    Abstract: A panoramic history of rules in the Western worldRules order almost every aspect of our lives. They set our work hours, dictate how we drive and set the table, tell us whether to offer an extended hand or cheek in greeting, and organize the rites of life, from birth through death. We may chafe under the rules we have, and yearn for ones we don’t, yet no culture could do without them. In Rules, historian Lorraine Daston traces their development in the Western tradition and shows how rules have evolved from ancient to modern times. Drawing on a rich trove of examples, including legal treatises, cookbooks, military manuals, traffic regulations, and game handbooks, Daston demonstrates that while the content of rules is dazzlingly diverse, the forms that they take are surprisingly few and long-lived.Daston uncovers three enduring kinds of rules: the algorithms that calculate and measure, the laws that govern, and the models that teach. She vividly illustrates how rules can change—how supple rules stiffen, or vice versa, and how once bothersome regulations become everyday norms. Rules have been devised for almost every imaginable activity and range from meticulous regulations to the laws of nature.     Abstract: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law. While the primary focus is a philosophical one, authors also engage in incisive analyses of historical, political and/or legal developments in their chosen countries.     Abstract: Over the last two decades, fighting modern slavery and human trafficking has become a cause célèbre. Yet large numbers of researchers, non-governmental organizations, trade unions, workers, and others who would seem like natural allies in the fight against modern slavery and trafficking are hugely skeptical of these movements. They object to how the problems are framed, and are skeptical of the "new abolitionist" movement. Why? This book tackles key controversies surrounding the anti-slavery and anti-trafficking movements head on. Champions and skeptics explore the fissures and fault lines that surround efforts to fight modern slavery and human trafficking today. These include: whether efforts to fight modern slavery displace or crowd out support for labor and migrant rights; whether and to what extent efforts to fight modern slavery mask, naturalize, and distract from racial, gendered, and economic inequality; and whether contemporary anti-slavery and anti-trafficking crusaders' use of history are accurate and appropriate

    Abstract: Usually, when we discuss racial injustice, we discuss racism in our public or political life. This means that we often focus on how the state discriminates on the basis of race in its application and enforcement of laws and policies. This book draws on the synergy of political theory and civil rights law to expand the boundary of racial justice and consider the way in which racial discrimination happens outside the governmental or public sphere. 'Private racism' is about recognizing that racial injustice also occurs in our private lives, including the television and movie industry, cyberspace, our intimate and sexual lives, and the reproductive market. Professor Sonu Bedi argues that private racism is wrong, enlarging the boundary of justice in a way that is also consistent with our Constitution. A more just society is one that seeks to address rather than ignore this less visible form of racism

    Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people

    Abstract: "Organizations deserve more attention than they have hitherto found-above all, a different sort of attention. This may seem a bold assertion given the many ways in which organizations are discussed in everyday communication and in the relevant scientific disciplines. But this is the very reason to concentrate our attention more strongly not on organizations as countable entities but on organization as a process. This is relevant from a theoretical perspective, given that inquiry into the essence of organization seems to have become unproductive (which is typical of questions of essence, indeed of what- questions per se). But a different understanding of organization could prove important for the purposes of practical policy. Precisely because organizations (again in the plural) have become crucial, indispensable to modern life, it could be important to have a better grasp of their "intrinsic logic." Especially if heteronomy-be it subjection to owners or other "masters," to liberal or socialist ideologies, or to representatives of interests that are themselves organized-is increasingly called into question, it could be important to give organizations a conception of themselves that enables them to answer for themselves"...

    Abstract: Distinguishing between civilians and combatants is a central aspect of modern conflicts. Yet such distinctions are rarely upheld in practice. The Civilianization of War offers new ways of understanding civilians' exposure to violence in war. Each chapter explores a particular approach to the political, legal, or cultural distinctions between civilians and combatants during twentieth-century and contemporary conflicts. The volume as a whole suggests that the distinction between combatants and non-combatants is dynamic and oft-times unpredictable, rather than fixed and reciprocally understood. Contributors offer new insights into why civilian targeting has become a strategy for some, and how in practice its avoidance can be so difficult to achieve. Several discuss distinct population groups that have been particularly exposed to wartime violence, including urban populations facing aerial bombing, child soldiers, captives, and victims of sexual violence. The book thus offers multiple perspectives on the civil-military divide within modern conflicts, an issue whose powerful contemporary resonance is all too apparent

    Abstract: This is a study of law, wrongdoing and justice as conceived in the minds of the ordinary people of England and Wales from the later eighteenth century to the First World War. Official justice was to become increasingly centralised with declining traditional courts, emerging professional policing and a new prison estate. However, popular concepts of what was, or should be, contained within the law were often at variance with its formal written content. Communities continued to hold mock courts, stage shaming processions and burn effigies of wrongdoers. The author investigates those justice rituals, the actors, the victims and the offences that occasioned them. He also considers the role such practices played in resistive communities trying to preserve their identity and assert their independence. Finally, whilst documenting the decline of popular justice traditions this book demonstrates that they were nevertheless important in bequeathing a powerful set of symbols and practices to the nascent labour movement. This book will be of interest to scholars and students of legal history and criminal justice as well as social and cultural history in what could be considered a very long nineteenth century. Stephen Banks is an associate professor in criminal law, criminal justice and legal history at the University of Reading, co-director of the Forum for Legal and Historical Research and author of A Polite Exchange of Bullets: The Duel and the English Gentleman, 1750-1850 (The Boydell Press, 2010).

The decline of serfdom between c.1300 and c.1500 in England is centralto this "Transition Debate", because it transformed the lives of ordinary people and opened up the markets in land and labour. Yet, despite its historical importance, there has been no major survey or reassessment of decline of serfdom for decades. Consequently, the debate over its causes, and its legacy to early modern England, remains unresolved. This dazzling study provides an accessible and up-to-date survey of the decline of serfdom in England, applying a new methodology for establishing both its chronology and causes to thousands of court rolls from 38 manors located across the south Midlands and East Anglia. It presents a ground-breaking reassessment, challenging many of the traditional interpretations of the economy and society of late-medieval England, and, indeed, of the very nature of serfdom itself. Mark Bailey is High Master of St Paul's School, and Professor of Later Medieval History at the University of East Anglia. He has published extensively on the economic and social history of England between c.1200 and c.1500, including Medieval Suffolk (2007).

    Abstract: This book offers fresh insights into the complex and various ways in which international frontiers influence cultural identities. The ten anthropological case studies collected here describe specific international borders in Europe, Asia, Africa and North America, and bring out the importance of boundary politics, and the diverse forms that it may take. The frontier itself may be of great symbolic importance; in other cases the symbolism lies rather in the disappearance of the traditional border. A frontier may be above all a barrier against immigration, or the front line between hostile armies.     Abstract: All societies must deal with the possibility of violence, and they do so in different ways. This book integrates the problem of violence into a larger social science and historical framework, showing how economic and political behavior are closely linked. Most societies, which we call natural states, limit violence by political manipulation of the economy to create privileged interests. These privileges limit the use of violence by powerful individuals, but doing so hinders both economic and political development. In contrast, modern societies create open access to economic and political organizations, fostering political and economic competition. The book provides a framework for understanding the two types of social orders, why open access societies are both politically and economically more developed, and how some 25 countries have made the transition between the two types

    Abstract: The Killing Trap, first published in 2005, offers a comparative analysis of the genocides, politicides and ethnic cleansings of the twentieth century, which are estimated to have cost upwards of forty million lives. The book seeks to understand both the occurrence and magnitude of genocide, based on the conviction that such comparative analysis may contribute towards prevention of genocide in the future. Manus Midlarsky compares socio-economic circumstances and international contexts and includes in his analysis the Jews of Europe, Armenians in the Ottoman Empire, Tutsi in Rwanda, black Africans in Darfur, Cambodians, Bosnians, and the victims of conflict in Ireland.     Abstract: A new theory of ethnic cleansing based on the most terrible cases (colonial genocides, Armenia, the Nazi Holocaust, Cambodia, Yugoslavia, Rwanda) and cases of lesser violence (early modern Europe, contemporary India, and Indonesia). Murderous cleansing is modern, 'the dark side of democracy'. It results where the demos (democracy) is confused with the ethnos (the ethnic group). Danger arises where two rival ethno-national movements each claims 'its own' state over the same territory. Conflict escalates where either the weaker side fights because of aid from outside, or the stronger side believes it can deploy sudden, overwhelming force. Escalation is not simply the work of 'evil elites' or 'primitive peoples'. It results from complex interactions between leaders, militants, and 'core constituencies' of ethno-nationalism. Understanding this complex process helps us devise policies to avoid ethnic cleansing in the future.

    Abstract: In Indonesia, the world's largest Muslim-majority country, Muslims struggle to reconcile radically different sets of social norms and laws, including those derived from Islam, local social norms, and contemporary ideas about gender equality and rule of law. In this 2003 study, John Bowen explores this struggle, through archival and ethnographic research in villages and courtrooms of the Aceh Province, Sumatra, and through interviews with national religious and legal figures. He analyses the social frameworks for disputes about land, inheritance, marriage, divorce, Islamic History and, more broadly, about the relationships between the state and Islam, and between Muslims and non-Muslims. The book speaks to debates carried out in all societies about how people can live together with their deep differences in values and ways of life. It will be welcomed by scholars and students across the social sciences, particularly those interested in anthropology, cultural sociology and political theory.

    Abstract: In this book, Thomas Buoye examines the impact of large-scale economic change on social conflict in eighteenth-century China. He draws upon a large body of actual, documented homicide cases originating in property disputes to recreate the social tensions of rural China during the Qianlong reign (1736–1795). The development of property rights, a process that had begun in the Ming dynasty, was accompanied by other changes that fostered disruption and conflict, including an explosion in the population growth and the increasing strain on land and resources, and increasing commercialization in agriculture. Buoye challenges the 'markets' and 'moral economy' theories of economic behaviour. Applying the theories of Douglass North for the first time to this subject, he uses an institutional framework to explain seemingly irrational economic choices. Buoye examines demographic and technological factors, ideology, and political and economic institutions in rural China to understand the link between economic and social change.

    Abstract: As a conquest dynasty, Qing China's new Manchu leaders desperately needed to legitimize their rule. To win the approval of China's native elites, they developed an ambitious plan to return Confucianism to civil society. Filial piety, the core Confucian value, would once again be upheld by the state, and laborious and time-consuming mourning rituals, the touchstones of a well-ordered Confucian society, would be observed by officials throughout the empire. In this way, the emperor would be following the ancient dictate that he 'govern all-under-heaven with filial piety'. Norman Kutcher's study of mourning looks beneath the rhetoric to demonstrate how the state - unwilling to make the sacrifices that a genuine commitment to proper mourning demanded - quietly but forcefully undermined, not reinvigorated, the Confucian mourning system. With acute sensitivity to language and its changing meanings, Kutcher sheds light on a wide variety of issues that are of interest to historians of late Imperial China

    Abstract: Between 1934 and 1941 Stalin unleashed what came to be known as the 'Great Terror' against millions of Soviet citizens. The same period also saw the 'Great Retreat', the repudiation of many of the aspirations of the Russian Revolution. The response of ordinary Russians to the extraordinary events of this time has been obscure. Sarah Davies's study uses NKVD and party reports, letters and other evidence to show that, despite propaganda and repression, dissonant public opinion was not extinguished. The people continued to criticise Stalin and the Soviet regime, and complain about particular policies. The book examines many themes, including attitudes towards social and economic policy, the terror, and the leader cult, shedding light on a hugely important part of Russia's social, political, and cultural history

    Abstract: Justice, equity, and fairness are central concerns of everyday life, whether we are assessing the fairness of individual acts, social programmes, or institutional policies. This book explores how the distribution of costs and benefits determine our intuition about fairness and why individual behaviour sometimes deviates from normative theories of justice. To make any comparison, one must first state how fair distributions of resources or burdens should be made. Here, competing theories, such as utilitarianism and economic efficiency, are discussed. The chapters cover many topics including an investigation of various rules and heuristics that people use to make fair distributions; the motivation for people to conform to rules of fairness even when they conflict with self-interest; differences between the views of liberals and conservatives; societal rules for the distribution or allocation of critical or scarce resources; and implications for public policy. This mixture of theoretical and applied perspectives provides a balanced look at the psychology of justice.

    Abstract: Francisco Vitoria was the earliest and arguably the most important of the Thomist political philosophers of the Counter-Reformation. Not only did he write important essays on civil and ecclesiastical power, but he became celebrated for his defence of the new world Indians against the imperialism of his own master, the King of Spain. Vitoria's political works are thus of great importance for an understanding both of the rise of modern absolutism, and the debate about the emergent imperialism of the European powers.     Abstract: Around 300 A.D. European patterns of marriage and kinship were turned on their head. What had previously been the norm - marriage to close kin - became the new taboo. The same applied to adoption, the obligation of a man to marry his brother's widow and a number of other central practices. With these changes Christian Europe broke radically from its own past and established practices which diverged markedly from those of the Middle East, North Africa and Asia. In this highly original and far-reaching work Jack Goody argues that from the fourth century there developed in the northern Mediterranean a distinctive but not undifferentiated kinship system, whose growth can be attributed to the role of the Church in acquiring property formerly held by domestic groups. He suggests that the early Church, faced with the need to provide for people who had left their kin to devote themselves to the life of the Church, regulated the rules of marriage so that wealth could be channelled away from the family and into the Church. Thus the Church became an 'interitor', acquiring vast tracts of property through the alienation of familial rights. At the same time, the structure of domestic life was changed dramatically, the Church placing more emphasis on individual wishes, on conjugality, and on spiritual rather than natural kinship. Tracing the consequences of this change through to the present day, Jack Goody challenges some fundamental assumptions about the making of western society, and provides an alternative focus for future study of the European family, kinship structures and marriage patterns. The questions he raises will provoke much interest and discussion amongst anthropologists, sociologists and historians

    Abstract: In this work the authors present a general theory of bureaucracy and use it to explain behaviour in large organizations and to explain what determines efficiency in both governments and business corporations. The theory uses the methods of standard neoclassical economic theory. It relies on two central principles: that members of an organization trade with one another and that they compete with one another. Authority, which is the basis for conventional theories of bureaucracy, is given a role, despite reliance on the idea of trade between bureaucracies. It is argued, however, that bureaucracies cannot operate efficiently on the basis of authority alone. Exchange between bureaucrats is hampered because promises are not enforceable. So trust and loyalty between members of bureaucratic networks play an important part. The authors find that vertical networks promote efficiency while horizontal ones impede it.

    Abstract: This book examines in detail the process of change in 240 city, county and state public bureaucracies responsible for local finance administration. Using the longitudinal method of analysis, the data show organizational structures to be much less stable than conventional stereotypes have suggested. Variables such as organizational leadership, claims to domain, and survival (as opposed to replacement or reorganization) were found to mediate environmental effects on bureaucracies. The book also discusses traditional theories of bureaucracy, theories emphasizing the importance of environment for organizational theory is possible. The concluding chapter draws extensive theoretical implications from the empirical findings of the study.
