    Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people

    Abstract: This book analyses the extent and the modalities of the securitization of asylum-seekers and refugees in the EU. Itargues that the development of the EU asylum policy, far from 'securitizing' asylum-seekers and refugees, has led to the strengthening and codification of several rights for these two categories of persons. However, the securitization of terrorism and the links that have been constructed between asylum, irregular migration and terrorism in the wake of the various terrorist attacks that have taken place in Europe in the last few years have had a significant impact on the ability of asylum-seekers to gain access to asylum systems in the EU. From a theoretical point of view, the book develops an original analytical framework that draws upon and further develops security studies- more precisely securitization theory- by connecting it to the literature on policy venues and venue-shopping. It therefore makes a significant contribution to the debates on both securitization and migration. Empirically examining the entire development of the EU's policy towards asylum-seekers and refugees, from its origins in 1993, this book will be of great interest to students of European and EU politics, refugees, migration, security, terrorism and counter-terrorism, security studies and International Relations

This has prompted concerns about the need and importance of holding algorithmic power to account, yet it is far from clear that existing legal and other oversight mechanisms are up to the task. This collection of essays, edited by two leading regulatory governance scholars, offers a critical0exploration of 'algorithmic regulation', understood both as a means for co-ordinating and regulating social action and decision-making, as well as the need for institutional mechanisms through which the power of algorithms and algorithmic systems might themselves be regulated. It offers a unique perspective that is likely to become a significant reference point for the ever-growing debates about the power of algorithms in daily life in the worlds of research, policy and practice. The range of contributors are drawn from a broad range of disciplinary perspectives including law, public administration, applied philosophy, data science and artificial intelligence

    Abstract: "Customary law and traditional authorities continue to play highly complex and contested roles in contemporary African states. Reversing the common preoccupation with studying the impact of the post/colonial state on customary regimes, this volume analyses how the interactions between state and non-state normative orders have shaped the everyday practices of the state. It argues that, in their daily work, local officials are confronted with a paradox of customary law: operating under politico-legal pluralism and limited state capacity, bureaucrats must often, paradoxically, deal with custom - even though the form and logic of customary rule is not easily compatible and frequently incommensurable with the form and logic of the state - in order to do their work as a state. Given the self-contradictory nature of this endeavour, officials end up processing, rather than solving, this paradox in multiple, inconsistent and piecemeal ways. Assembling inventive case studies on state-driven land reforms in South Africa and Tanzania, the police in Mozambique, witchcraft in southern Sudan, constitutional reform in South Sudan, Guinea's long durée of changing state engagements with custom, and hybrid political orders in Somaliland, this volume offers important insights into the divergent strategies used by African officials in handling this paradox of customary law and, somehow, getting their work done."--Provided by publisher

    Abstract: "This sociology of deviance textbook draws on up-to-date scholarship across a spectrum of deviance categories, providing a symbolic interactionist analysis of the deviance process. The book addresses positivistic theories of deviant behavior within a more encompassing description of the deviance process that includes the work of deviance claims-makers, rule-breakers, and social control agents. Cross-cultural and historical treatment of deviance categories provides background for understanding current conceptions of, and responses to, deviance. The book is divided into four parts. Section One introduces students to the sociology of deviance. A sociological approach to deviance is contrasted with popular views of deviants as demonic, mentally ill, and culturally exotic. Sociological methods for studying deviance are described, with particular emphasis on deviance ethnography. Classic positivistic theories of deviant behavior are presented with critique and discussion of revised formulations of the theories. The symbolic interactionist/constructionist approach is presented as a recursive set of processes involving deviance claims-making by moral entrepreneurs, rule-breaking, actions of social control, and stigma management and resistance by those labelled as deviant. Section Two focuses on high consensus criminal deviance, with chapters on murder, rape, street-level property crime, and white collar crime. Chapters in Section Three addresses various forms of lifestyle deviance, including alcohol abuse, drug abuse, and sex work.     Abstract: "Food security is one of the greatest challenges of our time. The food price crisis of 2008 exposed the vulnerabilities of the global food system. Governments across Asia acerbated the crisis by imposing export restrictions based on a policy of self-sufficiency. This book assesses whether self-sufficiency is an adequate response to the food security challenges we face. Pricing volatility drives isolationism at a time when climate change and increasingly uncertain weather patterns make it difficult for any single nation to guarantee adequate food production for itself. Through a collection of commissioned studies which draw upon the experience of leading experts and scholars in trade, investment, law, economics, and food policy, this book analyses the impact of this trend on the most essential crop in the Asian region - rice. It suggests that food security policy should be reconceptualised: from the national to the regional and even the global level. It also provides its own proposals as to how this new paradigm of collective food security should be understood and developed.     Abstract: Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year, tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased control in the 'security society'. Despite the fundamental problems it raises, exclusion from public space has received hardly any attention from legal scholars. This book addresses this gap and comprehensively explores the implications that this new form of intervention has for the constitutional essentials of liberal democracy: the rule of law, fundamental rights, and democracy. To do so, it analyses legal developments in three liberal democracies that have been at the forefront of promoting exclusion measures: the United Kingdom, the United States, and Switzerland.

Staat und Gesellschaft müssen miteinander verknüpft sein, sonst gerät die Legitimation politischer Entscheidungen in Gefahr. Die politische Teilhabe – etwa in Wahlen und Parteien – ist in Deutschland aber eng an die Staatsbürgerschaft geknüpft. Ausländer im rechtlichen Sinne dürfen nicht an allen politischen Entscheidungen mitwirken. Unter den Bedingungen einer fortschreitenden europäischen Integration und einer empirisch evidenten Zuwanderungsgesellschaft stellt sich daher die Frage, wie es um die Legitimation politischer Entscheidungen und um die politisch-demokratische Repräsentation derjenigen bestellt ist, die zwar in Deutschland wohnen, aber de jure nur eingeschränkte Teilhaberechte haben.     Abstract: ‘Crafting humans’ – and its corollary human enhancement – is a contested topic, both in medical sciences and the humanities.     Abstract: A new theory of ethnic cleansing based on the most terrible cases (colonial genocides, Armenia, the Nazi Holocaust, Cambodia, Yugoslavia, Rwanda) and cases of lesser violence (early modern Europe, contemporary India, and Indonesia). Murderous cleansing is modern, 'the dark side of democracy'. It results where the demos (democracy) is confused with the ethnos (the ethnic group). Danger arises where two rival ethno-national movements each claims 'its own' state over the same territory. Conflict escalates where either the weaker side fights because of aid from outside, or the stronger side believes it can deploy sudden, overwhelming force. Escalation is not simply the work of 'evil elites' or 'primitive peoples'. It results from complex interactions between leaders, militants, and 'core constituencies' of ethno-nationalism. Understanding this complex process helps us devise policies to avoid ethnic cleansing in the future

    Abstract: Netwar-like cyberwar-describes a new spectrum of conflict that is emerging in the wake of the information revolution. Netwar includes conflicts waged, on the one hand, by terrorists, criminals, gangs, and ethnic extremists; and by civil-society activists (such as cyber activists or WTO protestors) on the other. What distinguishes netwar is the networked organizational structure of its practitioners-with many groups actually being leaderless-and their quickness in coming together in swarming attacks. To confront this new type of conflict, it is crucial for governments, military, and law enforcement to begin networking themselves.

    Abstract: Broken family bonds can be one of the most intense sources of conflict. This book - which provides vital insights into the dynamics of family and other forms of violence - explores the damage caused to familial and social bonds by escalating feelings of shame during marital quarrels. Theories and research from large-scale conflict, marital dispute and communication processes are reviewed and provide a background for Retzinger's new integrative theory, which focuses on social bonds. The theory is applied to four case studies of marital quarrels in order to advance understanding of the escalation and resolution of conflict. The book includes a description of an intensive case study method for analyzing discourse and provides.
