    Kurzfassung: This study deals with a constitutional principle of the EU: the rule of law. The EU Treaties leave no doubt that the rule of law is a universal value on which the Union is founded. This value is not bound to remain internal; EU external relations should also be guided by the principle. However, a lack of conceptual and legal clarity on the principle makes it uncertain how it guides external relations. 0The basic question this study poses is therefore what the role of the rule of law is in EU external relations. 0More specifically, this study analyses this role by focussing on the external dimension of EU migration and asylum policy. Over the years the EU has developed this external dimension of an originally internal policy field. Measures such as externalising border control, readmission of migrants to third states or mobility opportunities for third country nationals have been promoted. This relatively new area of EU external relations is characterised by a high degree of operational and human rights sensitive activities. For example, Frontex, the EU border agency, operates beyond Europe`s borders, sometimes on the basis of undisclosed working arrangements with third States

    Kurzfassung: Computer gelten als prägende Faktoren unserer Gesellschaft, ohne dass die ihnen zugesprochene Gestaltungsmacht systematisch hinterfragt würde. Gemeinhin werden sie als Rechenmaschine, Medium oder Notationssystem adressiert. Unklar bleibt, welcher Status Computern als Ding überhaupt zukommt. Mit ihrer kritischen Neulektüre von Vilém Flusser und Mark Weiser legt Suzana Alpsancar zwei symptomatische Computerkonzepte im Diskurs des Digitalen frei. Sie zeigt, dass eine Reflexion der Gestaltungsmacht von Computern neben typischen Gebrauchsweisen gerade auch auf ihre potenzielle Widerständigkeit als Dinge abheben muss, um ihre Medialität angemessen erfassen zu können.

    Kurzfassung: A distinct European perspective on Asia emerged in the late Middle Ages. Early reports of a homogeneous "India" of marvels and monsters gave way to accounts written by medieval travelers that indulged readers' curiosity about far-flung landscapes and cultures without exhibiting the attitudes evident in the later writings of aspiring imperialists. Mining the accounts of more than twenty Europeans who made---or claimed to have made---journeys to Mongolia, China, India, Sri Lanka, and Southeast Asia between the mid-thirteenth and early sixteenth centuries, Kim Phillips reconstructs a medieval European vision of Asia that was by turns critical, neutral, and admiring. In offering a cultural history of the encounter between medieval Latin Christians and the distant East, Before Orientalism reveals how Europeans' prevailing preoccupations with food and eating habits, gender roles, sexualities, civility, and the foreign body helped shape their perceptions of Asian peoples and societies. Phillips gives particular attention to the texts' known or likely audiences, the cultural settings within which they found a foothold, and the broader impact of their descriptions, while also considering the motivations of their writers. She reveals in rich detail responses from European travelers that ranged from pragmatism to wonder. Fear of military might, admiration for high standards of civic life and court culture, and even delight in foreign magnificence rarely assumed the kind of secular Eurocentric superiority that would later characterize Orientalism. Placing medieval writing on the East in the context of an emergent "Europe" whose explorers sought to learn more than to rule, Before Orientalism complicates our understanding of medieval attitudes toward the foreign.

    Kurzfassung: The number of international human rights treaties and monitoring mechanisms has grown considerably over the past decades. States are increasingly confronted with criticism as to their domestic human rights record. What is the effect of all these treaties, monitoring and criticism? Do they lead to changes and improvements? This book addresses such questions. More in particular, it investigates the domestic impact and effectiveness of the process of state reporting under the six main UN human rights treaties in the Netherlands, New Zealand and Finland. The focus is on the effectiveness of the recommendations of the treaty bodies and the extent to which policy or legislation is changed as a result of these recommendations. This question has hardly been addressed before.0This book fills this empirical gap and provides insights into the factors at both the national and international level which contribute to the effectiveness of the treaty bodies recommendations. The book is original and thorough in its approach because it is based on an extensive analysis of a wide variety of documents as well as 175 interviews with various domestic human rights stakeholders in the three countries. This includes government officials, NGO representatives, members of parliament, lawyers and judges, representatives from human rights and Ombudsman institutions and academics.     Kurzfassung: The book addresses one of the most heinous crimes of Saddam Hussein's Baath regime in Iraq, the so-called Anfal Campaign against the Kurdish population in 1988: within a few months, thousands of villages were destroyed; up to 182,000 men and women abducted and murdered; tens of thousands of civilians detained and forcibly reset tled.
    Kurzfassung: Based on longstanding work with women Anfal survivors in the Germyan region of Kurdis tan-Iraq, the author explores their psychosocial situation and coping strategies over more than twenty years. She documents the women's path from victims to survivors, their struggle for truth, justice, and acknowledgement, and their conflicts with both the Kurdish national victimhood discourse and Iraqi national strategies in dealing with the past.
    Kurzfassung: The research gives an exceptional long-term psychological perspective on coping with extreme violence, beyond common discourses of trauma and "healing". It links psycho logical trauma research to memory studies and the debate on socio-political reconstruction in post-conflict societies.

    Kurzfassung: This research examines the role of prosecutors within the United States and in Switzerland and is completed by an overview of the prosecution institutions in France and Germany. The research recognizes that despite seemingly very different legal traditions and structures, prosecutors in these systems are similar enough that each system might learn from the others. Drawing upon the experiences of other nations, this research proposes solutions to the problems identified in connection with the position and powers of public prosecutors in the United States. Furthermore, it outlines the problems related to the increase of prosecutorial power and the lessons the European criminal justice systems surveyed can draw from the experience in the US. In terms of methodology, this research not only considers formal legal provisions but also systematic structural factors, academic literature and statistics revealing how the law and governing principles actually work in practice.

Or should we move to new post-secular arrangements when dealing with pluralism in Europe? They begin by exploring the theoretical perspective, asking what post-secularism is and looking at its relation to secularism. This book discusses how adjudicators and parties may refer to questions of jurisdiction and admissibility in order to avoid conflicting decisions on overlapping cases, excessive exercises of jurisdiction and the proliferation of litigation. It highlights an emerging, overlooked function of preliminary objections: transmission belts of procedure-regulating rules across the 'international judiciary'. Activating this often dormant, managerial function of preliminary objections would nurture coordination of otherwise independent and autonomous tribunals"--

    Kurzfassung: Why did Greek tragedy and "the tragic" come to be seen as essential to conceptions of modernity? And how has this belief affected modern understandings of Greek drama? In Genealogy of the Tragic, Joshua Billings answers these and related questions by tracing the emergence of the modern theory of the tragic, which was first developed around 1800 by thinkers associated with German Idealism. The book argues that the idea of the tragic arose in response to a new consciousness of history in the late eighteenth century, which spurred theorists to see Greek tragedy as both a unique, historically remote form and a timeless literary genre full of meaning for the present. The book offers a new interpretation of the theories of Schiller, Schelling, Hegel, Hölderlin, and others, as mediations between these historicizing and universalizing impulses, and shows the roots of their approaches in earlier discussions of Greek tragedy in Germany, France, and England. By examining eighteenth-century readings of tragedy and the interactions between idealist thinkers in detail, Genealogy of the Tragic offers the most comprehensive historical account of the tragic to date, as well as the fullest explanation of why and how the idea was used to make sense of modernity. The book argues that idealist theories remain fundamental to contemporary interpretations of Greek tragedy, and calls for a renewed engagement with philosophical questions in criticism of tragedy.

    Kurzfassung: Language and the Right to Fair Hearing in International Criminal Trials explores the influence of the dynamic factor of language on trial fairness in international criminal proceedings. By means of empirical research and jurisprudential analysis, this book explores the implications that conducting a trial in more than one language can have for the right to fair trial. It reveals that the language debate is as old as international criminal justice, but due to misrepresentation of the status of language fair trial rights in international law, the debate has not yielded concrete reforms. Language is the core foundation for justice. It is the means through which the rights of the accused are secured and exercised. Linguistic complexities such as misunderstandings, translation errors and cultural distance among participants in international criminal trials affect courtroom communication, the presentation and the perception of the evidence, hence jeopardizing the foundations of a fair trial. The author concludes that language fair trial rights are priority rights situated in the minimum guarantees of fair criminal trial; the obligation of the court to ensure fair trial or accord the accused person a fair hearing also includes the duty to ensure they can understand and be understood

    Kurzfassung: This book examines in detail both historical and current legal concepts of ‘religious cultural heritage’ within the context of the European continent. The latter group is primarily based on the variety of sacred cultural elements emanating from the different religious traditions of the peoples of Europe, which are deemed worthy of protection and preservation due to their outstanding value, in terms of their social, cultural and religious significance. In view of this, the study provides evidence of the European States’ active involvement with their sacred/cultural treasures, on the basis of the political and legal foundations of neutrality and pluralism. Furthermore, the book analyzes all relevant international legislative instruments (i.e. the plethora of EU, CoE and UNESCO norms), as well as all major European legislative patterns, in light of their significance for the aforementioned aspects of pluralism and neutrality. The interdisciplinary references listed at the end of each chapter provide an additional incentive for further reading on the subject matter. The most important finding to emerge from the study is that there is a shared legal ethos in Europe that imposes a duty of appropriate care concerning the vast variety of sacred cultural goods, and the religious cultural heritage in general, as an invaluable repository of European cultural capital. It also considers the sui generis nature of this capital: like any other type of asset, it may deteriorate or fade over time, necessitating investment in its preservation or refurbishment; nevertheless, like no other, this particular capital maintains a distinct cultural value, as it contains an additional characteristic of ‘sacredness’ expressed in the form of its ‘religious character,’ the latter being analyzed as a triptych of religious memory, religious aesthetics and religious beliefs

It advances a perspective of legal-theology that combines analysis of jurisprudential reflections and theological views within a broad historical and intellectual framework. The book advocates two approaches to the study of the legal history of the Halakhah: comparative jurisprudence and legal-theology, based on the understanding that jurisprudence and theology are indispensable and inseparable pillars of legal praxis

    Kurzfassung: Trauma has become a hotly contested topic in literary studies. But interest in trauma is not new; its roots extend to the Romantic period, when novelists and the first psychiatrists influenced each others' investigations of the 'wounded mind'. This book looks back to these early attempts to understand trauma, reading a selection of Romantic novels in dialogue with Romantic and contemporary psychiatry. It then carries that dialogue forward to postmodern fiction, examining further how empirical approaches can deepen our theorizations of trauma. Within an interdisciplinary framework, this study reveals fresh insights into the poetics, politics, and ethics of trauma fiction
