    Abstract: There is a highly significant and under-considered intersection and interaction between migration law and labour law. Labour lawyers have tended to regard migration law as generally speaking outside their purview, and migration lawyers have somewhat similarly tended to neglect labour law. The culmination of a collaborative project on 'Migrants at Work' funded by the John Fell Fund, the Society of Legal Scholars, and the Research Centre at St John's College, Oxford, this volume brings together distinguished legal and migration scholars to examine the impact of migration law on labour rights and how the regulation of migration increasingly impacts upon employment and labour relations. Examining and clarifying the interactions between migration, migration law, and labour law, contributors to the volume identify the many ways that migration law, as currently designed, divides the objectives of labour law, privileging concerns about the labour supply and demand over worker-protective concerns. In addition, migration law creates particular forms of status, which affect employment relations, thereby dividing the subjects of labour law. Chapters cover the labour laws of the UK, Australia, Ireland, Israel, Italy, Germany, Sweden, and the US. References are also made to discrete practices in Brazil, France, Greece, New Zealand, Mexico, Poland, and South Africa. These countries all host migrants and have developed systems of migration law reflecting very different trajectories. Some are traditional countries of immigration and settlement migration, while others have traditionally been countries of emigration but now import many workers. There are, nonetheless, common features in their immigration law which have a profound impact on labour law, for instance in their shared contemporary shift to using temporary labour migration programmes

    Abstract: Ausgehend von der klassischen Annahme Max Webers, wonach Herrschaft im Alltag Verwaltung sei, analysiert der Sammelband Kommunikationsprozesse zwischen Herrschaft, Administration und Administrierten in europäischen Territorien der Frühen Neuzeit. Der verbreiteten Vorstellung, dass diese Kommunikationsprozesse weitgehend von Befehl und Gehorsam bestimmt waren, setzen die in diesem Band versammelten Einzelstudien differenzierte historische Analysen der Konstellationen und Dynamiken des Dreiecksverhältnisses entgegen. Die Beiträge widmen sich den spezifischen Formen und Verfahren der Kommunikation zwischen Landesherrn, Verwaltungen und Untertanen, und befassen sich mit deren sprachlicher Ausgestaltung.     Abstract: ‘Crafting humans’ – and its corollary human enhancement – is a contested topic, both in medical sciences and the humanities.     Abstract: Is there universalism of human rights? If so, what are its scope and limits? This book is a doctrinal attempt to define universalism of human rights, as well as its scope and limits. The book presents tests of universalism on international, regional and national constitutional levels. It is maintained that universalism of human rights is both a concept and a normative reality. The normative character of human rights is scrutinized through the study of international and regional agreements as well as national constitutions. As a consequence, limitations of normativity are identified, usually on the international level, and take the form of exceptions, reservations, and interpretations.     Abstract: This book is a comparative study of the exclusion of illegally gathered evidence in the criminal trial , which includes 15 country studies, a chapter on the European Court of Human Rights, and a comparative synthetic conclusion. No other book has undertaken such a broad comparative study of exclusionary rules, which have now become a world-wide phenomenon. The topic is one of the most controversial in criminal procedure law, because it reveals a constant tension between the criminal court’s duty to ascertain the truth, on the one hand, and its duty to uphold important constitutional rights on the other, most importantly, the privilege against self-incrimination and the right to privacy in one's home and one's private communications. The chapters were contributed by noted world experts on the subject for the XVIII Congress of the International Academy of Comparative Law in Washington in July 2010.

    Abstract: Since the turn of the Millennium, world-wide initiatives from the private sector have turned the regulatory environment for food businesses upside down. For the first time in legal literature this book analyses private law initiatives relating to the food chain, often referred to as private (voluntary) standards or schemes.Private standards are used to remedy flaws in legislation in order to reach higher levels of consumer protection than the ones chosen by the EU legislature and to manage risks and liability beyond the traditional limits of food businesses. We see that litigation is no longer solely framed by legislative requirements, but ever more by private standards such as GlobalGAP, BRC, IFS, SQF and ISO. These private standards incorporate public law requirements thus embedding them in contractual relations and exporting them beyond the jurisdiction of public legislators. This book also addresses how private standards play a role in defining specific markets of growing importance. It is noted that organic standards have found an interesting symbioses with public law.Another development on this topic is that food businesses are inspected more often by private auditors than by public inspectors. Effects in terms of receiving or being denied certification far outweigh public law sanctions. In short private law has changed an entire legal infrastructure for the food sector. It emerges as competing with the public law regulatory infrastructure.This book is of interest to all who concern themselves with food law legislation and litigation and the evolving role of private standards on changing the landscape of food chains and innovation

Warum sind männliche Jugendliche erheblich häufiger delinquent als weibliche? Die Beiträge dieses Bandes stellen mögliche Ursachen, den unterschiedlichen Verlauf, die verschiedenen Folgen sowie die Behandlungsmöglichkeiten für die weiblichen oder männlichen Jugendlichen dar. Zwei Aspekte treten in den Vordergrund: - Die schon im frühen Kindesalter relevanten neurobiologischen Ursachen delinquenten Verhaltens betreffen überwiegend männliche Jugendliche. - Die sozialen Bedingungen dissozialer Entwicklung haben mehr Auswirkungen auf die Sozialisation bei männlicher Delinquenz; bei weiblichen Jugendlichen gibt es im sozialen Umfeld während der gesamten Entwicklung deutlich mehr Unterstützung für eine sozial unauffällige Entwicklung.     Abstract: The international carriage of goods by sea has been regulated by international conventions. These include the "International Convention for the Unification of Certain Rules of Law relating to Bills of Lading" ("Hague Rules"); the "Protocol to Amend the International Convention for the Unification of Certain Rules of Law Relating to Bills of Lading" ("Visby Rules"); and the "UN Convention on the Carriage of Goods by Sea." They were adopted in 1924, 1968 and 1978 respectively and the transport industry's commercial needs have since substantially changed. Furthermore the advent of subsequent regimes has resulted in the uniformity in the carriage of goods by sea once provided by the Hague Rules being lost. In order to update and modernize existing regimes the "UN Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea" ("Rotterdam Rules") was adopted on December 11, 2008 by the UN General Assembly and opened for signature on September 23, 2009. Since then drafters of the Rotterdam Rules, academics and practitioners have been publicizing, discussing, and evaluating the Rules. This book is an effort to further explore those same goals.

Fragen seiner verfassungsrechtlichen Grundierung und seiner verwaltungsrechtlichen Feinzeichnung sind so umstritten wie lange nicht. Das Leitmotiv, ob das heutige Wissenschaftsrecht in erster Linie dem Schutz der individuellen Forschungsleistungen einzelner Wissenschaftlerinnen und Wissenschaftler dient oder ein Baukasten zur Modernisierung der Hochschulen ist, führt wiederkehrend zu den Grundfragen des modernen Öffentlichen Rechts. Diese Entwicklungen vor Augen beging das Institut für Öffentliches Recht an der Juristischen Fakultät der Georg-August-Universität Göttingen seine Neugründung mit einer Arbeitstagung zum Thema Aktuelle Probleme des Wissenschaftsrechts.     Abstract: Summary: Despite the crucial role played by both law and architecture in Roman culture, the Romans never developed a type of building that was specifically and exclusively reserved for the administration of justice: courthouses did not exist in Roman antiquity. The present volume addresses this paradox by investigating the spatial settings of Roman judicial practices from a variety of perspectives. Scholars of law, topography, architecture, political history, and literature concur in putting Roman judicature back into its concrete physical context, exploring how the exercise of law interacted with the environment in which it took place, and how the spaces that arose from this interaction were perceived by the ancients themselves. The result is a fresh view on a key aspect of Roman culture
