    Abstract: This monograph addresses the question: what was the role played by the judiciary in the reforms undertaken by the Second Spanish Republic? To answer this question, it analyses numerous documentary sources concerning the way in which the courts and tribunals interpreted some of the major regulatory and institutional changes promoted by the Republican regime within the framework of the social and democratic constitutionalism of the interwar period. The study of a sample of the separation of Church and State, regional autonomy, the abuse of government detentions and the new law on vagrants and thugs makes it possible to identify a profound conflict between the judicial apparatus and the incipient constitutional state
