    Kurzfassung: This sixth peer review of the OECD Principles of Corporate Governance analyses the corporate governance framework and practices relating to corporate risk management, in the private sector and in state-owned enterprises. The review covers 26 jurisdictions and is based on a general survey of all participating jurisdictions in December 2012, as well as an in-depth review of corporate risk management in Norway, Singapore and Switzerland. The report finds that while risk-taking is a fundamental driving force in business and entrepreneurship, the cost of risk management failures is often underestimated, both externally and internally, including the cost in terms of management time needed to rectify the situation. The reports thus concludes that corporate governance should ensure that risks are understood, managed, and, when appropriate, communicated.

It provides an overview of the two themes of modernisation and innovation, focusing on identifying the attributes of the modern rural economy and showing how it differs from the traditional rural economy and from metropolitan economies. It also shows how rural innovation is a key driver of rural economic growth using patents as a measure. The second part of the book consists of four chapters that offer evidence of rural regions’ potential to contribute to national economic growth. In addition, each provides useful context for Part I by outlining four different perspectives on the process of modernisation and innovation, and specifically, how they can take place in the rural territories of OECD countries. In each paper, the authors explore the opportunities and impediments to these twin processes and how government policy can help or hinder them.

    Kurzfassung: This report takes stock of progress made in implementing the 2010 Recommendation on Principles for Transparency and Integrity in Lobbying – the only international instrument addressing major risks in the public decision-making process related to lobbying. The review process found that although there is an emerging consensus on the need for transparency to shed light on lobbying, new regulations are often scandal-driven instead of forward looking. In countries that have regulations in place, the degree of transparency in lobbying varies considerably across OECD members. Moving forward, it will be essential for countries to focus efforts on the implementation of the Recommendation, in order to strengthen confidence in the public decision-making process and restore trust in government. It will also be crucial to strengthen the implementation of the wider integrity framework, as it is the prime tool for safeguarding transparency and integrity in the decision-making process in general and lobbying practices in particular.

    Kurzfassung: Public institutions play a critical role in promoting gender-sensitive policies and gender equality more broadly, in the MENA region and around the world. Advancing gender balance in public institutions and public life more generally, including the judiciary, parliaments, and the political executive constitutes a major step towards gender-responsive policies and non-discrimination and serves as a key milestone in promoting gender equality. This report provides a comparative overview of the policies affecting women’s participation in public life across the MENA region. It examines the existing barriers to women’s access to public decision-making positions, and provides a cross-country assessment of current instruments and institutions to advance women’s empowerment in the MENA region. The report undertakes an analysis of the existing legal barriers for gender equality in public life, including with regard to political and economic rights, freedom of movement, labour law, family law, access to justice and gender-based violence and provides focused policy-recommendations to close legal and institutional gaps. The report has been prepared by the OECD, in partnership with Centre for Arab Women Training and Research (CAWTAR) and with the support of the Arab Administrative Development Organisation (ARADO) and covers the following countries: Algeria, Egypt, Morocco, the Palestinian Authority, Jordan, Lebanon, Tunisia, the United Arab Emirates and Yemen.

Ce rapport comprend également un plan d’actions (Chapitre 3) assorti de mesures concrètes pour mettre en œuvre les recommandations proposées. Ce rapport s’inscrit dans le cadre du dialogue sur les politiques conduit conjointement par l’OCDE et le Global Water Partnership-Mediterranean (GWP-Med) en Tunisie dans le cadre du projet labellisé par l’Union pour la Méditerranée (UpM) « Gouvernance et Financement du Secteur de l’Eau en Méditerranée », avec le soutien financier du fonds fiduciaire FEMIP de la Banque Européenne d’Investissement.

    Kurzfassung: Corruption has a devastating impact on developing and transition countries, with estimates of $20 billion to $40 billion per year stolen by public officials, a figure equivalent to 20 to 40 percent of official development assistance flows. The return of the proceeds of corruption— asset recovery—can have a significant development impact. Returns can be used directly for development purposes, such as improvements in the health and education sectors and reintegration of displaced persons, with additional benefits of improved international co-operation and enhanced capacity of law enforcement and financial management officials. Development agencies and those committed to development effectiveness have a role in the asset recovery process. They have made international commitments to fight corruption and recover the proceeds of corruption in the Third High Level Forum on Aid Effectiveness: Accra Agenda for Actions, held in Accra, Ghana, in 2008, and in the Fourth High Level Forum on Aid Effectiveness: Partnership for Effective Development, held in Busan, Republic of Korea, in 2011. Despite these efforts, there has been difficulty in translating these commitments into concrete action. This StAR-OECD publication reports on how OECD countries are performing on asset recovery. Drawing on data collected between 2006 and 2012, the report provides recommendations and good practices, and suggests specific actions for development agencies. Few and Far is primarily intended to support the anti-corruption and asset recovery efforts of developed and developing jurisdictions, with a particular focus on actions for development agencies. In addition, civil society organisations engaged in governance and development issues may wish to use these findings and recommendations in their reports and advocacy efforts.

    Kurzfassung: Mexico has made several efforts to design and implement a regulatory improvement policy over the past several years. The institutions involved in the better regulation policy have played a key role in enhancing regulatory quality. This includes the Federal Regulatory Improvement Commission (COFEMER), the Ministry of Economy, and the Ministry of Public Administration. Mexico now has two decades of experience in the application of Regulatory Impact Analysis (RIA). Over this period, it has continued to expand the scope of RIA, to refine and improve the specific requirements and to invest substantial resources in implementation. Recently, Mexico has adopted the internationally recognised Standard Cost Model, which has brought a renewed impetus across the federal government to reduce administrative burdens generated by formalities. There is also a thriving multi-level regulatory governance programme. As a result, Mexico is currently at a stage where positive results are being obtained. However, this is not the time to slow down; instead, further work should be fostered to step up to a new phase of regulatory quality which embeds an effective and profound regulatory improvement culture across the federal government.

The global financial crisis however has brought new challenges, especially during the second shock, from 2011 onwards. The government’s recovery plan, which includes various measures such as fiscal consolidation, stimulating innovation and sub-national government reform has an important territorial dimension. This review focuses on how sub-national institutions and development can help the Netherlands meet its challenges. In the short-term, factors such as the contribution of all regions, better use of resources, and more efficient provision of goods and services can help the recovery. In the long term, improving national competitiveness will largely depend on a strong performance of the polycentric city structure, which characterises the Netherlands. The key policy areas explored in this review include: the recently created top-sector innovation policy; decentralisation; and territorial reforms such as municipal and provincial re-scaling through mergers or co-operation.

    Kurzfassung: This report assesses the main governance and financing challenges to private sector participation (PSP) in the water supply and sanitation sector of Jordan, and provides ways forward to address them, based on international experience and OECD compendium of principles and good practices. Using the diagnostic analysis of the governance challenges to PSP in the Jordan water sector (Chapter 1), the report identifies ways forward to overcome bottlenecks focusing on three key pillars (Chapter 2): i) managing public-private partnership in a fiscally constrained environment through appropriate budget processes; ii) reducing the regulatory risks through supporting the development of a high-quality framework; and iii)managing and enhancing stakeholder engagement to improve accountability and buy-in. The report also includes an action plan with concrete measures to implement the recommendations proposed in the report. The report has been developed as part of a water policy dialogue conducted by the OECD jointly with the Global Water Partnership-Mediterranean (GWP-Med) in the context of the project labelled by the Union for the Mediterranean (UfM) “Governance and Financing for the Mediterranean Water Sector”, with the support of the FEMIP Trust Fund of the European Investment Bank.

    Kurzfassung: The work undertaken by the Greek authorities in recent years to reinforce competition law and the Hellenic Competition Commission, to simplify business administration and to liberalise professional services have demonstrated the political willingness to address the problem of existing regulatory barriers to competition that have contributed to holding back the economic recovery. The OECD Competition Assessment Project, through the scrutiny of legislation in four sectors of the Greek economy, food processing, retail trade, building materials and tourism, has identified 336 areas where particular reform can be undertaken, from a total of 539 provisions that were selected using the OECD Competition Assessment Toolkit. If our recommendations are implemented, benefits to consumers in Greece and to the Greek economy should arise in all four sectors. Throughout this report, we seek to identify the sources of those benefits and where possible provide quantitative estimates. Estimates are made on the basis of experiences of deregulation in other countries in some instances, or by relating conservative estimates of efficiency gains to the overall size of the business activity affected.

    Kurzfassung: Regional development policy is a priority of Colombia’s government. The country has experienced sustained economic growth over the past decade; yet several territories still lack development opportunities. To promote growth in all regions the government has engaged in a series of reforms. For instance, it started allocating royalty payments generated by hydrocarbon resources to all departments and most municipalities, including those that are not endowed with natural resources. The reform also promotes better multilevel governance and represents a good policy practice for countries seeking to link natural resource development with regional development. To support the current efforts of Colombia’s government, this report illustrates policy recommendations to help national authorities adopting a territorial approach to inclusive economic development. In particular, the OECD recommends to: a) improve the quantity and quality of regional statistics and formulate urban and rural taxonomies that help tailor policies to places; b) involve territorial constituencies in the design of policy interventions and allocate to them more implementation responsibilities within the framework of the National Development Plan; c) promote coordination among subnational bodies to scale up investment in territories to avoid that public investment – and royalty payments – gets dispersed in a myriad of small-scale projects.

    Kurzfassung: The ability of citizens to demand accountability and more open government is fundamental to good governance. There is growing recognition of the need for new approaches to the ways in which donors support accountability, but no broad agreement on what changed practice looks like. This publication aims to provide more clarity on the emerging practice. Based on four country studies Mali, Mozambique, Peru and Uganda, a survey of donor innovations and cutting-edge analysis in this field, and the findings of a series of special high-level international dialogues on how to best support accountability support to parliaments, political parties, elections and the media. The publication takes the view that a wholesale shift in behaviour is required by parts of the development assistance community - moving outside conventional comfort zones and changing reflexes towards new approaches to risk taking, analysis and programming around systems of accountability and ‘do no harm’ efforts in political engagement. This piece is aimed at a range of development practitioners, as well as a wider audience, including civil society actors and citizens around the world who interact with donors working on accountability support.

    Kurzfassung: Las brechas de género se encuentran presentes en todas las actividades de la vida económica e implican grandes pérdidas de productividad, en los niveles de vida de las personas y en la economía. Este informe nuevo de la OCDE se centra en cómo cerrar dichas brechas, de la mejor manera, bajo cuatro amplios temas: 1) igualdad de género, normas sociales y políticas públicas; 2) educación; 3) empleo; y 4) emprendimiento. Mensajes de políticas clave: -Una mayor igualdad de género en el logro escolar tiene un fuerte efecto positivo en el crecimiento económico; -Los estereotipos necesitan ser abordados, desde una edad temprana, en las posibles opciones educativas. Por ejemplo, al adaptar las estrategias y los materiales de enseñanza para incrementar el interés de los niños en la lectura y de las niñas en las matemáticas y la ciencia; motivar más a las niñas y orientarlas a los cursos de ciencia, ingeniería y matemáticas en la educación superior; y a buscar empleo en dichos campos; -El cuidado infantil de calidad y a precio asequible es un factor clave para una mayor igualdad en el empleo. Pero el cambio también debe suceder en el hogar dado que las tareas domésticas y el cuidado se reserva aún a las mujeres en muchos países. La política puede apoyar dicho cambio, por ejemplo, mediante autorizaciones para ausencia laboral que explícitamente incluya al padre. -Las políticas de apoyo para las mujeres empresarias necesitan dirigirse a todas las empresas y no solamente a las pequeñas y las nuevas. El Gobierno de Colombia ha puesto un énfasis particular en la simplificación de trámites que impactan a empresas y ciudadanos. Además, ha puesto en marcha diversas iniciativas para hacer a la administración más transparente y accesible para los ciudadanos. Sin embargo, después de varios años en operación, este enfoque debe ajustarse para abordar los antecedentes de la regulación. Colombia aun carece de una política de mejora regulatoria con un enfoque de gobierno completo y requiere repensar el diseño institucional para una implementación coherente de diferentes herramientas regulatorias. También necesita adoptar un enfoque sistemático para controlar y revisar la justificación y la lógica detrás de los trámites y, sobre todo, de las regulaciones. Finalmente, como en muchos otros países, el desarrollo y aplicación de una política integral de gobernanza regulatoria para los gobiernos subnacionales y la coordinación multi-nivel son temas pendientes.

    Kurzfassung: The OECD Budget Practices and Procedures Database provides detailed data on how budgets are made in OECD countries from formulation, to approval, execution and reporting based on surveys conducted every four to five years. This publication presents the results of the latest survey, conducted in 2012, and compares this with the previous survey, conducted in 2007. It finds that fiscal sustainability is a key issue for countries today. It also highlights the growing use of medium-term expenditure frameworks, capital budgeting and top-down budgeting, and it examines transparency of budgeting as well as budgeting flexibility.

    Kurzfassung: With procurement accounting for 13% of GDP and a third of government expenditures on average in OECD countries, investing in appropriate processes to mitigate risks of waste and corruption leads to efficiency gains considering the financial stakes. In 2008 OECD countries committed to promoting transparency, integrity, good management as well as accountability in procurement with the adoption of the OECD Recommendation on Enhancing Integrity in Public Procurement. This assessment of progress made in OECD countries shows that as a result of austerity measures governments have been under tight budgetary constraints to provide smarter procurement, that is better service delivery at lower cost. Because environmental protection has become a growing societal imperative, the review of progress made shows that there is a strong political push in OECD countries to integrate environmental considerations in procurement. With the economic crisis, some governments have been tempted to use procurement to ease its socio-economic impact on societies by providing a substitute for direct social policies to support employment for specific communities. However few governments have invested in prioritising the objectives pursued through procurement, assessing their costs or benefits, and measuring their actual impact.

Le rapport comprend également des références aux expériences des pays du Moyen Orient et d’Afrique du Nord dans la mise en place de politiques de promotion de l’intégrité. Les propositions d’action de cette première évaluation fournissent une feuille de route aux autorités tunisiennes en vue de renforcer le cadre d’intégrité dans le secteur public. Elles incluent, parmi d'autres, la réalisation des diagnostics détaillés des vulnérabilités dans le système pour identifier des mesures prioritaires de réforme. En plus, il est conseillé aux autorités d'identifier des mesures prioritaires sur la base des diagnostics developer en coopération avec les parties prenantes. Un accent particulier est mis sur le domaine des marchés publics qui est un domaine particulièrement vulnérable à la corruption.

    Kurzfassung: During several past years countries in Eastern Europe and Central Asia have introduced important anti-corruption reforms. However, corruption remains high in the region. This report identifies progress achieved in the region as well as remaining challenges which require further action by countries. The report analyses three broad areas of anti-corruption work, including anti-corruption policies and institutions, criminalisation of corruption and law-enforcement, and measures to prevent corruption in public administration and in the business sector. The analysis is illustrated by examples of good practice from various countries and comparative cross-country data. The report focuses on eight countries in the region which participate in the OECD/ACN initiative knows as the Istanbul Anti-Corruption Action Plan which including Armenia, Azerbaijan, Georgia, Kazakhstan, Kyrgyzstan, Tajikistan, Ukraine and Uzbekistan. It also presents examples from other countries in the region to give a broader perspective for the analysis. The report covers the period between 2008 and 2012, when the second round of monitoring of Istanbul Action Plan countries was implemented, and is based on the results of this monitoring.

    Kurzfassung: Supreme audit institutions have a distinct role in supporting the development of a more strategic and forward looking state. This report assesses the role of Brazil's SAI – the Federal Court of Accounts (Tribunal de Contas da União or TCU) – in enhancing accountability and informing decision making within the federal government. The review focuses specifically on the audit of the Consolidated Year end Government Report (Prestação de Contas da Presidenta de República or PCPR). Although the TCU is a well respected independent government institution and completes the audit of the PCPR in line with constitutional provisions and international best practice, several challenges remain. Deepening TCU understanding of challenges and barriers affecting the use of its audit – especially by the legislature – is critical for enhancing accountability and informing decision making. Moreover, framing clearly and concisely the main findings will make the TCU work audit more accessible and elevate the imperative for action. Creating a more explicit and co-ordinated TCU communication strategy will also improve the value and benefit of the audit findings.

    Kurzfassung: This report provides a comparative overview of common standards and key features of specialised anti-corruption institutions and comprehensive descriptions of 19 anti-corruption institutions operating in different parts of the world, presented in a comparable framework. This new edition of an 2008 report reflects the evolving understanding of international standards and the practice and the most recent experiences of anti-corruption institutions. The report discusses three "models" of anti-corruption institutions: multi-functional anti-corruption agencies, institutions fighting corruption through law enforcement and prevention institutions. Encouraged by international conventions and success of some specialised anti-corruption institutions in earlier times, such as the Hong Kong’s anti-corruption commission, many countries around the world, including those in Eastern Europe, have created new specialised institutions to prevent and combat corruption over the past decade. Establishing such bodies was often seen as the only way to reduce widespread corruption, as existing institutions were considered too weak for the task, or were considered to be part of the corruption-problem. The report highlights that while many of these new anti-corruption agencies have shown good results, they cannot fight corruption alone. Other public institutions, including various specialised integrity and control bodies, and internal units in various public institutions should play a role in preventing and detecting corruption in different sectors of public administration.
