters, undocumented immigrants and Roma people, he analyses the conditions that make them possible and tolerable, including entrenched policies of segregation and stigmatization, economic marginalization and racial discrimination. Richly documented and compellingly told, this unique account of contemporary urban policing shows that, instead of enforcing the law, the police are engaged in the task of enforcing an unequal social order in the name of public security."--Publisher's description

    Kurzfassung: The more international law, taken as a global answer to global problems, intrudes into domestic legal systems, the more it takes on the role and function of domestic law. This raises a separation of powers question regarding law-making powers. In this book the author considers that specific issue.In contrast to other studies on domestic courts applying international law, the author’s constitutional orientation focusses on the presumptions concerning the distribution of state power. He collects and examines relevant decisions regarding treaties and customary international law from four leading legal systems, the US, the UK, France, and the Netherlands. Those decisions reveal that institutional and conceptual allegiances to constitutional structures render it difficult for courts to see their mandates and powers in terms other than exclusively national. What follows is a constitutional asymmetry between international law and national law generating an inevitable dualism which cannot necessarily be overcome by express constitutional provisions accommodating international law. The separation of powers thus frames the two principal horizons for any future, practicable attempts at integrating of the two legal orders. Either established concepts of constitutional law and constitutionalism will have to be revised, or what international law may do within a municipal legal system will have to be recalculated. This book offers new insight and new approaches in dealing with international law questions before domestic courts. It is an interesting work of reference and a basis for further debate on this topic among academics and practitioners in the fields of international and constitutional law.     Kurzfassung: How does copyright law take into account the interests of third parties, especially the general publics interest in the greatest possible dissemination of knowledge and culture? Twelve basic questions give copyright law experts from more than forty countries the opportunity to provide answers related to their national law on the following matters: categories of works and subject matter, eligibility conditions, duration, "users rights, the three-step test, misuse, differentiations between categories of right holders, TPM, and relations of copyright law to other legal areas such as fundamental rights, competition law, consumer protection law, media law etc. The standardized form of the reports makes it easy to see the impacts of copyright law in the industrialized countries as well as in emerging economies; in common-law and civil-law approaches; in countries of the Andean Community and of the European Union, as well as in countries that are not party to the WIPO Treaties. A detailed preliminary chapter provides an approachable overview of issues and results. This chapter also discusses the voice of academia, represented by the European Copyright Code of the "Wittem Group.

    Kurzfassung: The Global Forum on Transparency and Exchange of Information for Tax Purposes is the multilateral framework within which work in the area of tax transparency and exchange of information is carried out by over 90 jurisdictions which participate in the work of the Global Forum on an equal footing. The Global Forum is charged with in-depth monitoring and peer review of the implementation of the standards of transparency and exchange of information for tax purposes. These standards are primarily reflected in the 2002 OECD Model Agreement on Exchange of Information on Tax Matters and its commentary, and in Article 26 of the OECD Model Tax Convention on Income and on Capital and its commentary as updated in 2004, which has been incorporated in the UN Model Tax Convention. The standards provide for international exchange on request of foreseeably relevant information for the administration or enforcement of the domestic tax laws of a requesting party. “Fishing expeditions” are not authorised, but all foreseeably relevant information must be provided, including bank information and information held by fiduciaries, regardless of the existence of a domestic tax interest or the application of a dual criminality standard. All members of the Global Forum, as well as jurisdictions identified by the Global Forum as relevant to its work, are being reviewed. This process is undertaken in two phases. Phase 1 reviews assess the quality of a jurisdiction’s legal and regulatory framework for the exchange of information, while Phase 2 reviews look at the practical implementation of that framework. Some Global Forum members are undergoing combined – Phase 1 plus Phase 2 – reviews. The ultimate goal is to help jurisdictions to effectively implement the international standards of transparency and exchange of information for tax purposes. All review reports are published once approved by the Global Forum and they thus represent agreed Global Forum reports.

    Kurzfassung: The analysis of the inner workings of the firm has been largely absent from economic assessments of environmental policy. In an effort to partly fill this vacuum, this book summarises the results of an OECD project which collected and analysed data from over 4,000 facilities in seven OECD countries.
