    Abstract: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’. Daems has published widely on punishment and prisons, in particular from a European perspective. With Palgrave, he previously published Electronic Monitoring: Tagging Offenders in a Culture of Surveillance (2020) and Europe in Prisons: Assessing the Impact of European Institutions on National Prison Systems (2017, co-edited with Luc Robert). .

    Abstract: This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses. Jodie Hodgson is a lecturer in Criminology at Manchester Metropolitan University, UK. Jodie has previously worked as a lecturer at Leeds Beckett University and the University of Liverpool. She completed her PhD at Liverpool John Moores University. Her research interests are situated within the areas of youth justice, feminism and critical criminology.

    Abstract: Der Konferenzband diskutiert aus interdisziplinären Perspektiven das Kopftuch im Kontext von Verbotsdebatten im deutschsprachigen Raum und möglichen Konsequenzen für das gesellschaftliche Miteinander. Der Mehrwert dieser Publikation ergibt sich aus der Auseinandersetzung mit dem sonst populistisch und politisch ausgeschlachteten Thema des muslimischen Kopftuches und bietet anstelle dessen eine differenzierte und vor allem differenzierende Elaboration sowohl für die im Feld stehenden Lehrenden als auch für die interessierte Allgemeinheit.     Abstract: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law. While the primary focus is a philosophical one, authors also engage in incisive analyses of historical, political and/or legal developments in their chosen countries. Examples of these include South Africa, Colombia, Rwanda, Israel and the land of Palestine, which they know all too well on a personal basis and from daily experience.     Abstract: Who is a child’s legal mother? Must a child have exactly one mother, can it have two or three, or can it have two fathers, but no mother? Or has the concept of motherhood become obsolete and should we just talk of parenthood in a gender neutral way? Questions such as these would have appeared esoteric only a few decades ago, but as a result of new social developments (such as frequent family reconstitutions, gay and lesbian emancipation or surrogacy) and of technological innovations (such as egg and embryo donations) they have become issues in a vehement debate. The interdisciplinary contributions to this book focus on the legal definition of motherhood, on the way in which legal conceptions structure the social discourse on motherhood (and vice versa), and on the influence of legal rules on power relations between mothers, fathers, children and the state. Among the issues addressed are - the challenges to our understanding of the legal regulation of motherhood by developments in reproductive medicine; - the challenges to our understanding of the legal regulation of motherhood by parental constellations deviating from the mother-father-model (single motherhood by choice, same-gender parenthood, multiple parenthood); - the exercise of parental rights in case of parental separation and the impact of legal rules on the bargaining positions of mothers and fathers.

    Abstract: Junge und minderjährige Geflüchtete sind spätestens seit 2015 eine nicht mehr aus der Kinder- und Jugendhilfe wegzudenkende Zielgruppe. Im Fokus der Veranstaltung stand deshalb drei Jahre "nach dem Ankommen" die Perspektivplanung in der Arbeit mit jungen Flüchtlingen - dies im Hinblick auf die Hilfeplanung insgesamt, mögliche Hilfeformen auch nach dem 18. Lebensjahr sowie die Zukunftsperspektiven und die Verselbstständigung der jungen Geflüchteten. Ein Schwerpunkt der Veranstaltung lag auf der Frage nach dem Ist-Stand und den Perspektiven der kommunalen Integration junger Geflüchteter in der Praxis. Welches sind in diesem Zusammenhang die dringendsten Aufgaben? Und welche Herausforderungen sind damit fachlich, infrastrukturell und personell für die Kinder- und Jugendhilfe verbunden?

    Abstract: Mit dem Anstieg der Lebenserwartung in Europa geht ein Wandel der Erwerbs- und Lebensverläufe einher, die durch Brüche und Wechsel der beruflichen Tätigkeiten geprägt sind. Ein zentrales Anliegen ist daher, jedem die Teilhabe am Erwerbsleben über den gesamten Lebensverlauf zu ermöglichen und zugleich soziale Rechte durch angemessenen sozialen Schutz zu gewährleisten. Mit juristischen, sozialpolitischen und empirischen Analysen widmet sich dieses Buch dem Zusammenspiel verschiedener Sozialschutzmechanismen und ihren Schwierigkeiten, sich den neuen Entwicklungen anzupassen. Es präsentiert die Impulse europäischer Instanzen und die Antworten verschiedener europäischer Staaten auf die Herausforderung, Flexibilisierung der Beschäftigung und Modernisierung der Sozialschutzsysteme in Einklang zu bringen. Increasing life expectancy in Europe entails a remodelling of career development and life course, marked by discontinuities and changing professional activities. One of the concerns is ensuring that everybody may participate in gainful activities during his or her life course while also guaranteeing social rights through adequate social protection. By means of legal, socio-political and empirical analyses this book embarks on the interrelationship of different social protection mechanisms and the resulting difficulties of adapting to these new employment patterns. It presents European impulses and the reactions of several European states to the challenge of reconciling flexibility of employment and modernisation of social protection. L’augmentation de l’espérance de vie en Europe suscite un changement des modes de parcours professionnels et de vie constitués de ruptures et de conversions d’activité. L’une des préoccupations est de permettre à chacun de poursuivre une activité professionnelle tout au long de sa vie tout en pouvant bénéficier d’une protection sociale adaptée. A travers des analyses juridiques, socio-politiques et empiriques, cet ouvrage aborde les interférences et les difficultés d’adaptation des mécanismes de protection sociale aux nouvelles évolutions.     Abstract: Das Thema Asyl ist in den Medien allgegenwärtig. Seit die Flüchtlingszahlen 2015 dramatisch gestiegen sind, stehen einerseits Forderungen nach einer Aufnahmebegrenzung und andererseits die Position, dass es keine Obergrenze beim Recht auf eine individuelle Prüfung des Asylanspruchs geben könne, im politischen Raum gegeneinander. Dabei besteht in der Öffentlichkeit wenig Klarheit darüber, wozu eigentlich das Grundgesetz und dessen Artikel 16a, die Genfer Flüchtlingskonvention und europäische Regelungen die Bundesrepublik verpflichten. Auch bezüglich des tatsächlichen Zusammenhangs zwischen Asylrecht und Zuwanderung besteht Informationsbedarf. Diesen Fragen gehen die Beitragsautorinnen und -autoren in diesem Sammelband nach. Die hierbei gewonnenen Erkenntnisse und Ergebnisse reflektieren das Themenfeld Asyl aus juristischer, politikwissenschaftlicher und praktischer Perspektive. Quelle: Verlag.

Each of these country reports contains a historical perspective on the evolution of domestic rules regarding custody and guardianship, and on the introduction and development of the notion of the best interests of the child. In addition to a selection of country reports from the workshop, the volume includes two comparative analyses on questions of parental care in both public and private international law.     Abstract: This book provides a comparative perspective on one of the most intriguing developments in law: the influence of basic rights and human rights in private law. It analyzes the application of basic rights and human rights, which are traditionally understood as public law rights, in private law, and discusses the related spillover effects and changing perspectives in legal doctrine and practice. It provides examples where basic rights and human rights influence judicial reasoning and lead to changes of legislation in contract law, tort law, property law, family law, and copyright law. Providing both context and background analysis for any critical examination of the horizontal effect of fundamental rights in private law, the book contributes to the current debate on an important issue that deserves the attention of legal practitioners, scholars, judges and others involved in the developments in a variety of the world’s jurisdictions. This book is based on the General Report and national reports commissioned by the International Academy of Comparative Law and written for the XIXth International Congress of Comparative Law in Vienna, Austria, in the summer of 2014.

    Abstract: Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics.Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be ‘believed’ by the subjects and the political élites. Such a communicative orientation of constitutional processesbecame palpable in the ‘religious’ affinities of the constitutional preambles. They were held as ‘creeds’ of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents’ big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the ‘renaissance’ of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law.     Abstract: Equal is not Enough? is the title of a series of conferences that has aimed, over the years, to generate a better understanding of what shapes and reshapes inequalities by inviting and promoting multi-disciplinary insights and reflection. One of the conferences focused on discrimination law.
