    Abstract: Terrorismus ist noch immer eines der bedrohlichsten Phänomene der heutigen Zeit. In diesem Buch werden mithilfe von Gerichtsakten vom Generalbundesanwalt beim Bundesgerichtshof in Karlsruhe die Radikalisierungsprozesse von 58 deutschen Jihadisten analysiert. Durch das umfassende Datenmaterial ist es möglich, die Wege dieser Personen von der Radikalisierung bis zum Anschluss an eine terroristische Organisation im Ausland (u.a. Islamischer Staat) sowie ausgeübte strafrechtlich relevante Handlungen zu rekonstruieren. Mithilfe einer Netzwerkanalyse wird das radikale Netzwerk untersucht, das aus Deutschland mit Jihadkämpfern im In- und Ausland verbunden gewesen ist. Dabei wird ein Augenmerk auf den Aufbau, die Funktionsweise und die Schlüsselpersonen des Netzwerks gelegt. Auch werden die unterschiedlichen Rollen und Unterstützungshandlungen der Netzwerkmitglieder in den Fokus genommen. Zusätzlich werden strafrechtlich relevante Radikalisierungs- und Mobilisierungsstrategien salafistisch-jihadistischer Prediger entschlüsselt, die weitaus tiefere Verbindungen zu terroristischen Organisationen im Ausland haben als bisher angenommen. Die Autorin Kristin Weber ist Kriminologin, Soziologin und wissenschaftliche Mitarbeiterin im Bereich der Radikalisierungs-, Terrorismus- und Extremismusforschung. An der Deutschen Hochschule der Polizei in Münster-Hiltrup hat sie ihre Dissertation im Rahmen des Projektes X-Sonar "Analyse extremistischer Bestrebungen in sozialen Netzwerken", welches vom Bundesministerium für Bildung und Forschung gefördert wurde, geschrieben.

Im Mittelpunkt steht eine ausführliche praxisbezogene Analyse der möglichen Interessenkonflikte der Datenschutzbeauftragten. Es wird herausgearbeitet, wie sich diese Interessenkonflikte auf die Praxis der betrieblichen und behördlichen Datenschutzbeauftragten auswirken und welche Unterschiede sich bei einer internen oder externen Benennung des Datenschutzbeauftragten ergeben. Art. 38 Abs. 6 S. 1 DSGVO sieht ein Verbot der Zuweisung konfligierender Aufgaben vor – die Möglichkeiten eines Interessenkonflikts des Datenschutzbeauftragten gehen jedoch weit über diese normierte Konfliktmöglichkeit hinaus. Konkret werden in der Arbeit Interessenkonflikte in Bezug auf die unabhängige Stellung, die Aufgaben, die Pflichten und die Rechtsbeziehungen des Datenschutzbeauftragten betrachtet. Bei der Analyse der Interessenkonflikte wird berücksichtigt, dass der Datenschutzbeauftragte zugleich dem Verantwortlichen, den Betroffenen, den Aufsichtsbehörden und dem Datenschutz als abstraktes Schutzgut verpflichtet ist. Schließlich wird in der Arbeit aufgezeigt, welchen Verbundenheiten sich der Datenschutzbeauftragte ausgesetzt sieht und welche Antworten des Rechts den Interessenkonflikten gegenüberstehen.

Um diese Hintergrundermittlungen nicht vorzeitig aufzudecken, wird die sog. ›Legendierte Kontrolle‹ eingesetzt, bei der die Ermittlungsbehörden eine Durchsuchung als allgemeine Verkehrskontrolle tarnen. Die Arbeit ordnet das Instrument in das bestehende System verdeckter und täuschender Ermittlungsmaßnahmen ein. Sie analysiert die verfassungs- und strafverfahrensrechtliche Zulässigkeit des staatlichen Vorgehens, das sich im Grenzbereich zwischen Gefahrenabwehr und Strafverfolgung bewegt. Ein besonderer Schwerpunkt liegt auf der Frage, ob entgegen dem Grundsatz der Aktenwahrheit eine legendierte, also unzutreffende oder unvollständige Aktenführung erlaubt sein kann.     Abstract: Die Zuordnung zu einem Geschlecht hat für die individuelle Identität eines Menschen herausragende Bedeutung. Gleichzeitig wird diese Frage von den Rechtsordnungen der Europäischen Union nach wie vor sehr unterschiedlich beantwortet. Während immer mehr Staaten dazu übergehen, einer Person eine selbstbestimmte Entscheidung über ihr rechtliches Geschlecht zu ermöglichen, stellen zahlreiche Staaten weiterhin hohe Anforderungen an dessen Änderung. Angesichts der Diversität nationaler Regelungen untersucht Alix Schulz, wie das rechtliche Geschlecht eines Menschen in grenzüberschreitenden Sachverhalten bestimmt wird und welche grund- und menschenrechtlichen Vorgaben hierbei zu beachten sind

    Abstract: In der juristischen Literatur wird der Begriff der "Pfadabhängigkeit" zumeist metaphorisch verwendet. Anders ist dies in den benachbarten Gesellschaftswissenschaften, wo das gleichnamige Konzept der Erklärung insbesondere institutioneller Entwicklungsprozesse dient. Nico Schröter geht der Frage nach, ob und wie eine Rezeption dieses Konzepts auch für die Rechtswissenschaft erkenntnisversprechend ist. Dabei kann eine (informierte) Rezeption insbesondere dazu dienen, informelle Strukturbildungsprozesse im Recht besser zu verstehen. So bietet Pfadabhängigkeit eine plausible Erklärung für die relative Stabilität judikativer Entscheidungsstandards und rechtsdogmatischer Sätze sowie - in Ansätzen - auch dafür, inwieweit diese einem Wandel unterliegen. Die Rezeption des Pfadabhängigkeitskonzepts liefert daher eine Antwort auf bestehende Theoriedefizite bei der Erklärung rechtlicher Phänomene

Ihr Gegenstand ist darüber hinaus die Rechtstheorie in einem umfassenden Sinne, etwa die Vorgeschichte der Volksgeistlehre und die Unterscheidung von Privatrecht und öffentlichem Recht. Thematisiert wird auch die äußere Geschichte der Rechtswissenschaft und ihrer Institutionen, wie die Juristenfakultäten im nachfriderizianischen Preußen und die Naturrechtsvorlesungen im 18. und 19.     Abstract: This book considers the intellectual property protection of clinical test data that has been submitted to governments, in particular through test data exclusivity rights. It focuses on how these intellectual property rights first emerged in the early 1980s, how they have globalised over the past four decades, and what impact they have had upon access to medicine. This book makes a number of significant and original contributions to the literature around the protection of submitted test data. First, the book draws upon the theory of regulatory globalisation to provide an explanation of how intellectual property rights in submitted pharmaceutical test data have become nearly ubiquitous in the legal systems of most major economies. Second, through a comprehensive analysis and synthesis of provisions on the protection of submitted test data in free trade agreements, as well as a comparison of a range of national approaches to the protection of submitted test data, it reveals the broader global regulatory pattern that has given rise to these intellectual property rights. Third, by analysing data on drug approvals in the US, it provides an empirical insight into the impact of test data exclusivity in national pharmaceutical markets. Fourth, the book covers a number of developments regarding test data exclusivity that have occurred as a result of responses to the COVID-19 pandemic, both at the national level as well as at the World Trade Organisation (WTO). This book will appeal to academics researching the intersection of intellectual property and the life sciences, civil society activists working to promote access to medicines, and students (particularly those at the post-graduate level) studying the relationship between intellectual property and medicine.

    Abstract: This brief maps the available data augmented by expert interviews on the impact of the Covid-19 measures on DV in eight European Member States during the first lock-down. The volume addresses an on-going situation, additionally complicated by renewed lockdown restrictions during autumn and early winter 2020. It assesses the assumptions of an imminent wave of domestic violence against reliable data from crime statistics, surveys, and various institutions responding to domestic violence. Collecting partner country reports from Austria, Finland, France, Germany, Hungary, Portugal, Scotland and Slovenia, it demonstrates the effects that lockdown measures starting March 2020 had on reported DV incidents. It considers the differences between each country with respect to policing, legal systems, social and cultural factors and highlights best practices to prevent conditions resulting from Covid-19 lockdown undermining victims’ security and frontline responders’ capacities to provide services and prevent domestic violence.

    Abstract: This proceedings volume combines chapters derived from papers presented at the 4th and 5th Annual Conferences on the Future of the Commercial Contract in Scholarship and Law Reform.     Abstract: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’.     Abstract: Klauseln in Allgemeinen Haftpflichtversicherungsbedingungen („AHB“), die den Versicherungsfall definieren, stehen regelmäßig im Mittelpunkt deckungsrechtlicher Auseinandersetzungen. Nicht nur ist der Eintritt des Versicherungsfalls innerhalb der Versicherungszeit zentrale Deckungsvoraussetzung. Der Versicherungsfall ist auch Anknüpfungspunkt für diverse nachgelagerte Fragestellungen, die über das Bestehen des Versicherungsschutzes entscheiden, nicht zuletzt bei einer Vielzahl versicherungsvertraglicher Obliegenheiten. Für Versicherungsnehmer ist es somit von besonderer Bedeutung, dass der Versicherungsfall klar, verständlich und interessengerecht definiert ist. Daraus folgt das Bedürfnis, die entsprechenden Klauseln auf ihre inhaltliche Angemessenheit und transparente Ausgestaltung hin kontrollieren zu können. Im Schwerpunkt geht die Arbeit daher der Frage nach, ob eine solche AGB-rechtliche Inhaltskontrolle rechtlich zulässig ist. Hierzu stellt die Autorin zunächst den sachlichen Anwendungsbereich der Inhaltskontrolle und den Bereich kontrollfreier Leistungsbeschreibungen in Allgemeinen Versicherungsbedingungen dar.     Abstract: This book explores the issue of leadership criminality from a new angle by comparing two highly relevant modes of responsibility. By contrasting individual criminal responsibility for ordering international crimes with indirect perpetration through an organisation, it shows the doctrinal weaknesses of the latter and outlines the much-overlooked advantages of the former. The volume analyses the development of both forms of responsibility, looking at their origins, and their reception in academia and practical use in jurisprudence. The history of indirect perpetration through an organisation (Organisationsherrschaft) is portrayed from its German academic origin, through German jurisprudence to the reception of the doctrine at the International Criminal Court. By comparing the doctrine’s stages of evolution, the book sheds light on the different aspects of the various models of indirect perpetration through an organisation and carves out general and fundamental criticism of it. The characteristics of ordering liability are explored in depth through an analysis of jurisprudence of the Nuremberg subsequent trials, the ad hoc tribunals and the International Criminal Court. This historic and doctrinal comparison reveals a well-defined and to-date much neglected mode of responsibility with enormous potential for the adjudication of leadership figures in the ambit of international criminal law and only one conclusion can follow from this analysis: it calls for practitioners and academics to leave the well-trodden paths of national criminal law doctrine and embrace truly international modes of liability such as the ordering of a crime. Dr. Johannes Block is a criminal lawyer specializing in international criminal law, responsibility of leadership figures, questions of perpetration and participation in crime as well as the national-socialists’ crimes.     Abstract: Diese Arbeit widmet sich den Gefahren der Vernetzung durch Vernetzung. Ziel ist eine kritische Auseinandersetzung mit dem Begriffsverständnis Organisierter Kriminalität in der analogen und digitalen Welt, wobei die kriminologische und strafrechtliche Perspektive beleuchtet wird. Um dem Mythos, der um das Phänomen Organisierte Kriminalität herrscht, nachzugehen und ihn zu objektivieren, wird zunächst der Wandel und die Bedeutung der gesellschaftlichen, wirtschaftlichen und kriminellen Vernetzung nachgezeichnet und die daraus resultierenden Gefahren insbesondere durch Cybercrime und die Relevanz für Organisierte Kriminalität aufgezeigt. Im Anschluss wird die Etymologie und das Begriffsverständnis Organisierter Kriminalität in der analogen und digitalen Welt aus einer kriminologischen Perspektive untersucht und erörtert, inwieweit sich das Strafrecht an den Erkenntnissen orientiert, neuere Erscheinungsformen wie Cybercrime umfasst und am Begriff Organisierte Kriminalität schärfen lässt. Abschließend wird die Funktion und der Wert des Labels Organisierte Kriminalität diskutiert. Die Autorin Nicole Selzer ist Forschungsreferentin und identifiziert zukünftige Forschungsthemen im Cybersicherheitsbereich, um entsprechende Forschungsprojekte anzustoßen und Ausschreibungen zu entwerfen.

    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment.
