    Abstract: The unmatched technological achievements in artificial intelligence (AI), robotics, computer science, and related fields over the last few decades can be considered a success story. The technological sophistication has been so groundbreaking in various types of applications that many experts believe that we will see, at some point or another, the emergence of general AI (AGI) and, eventually, superintelligence. This book examines the impact of AI on human rights by focusing on potential risks and human rights legislation and proposes creating a Universal Convention for the Rights of AI Systems (AI Convention). John-Stewart Gordon, PhD in Philosophy, serves as an adjunct full professor at LSMU and has held various academic roles. He's an associate editor at AI & Society, serves on multiple editorial boards, and is the general editor of Brill's Philosophy and Human Rights series. With over 90 publications, John is a prolific contributor to practical philosophy.

    Abstract: What is 'modern slavery' and who is responsible for it? What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

    Abstract: "Genocide is a problem: not only the terrible fact of mass death, but also how the relatively new idea and law of genocide organises and distorts our thinking about civilian destruction. Taking the normative perspective of civilian immunity from military attack, this book argues that the implicit hierarchy of international law, atop which sits genocide as the "crime of crimes," blinds us to other types of humanly caused civilian death, like bombing cities, the "collateral damage" of missile and drone strikes, blockades, and sanctions. In other words, talk of genocide functions ideologically to detract from systematic violence against civilians perpetrated by governments. The Problems of Genocide also contends that this violence is the consequence of "permanent security" imperatives: the striving of states, and armed groups seeking to found states, to make themselves invulnerable to threats. To solve the problems of genocide, this book proposes replacing it with permanent security, which should be criminalized"--

    Abstract: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.

    Abstract: Das Buch untersucht das menschenrechtliche Verbot der Diskriminierung aufgrund der Rasse einschließlich der Schutzvorschriften gegen Hassrede und beleuchtet umfassend die relevanten Entscheidungen unterschiedlicher nationaler und internationaler Gerichte. Es folgt dabei einem interdisziplinären und rechtsvergleichenden Ansatz, der sozial- und kulturwissenschaftliche Theorien und Befunde einbezieht, um rechtsdogmatische Fragen im Bereich des Antidiskriminierungsrechts zu erörtern. Die Entscheidungen ausländischer Gerichte werden schlaglichtartig dargestellt, soweit sie für die Analyse relevant sind. Zugrunde liegt die Frage, was heute unter Rassismus zu verstehen ist und ob Phänomene wie Ausländer- und Fremdenfeindlichkeit sowie Rechtsextremismus darunter fallen. Insbesondere Rasse als Rechtsbegriff wird ausführlich besprochen. Zentrale Bezugspunkte für die folgende Auseinandersetzung mit dem „Recht gegen rassische Diskriminierung“ sind die Europäische Rasserichtlinie (Richtlinie 2000/43/EG), die Antirassismuskonventionen der Vereinten Nationen und die Europäische Menschenrechtskonvention (EMRK). Das deutsche Grundgesetz wendet sich in Art. 3 Abs. 3 S. 1 GG gegen Rassismus, aber eine umfangreiche Dogmatik, die dem heutigen Phänomen des Rassismus gerecht werden kann, fehlt. Das vorliegende Werk leistet mithilfe eines menschenrechtsinformierten und differenzierten Verständnisses von Rassismus hierzu einen wichtigen Beitrag. Damit soll die These begründet werden, dass nur ein strukturelles Verständnis von Rassismus das Recht gegen Rassismus wirksam werden lässt.

Internet companies manage the web-based public infrastructure, the public sphere, and public life. As such, their practices have significant consequences for human rights, both in terms of the opportunities they offer and the potential harm they can cause. At the same time, human rights law is state-centric in nature and holds no direct obligations for companies. This book takes the necessary step of examining the role, responsibilities and practices of these private actors vis-à-vis human rights standards and norms. Part of public life and discourse has always unfolded within commercial domains, but the current situation is different in scope and character. In the online realm the vast majority of social interactions, discussions, expressions, controversies, etc. take place within platforms and services provided for by private companies. Moreover, the communications that people provide when socializing online are an essential part of the online business model, used to generate revenue. As such, it is a fundamentally different business model than that of mass media in the pre-internet age. Where newspaper revenue is linked to selling a relatively well-known product, the revenue model of a social media platform is intrinsically linked to the communications, behavior and social life of its users in a way that is largely invisible to the user. Das Buch zeigt auf, inwiefern die beschleunigenden Maßnahmen in der Gesamtschau als ungenügend im Sinne der Rechtsschutzanforderungen der EMRK bewertet werden müssen. Auch andere Rechtsordnungen legen den Fokus auf Prävention oder Kompensation. Umfassender Rechtsschutz ist aber nur in der Kombination zu gewährleisten.     Abstract: Das Buch untersucht mit der Margin of Appreciation eine der bekanntesten und doch umstrittensten Rechtsfiguren der Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte. Es entwickelt eine schlüssige Kritik ihrer bisherigen dogmatischen Fassung und zugleich einen praktisch anschlussfähigen Vorschlag für eine Neuaufstellung der überkommenen Doktrin. Bestehende kritische Ansätze des bisherigen Schrifttums werden aufgearbeitet, weiterentwickelt und mit besonderer Konsequenz angewandt. Die Autorin wählt dabei einen methodischen Zugriff auf mittlerer Abstraktionshöhe, der es ermöglicht, sowohl die konkrete Rechtsprechungspraxis zu berücksichtigen, als diese auch mit abstrakten, vornehmlich demokratietheoretischen Einwänden zu konfrontieren. Durch eine radikale Reduktion derjenigen Faktoren, die nach überkommener Auffassung für Übung und Umfang richterlicher Zurückhaltung maßgeblich sind, wird die Margin of Appreciation im Ergebnis entschieden verschlankt und rationalisiert.

    Abstract: Dieses Buch behandelt die völkerrechtliche Immunität von Staaten und ihren Untergliederungen gegen hoheitliche Zwangsmaßnahmen anderer Staaten. Solche Maßnahmen umfassen jegliche Zugriffe auf staatliches Vermögen, die in gerichtlichen Vollstreckungs- und Anspruchssicherungsverfahren vorgenommen werden. Diese Immunität hat mit einem sich wandelnden Souveränitätsverständnis im Völkerrecht kontinuierlich Modifikationen erfahren, die sich zunächst in Ausnahmen für privatwirtschaftliches Handeln des Staates und später in Ansätzen zur normativen Einschränkung der Immunität nach schweren Völkerrechtsbrüchen äußerten. In diesem Buch werden die Entstehung und der aktuelle völkerrechtliche Gehalt der Vollstreckungsimmunität und ihrer Einschränkungen aus verschiedenen Quellen ermittelt. Zuvorderst wird die nationale Gesetzgebungs- und Spruchpraxis verschiedener Staaten untersucht und verglichen. Auch internationale Kodifikationen zur Staatenimmunität, vor allem die United Nations Convention on Jurisdictional Immunities of States and Their Property, und das Urteil des Internationalen Gerichtshofs im Fall "Jurisdictional Immunities of the State" aus dem Jahre 2012 werden im Zusammenhang dargestellt. Anders als die kommerzielle Ausnahme zur Vollstreckungsimmunität lässt sich eine Ausnahme für die Aufarbeitung schwerer Völkerrechtsbrüche nicht auf eine gewachsene Staatenpraxis stützen, sondern wird in der Literatur mit dogmatischen Argumenten begründet. Hierzu zählen die Heranziehung einer Normenhierarchie, übergreifender Gerechtigkeitsargumente oder des völkerrechtlichen Instruments der Gegenmaßnahme ebenso wie die Darstellung, die der Staatenimmunität eine Kollision mit fundamentalen Menschenrechten attestiert und diesen Normenkonflikt zulasten der Immunität auflöst. Diese Ansätze werden im vorliegenden Buch eingehend auf ihre Stichhaltigkeit nach dem geltenden Völkerrecht untersucht und auf die besondere Situation einer Geltendmachung der Vollstreckungsimmunität übertragen. Schließlich gibt das Werk einen Überblick über die Völkerrechtsentwicklung und das aus ihr jeweils folgende Souveränitäts- und Immunitätsverständnis. Aus dieser Analyse heraus werden Prognosen und Vorschläge dafür erarbeitet, wie sich die Staaten- und Vollstreckungsimmunität - als Ausfluss der staatlichen Souveränität - zukünftig im völkerrechtlichen Gefüge positionieren kann und welche Ansätze dazu genutzt werden könnten, auftretende Adjudikations- und Vollstreckungsdefizite völkerrechtskonform zu bewältigen.

Das Buch untersucht privatrechtliche und völkerrechtliche Strategien. Anhand ausgewählter Ansätze kommt die Autorin zu dem Ergebnis, dass keine rechtliche Notwendigkeit für den gegenwärtigen Zustand eines defizitären Schutzes vor Menschenrechtsverletzungen im Zusammenhang mit wirtschaftlichen Aktivitäten von Unternehmen besteht.     Abstract: David Jungbluth zeigt auf, dass zeitgleich mit dem Entstehen des Begriffs der „Wirtschaftsverfassung“ die Auseinandersetzung um dessen Inhalt begann. Insofern wird herausgearbeitet, dass sowohl die von der Weimarer Nationalversammlung als auch die vom Parlamentarischen Rat getroffenen wirtschaftssystematischen Entscheidungen von Weimar bis heute im Rahmen der Verfassungsexegese immer wieder ignoriert wurden. Die Analyse gibt daher Anlass zu hinterfragen, inwieweit die Verfassungsinterpretation das erforderliche Mindestmaß an Zurückhaltung sowohl gegenüber dem Verfassungsgeber wie auch gegenüber dem Entscheidungsspielraum des wirtschaftspolitischen Gesetzgebers aufzubringen bereit ist, und inwieweit, losgelöst vom konkreten Sujet der Untersuchung, eine sich selbst als objektiv klassifizierende Verfassungsauslegung überhaupt als eine solche neutraler Provenienz bezeichnet werden kann.     Abstract: Warfare in the twenty-first century presents significant challenges to the modern state. Serious questions have arisen about the use of drones, target selection, civilian exposure to harm, intervening for humanitarian reasons, and war as a means of forcing regime change. In Just War and Human Rights Todd Burkhardt argues that updating the laws of war and reforming just war theory is needed. A twenty-year veteran of the US Army, Burkhardt claims that war is impermissible unless it is engaged, fought, and concluded with right intention. A state must not only have a just cause and limit its war-making activity in order to vindicate the just cause, but it must also seek to vindicate its just cause in a way that yields a just and lasting peace. A just and lasting peace is motivated by the just war tenet of right intention and predicated on the realization of human rights. Therefore, human rights should not only dictate how a state treats its own people but also how a state treats the people of other countries, insulating them and protecting innocent civilians from the harms of war. --

    Abstract: Christina Hellrung untersucht, ob die Anforderungen der UN-Behindertenrechtskonvention an ein inklusives Zusammenleben von Kindern mit und ohne Behinderungen im Sozialrecht verwirklicht werden können. Vor dem Hintergrund des völkerrechtlichen Verständnisses von Inklusion, Exklusion und Behinderung werden unterschiedliche Facetten vom Recht des Kindes mit Behinderung auf Inklusion sowie dessen verfassungsrechtliche Verankerung aufgezeigt. Ausgehend von der Fürsorgeentwicklung im deutschen Behindertenrecht wird die im SGB VIII und SGB XII geregelte Eingliederungshilfe für Kinder mit Behinderungen unter kritischer Betrachtung der bestehenden rechtlichen Abgrenzungsprobleme an der Schnittstelle medizinischer, sozialer und schulischer Rehabilitation auf ihr Inklusionspotenzial untersucht. Dabei werden auch die geplanten Reformbestrebungen im Bundesteilhabegesetz kritisch auf den Prüfstand genommen.     Abstract: Die Piraterie rückte durch eine Häufung von Übergriffen auf Handelsschiffe vor der Küste Somalias verstärkt in das Blickfeld der Staatengemeinschaft. Eilig wurde der Entschluss gefasst, dem Problem auch mit Strafverfolgung beizukommen. Nach einer Phase der Orientierung einigte sich die Weltgemeinschaft auf die Regionalisierung des Problems - also die Verlagerung der Strafverfolgung und des Strafvollzugs auf Anrainerstaaten des Indischen Ozeans.     Abstract: This volume analyses the legal grounds, premises and extent of pecuniary compensation for violations of human rights in national legal systems. The scope of comparison includes liability regimes in general and in detail, the correlation between pecuniary remedies available under international law and under domestic law, and special (alternative) compensation systems. All sources of human rights violations are embraced, including historical injustices and systematical and gross violations. The book is a collection of nineteen contributions written by public international law, international human rights and private law experts, covering fifteen European jurisdictions (including Central and Eastern Europe), the United States, Israel and EU law. The contributions, initially prepared for the 19th International Congress of Comparative law in Vienna (2014), present the latest developments in legislation, scholarship and case-law concerning domestic causes of action in cases of human rights abuses. The book concludes with a comparative report which assesses the developments in tort law and public liability law, the role of the constitutionalisation of the right to damages as well as the court practice related to the process of enforcement of human rights through monetary remedies. This country-by-country comparison allows to consider whether the value of protection of human rights as expressed in international treaties, ius cogens and in national constitutional laws justifies the conclusion that the interests at stake should enjoy protection under the existing civil liability rules, or that a new cause of action, or even a whole new set of rules, should be created in national systems.

    Abstract: This book looks at the centerpiece of the international women’s rights discourse, the Convention on the Elimination of all Forms of Discrimination against Women (CEDAW), and asks to what extent it affects the lives of women worldwide. Rather than assuming a trickle-down effect, the author discusses specific methods which have made CEDAW resonate. These methods include attempts to influence the international level by clarifying the meaning of women’s rights and strengthening the Convention’s monitoring procedure, and building connections between international and domestic contexts that enable diverse actors to engage with CEDAW. This analysis shows that while the Convention has worldwide impact, this impact is fundamentally dependent on context-specific values and agency. Hence, rather than thinking of women’s rights exclusively as normative content, Zwingel suggests to see them as in process. This book will especially appeal to students and scholars interested in transnational feminism and gender and global governance

    Abstract: The book examines the rights of defendants in infringement procedures and those of the notifying parties in merger proceedings before the European Commission and the Chinese competition authorities. The initial chapters offer a general introduction to EU and Chinese competition law respectively, paying particular attention to the substantive rules of competition law. Subsequent chapters present an overview of the procedural rights of the notifying parties in merger cases in both legal systems surveyed, address the procedural rights of defendants in infringement cases, and provide an international perspective on differences in the notification and enforcement procedures between legal systems. The final chapter draws comparative conclusions and includes a number of suggestions for improvement.

    Abstract: This book investigates how human rights law can be applied to corporate entities. To date there have been insufficient international legal mechanisms to bring corporations to justice for their misconduct abroad. The book argues that rather than trying to solve the problem locally, an international approach to corporate human rights compliance needs to be sought to prevent future corporate human rights abuses. Implementing effective and enforceable human rights compliance policies at corporate level allows businesses to prevent negative human rights impacts such as loss of revenue, high litigation costs and damage to reputation. By considering human rights to be an inherent part of their business strategy, corporations will be well equipped to meet national and regional business and human rights standards, which will inevitably be implemented in the next few years. This approach, in turn, also furthers the fundamental aim of international human rights law.

    Abstract: In this book various perspectives on fundamental rights in the fields of public and private international law are innovatively covered.     Abstract: This book brings together a number of perspectives on how different European states have responded to the phenomenon of football crowd disorder and violence, or “hooliganism”. It applies a comparative legal approach, with a particular focus on civil and human rights, to analyze domestic legislation, policing and judicial responses to the problem of “football hooliganism” in Europe. Academics and legal professionals from eight different European countries introduce and analyze the different approaches and draw together common themes and problems from their various jurisdictions.     Abstract: This work compiles experiences and lessons learned in meeting the unique needs of women and children regarding crime prevention and criminal justice, in particular the treatment and social reintegration of offenders and serves as a cross-disciplinary work for academic and policy-making analyses and follow-up in developing and developed countries. Furthermore, it argues for a more humane and effective approach to countering delinquency and crime among future generations. In a world where development positively depends on the rule of law and the related investment security, two global trends may chart the course of development: urbanization and education. Urbanization will globalize the concepts of “justice” and “fairness”; education will be dominated by the urban mindset and digital service economy, just as a culture of lawfulness will. This work looks at crime prevention education as an investment in the sustainable quality of life of succeeding generations, and at those who pursue such crime prevention as the providers of much-needed skills in the educational portfolio. Adopting a reformist approach, this work collects articles with findings and recommendations that may be relevant to domestic and international policymaking, including the United Nations Studies and their educational value for the welfare of coming generations. The books address the relevant United Nations ideas by combining them with academic approaches. Guided by the Editors’ respective fields of expertise, and in full recognition of academic freedom and “organized scepticism”, it includes contributions by lawyers, criminologists, sociologists and other eminent experts seeking to bridge the gap between academic and policy perspectives, as appropriate, against the international background, including the United Nations developments. The second volume opens with Part IV, which presents articles on different kinds of crime prevention. The effectiveness of punishment and, in particular, imprisonment is examined by contrasting it with alternative sanctions and the following questions are raised: Does harsh punishment have a crime preventive effect? What are the side effects of imprisonment on the offenders and their families? Are alternatives, such as restorative justice or mediation, more effective and cheaper? Part V outlines proactive strategies of crime prevention, e.g. for potential sex offenders or in the domain of internet crime. Part VI envisions a more peaceful and inclusive society, which would be realized by improving the protection of women and children in their everyday life, and easing the reintegration of those who have become offenders. The importance of the role played by the UN in formulating these goals is underlined. The volume concludes with an epilogue of the 70th President of the United Nations Economic and Social Council, Martin Sajdik, and a post scriptum of the editors.

    Abstract: This book explores the EU law notion of ‘individual rights’. It examines which sorts of rules grant EU legal rights to individuals, how it is decided if a right is conferred, and which individuals may claim the judicial protection of a right. It further discusses the legal implications and consequences of holding an EU legal right with respect to the interpretation and application of EU law in general and to specific remedies such as declaratory remedies, injunctions, restitution and damages. On a more overarching level, the book explores the question of how the idea of EU law rights relates to other fundamental EU law concepts such as the principles of effectiveness and direct effect, and discusses the legal stringency of the EU courts’ ‘rights language’ in light of the overall aim of European integration. It thus contributes to the body of literature that aims to shed new light on the borders of the sui generis legal order that is EU law.

    Abstract: The European Court of Human Rights has long abandoned the view that human rights merely impose obligations of restraint on State authorities (so-called negative obligations). In addition, States are under positive obligations to take steps to actively protect and ensure the rights and freedoms guaranteed by the European Convention on Human Rights. While the concept of positive obligations has become increasingly important in the jurisprudence of the European Court, it remains relatively underexplored in the literature. This book goes beyond the existing scholarship by analytically, critically and normatively engaging with the Courts positive obligations case law in a comprehensive and in-depth manner. The book begins by providing an overview of the Courts jurisprudence in this area. Building upon this overview, it brings to the fore the legal methodological consequences attached by the Court to the labels of positive and negative obligations. It moreover critically examines how the Court constructs the distinction between positive and negative obligations, building upon the underlying distinctions between public authorities and private entities, on the one hand, and State action and inaction, on the other. The central argument made in this volume is that in a positive State, in which the authorities have affirmatively intervened in so many areas, it has become increasingly difficult to draw a baseline to properly distinguish between action and inaction. Finally, the author makes suggestions for legal methodological change. This book will prove to be highly valuable for any practitioner or academic interested in the law of the European Convention on Human Rights.--

    Abstract: The European system of human rights protection faces institutional and political pressures which threaten its very survival. These institional pressures stem from the backlog of applications before the European Court of Human Rights, the large number of its judgments that remain unimplemented, and the political pressures that arise from sustained attacks on the Court's legitimacy and authority, notably from politicians and jurists in the United Kingdom. This book addresses the theme which lies at the heart of these pressures: the role of national parliaments in the implementation of judgments of the Court. It combines theoretical and empirical insights into the role of parliaments in securing domestic compliance with the Court's decisions, and provides detailed investigation of five European states with differing records of human rights compliance and parliamentary mobilisation: Ukraine, Romania, the United Kingdom, Germany, and the Netherlands. How far are parliaments engaged in implementation, and how far should they be? Do parliaments advance or hinder human rights compliance? Is it ever justifiable for parliaments to defy judgments of the Court? And how significant is the role played by the Parliamentary Assembly of the Council of Europe? Drawing on the fields of international law, international relations, political science, and political philosophy, the book argues that adverse human rights judgments not only confer obligations on parliamentarians but also create opportunities for them to develop influential interpretations of human rights and enhance their own democratic legitimacy. It makes an authoritative contribution to debate about the future of the European and other supranational human rights mechanisms and the broader relationship between democracy, human rights, and legitimate authority

    Abstract: The discourse on the human right to water presents deliberations on the concept, content and rationale for the right, with little attention to the practical question of translating the right into reality. This book aims to fill this void by focusing on ‘realization’ of the right by its holders, examining how effective the mechanisms are for ‘implementing’ the right in enabling its universal realization. In a quest to answer this question, the book draws a conceptual differentiation between ‘implementation’ and ‘realization’ of the right, arguing that unlike implementation - which is an objective process of creation - and implementation of measures such as legal frameworks, institutional structures or policy and action guidelines, realization of the right is a subjective process that extends much beyond. It takes shape within specific contextual settings which may include varied situations, yet remains neglected in the related academic and action forums. This book attempts to address this void by discussing some of the most significant contexts and the underlying problems and concerns that strongly influence realization of the human right to water. It contends that if the right is to be truly realized, these different contexts - which can be further classified as 'objective' and 'subjective' - must be understood, analysed and appropriately addressed before framing and implementing relevant action. The book further situates the human right to water discourse in a broader interdisciplinary perspective, expanding its scope beyond the narrower legal dimensions, linking it to the wider field of water resources management/governance. Through the novel ideas it proposes, the book makes an innovative and unique contribution in the field of human right to water which is of great scientific value

    Abstract: Given the popularity of drones and the fact that they are easy and cheap to buy, it is generally expected that the ubiquity of drones will significantly increase within the next few years. This raises questions as to what is technologically feasible (now and in the future), what is acceptable from an ethical point of view and what is allowed from a legal point of view. Drone technology is to some extent already available and to some extent still in development. The aim and scope of this book is to map the opportunities and threats associated with the use of drones and to discuss the ethical and legal issues of the use of drones. This book provides an overview of current drone technologies and applications and of what to expect in the next few years. The question of how to regulate the use of drones in the future is addressed, by considering conditions and contents of future drone legislation and by analyzing issues surrounding privacy and safeguards that can be taken. As such, this book is valuable to scholars in several disciplines, such as law, ethics, sociology, politics and public administration, as well as to practitioners and others who may be confronted with the use of drones in their work, such as professionals working in the military, law enforcement, disaster management and infrastructure management. Bart Custers PhD MSc LLM is associate professor and head of research at eLaw, the Center for Law and Digital Technologies at Leiden University, the Netherlands. With a background in both law and physics, his research is focused law and digital technologies. He is also the former head of the research division on Crime, Law Enforcement and Sanctions of the research center (WODC) of the Ministry of Security and Justice in the Netherlands. His research interests include discrimination and privacy issues of new technologies, particularly data mining and profiling, and technology in policing. His research in the area of criminal law is focused on technologies that may contribute to law enforcement, criminal investigation and prosecution. Examples of such technologies are Automated Number Plate Recognition (ANPR), wiretapping, fingerprints, forensic DNA research, database coupling, data mining and profiling, camera surveillance, network analyses and the use of drones.Dr. Custers has published two books on discrimination and privacy in the context of Big Data. In 2015 he co-authored (in Dutch) a book on the use of drones. On a regular basis he gives lectures on profiling and privacy issues of new technological developments. He presented his work at international conferences in the United States, China, Japan, the Middle East and throughout Europe. He has published his work, over 80 publications, in both scientific and professional journals and newspapers.

    Abstract: This book focuses on the most important implications of the "fair hearing" right for conducting civil proceedings. It provides a thorough and critical analysis of the case law of the European Court of Human Rights (the Strasbourg Court) regarding Article 6 of the European Convention on Human Rights. It puts forward a generally applicable framework for the analysis of the various procedural issues to which the "fair hearing" right may give rise, then applies that framework to discuss a selection of specific procedural issues. The book investigates several important questions of general scope in the context of ECHR Article 6, such as: What is the relevance of case law regarding criminal proceedings when the "fair hearing" right is applied to civil proceedings? How does the Strasbourg Court actually proceed when evaluating whether specific court proceedings have been "fair"? What are the roles of fundamental concepts such as the "margin of appreciation" and proportionality in this regard? In the subsequent discussion of specific procedural issues, the focus is on the balance that must be struck between procedural safeguards and the objectives of efficiency and economy. The book considers specific procedural issues such as: When must an oral hearing be held in order for civil proceedings to be "fair"? When will a refusal of specific evidence render civil proceedings unfair? When is a civil litigant entitled to l egal aid? As such, the book not only presents current case law; it also compares various strands of the case law regarding the "fair hearing" right, and argues that the Strasbourg Court's approach to various pertinent issues needs to become more consistent. Offering an in-depth examination of the Strasbourg Court's case law regarding ECHR Article 6, this book should be consulted by anyone interested in fundamental fair trial rights.

    Abstract: This book addresses the interpretation and application of human rights norms by International Criminal Tribunals (ICTs). Such Tribunals are widely heralded as human rights defenders. At the same time, however, they employ activities that necessary entail the risk of human rights violations: they conduct criminal investigations, arrest and detain individuals, and put them on trial. This book investigates this flip-side of the ICTs’ relationship with international human rights law, and focuses on the ICTs’ own interpretation and application of human rights norms. First, the book addresses whether and how ICTs are bound by human rights law, since unlike states they do not sign or ratify human rights conventions. Second, the book provides an in-depth analysis of the way in which ICTs interpret and apply human rights norms, compared to the way in which these norms are interpreted in a traditional state-context. Relying on the unique circumstances in which they operate, ICTs have often deviated from generally accepted interpretations of human rights. The author critically examines this so-called contextual approach and seeks to recommend ways in which ICTs can improve their interpretative practice by giving due regard to the context in which they operate, while still providing adequate human rights protection. Addressing the ICTs’ possible leeway in terms of contextualization, this book contributes to the broader debate about adherence to human rights norms in international law. Krit Zeegers is an Associate at Allen & Overy LLP, Amsterdam, and previously worked as a researcher / junior lecturer at the University of Amsterdam.
