    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.     Abstract: This volume analyzes the development of the reactions to Covid-19 by governments, the public and the crime patterns in 16 European countries. All countries are members of the European Union and share common European norms and values, but the Covid-19 pandemic can serve as an example of how these norms and values are interpreted differently with regard to people’s trust in public institutions, governmental control strategies, dealing with fear, anxiety and other emotional responses to the new virus, crime patterns and law enforcement priorities to prevent and combat them. The volume provides empirical data based on available statistics, media analysis and qualitative data from interviews and observations, and examines the similarities and differences in crime patterns and the consequences for local communities and law enforcement priorities. .

    Abstract: The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. Evidenced based outcomes and disparities between heterosexual and LGBTQ populations are carefully delineated to provide a legal rationale for a compelling governmental interest, and policy recommendations are provided - including overdue federal legislation to prohibit discrimination based on sexual orientation.     Abstract: "The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. Evidenced based outcomes and disparities between heterosexual and LGBTQ populations are carefully delineated to provide a legal rationale for a compelling governmental interest, and policy recommendations are provided - including overdue federal legislation to prohibit discrimination based on sexual orientation.     Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it.     Abstract: "Why should we care about religious liberty? Leading commentators, United Kingdom courts, and the European Court of Human Rights have de-emphasised the special importance of religious liberty. They frequently contend it falls within a more general concern for personal autonomy. In this liberal egalitarian account, religious liberty claims are often rejected when faced with competing individual interests - the neutral secular state must protect us against the liberty-constraining acts of religions. Joel Harrison challenges this account. He argues that it is rooted in a theologically derived narrative of secularisation: rather than being neutral, it rests on a specific construction of 'secular' and 'religious' spheres. This challenge makes space for an alternative theological, political, and legal vision. Drawing from Christian thought, from St Augustine to John Milbank, Harrison develops a post-liberal focus on association. Religious liberty, he argues, facilitates creating communities seeking solidarity, fraternity, and charity - goals that are central to our common good"--

Citizenship was once an exceptional status, a kind of aristocracy of the ancient world in which freedom and political voice were not taken for granted. Even as the nation-state emerged as the primary form of human association, citizenship remained an anomalous status, reserved for the few who were privileged as such in republican democracies. More recently, it has been the individual marker of membership in all national communities. It is generic; almost everyone has it, hence the ubiquity that has made it sometimes unseen.     Abstract: "This book compares the rights and social inclusion of two racialized minority groups: Roma in Central and Southeast Europe ("CSEE") and African Americans in the United States ("U.S."), primarily in the American South.     Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

Gegenstand seiner Untersuchung sind Deutschland, die USA und die EU. Als Alternative zu einem verbreiteten staats- und souveränitätszentrierten Verständnis schlägt er eine föderale Theorie der Mehrebenen-Grundrechtsjudikatur vor. Mit einer solchen föderalen Sichtweise lassen sich dogmatische Figuren, über die Anwendungsbereiche, Kontrollmaßstäbe und -intensität definiert werden, als Ausdruck der institutionellen Strukturen und der Interaktion der beteiligten Gerichte begreifen. Praktischer Ertrag der Forschung sind Vorschläge, die Gerichten in Mehrebenen-Strukturen Orientierung bieten können, vor allem angesichts der aktuellen Herausforderungen, mit denen der Grundrechtsschutz in Europa konfrontiert ist.
    Abstract: Thomas Kleinlein examines the federal fundamental rights systems of Germany, the USA and the EU, comparing their varying potential for a dialogic and pluralistic judicature. His resulting suggestions could serve as guidelines for action in multilayered structures.
