    Abstract: Zur Bewältigung von Organisierter (Drogen)Kriminalität finden zeitlich und finanziell aufwändige, meist verdeckte Ermittlungen gegen eine Vielzahl von Akteuren statt. Um diese Hintergrundermittlungen nicht vorzeitig aufzudecken, wird die sog. ›Legendierte Kontrolle‹ eingesetzt, bei der die Ermittlungsbehörden eine Durchsuchung als allgemeine Verkehrskontrolle tarnen. Die Arbeit ordnet das Instrument in das bestehende System verdeckter und täuschender Ermittlungsmaßnahmen ein. Sie analysiert die verfassungs- und strafverfahrensrechtliche Zulässigkeit des staatlichen Vorgehens, das sich im Grenzbereich zwischen Gefahrenabwehr und Strafverfolgung bewegt. Ein besonderer Schwerpunkt liegt auf der Frage, ob entgegen dem Grundsatz der Aktenwahrheit eine legendierte, also unzutreffende oder unvollständige Aktenführung erlaubt sein kann. Hier werden die Grenzen der staatlichen Täuschungsbefugnis – trotz der Maxime einer effektiven Strafverfolgung – gegenüber Beschuldigten herausgearbeitet

Dadurch sowie durch allgemeine aktuelle Entwicklungen im Bibliothekswesen ergeben sich in etlichen Entgeltgruppen Veränderungen.Das neue Standardwerk für die Erstellung von Stellenbeschreibungen und Stellenbewertungen in wissenschaftlichen Bibliotheken führt neben neuen auch umfassend aktualisierte Arbeitsvorgänge auf und versteht sich als Instrument, um Tätigkeiten in Bibliotheken den unbestimmten Rechtsbegriffen bzw. Entgeltgruppen der derzeit gültigen Entgeltordnung zuzuordnen. Ergänzt wird das Werk durch Grundlagenwissen zum Thema Eingruppierung, Stellenbeschreibung und Stellenbewertung.Nachdem Ende 2020 die Arbeitsvorgänge in Bibliotheken, 1.     Abstract: Anyone who visits Berlin’s Olympic Park will inevitably stumble across the continued effects of the site's Nazi monumentality—and also its largely unbroken tradition of ethnic and anti-Semitic monumentality. The criticism of this is diverse, but so far rather loosely interwoven: Where does the debate stand—or, indeed, where do the debates stand? What views are there from the perspectives of history, museums, art, politics, sport or monument protection? Where can bridges of criticism be built, where are the different perspectives contradictory, and where is fundamental reorientation or readjustment of the debate(s) required? This anthology attempts to address these questions, not only to outline or initiate paths of debate but also to identify fundamental problems.

    Abstract: This book examines the digitalization of Small and Medium Enterprises (SMEs) in Indonesia and its challenges in the context of an emerging economy and the Covid-19 crisis. During the Covid-19 pandemic, business digitalization became a must for a business to avoid collapse and people saw that digital transformation is a panacea for SMEs to help them survive and revive from the crises. Governments and other stakeholders in many countries including Indonesia have launched policies and programs to support SMEs. Transforming SMEs' conventional businesses into digitalized versions, however, is a complex issue influenced by various factors. These factors encompass both internal changes within the organization and external dynamics in the ecosystem in which they operate. This book, therefore, is a new approach towards understanding the digitalization of SMEs in Indonesia and includes contributions from scholars with different, multi-disciplinary perspectives and demonstrates that digital transformation of SMEs is not all about technology adoption but also involves other aspects such as social, economic, and public governance factors.     Abstract: In diesem Buch wird erstens Hegels ideengeschichtlicher Beitrag zur Genese von Sozialstaatstheorien herausgearbeitet und zweitens seine politische Theorie für die politiktheoretische Modellierung von Sozialstaatlichkeit fruchtbar gemacht. Im genuin modernen Konflikt des Auseinandertretens von Gesellschaft und Staat, von sich selbst verwirklichendem Individuum auf dem Markt und der Gemeinschaft, zeichnet sich eine neue zentrale Funktion des Staats ab: Die Garantie der Freiheit für seine Bürger. Der Sozialstaat als Mittel dieser staatlichen Freiheitsgarantie erfüllt somit nicht nur eine bedeutende Rolle in der Versöhnung von Individuum und Gemeinschaft, sondern bildet hierdurch zugleich ein zentrales Legitimationselement des modernen Staats. Der Autor Dr. Joshua Folkerts war Wissenschaftlicher Mitarbeiter am Graduiertenkolleg „Deutungsmacht“ der Universität Rostock sowie Fulbright-Gastwissenschaftler an der Boston University. Im Mittelpunkt steht eine ausführliche praxisbezogene Analyse der möglichen Interessenkonflikte der Datenschutzbeauftragten. Es wird herausgearbeitet, wie sich diese Interessenkonflikte auf die Praxis der betrieblichen und behördlichen Datenschutzbeauftragten auswirken und welche Unterschiede sich bei einer internen oder externen Benennung des Datenschutzbeauftragten ergeben. Art. 38 Abs. 6 S. 1 DSGVO sieht ein Verbot der Zuweisung konfligierender Aufgaben vor – die Möglichkeiten eines Interessenkonflikts des Datenschutzbeauftragten gehen jedoch weit über diese normierte Konfliktmöglichkeit hinaus. Konkret werden in der Arbeit Interessenkonflikte in Bezug auf die unabhängige Stellung, die Aufgaben, die Pflichten und die Rechtsbeziehungen des Datenschutzbeauftragten betrachtet. Bei der Analyse der Interessenkonflikte wird berücksichtigt, dass der Datenschutzbeauftragte zugleich dem Verantwortlichen, den Betroffenen, den Aufsichtsbehörden und dem Datenschutz als abstraktes Schutzgut verpflichtet ist. Schließlich wird in der Arbeit aufgezeigt, welchen Verbundenheiten sich der Datenschutzbeauftragte ausgesetzt sieht und welche Antworten des Rechts den Interessenkonflikten gegenüberstehen.

    Abstract: Spätestens seit der Corona-Pandemie werden Verschwörungstheorien zunehmend als gesellschaftspolitisches Problem wahrgenommen und sind zum Politikum geworden.     Abstract: Terrorismus ist noch immer eines der bedrohlichsten Phänomene der heutigen Zeit. In diesem Buch werden mithilfe von Gerichtsakten vom Generalbundesanwalt beim Bundesgerichtshof in Karlsruhe die Radikalisierungsprozesse von 58 deutschen Jihadisten analysiert. Durch das umfassende Datenmaterial ist es möglich, die Wege dieser Personen von der Radikalisierung bis zum Anschluss an eine terroristische Organisation im Ausland (u.a. Islamischer Staat) sowie ausgeübte strafrechtlich relevante Handlungen zu rekonstruieren. Mithilfe einer Netzwerkanalyse wird das radikale Netzwerk untersucht, das aus Deutschland mit Jihadkämpfern im In- und Ausland verbunden gewesen ist. Dabei wird ein Augenmerk auf den Aufbau, die Funktionsweise und die Schlüsselpersonen des Netzwerks gelegt. Auch werden die unterschiedlichen Rollen und Unterstützungshandlungen der Netzwerkmitglieder in den Fokus genommen. Zusätzlich werden strafrechtlich relevante Radikalisierungs- und Mobilisierungsstrategien salafistisch-jihadistischer Prediger entschlüsselt, die weitaus tiefere Verbindungen zu terroristischen Organisationen im Ausland haben als bisher angenommen. Die Autorin Kristin Weber ist Kriminologin, Soziologin und wissenschaftliche Mitarbeiterin im Bereich der Radikalisierungs-, Terrorismus- und Extremismusforschung. An der Deutschen Hochschule der Polizei in Münster-Hiltrup hat sie ihre Dissertation im Rahmen des Projektes X-Sonar "Analyse extremistischer Bestrebungen in sozialen Netzwerken", welches vom Bundesministerium für Bildung und Forschung gefördert wurde, geschrieben.

    Abstract: Global Labour History has rapidly gained ground as a field of study in the 21st century, attracting interest in the Global South and North alike. Scholars derive inspiration from the broad perspective and the effort to perceive connections between global trends over time in work and labour relations, incorporating slaves, indentured labourers and sharecroppers, housewives and domestic servants. Casting this sweeping analytical gaze, this book discusses the core concepts ‘capitalism’ and ‘workers’, and refines notions such as ‘coerced labour’, ‘household strategies’ and ‘labour markets’. It explores in new ways the connections between labourers in different parts of the world, arguing that both ‘globalisation’ and modern labour management originated in agriculture in the Global South and were only later introduced in Northern industrial settings. It reveals that 19th-century chattel slavery was frequently replaced by other forms of coerced labour, and it reconstructs the laborious 20th-century attempts of the International Labour Organisation to regulate labour standards supra-nationally. The book also pays attention to the relational inequality through which workers in wealthy countries benefit from the exploitation of those in poor countries. The final part addresses workers’ resistance and acquiescence: why collective actions often have unanticipated consequences; why and how workers sometimes organise massive flights from exploitation and oppression; and why ‘proletarian revolutions’ took place in pre-industrial or industrialising countries and never in fully developed capitalist societies.

    Abstract: Mit der Gründung der Europäischen Staatsanwaltschaft (EUStA) ist ein Quantensprung in der grenzüberschreitenden Strafverfolgung in Europa gelungen. Ein Jahr nach Aufnahme der operativen Tätigkeit fand eine Tagung an der LMU München statt, die sich ersten Erfahrungen, praktischen Problemen sowie ungeklärten wissenschaftlichen Fragestellungen im Zusammenhang mit der EUStA widmete. Kerstin Zettl-Schabath vergleicht mithilfe eines umfassenden Datensatzes für die Jahre 2000-2019 die staatlichen Cyber-Proxy-Strategien von China, Russland, den USA und Israel. Dabei zeigen sich je nach politischem System deutliche Abweichungen: Autokratien nutzen Proxys als "Puffer" gegenüber Demokratien, um für ihre Taten nicht belangt zu werden. Für Demokratien dagegen können Berichte privater IT-Unternehmen "Täter-Wissen" kommunizieren sowie Handlungsdruck infolge politischer Verantwortungszuweisungen reduzieren.

    Abstract: Der Band versammelt Beiträge zu den sechs frühen juristischen Max-Planck-Instituten und der Herausbildung eines rechtswissenschaftlichen Schwerpunkts in der Max-Planck-Gesellschaft.     Abstract: Why do certain parts of the state in Africa work so effectively despite operating in difficult governance contexts? How do 'pockets of bureaucratic effectiveness' emerge and become sustained over time? And what does this tell us about the prospects for state-building and development in Africa? Repeated economic and social crises have demanded that development thinkers and policy actors have had to engage with the critical role that states play in delivering development. Pockets of Effectiveness and the Politics of State-building and Development in Africa shows that politics is the driving factor that shapes how well state agencies perform their roles. It deploys a new conceptual framework – the power domains approach – to explore the shifting fortunes of key state agencies in five countries – Ghana, Kenya, Rwanda, Uganda, and Zambia – over the past three decades. Our original research reveals when, how and why political rulers decide to build effective state agencies and enable them to deliver certain forms of economic development – often through forming strategic coalitions with senior bureaucrats and with international support – and also when this support falters and gives way to a politics of survival. Comparative analysis identifies two potential trajectories towards state-building in Africa, each shaped by different configurations of social and political power. The book critiques the role that international development agencies have played in (mis)shaping the state in Africa and suggests a new strategic agenda for building the state capacities required to deliver sustained development at the current juncture. The book closes with critical commentaries from two leading scholars in the field, to help place our work in context and establish the next steps for research and strategy in this increasingly important area of development theory and practice

    Abstract: Since 1994, as the ruling party in South Africa, the ANC have become synonymous with and indivisible from the fight against apartheid rule. This has left little space for competing accounts, visions, and political projects to find their appropriate place in the historical narrative. In this innovative book, Toivo Asheeke moves beyond these well-trodden histories, to tell the previously neglected story of the Black Consciousness Movement (BCM), a militant revolutionary nationalist wing of the anti-colonial struggle. Using archival sources from four countries and interviews with former veterans of the movement, Asheeke explores the BCM's engagement with guerrilla warfare, community feminism and Black Internationalism. Uncovering the personal and political histories of those who have previously received scant scholarly attention, Asheeke both illuminates the history of Africa's decolonization struggle and that of the wider Cold War

    Abstract: The unmatched technological achievements in artificial intelligence (AI), robotics, computer science, and related fields over the last few decades can be considered a success story. The technological sophistication has been so groundbreaking in various types of applications that many experts believe that we will see, at some point or another, the emergence of general AI (AGI) and, eventually, superintelligence. This book examines the impact of AI on human rights by focusing on potential risks and human rights legislation and proposes creating a Universal Convention for the Rights of AI Systems (AI Convention).     Abstract: This edited collection focuses on the comparative analysis of the application of Shari’a in countries with Muslim minorities (e.g. USA, Australia, Germany and Italy) and majorities (e.g. Malaysia, Bangladesh, Turkey, and Morocco).     Abstract: Waiting for the Revolution to End explores the Syrian revolution through the experiences of citizens in exile. Based on more than three years of embedded fieldwork with Syrians displaced in the border city of Gaziantep (southern Turkey), the book places the Syrian revolution and its tragic aftermath under ethnographic scrutiny. It charts the evolution from peaceful uprising (2011) to armed confrontation (2012), descent into fully fledged conflict (2013) and finally to proxy war (2015), to propose an understanding of revolution beyond success and failure. While the Assad regime remains in place, the Syrian revolution (al-thawra) still holds a transformational power that can be located on intimate and world-making scales. Charlotte Al-Khalili traces the unintended consequences of revolution and its unexpected consequences to reveal the reshaping of Syrian life-worlds and exiles’ evolving theorizations, experiences and imaginations of al-thawra. She describes the in-between spatio-temporal realm inhabited by Syrians displaced to Turkey as they await the revolution’s outcomes, and maps the revolution’s multidimensional and multi-scalar effects on their everyday life. By following the chronology of events inside Syria and Syrians’ geography of displacement, the book makes the relation between revolution and displacement its centerpiece, both as an ethnographic object and an analytical device.     Abstract: This book explores the issue of leadership criminality from a new angle by comparing two highly relevant modes of responsibility. By contrasting individual criminal responsibility for ordering international crimes with indirect perpetration through an organisation, it shows the doctrinal weaknesses of the latter and outlines the much-overlooked advantages of the former. The volume analyses the development of both forms of responsibility, looking at their origins, and their reception in academia and practical use in jurisprudence. The history of indirect perpetration through an organisation (Organisationsherrschaft) is portrayed from its German academic origin, through German jurisprudence to the reception of the doctrine at the International Criminal Court. By comparing the doctrine’s stages of evolution, the book sheds light on the different aspects of the various models of indirect perpetration through an organisation and carves out general and fundamental criticism of it. The characteristics of ordering liability are explored in depth through an analysis of jurisprudence of the Nuremberg subsequent trials, the ad hoc tribunals and the International Criminal Court. This historic and doctrinal comparison reveals a well-defined and to-date much neglected mode of responsibility with enormous potential for the adjudication of leadership figures in the ambit of international criminal law and only one conclusion can follow from this analysis: it calls for practitioners and academics to leave the well-trodden paths of national criminal law doctrine and embrace truly international modes of liability such as the ordering of a crime. This volume in the ICJ series provides practitioners, researchers and students with a detailed account of forms of leadership liability and an innovative approach to the topic’s most discussed issue. Dr. Johannes Block is a criminal lawyer specializing in international criminal law, responsibility of leadership figures, questions of perpetration and participation in crime as well as the national-socialists’ crimes. He studied in Münster, Germany and Bogotá, Colombia and obtained his Dr. iur. from the University of Cologne, where he also worked and taught as a research assistant for several years. His legal clerkship led him to organized crime investigations, criminal defence, the European Commission and the German Federal Ministry of Justice.

    Abstract: Across Europe, people are deeply concerned about the state of democracy. This book shifts the attention away from ever-changing populist politicians that capture newspaper headlines to the centre-left and centre-right people's parties that used to buttress the democratic order over the past decades, but which are now in steep decline. Why does the crisis of these parties contribute so profoundly to today's crisis of democracy? And why were these parties so important for the stabilization and legitimation of democracy in the past century in the first place? By providing a long-term and transnational account of the history of democracy in modern Europe, the book reveals the striking parallels between the history of democracy and the history of the people's parties since 1918. The first part of the book shows how the failure to turn traditional working-class and confessional mass parties into people's parties played a vital role in the collapse of democracy in the 1920s and 1930s. It also explores the attractiveness of the people's party ideal centred on moderation, compromise and openness to pioneering politicians in the mid-century. The second part of the book then traces the practical application and breakthrough of this ideal in the decades after World War II and shows how this contributed to the stabilization and legitimation of democracy in the postwar decades. In the final part of the book, Corduwener turns to the slow decline of the people's parties since the mid-1970s. It explores how their failure to represent volatile and polarized societies was reflected in their aim to turn into 'open' and 'flexible' parties focused primarily on providing governmental efficiency - and how this eventually turned against them by alienating their members and voters. In so doing, Corduwener offers an original and timely study of twentieth century democracy that transcends traditional party groupings, divisions between eras, and national boundaries.

How does society (mis)handle pressing challenges such as armed violence, cultural difference, ecological degradation, economic restructuring, geopolitical shifts, global pandemics, migration flows, and technological change in ways that are (not) democratic, effective, fair, peaceful, and sustainable? This volume addresses these key questions with reference to the theme of 'polycentrism', i.e. the idea that contemporary governing is dispersed, fluctuating, messy, elusive, and headless. Chapters develop this notion of polycentrism from the perspectives of a broad spectrum of academic disciplines and theoretical approaches, offering comprehensive coverage of exciting new thinking about how today's world is (mis)ruled. The book identifies four paradigms of knowledge about polycentric governing - organizational, legal, relational, and structural - and pursues conversations across the divides that normally keep these approaches within separate research communities. These exceptional inter-paradigm exchanges focus particularly on issues of techniques (how governing is done), power (what forces drive governing), and legitimacy (whether governing is rightful). Comparisons between the multiple perspectives on polycentric governing highlight, and help to clarify, the distinctive emphases, potentials, and limitations of each approach. In addition, various combinations of the different theories generate promising novel avenues of thought about polycentrism. It assesses the assumptions of an imminent wave of domestic violence against reliable data from crime statistics, surveys, and various institutions responding to domestic violence. Collecting partner country reports from Austria, Finland, France, Germany, Hungary, Portugal, Scotland and Slovenia, it demonstrates the effects that lockdown measures starting March 2020 had on reported DV incidents.     Abstract: This book offers a comprehensive analysis of the legal questions that arise for the legislative branch when implementing the crime of aggression into domestic law. Despite being the “supreme international crime” that gave birth to international criminal law in Nuremberg, its ICC Statute definition has been incorporated into domestic law by fewer than 20 States. The crime of aggression was also omitted in the rich debate held among German scholars in the early 2000s regarding the legislative implementation of other ICC Statute crimes. The current inability of the International Criminal Court to respond to the Russian aggression towards Ukraine invites the continuation of these academic debates without neglecting the particularities of the crime of aggression. The fundamental issues discussed in this volume include the obligation to criminalize aggression, the core wrong of the crime, the normative gaps under domestic law and the jurisdictional gaps under the ICC Statute. To facilitate the operationalization of domestic implementation, the book explores the technical options for incorporating the definition into domestic law, the geographical ambit of domestic jurisdiction—most notably universal jurisdiction—as well as legal challenges such as immunities. The book is aimed primarily at researchers and States with an interest in the domestic implementation of international criminal law but those already working in the field should also find much of interest contained within it. Dr. Annegret Hartig is Program Director of the Global Institute for the Prevention of Aggression and worked as a researcher at the University of Hamburg where she obtained her doctoral degree in international criminal law.

    Abstract: This book introduces a new theoretical framework that examines Iran in relation to the theological concept of Anfal, a confiscatory regime seen in Iran since 1979 where public assets belong to the leader of Iran. Through analysing the economic impacts of Anfal, the effects of political capitalism and destructive coordination and how they lead to the economics of hoarding and the flight of capital and labour are highlighted. The economics of predation, ecological disaster, and cooperative coordination are also discussed. This book aims to highlight the economic consequences of Anfal and its role in sustaining destructive condition and shaping the Islamic political capitalism. It will be relevant to students and researchers interested in the political economy, Middle Eastern and Islamic studies. Mehrdad Vahabi is Professor of Economics at University Sorbonne Paris Nord and director of the research center on Economics at North Paris (CEPN) affiliated to the French National Center for Scientific Research (CNRS). He has published many books in English, French and Persian among them The Political Economy of Destructive Power (Edward Elgar, 2004), The Political Economy of Predation (Cambridge University Press, 2015). He has published more than a hundred articles in peer journals and is an editor of Public Choice.

    Abstract: This book explores the role of capital and labor migration in the expansion of the capitalist world-system. It presents comprehensive case studies on various historical periods of hegemony recognized by world-system theory: the Dutch hegemony (1625-1675), British hegemony (1815-1873), and US hegemony (1945-1970). Moreover, the book identifies an earlier period of economic dominance in Western Europe when merchant-bankers from Florence dominated the regional wool trade in the early thirteenth century. In these four intervals of dominance, i.e., from the medieval period to the late twentieth century, capital and labor migration formed the basis of capitalist development in the hegemonic core states as well as in peripheral regions under their economic and political influence. In turn, the book analyzes the migration patterns associated with the rise of hegemony from the perspectives of class relations between employers and workers, technological advances at the workplace, economic cycles, and state policies on labor migration. It concludes with a projection that heightened migration will continue to characterize the capitalist world system, especially as many poor and displaced populations in peripheral regions resort to migration for survival. Accordingly, it appeals to scholars in the fields of politics, sociology, history, anthropology, and economics who are interested in globalization and world-system analysis.

    Abstract: This open access book is the product of three years of academic research that has been carried out in the EU-funded Jean Monnet Network on “Post-Truth Politics, Nationalism and the Delegitimation of European Integration” since 2019. Drawing on the multidisciplinary expertise of the network’s members, the book explores the impact of the phenomenon of post-truth politics on European integration and the European Union. It places particular emphasis on how post-truth politics has played out in the public sphere and asks what impact the phenomenon has had on public deliberation, but reflects also on its implications for democracy in a wider sense.     Abstract: This proceedings volume combines chapters derived from papers presented at the 4th and 5th Annual Conferences on the Future of the Commercial Contract in Scholarship and Law Reform. This ongoing research project brings together scholars from all over the world at an annual international conference in London. The book focusses on technology in commercial contract law as well as on sustainability in commercial contracts. Across the chapters, contributors from different countries examine the data, press coverage, and provide professional observations on how policing, law enforcement, police powers and community relations were managed. They focus on how security and governmental actors often failed to align with the formal scripts that were specifically designed for crisis-management, resulting in the wavering application of professional discretion and coercive powers. Their different approaches were evident: in some regions police were less dominantly visible compared to other regions, where the police used a top-down visible and repressive stance vis-à-vis public alignment with COVID rules, including the imposition of lockdown and curfews. Some contributors draw on data from the COROPOL (Corona Policing) Monitor which collated data on crime, plural policing and public order in Europe and around the world during the early phases of the COVID crisis. Overall, this book seeks to provide comparative critical insights and commentary as well as a practical and operational understanding of security governance during the COVID-19 crisis and the lessons learned to improve future preparedness. Monica den Boer is Professor of Military Policing Operations at the Netherlands Defence Academy. Her primary research focus is on the evolution of military policing, as well as border policing, international policing, urban policing and the policing of organised crime and terrorism. She served as member of the Dutch national parliament from 2017 to 2020. Prior to this she worked in several academic and professional environments, including the Police Academy of the Netherlands and the VU University Amsterdam. Eric Bervoets is a police scientist and criminologist. He has been active as a researcher since 1997. After a master's degree in public administration at Rotterdam Erasmus University, the Netherlands, Bervoets obtained his PhD in 2006 with a dissertation on policing troubled neighbourhoods. In 2020, he was appointed Research Fellow at the Netherlands Defence Academy. Linda Hak obtained her BSc in Criminology at Erasmus University and a master’s degree in Legal Psychology at Maastricht University, the Netherlands. She served as a research intern at Bureau Bervoets and is employed as a detective assistant for the National Police of the Netherlands.

    Abstract: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’.     Abstract: Despite massive investments in mitigation capabilities, financial crime remains a trillion-dollar global issue with impacts that extend well beyond the financial services industry. Worldwide, there are between 800 billion dollars and 2 trillion dollars laundered annually with the United States making up at least 300 billion dollars of that figure. Although it is not possible to measure money laundering in the same way as legitimate economic activity, the scale of the problem is considered enormous. The cybersecurity landscape is always shifting, with threats becoming more sophisticated all the time. Managing risks in the banking and financial sectors requires a thorough understanding of the evolving risks as well as the tools and practical techniques available to address them. Cybercrime is a global problem, which requires a coordinated international response. This book outlines the regulatory requirements that come out of cyber laws and showcases the comparison in dealing with AML/CFT and cybersecurity among the G-20, which will be of interest to scholars, students and policymakers within these fields. Through analyzing policy and legislative documents, participant observation and interviews, it seeks to understand how normalization is implemented differently in prison legislation, policies and practices and compares the two societies for context. It also considers the material prison environment, security, the social environment and the use of time in prison. It provides insights into how normalization can be successfully and holistically implemented in both policy and practice, to contribute to a more ‘pure’ form of liberty deprivation as punishment without too many unintended effects. Helene De Vos is an affiliated senior researcher at KU Leuven, Belgium, and the executive director of RESCALED.     Abstract: This book considers the intellectual property protection of clinical test data that has been submitted to governments, in particular through test data exclusivity rights. It focuses on how these intellectual property rights first emerged in the early 1980s, how they have globalised over the past four decades, and what impact they have had upon access to medicine. This book makes a number of significant and original contributions to the literature around the protection of submitted test data. First, the book draws upon the theory of regulatory globalisation to provide an explanation of how intellectual property rights in submitted pharmaceutical test data have become nearly ubiquitous in the legal systems of most major economies. Second, through a comprehensive analysis and synthesis of provisions on the protection of submitted test data in free trade agreements, as well as a comparison of a range of national approaches to the protection of submitted test data, it reveals the broader global regulatory pattern that has given rise to these intellectual property rights. Third, by analysing data on drug approvals in the US, it provides an empirical insight into the impact of test data exclusivity in national pharmaceutical markets. Fourth, the book covers a number of developments regarding test data exclusivity that have occurred as a result of responses to the COVID-19 pandemic, both at the national level as well as at the World Trade Organisation (WTO). This book will appeal to academics researching the intersection of intellectual property and the life sciences, civil society activists working to promote access to medicines, and students (particularly those at the post-graduate level) studying the relationship between intellectual property and medicine.

    Abstract: Dieses Open-Access-Buch behandelt umfassend die rechtlichen Grundlagen der im Jahr 2017 eingeführten Echtzeitüberweisung (SEPA Instant Payment). Der Autor stellt wiederholt Inkonsistenzen zwischen dem europarechtlich harmonisierten Zahlungsverkehrsrecht und dem maßgeblichen Interbankenabkommen heraus und zeigt an diesen Stellen bereits detailliert neue Lösungen auf Grundlage des gegenwärtigen Rechts auf. In einem weiteren Schwerpunkt wird die Rolle der Echtzeitüberweisung in der Digitalisierung der Bankenbranche, insbesondere im Verhältnis zum Bargeld und zu weiteren Bezahldiensten wie PayPal, erörtert. De lege ferenda schlägt der Autor größere Anpassungen im Fristenregime und die Einführung eines Chargeback-Systems, wie es aus der Kreditkartenzahlung bekannt ist, in konkreter Ausgestaltung vor. Die Anregungen im rechtspolitischen Teil des Werks zielen auf einen Einklang der sich ergänzenden Rechtsquellen sowie eine Erhöhung der Attraktivität der Echtzeitüberweisung in der Praxis ab.     Abstract: The European Union (‘EU’) is promoting a suite of innovations in international economic regulation—among them, reforms for secure and sustainable investment, a comprehensive approach to the mutual recognition of professional qualifications, a viable carbon border adjustment mechanism, heightened intellectual property rights protection, the arm’s length principle in taxation, and an increased commitment to non-economic vales. Through a critical analysis of key regulations and policies, this volume explores the evolving architectures of international economic agreements in light of EU practice. A comprehensive analysis indicates that novelties are rooted in geoeconomic considerations, through which a fundamental shift is underway towards the adoption of comprehensive bilateral trade agreements. Whilst innovation has the potential to significantly harmonise cross-border regulatory frameworks, it can also trigger significant fractures, particularly when applied restrictively and asymmetrically. Arguably, the ‘Brussels effect’ will to a certain extent foster a progressive development of international economic regulation, while in some respects being constrained by the status quo of the international economic regime. This volume is part of the Jean Monnet project Third Country Engagement with EU Trade Policy led by the ANU Centre for European Studies at the Australian National University, and supported by the European Commission under the Erasmus+ actions. The project seeks to explore and improve understanding of the EU’s evolving trade policy and its implications for third countries, including Australia and countries in the Asia-Pacific region.
