    Abstract: This book studies the normative intersection between integration, immigration and nationality in the European Union (EU). It examines the relationship between integration and the legal frameworks of admission, stay and access to nationality by third country nationals at national and European levels. Integration is being subject to multifaceted processes transforming its traditional policy and legal settings, as well as its classical theoretical premises and approaches. The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. The legal elements of integration are being developed through two parallel settings: the EU Framework on Integration and European immigration law. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy

    Abstract: What changed in the United States with Hurricane Katrina was a feeling that we have entered a period of consequences. - Al Gore On February 05, 2007, the Intergovernmental Panel on Climate Change (IPCC) published the executive summary of its fourth assessment report (to be published April 06, 2007). In the summary, it not only acknowledged that climate change is happening at an accelerated rate, but also that its consequences would be dreary: changes in precipitation and in wind patterns, a rise of the sea levels, and desert- cation will globally impact the frequency of disasters and impair living standards. Whether or not we believe climate change is happening, over the past two years, we have witnessed a rise of the topic from oblivion to ubiquity and have experienced a growing emphasis on ?nding measures to prevent climate change. There is an unprecedented agreement among environmentalists, politicians, the public, and industry that we have to take effective action. Politicians are putting their creative plans to action unusually fast: Australia bans the light bulb, B- gium switches off lamps along lighted highways, and the US introduces daylight savings time two weeks earlier than in previous years. Industry, the most unlikely candidate for support, is rallying together in action groups like US-Cap or 2 Grad, and more and more consumers are offsetting their emissions through websites like myclimate. Merle Grobbel holds a PhD in Political Science (Public Policy) and works as a consultant for McKinsey Company.

Die ausgewogene finanzielle Belastung zwischen jetzt lebenden und künftigen Generationen wie auch die Sorge um die Zukunftschancen unserer Kinder sind dabei die zentralen Grundfragen der Debatte. So sieht sich auch die sozialwissenschaftliche Forschung vor die Herausforderung gestellt, klassische Konzepte intragenerationeller Gerechtigkeit daraufhin zu überprüfen, inwiefern sie Forderungen nach intergenerationeller Gerechtigkeit standhalten. Neben den empirischen und philosophischen Grundfragen analysieren die Beiträger dieses Bandes das Thema Generationengerechtigkeit aus einer ordnungsökonomischen Perspektive. Es geht zum einen um eine Begründung dafür, warum überhaupt heutige Gesellschaftsmitglieder die Interessen zukünftiger Generationen berücksichtigen sollen. Zum anderen werden solche gesellschaftlichen Regeln gesucht, die im besten Falle geeignet sind, die Interessen der kommenden Generationen langfristig zu sichern und dabei zugleich für die heute Lebenden akzeptabel sind. Eine tragfähige ordnungsökonomische Konzeption der Generationengerechtigkeit muss sich dann auch als Leitfaden für einzelne Felder der praktischen Politik bewähren.     Abstract: Vom 19. Jahrhundert als einer Mediengesellschaft zu sprechen, erscheint als ein Anachronismus. Der Begriff sucht den Bedeutungsgewinn und die Diversifizierung der Medien in der Gegenwart zu erfassen und damit nicht zuletzt heutige von früheren Gesellschaften abzugrenzen. Die Annahme, dass Medien in früheren Gesellschaften nicht ebenfalls eine zentrale und spezifische Rolle zukam, wäre jedoch irrig. So war das 19. Jahrhundert nicht nur vom Aufstieg einer Vielzahl einstmals neuer Medien geprägt, sondern auch dadurch, dass sich die Gesellschaft über öffentliche und mediale Kommunikation erst konstituierte und ausdifferenzierte. Der Band macht es sich zur Aufgabe, ineinander greifende zentrale mediale und gesellschaftliche Entwicklungen für Deutschland und für Frankreich in einer übergreifenden wie vergleichenden Perspektive vorzustellen..

    Abstract: European Labour Law explores how individual European national legal systems, in symbiosis with the European Union, produce a transnational labour law system that is distinct and genuinely European in character. Professor Brian Bercusson describes the evolution of this system, its national, transnational and global contexts and its institutional and substantive structures. The collective industrial-relations dimension of employment is examined, and the labour law of the EU as manifested in, for example, European works councils is analysed. Important subjects which have traditionally received little attention in some European labour law systems are covered, for example, the fragmentation of the workforce into atypical forms of employment. Attention is also given to the enforcement of European labour law through administrative or judicial mechanisms and the European social dialogue at intersectoral and sectoral levels.     Abstract: Vom 19. Jahrhundert als einer Mediengesellschaft zu sprechen, erscheint als ein Anachronismus. Der Begriff sucht den Bedeutungsgewinn und die Diversifizierung der Medien in der Gegenwart zu erfassen und damit nicht zuletzt heutige von früheren Gesellschaften abzugrenzen. Die Annahme, dass Medien in früheren Gesellschaften nicht ebenfalls eine zentrale und spezifische Rolle zukam, wäre jedoch irrig. So war das 19. Jahrhundert nicht nur vom Aufstieg einer Vielzahl einstmals neuer Medien geprägt, sondern auch dadurch, dass sich die Gesellschaft über öffentliche und mediale Kommunikation erst konstituierte und ausdifferenzierte. Der Band macht es sich zur Aufgabe, ineinander greifende zentrale mediale und gesellschaftliche Entwicklungen für Deutschland und für Frankreich in einer übergreifenden wie vergleichenden Perspektive vorzustellen.

    Abstract: The introduction of the 'Common Consolidated Corporate Tax Base' as a means for an efficient and equitable taxation of multinational enterprises in Europe represents the most important issue of European business taxation. Starting in 2001, the Commission and the Member States have cooperated in order to develop an innovative technique for the measurement and the allocation of business profits within the European Union. This venture is not only the most ambitious political project of the current European Commission, it also challenges traditional legal and economic concepts of business taxation. This book contains the proceedings of an International Tax Conference, organised under the auspices of the German Presidency in the European Union and designed in cooperation with the Centre for European Economic Research (Mannheim) and the Max Planck Institute for Intellectual Property, Competition and Tax Law (Munich) including presentations from European and American academics and tax practitioners.

    Abstract: Hauptbeschreibung In den vergangenen Jahrzehnten hat die deutsche Asylrechtsprechung ein festes Gerüst asylrechtlicher Rechtsfiguren und Auslegungsgrundsätze geschaffen, dessen tragende Pfeiler auf einer in weiten Teilen völlig eigenständigen Interpretation maßgeblicher Vorschriften der Genfer Flüchtlingskonvention beruhen. Der Prozess der Harmonisierung des Flüchtlingsrechts auf europäischer Ebene und vor allem die Richtlinie 2004/83/EG des Rates vom 29.04.2004 (Qualifikationsrichtlinie) als eines der zentralen Elemente dieser Asylrechtsharmonisierung verlangen der deutschen Asylrechtsprechung eine grundlegende Revision und Neuorientierung ab. Vor diesem Hintergrund geht die Autorin, selbst Richterin am Verwaltungsgericht, am Beispiel des Widerrufs von Flüchtlingsanerkennungen im Einzelnen der Frage der Völkerrechts- und Europarechtskonformität der deutschen Rechtsprechung nach. Annegret Titze legt dabei besonderes Gewicht auf die dogmatische Entfaltung der für alle Auslegungsfragen im materiellen Asylrecht nunmehr maßgeblichen methodischen Grundlagen, die bei der Auslegung von Völkervertragsrecht einerseits und der Auslegung von EG-Recht andererseits sowie bei der Verzahnung beider Rechtskreise im Bereich der Qualifikationsrichtlinie zu beachten sind.     Abstract: This publication deals with the European dimension of tort law. It provides a critical analysis of the acquis communautaire, asking if and to what extent the provisions and case law in the field of tort law are based on a conclusive system and are in accord with the national legal systems. It thus evaluates whether the acquis communautaire form the beginning of a comprehensive and coherent EC tort law or if the single directives and regulations are contradictory and lack a general concept that is yet to be found. To gain an overview of 'EC Tort Law' certain provisions and decisions were analysed by a group of authors under thirteen elements that form the basis of tort law e.g. fault/strict liability, causation, damage, damages and limitation of actions. An analysis of these aspects was then undertaken by another group of authors each focusing on their respective legal families within the European Union. The publication also contains a section on terminological issues in EC tort law.

    Abstract: Die Europäisierung des Rechts in der Europäischen Union führt zu tiefgreifenden Veränderungen in den Rechtsordnungen ihrer Mitgliedsstaaten. Besondere Schwierigkeiten wirft sie für die Staaten Mittel- und Osteuropas auf, die der Europäischen Union erst seit kurzem beigetreten sind. Der vorliegende Band behandelt die Auswirkungen der Europäisierung auf die deutsche und die ungarische Rechtsordnung aus rechtshistorischer, zivilrechtlicher und öffentlich-rechtlicher Perspektive und lässt sie dadurch in ihrer Vielfalt plastisch hervortreten. Die Schwerpunkte der insgesamt 18 Beiträge liegen im Bereich der Rechtsgeschichte, des allgemeinen Zivilrechts, des Gesellschaftsrechts, des geistigen Eigentums, des Zivil- sowie des Verwaltungsprozessrechts, und erörtern auch die Problematik der Diskriminierungsverbote und schließlich die Souveränitätskonzeption. Der Band versammelt die Vorträge des Deutsch-Ungarischen Kolloquiums der Juristischen Fakultäten der Universität Göttingen und der Eötvös Loránd Universität Budapest über die Europäisierung des Rechts, das im Oktober 2007 in Budapest stattfand. Dieses gemeinsame Kolloquium ist die jüngste Frucht der langjährigen Kooperation der beiden Fakultäten in Forschung und Lehre. Band 5 der Reihe αGöttinger Juristische Schriften. Die Reihe wird von der Juristischen Fakultät der Georg-August-Universität herausgegeben und macht Veranstaltungen an der Fakultät einer interessierten Öffentlichkeit zugänglich.
