Abstract: This book proposes a new agenda for research into a Critical Theory of Human Rights. Each chapter pursues three goals: to reconstruct modern philosophical theories that have contributed to our views on human rights; to highlight the importance of humanity and human dignity as a complementary dimension to liberal rights; and, finally, to integrate these issues more directly in contemporary discussions about cosmopolitanism. The authors not only present multicultural perspectives on how to rethink political and international theory in terms of the normativity of human rights, but also promote an

Abstract: The number of international human rights treaties and monitoring mechanisms has grown considerably over the past decades. States are increasingly confronted with criticism as to their domestic human rights record. What is the effect of all these treaties, monitoring and criticism? Do they lead to changes and improvements? This book addresses such questions. More in particular, it investigates the domestic impact and effectiveness of the process of state reporting under the six main UN human rights treaties in the Netherlands, New Zealand and Finland. The focus is on the effectiveness of the recommendations of the treaty bodies and the extent to which policy or legislation is changed as a result of these recommendations. This question has hardly been addressed before.0This book fills this empirical gap and provides insights into the factors at both the national and international level which contribute to the effectiveness of the treaty bodies recommendations. The book is original and thorough in its approach because it is based on an extensive analysis of a wide variety of documents as well as 175 interviews with various domestic human rights stakeholders in the three countries. This includes government officials, NGO representatives, members of parliament, lawyers and judges, representatives from human rights and Ombudsman institutions and academics. The book discusses a large number of concrete examples of effective recommendations of the treaty bodies to illustrate the major conclusions

Abstract: "This volume aims to introduce cultural rights and cultural diversity to a non-legal audience as well as to legal and human rights specialists who may not be very familiar with this area of law - which has been termed the Cinderella of the human rights family. Cultural rights and the associated notion of cultural diversity are under-conceptualized from a theoretical viewpoint and poorly understood by governments and rights-holders and thus not implemented as well as they might be. It is therefore necessary to specify clearly the content, and scope of these rights and their relationship to other human rights as well as the various domains in which they are important. Underlying this work is the belief that cultural rights and cultural diversity are increasingly implicated in important areas of policy and legal development and so need to be better understood by governments, governmental authorities, cultural specialists and the rights-holders themselves. Over recent years, the subject of cultural rights has expanded greatly, from that of a national culture available to all citizens to the non-material elements of heritage which, in turn, involves the idea of active public participation in the decision-making process and of citizens being able to contribute actively to their culture. As a result, there is increasing demand for better promotion and protection of cultural rights as an integral part of human rights. The book is divided into two parts. The first section sets out the broader context in which cultural rights and diversity operate, and examines in detail the concept of cultural diversity and its applications, introducing the potential scope for and content of cultural rights and specific challenges they pose to human rights theory. Abstract: "Although nomadic peoples are scattered worldwide and have highly heterogeneous lifestyles, they face similar threats to their mobile livelihood and survival. Commonly, nomadic peoples are facing pressure from the predominant sedentary world over mobility, land rights, water resources, access to natural resources, and migration routes. Adding to these traditional problems, rapid growth in the extractive industry and the need for the exploitation of the natural resources are putting new strains on nomadic lifestyles. This book provides an innovative rights-based approach to the issue of nomadism looking at issues including discrimination, segregation, freedom of movement, land rights, cultural and political rights, and effective management of natural resources. Jeremie Gilbert analyses the extent to which human rights law is able to provide protection for nomadic peoples to perpetuate their own way of life and culture, and asks why such protection should be granted. The book questions whether the current human rights regime is able to protect nomadic peoples, and highlights the lacuna that currently exists in international human rights law in relation to nomadic peoples. It goes on to propose avenues for the development of specific rights for nomadic peoples, offering a new reading on freedom of movement in the context of nomadic peoples and their rights to land and natural resources"--

Abstract: "Forum shopping, which consists of strategic forum selection, parallel litigation and serial litigation, is a phenomenon of growing importance in international adjudication. Preliminary objections (or a party's placement of conditions on the existence and development of the adjudicatory process) have been traditionally conceived as barriers to adjudication before single forums. This book discusses how adjudicators and parties may refer to questions of jurisdiction and admissibility in order to avoid conflicting decisions on overlapping cases, excessive exercises of jurisdiction and the proliferation of litigation. It highlights an emerging, overlooked function of preliminary objections: transmission belts of procedure-regulating rules across the 'international judiciary'. Activating this often dormant, managerial function of preliminary objections would nurture coordination of otherwise independent and autonomous tribunals"--

Abstract: "This book is the result of a conference held at the Australian National University in Canberra in December 2012. The aim of the conference was to bring together scholars and human rights practitioners from around the world to examine the United Nations Human Rights Council's novel mechanism, the Universal Periodic Review (UPR). The first four year cycle of the UPR concluded in 2012 and the conference was designed to assess the UPR's progress as a technique to protect human rights at the international level"--
Abstract: "The Universal Periodic Review is an intriguing and ambitious development in human rights monitoring which breaks new ground by engaging all 193 members of the United Nations. This book provides the first sustained analysis of the Review and explains how the Review functions within the architecture of the United Nations. It draws on socio-legal scholarship and the insights of human rights practitioners with direct experience of the Review in order to consider its regulatory power and its capacity to influence the behaviour of states. It also highlights the significance of the embodied features of the Review, with its cyclical and intricately managed interactive dialogues. Additionally, it discusses the rituals associated with the Review, examines the tendency of the Review towards hollow ritualism (which undermines its aspiration to address human rights violations comprehensively) and suggests how this ritualism might be overcome"--

Abstract: This text provides a comparative perspective on the criminalisation of forced marriage, focusing on the question of whether, and, if so how, the practice of forced marriage should be criminalised under Dutch and international law. After offering a thorough description of the phenomenon of forced marriage in and outside of conflict situations, a synthesised doctrinal foundation for criminalisation on the national and international level is presented

Abstract: "In Rough Justice, David Bosco tells the story of the movement to establish the International Criminal Court and its tumultuous first decade. He also considers its prospects for the future, especially the very real challenges that it faces. He has access to many of the court's principals, and this will be an authoritative account of an international institution that is prototypical of the post-Cold War era"--
Abstract: "Ten years ago, in the wake of massive crimes in central Africa and the Balkans, the first permanent international criminal court was established in The Hague despite resistance from some of the world's most powerful states. In the past decade, the court has grown from a few staff in an empty building to a bustling institution with more than a thousand lawyers, investigators, and administrators from around the world. Despite its growth and the backing of more than 120 nations, the ICC is still struggling to assert itself in often turbulent political crises. The ICC is generally autonomous in its ability to select cases and investigate crimes, but it is ultimately dependent on sovereign states, and particularly on the world's leading powers. These states can provide the diplomatic, economic, and military clout the court often needs to get cooperation-and to arrest suspects. But states don't expend precious political capital lightly, and the court has often struggled to get the help it needs. When their interests are most affected, moreover, powerful states usually want the court to keep its distance. Directly and indirectly, they make their preferences known in The Hague. Rough Justice grapples with the court's basic dilemma: designed to be apolitical, it requires the support of politicians who pursue national interests and answer to domestic audiences. Through a sharp analysis of the dynamics at work behind the scenes, Bosco assesses the ways in which powerful states have shaped the court's effort to transform the vision of international justice into reality. This will be the definitive account of the Court and its uneven progress toward advancing accountability around the world"--

Abstract: This study deals with a constitutional principle of the EU: the rule of law. The EU Treaties leave no doubt that the rule of law is a universal value on which the Union is founded. This value is not bound to remain internal; EU external relations should also be guided by the principle. However, a lack of conceptual and legal clarity on the principle makes it uncertain how it guides external relations. 0The basic question this study poses is therefore what the role of the rule of law is in EU external relations. 0More specifically, this study analyses this role by focussing on the external dimension of EU migration and asylum policy. Over the years the EU has developed this external dimension of an originally internal policy field. Measures such as externalising border control, readmission of migrants to third states or mobility opportunities for third country nationals have been promoted. This relatively new area of EU external relations is characterised by a high degree of operational and human rights sensitive activities. For example, Frontex, the EU border agency, operates beyond Europe`s borders, sometimes on the basis of undisclosed working arrangements with third States

Abstract: This book explores the importance of autonomy in family law. It argues that traditional understandings of autonomy are inappropriate in the family law context and instead recommends the use of relational autonomy. The book starts by explaining how autonomy has historically been understood, before exploring the problems with its use in family law. It then sets out the model of relational autonomy which, it will be argued, is more appropriate in this context. Finally, some examples of practical application are presented. The issues raised and theoretical discussion is relevant to any jurisdiction

Abstract: The book provides in depth studies of two epistemological aspects of Jewish Law (Halakhah) as the?Word of God?? the question of legal reasoning and the problem of knowing and remembering. - How different are the epistemological concerns of religious-law in comparison to other legal systems? - In what ways are jurisprudential attitudes prescribed and dependent on theological presumptions? - What specifies legal reasoning and legal knowledge in a religious framework? The author outlines the rabbinic jurisprudential thought rooted in Talmudic literature which underwent systemization and enhancement by the Babylonian Geonim and the Andalusian Rabbis up until the twelfth century. The book develops a synoptic view on the growth of rabbinic legal thought against the background of Christian theological motifs on the one hand, and Karaite and Islamic systemized jurisprudence on the other hand. It advances a perspective of legal-theology that combines analysis of jurisprudential reflections and theological views within a broad historical and intellectual framework. The book advocates two approaches to the study of the legal history of the Halakhah: comparative jurisprudence and legal-theology, based on the understanding that jurisprudence and theology are indispensable and inseparable pillars of legal praxis

Abstract: Language and the Right to Fair Hearing in International Criminal Trials explores the influence of the dynamic factor of language on trial fairness in international criminal proceedings. By means of empirical research and jurisprudential analysis, this book explores the implications that conducting a trial in more than one language can have for the right to fair trial. It reveals that the language debate is as old as international criminal justice, but due to misrepresentation of the status of language fair trial rights in international law, the debate has not yielded concrete reforms. Language is the core foundation for justice. It is the means through which the rights of the accused are secured and exercised. Linguistic complexities such as misunderstandings, translation errors and cultural distance among participants in international criminal trials affect courtroom communication, the presentation and the perception of the evidence, hence jeopardizing the foundations of a fair trial. The author concludes that language fair trial rights are priority rights situated in the minimum guarantees of fair criminal trial; the obligation of the court to ensure fair trial or accord the accused person a fair hearing also includes the duty to ensure they can understand and be understood

Abstract: This book examines selected legal complexities of the notion of torture and the issue of the proper foundation for legally characterizing certain acts as torture, especially when children are the targeted victims of torture. ICC case law is used to highlight the International Criminal Court’s reluctance in practice to prosecute as a separable offence the crime of torture as set out in one or more of the relevant provisions of the Rome Statute where children are the particularized targets as part of a common plan during armed conflict. Also addressed is the failure of the ICC to consider that the young age of the victims of torture (i.e. children) should be an aggravating factor taken into account in determining the ICC sentence for those convicted of the torture of civilians, including children, in the context of armed conflict as part of a common plan. The six UN-designated grave crimes against children (including child soldiering for State or non-State forces perpetrating mass atrocities, and sexual violence perpetrated on a systematic and widespread basis against children including child soldiers), it is argued, are also instances of the torture of children as part of a common plan such that separate charges of torture are legally supportable (along with the other charges relating to additional Rome Statute offences involved in such circumstances). Useful legal perspectives on the issue of the torture of children in its various manifestations gleaned from the case law of other international judicial forums such as the Inter-American Court of Human Rights and the ICTY are also examined
Description / Table of Contents: Part I Introduction: Contentious issues regarding what constitutes torturePart II Re-examining ICC cases involving the torture of children where torture was improperly not charged: The UN designated six most grave crimes against children as torture -- Part III A consideration of ICC cases in which torture was charged: Disregarding children as the particularized targets of torture in cases where torture was charged -- Part IV Conclusion: The de-politicization/denigration of children due to the disregard of children as the particularized targets of torture.

Abstract: Politicians and diplomats have for many years proclaimed a human right to water as a solution to the global water crisis, most recently in the 2010 the UN General Assembly Resolution “The human right to water and sanitation”. To what extent, however, can a right to water legally and philosophically exist and what difference to international law and politics can it make? This question lies at the heart of this book. The book’s answer is to argue that a right to water exists under international law but in a more differentiated and multi-level manner than previously recognised. Rather than existing as a singular and comprehensive right, the right to water should be understood as a composite right of different layers, both deriving from separate rights to health, life and an adequate standard of living, and supported by an array of regional and national rights. The author also examines the right at a conceptual level. After disproving some of the theoretical objections to the category of socio-economic rights generally and the concept of a right to water more specifically, the manuscript develops an innovative approach towards the interplay of different rights to water among different legal orders. The book argues for an approach to human rights - including the right to water - as international minimum standards, using the right to water as a model case to demonstrate how multilevel human rights protection can function effectively. The book also addresses a crucial last question: how does one make an international right to water meaningful in practice? The manuscript identifies three crucial criteria in order to strengthen such a composite derived right in practice: independent monitoring; enforcement towards the private sector; and international realization. The author examines to what extent these criteria are currently adhered to, and suggests practical ways of how they could be better met in the future

Abstract: In this, the second decade of the 21st Century, the law relating to conflict is confronted by a number of challenges this book seeks to identify and to discuss. Topics as diverse as the evolving spectrum of conflict, innovations in weaponry, automated and autonomous attack, the depersonalisation of warfare, detention operations, the influence of modern media and the application of human rights law to the conduct of hostilities are examined to see to what extent existing legal norms are under attack. The book takes each topic in turn, explains relevant provisions of contemporary law and analyses exactly where the legal problem lies. The analysis then develops the theme, examining for example the implications of current rules as to deception operations for certain applications of cyber warfare. The book, written in an accessible style, demonstrates the continuing relevance of established rules and the importance of compliance with them. It is a valuable tool for further discussion and research involving academics, military lawyers and commanders, governments, ministries of defence and foreign affairs, libraries, diplomats, think tanks, policy units, NGOs, journalists, students and all others with an interest in law of armed conflict issues. Dr William H. Boothby is the Former Deputy Director of Legal Services, Royal Air Force, United Kingdom

Abstract: Human rights are much talked about and much written about, in academic legal literature as well as in political and other social sciences and the general political debate. This book argues that the universality of basic human rights is one of the values of the concept of rights. It points out the risk of a certain “inflation” caused by the current habit of talking so much and so often about human rights and of using them as a basis for claims of various kinds. These rights, their understanding and interpretation may need to become more “purist” to ensure that universal human rights as a concept survive. Another chapter concentrates on the analysis of the frames of “EU protected human rights” from the perspective of effective implementation. Further, the book not only deals with the complicated relations between the EU and international law, but also seeks to show the horizontal effect. To that end, the fears and hopes of the member states and interest groups are categorized and commented on. Lastly, the gaps in theory and practice are addressed, current trends related to implementation are pointed out, and suggestions are made concerning how to make the best out of the Charter

Abstract: This volume contributes to the on-going legal discussion on pressing procedural and substantial law issues in the ambit of international human rights and civil liberties. While the 20th century has seen the true awakening of human rights, the 21st century poses new challenges to this ever-unfolding area of law. Not only do international tribunals and quasi-tribunals worldwide and domestic US and European continental courts have to deal with increasing numbers of complaints and petitions from individuals and groups on a vast array of societal problems, the legal issues put to them are sometimes extremely difficult to resolve as they relate to very sensitive issues. This book examines issues ranging from the status of human rights under US law to the status of the ECHR in the broader context of international law. It looks at the role of positive obligations in the case law of the Strasbourg Court, as well the impact of its case-law on childbirth and push-back operation towards boat people, but also at the growing unwillingness of ECHR member states to cooperate with the Strasbourg Court. It explores the new frontiers in US Capital punishment litigation, the first case before the International Criminal Court and the legal effect of judgments of the European Court on third states

Abstract: "This highly original work demonstrates the role and importance of customary law as the primary source of law for indigenous peoples all over the world. The book reviews the relationship between customary, positive and natural law from the time of Plato up to the present day. It examines its recognition in constitutional law and in international human rights and environmental instruments. The author analyses the role of customary law in tribal, national and international governance of indigenous peoples' lands, resources and cultural heritage. He explores the challenges and opportunities for its recognition by courts and alternative dispute resolution mechanisms, including issues of proof of law and conflicts between customary practices and human rights. It concludes that indigenous peoples' rights to their customary legal regimes and states' obligations to respect and recognise customary law, in order to secure their human rights, are principles of international customary law, and as such binding on all states. At a time when the land and resources of indigenous peoples are increasingly under threat, the book provides an accessible overview of the key issues for both legal and non-legal scholars, students of human rights and environmental justice, and indigenous peoples themselves"--

Abstract: The present dissertation addresses the manifold legal aspects of the administrative and constitutional problems of accreditation in german institutions of higher education. Issues are raised in respect to well-known questions concerning the legal nature of accreditation, as well as to the related encroachment upon fundamental rights. Furthermore, new challenges such as system accreditation and the seldom debated issues concerning the contractual relationships of the involved parties, or the democratic legitimation of the accreditation administration and the legal nature of its decisions are discussed. The study also draws comparisons to similarly structured areas of law - in so doing, further questions of modernisation in higher education, the debate surrounding privatisation and legal aspects of the administrative organisation are commented on

Abstract: This book offers the first scholarly analysis of the United Nations' work in the field of human rights education (HRE) and examines why HRE is so important. Paula Gerber argues that international law can learn from the medical profession, which has long recognized that 'prevention is better than cure'. There is an urgent need for HRE to be recognized as one of the best ways of preventing future human rights abuses; it is, in essence, a prophylactic for human rights violations. The book explores the provenance of human rights education in international law before critiquing the UNs work in this area across numerous different organs, including treaty committees, the Human Rights Council, General Assembly and Office of the High Commissioner for Human Rights. The author identifies a number of deficiencies in the UNs HRE activities, and makes recommendations for how the UN can more effectively promote HRE and increase states compliance with their international HRE obligations. This book provides a unique and timely insight into the workings of the UN in this vital aspect of international human rights law. Understanding Human Rights will strongly appeal to UN Bureaucrats, civil servants, human rights academics, human rights institutions and NGOs

Abstract: The World Trade Organization (WTO) is often accused of, at best, not paying enough attention to human rights or, at worst, facilitating and perpetuating human rights abuses. This book weighs these criticisms and examines their validity, incorporating legal arguments as well as some economic and political science perspectives. After introducing the respective WTO and human rights regimes, and discussing their legal and normative relationship to each other, the book presents a detailed analysis of the main human rights concerns relating to the WTO. These include the alleged democratic deficit within the Organization and the impact of WTO rules on the right to health, labour rights, the right to food, and on questions of poverty and development. Given that some of the most important issues within the WTO concern its impact on poor people within developing States, the book asks whether rich States have an obligation to the people of poorer States to construct a fairer trading system that better facilitates the alleviation of poverty and development. Against this background, the book examines the current Doha round proposals as well as suggestions for reform of the WTO to make it more 'human rights-friendly'.

Abstract: "The intersections between culture and human rights are shown to have engaged some of the most heated and controversial debates across international law and theory. As understandings of culture have evolved in recent decades to encompass culture as ways of life, there has been a shift in emphasis from national cultures to cultural diversity within and across states. This has entailed a push to more fully articulate cultural rights within human rights law. This volume provides a taster of the responses by international law, and particularly human rights law, to some of the thorniest, perennial, and ... sometimes violent confrontations and contestations fuelled by culture in relations between individuals, groups, and the state in international society."--Front jacket flap
