    Abstract: What is 'modern slavery' and who is responsible for it? What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

Taking the normative perspective of civilian immunity from military attack, this book argues that the implicit hierarchy of international law, atop which sits genocide as the "crime of crimes," blinds us to other types of humanly caused civilian death, like bombing cities, the "collateral damage" of missile and drone strikes, blockades, and sanctions. In other words, talk of genocide functions ideologically to detract from systematic violence against civilians perpetrated by governments. The Problems of Genocide also contends that this violence is the consequence of "permanent security" imperatives: the striving of states, and armed groups seeking to found states, to make themselves invulnerable to threats. To solve the problems of genocide, this book proposes replacing it with permanent security, which should be criminalized"--

    Abstract: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.

Zugrunde liegt die Frage, was heute unter Rassismus zu verstehen ist und ob Phänomene wie Ausländer- und Fremdenfeindlichkeit sowie Rechtsextremismus darunter fallen. Insbesondere Rasse als Rechtsbegriff wird ausführlich besprochen. Zentrale Bezugspunkte für die folgende Auseinandersetzung mit dem „Recht gegen rassische Diskriminierung“ sind die Europäische Rasserichtlinie (Richtlinie 2000/43/EG), die Antirassismuskonventionen der Vereinten Nationen und die Europäische Menschenrechtskonvention (EMRK). Das deutsche Grundgesetz wendet sich in Art. 3 Abs. 3 S. 1 GG gegen Rassismus, aber eine umfangreiche Dogmatik, die dem heutigen Phänomen des Rassismus gerecht werden kann, fehlt. Das vorliegende Werk leistet mithilfe eines menschenrechtsinformierten und differenzierten Verständnisses von Rassismus hierzu einen wichtigen Beitrag. Damit soll die These begründet werden, dass nur ein strukturelles Verständnis von Rassismus das Recht gegen Rassismus wirksam werden lässt.

    Abstract: International human rights law has emerged as an academic subject in its own right, separate from, but still related to international law. This book explains the distinctive nature of this discipline by examining the influence of the idea of human rights on general international law. Rather than make use of a particular moral philosophy or political theory, it explains human rights by examining the way the term is deployed in legal practice, on the understanding that words are given meaning through their use. Relying on complexity theory to make sense of the legal practice of the United Nations, the core human rights treaties, and customary international law, the work demonstrates the emergence of the moral concept of human rights as a fact of the social world. It reveals the dynamic nature of this concept, and the influence of the idea on the legal practice, a fact that explains the fragmentation of international law and special nature of international human rights law.

The case studies included illustrate the need to vary the application of human rights in differing cultural environments, and the book suggests a new framework: a flexible universalism that returns to basics-focusing on the great evils of the human condition. This approach will help the human rights movement succeed in a multipolar era.

    Abstract: "Rights Make Might examines why the three most salient minority groups in Japan all expanded their activism since the late 1970s and chronicles the galvanizing effects of global human rights ideas and institutions on local social movements. The prehistory of the three groups reveals that minority politics in Japan before the 1970s featured politically dormant Ainu - an indigenous people in northern Japan -, active but unsuccessful Koreans - a stateless colonial legacy group -, and active and established Burakumin - a former outcaste group that still faced social discrimination. Despite the unfavorable domestic political environment, the infusion of global human rights ideas and the opening of international human rights arenas as new venues for contestation transformed minority activists' movement actorhood, or subjective understanding about their position and entitled rights in Japan, as well as the views of the Japanese public and political establishment toward those groups, thus catalyzing substantial gains for all three groups. Having benefited from global human rights, all three groups also repaid their debt by contributing to the consolidation and expansion of global human rights principles and instruments. Drawing on interviews and archival data, Rights Make Might offers a detailed historical and comparative analysis of the co-constitutive relationship between international human rights activities and local politics that contributes to our understanding of international norms, multilateral institutions, social movements, human rights, and ethno-racial politics."

    Abstract: This book demonstrates the importance of a duty-based approach to morality. The dominance of what has been labeled “rights talk” leads to the neglect of duties without corresponding rights (e.g., duties of virtue) and stimulates the proliferation of questionable human rights. Therefore, this book argues for a duty-based perspective on morality in order to, first, salvage duties of virtue, and, second, counter the trend of rights-proliferation by providing some conceptual clarity concerning rights and duties that will enable us to differentiate between genuine and spurious rights-claims. The argument for this duty-based perspective is made by examining two particularly contentious duties: duties to aid the global poor and civic duties. These two duties serve as case studies and are explored from the perspectives of political theory, jurisprudence and moral philosophy. The argument is made that both these duties can only be adequately defined and allocated if we adopt the perspective of duties, as the predominant perspective of rights either does not recognize them to be duties at all or else leaves their content and allocation indefinite. This renewed focus on duties does not wish to diminish the importance of rights. Rather, the duty-based perspective on morality will strengthen human rights discourse by distinguishing more strictly between genuine and inauthentic rights. Furthermore, a duty-based approach enriches our moral landscape by recognizing both duties of justice and duties of virtue. The latter duties are not less important or supererogatory, but function as indispensable complements to the duties prescribed by justice. In this perceptive and exceptionally lucid book, Eric Boot argues that a duty-focused approach to morality will remedy the shortcomings he finds in the standard accounts of human rights. The study tackles staple philosophical topics such as the contrasts between duties of virtue and duties of justice and imperfect and perfect obligations. But more importantly perhaps, it also confronts the practical question of what our human rights duties are and how we ought to act on them. Boot's book is a splendid example of how philosophy can engage and clarify real world problems.     Abstract: "Cosmopolitanism, as an intellectual and political project, has failed. The portrayal of human rights, especially European, as evidence of cosmopolitanism in practice is misguided. Cosmopolitan theorists point to the rise of claims-making to the European Court of Human Rights (ECtHR) among Europe's Muslims to protect their right to religious freedom, mainly concerning the hijab, as evidence of cosmopolitan justice. However, the outcomes of such claims-making show that far from signifying a cosmopolitan moment, European human rights law has failed Europe's Muslims. Human Rights, Islam and the Failure of Cosmopolitanism provides an empirical examination of claims-making and government policy in Western Europe focusing mainly on developments in the UK, Germany, France, Italy and the Netherlands. A consideration of public debates and European law of conduct in the public sphere shows that cosmopolitan optimism has misjudged the magnitude of the impact claims-making among Europe's Muslims. To overcome this cul-de-sac, European Muslims should turn to a new 'politics of rights' to pursue their right to religious expression. This eye-opening book will be of interest to undergraduate and postgraduate students studying subjects such as Sociology, Human Rights, Minority Rights, Cosmopolitanism and Ethnic and Racial Studies" --

Antworten hierauf geben Expertinnen und Experten aus den Bereichen Menschenrechte, Medizinrecht, Philosophie, Medizinethik, Literaturwissenschaft, aus der Inneren Medizin, der Palliativ- und der Rechtsmedizin sowie den Pflege- und Gesundheitswissenschaften. Abgerundet wird der Band durch ein Interview mit der Behindertenrechtsaktivistin Dinah Radtke zur »Überraschenden Erfahrung von Lebensqualität« bei Menschen, die auf Assistenz und technische Geräte angewiesen sind. Mit Beiträgen u.a. von Jan P. Beckmann, Heiner Bielefeldt und Oliver Tolmein.
